TO FIRE PROTECTION AGREEMENT

SECTION 1 ,
Parties �
The first parties to this Agreement are the City of Shoreview, the'
City of Arden Hills, and the City of North Oaks, each a municipal corporation
of the State of Minnesota operating as a statutory city under Minnesota
Statutes Chapter 412 (hereinafter collectively referred to as "City").
. ` The second party to this Agreement is the Lake Johanna Volunteer Fire
Departi�ient, Inc., a nonprofit corporation, or anized and operating uncfer the
provisions' of Minnesota Statutes Chapter 317 �hereinafter referred to; as
"Department").
: SECTION 2
Amendment to Fire Protection Agreement

i � I�n anticipation of the expiration of the five-year contractual term :
� 'cov'ered by the Fi�re Protection Agreement dated the 3rd day of_October, :
1977 (herein "F,P.A. 10-3-77"), the City and the Department, through their
representatives, have met and discussed proposals for continuing a cantrac-

tual relationship for f�re protection services. Except as hereinafter provided
or where inconsistent herewith, the te��F.P:A. 10-3-TT shall remain in
full force and effect:
A. Sectio'n 5 of the F.P.A. 10-3-77 is hereb amended to read:

SECTION 5 Term
� The term of this Agreement shall be for a perioci o# five (5) years
commencing'on July T, 1982 and terminat_ing June 30, 1987 unless
' termina`ted by mutual consent of the parties or pursuan�t to other :
provisions of this Agreement.
Negotiations for a continuance of this contract, or a succeedinq -
contract shall commence no later than the beginning of the fifth (5th) ,
_ �year in the term of this contract. -
B. Section 19 (G) is hereby added to read:

G. In the event that the Department compensation as:calculated
pursuant to Section 19 (C) of the F.P.A. 10-3-77, results in
,a compensation increase of less than lOq, a 10;� increase shall
: `tie`ap'plied. In the event that the Department campensation
as calculated in Section 19 (C) of the F.P.A. 10-3-77,, results
, in a compensation increase of more than 15�,, a 15% increase

C. 5ection 19 (H) i5 hereby added to read:
N. During the five-year term of this extended Fire Protection
Agreement, the compensation provisions of Section 19 may be
renegotiated if any of the following events occur:
1. If the levy limitation applicable ta the City changes during
tt�e five year extended term; or
2. If the Department compensation as calculated pursuant to
Section 19(C) of the F.P.A. 10-3-77 prevents the Department
from meeting current operational and capital needs; or
3. If the Department
