RESOLUTION NO. 2014-039
RESOLUTION DISPENSING WITH STATUTORY REQUIREMENTS FOR
REVIEW BY PLANNING COMMISSION OF DISPOSAL OF REAL
PROPERTY, APPROVAL OF DEED TO REAL PROPERTY, APPROVAL
OF ACQUISITION OF TRAIL EASEMENT, APPROVAL OF EASEMENT
TERMINATION
WHEREAS, Space Center Arden Hills, LLC ("Space Center") is the fee owner of
property to be platted as Lots 1 and 2, Block 1, Gateway Second Addition, Ramsey County,
Minnesota(the"Subject Property");
WHEREAS,the City of Arden Hills ("City") has a fee owner interest in portions of
previously vacated road right of way located within the Subject Property;
WHEREAS, although right of way within the prior right of way within the Subject
Property has been previously vacated by the City, the City still retains additional fee ownership
interest and a private road and access easement within the Subject Property; with the platting of
Gateway Second Addition("Plat") and dedication of Gateway Court within the Plat, the City
Council finds that it has no purpose for the fee ownership interests for right of way or a private
road and access easement located within the Subject Property and that conveyance of the City's
interest in the Subject Property to Space Center and termination of private road and access
easement is in the best interests of the City and necessary to clear title to the property;
WHEREAS,the City requires a trail easement over the existing public trail located
within Lot 1, Block 1, Gateway 2nd Addition and Space Center agrees to provide the necessary
easement;
WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review
the City's proposed disposal or acquisition of real property for compliance with the comprehensive
plan and to report to the City Council in writing its findings; and
WHEREAS, Minn. Stat. §462.356, subd. 2 provides for an exception from the requirement
for review by the Planning Commission upon 2/3 vote of the City Council dispensing with the
requirement and finding that the disposal or acquisition of the real property has no relationship to
the comprehensive municipal plan;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARDEN HILLS,MINNESOTA,AS FOLLOWS:
1. The City Council finds that the disposal of the City's fee ownership interest in
portions of the Subject Property has no relationship to the comprehensive plan.
2. Review by the Planning Commission of the disposal of the Subject Property is
hereby dispensed with;
3. Conveyance of the City's interest in the Subject Property by quit claim deed to
Space Center is hereby approved conditioned upon the recording of the Plat;
4. A Termination of the Road and Access Easement for the City's road and access
easement located within the Subject Property is hereby approved;
5. The Mayor, City Administrator, City staff and City consultants are authorized and
directed to take any and all steps and actions necessary or convenient in order to accomplish the
intent of this Resolution; and
6. The conveyance by Space Center of a trail easement to the City for the existing
public trail located on Lot 1, Block 1, Gateway Second Addition is hereby approved.
