SS-83-6 AND W-86-2 (SANITARY SEWER INTERCEPTOR AND TRUHLER ADDITION WATER MAIN IMPROVEMENTS) WHEREAS, two years have elapsed since the City Council ordered the sanitary sewer interceptor project to be installed between the south shore of Round Lake and the north right-of-way line of Interstate Highway No. 694, extending westward from the west right-of-way line of State Trunk Highway No. 62 (Old Highway No. 10), which is identified as Improvement No. SS-83-6, and WHEREAS, Improvement No. SS-83-6 has never been constructed, and WHEREAS, the Feasibility Report prepared by the City Engineer indicates that the construction of a water main improve- m�nt (Improvement No. W�86-2) in connection with the proposed Truhler Addition would be feasible, and WHEREAS, the City Engineer has proposed that Improvement Nos. SS-83-6 and W-86-2 be constructed together, at the same time, in the same excavated trench, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA THAT Improvement Nos. SS-83-6 and W-86-2 be combined for construction purposes but be separated for assessment purposes--subject, however, to confirmation from the City bond counsel that the two projects can be separated for assessment purposes. The motion for the adoption of the foregoing Resolution was duly seconded by Council member Sather and, upon vote being taken thereon, the following voted in favor thereof: A11; and �� the following voted against the same: None; whereupon said Resolution was declared duly passed and adopted. Thereafter, Council member Hansen introduced and moved the adoption o.f the following Resolution: RESOLUTION NO. 86-21 RESOLUTION RECEIVING FEASIBILITY REPORT FOR IMPROVEMENT NO. W-86-2 (TRUHLER ADDITION WATER MAIN IMPROVEMENT) AND SCHEDULING PUBLIC HEARING ON COMBINED IMPROVEMENT NOS. SS-83-6 AND W-86-2 (SANITARY SEWER INTERCEPTOR AND TRUHLER ADDITION WATER MAIN IMPROVEMENT) WHEREAS, by Resolution adopted on April 23 , 1984 � (Resolution No. 84-14), the Council of the City ordered the construction of Improvement No. SS-83-6," and WHEREAS, by Resolution adopted on March 10, 1986 (Resolution No. 86-15), the Council of the City directed the City Engineer to prepare a preliminary report as to the feasibility of the City's installation of water main and appurtenance improve- ments in connec�ion with the proposed development by Naegele, Inc. of the Truhler Addition, a proposed subdivision of the tract(s) of land lying at the northeast corner of the intersection of Interstate Highway Nos. 35W and 694, and to include in such report the estimated cost of the proposed improvements and an indication as to whether they should best be made as proposed or in connection with some other improvements, and WHEREAS, the Preliminary Feasibility Report and Cost Estimate for Improvement No. W-86-2 has been submitted to and considered by the Council, - 3 - NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA THAT: 1. The Preliminary Feasibility Report and Cost Estimate for Improvement No. W-86-2 (Truhler Addition Water Main Improvement) be approved in the form submitted and be placed on file in the office of the Clerk-Administrator of the City, and the Council's approval two years ago of the feasibility of Improvement No. SS-83-6 be ratified and affirmed; 2. The Council meet at the City Hall, 1450 West Highway 96, in the City on June 9, 1986 at 7:30 o'clock p.m. for the purpose of holding a public hearing on Combined Improvement Nos. SS-83-6 and W-86-2 under and pursuant to the provisions of Chapter 429 of Minnesota Statutes, as amended; 3. The Clerk-Administrator be authorized and directed to cause notice of the time, place and purpose of that meeting to be published twice in the official newspaper, New Brighton Bulletin, which publications shall be a week apart, and the second publication shall not be less than three days before the date of the meeting, which Notice shall be substantially in the form attached hereto as Exhibit "A"; and 4. The general nature, estimated cost and area proposed to be assessed for the Improvement be determined to be as stated in the Notice appended hereto as Exhibit "A" just as though the same were separately set forth and resolved herein. The motion for adoption of the foregoing Resolution was seconded by Council member Hicks and, upon vote being taken thereon, the following voted in favor thereof: A11; and the following voted against the same: None; whereupon said Resolu- tion was declared duly passed and adopted. Thereupon, Council member Hicks introduced the following Resolution and moved its adoption: - 4 -
