APPROVAL OF AGENDA – JULY 8, 2015 Vice Chair Hames stated the agenda will stand as published. APPROVAL OF MINUTES May 6, 2015 – Planning Commission Regular Meeting Commissioner Zimmerman moved, seconded by Commissioner Holewa, to approve the May 6, 2015, Planning Commission Regular Meeting minutes as presented. The motion carried unanimously (6-0). June 3, 2015 – Planning Commission Work Session Meeting Commissioner Zimmerman moved, seconded by Commissioner Holewa, to approve the June 3, 2015, Planning Commission Work Session Meeting minutes as presented. The motion carried unanimously (6-0). June 17, 2015 –Planning Commission Special Work Session Meeting ARDEN HILLS PLANNING COMMISSION – July 8, 2015 2 Commissioner Zimmerman moved, seconded by Commissioner Holewa, to approve the June 17, 2015, Planning Commission Special Work Session Meeting minutes as presented. The motion carried unanimously (6-0). PLANNING CASES A. Planning Case 15-014; Conditional Use Permit – Verizon Wireless – 2 Pine Tree Drive – Public Hearing Associate Planner Bachler stated that Verizon has requested a CUP to install twelve wireless panel antennas and related equipment on the existing Bethel University building at 2 Pine Tree Drive. Verizon currently has antennas installed on the tower located at 1296 County Road F, near the intersection of Hamline Avenue and Interstate 694. The purpose of the additional antennas at 2 Pine Tree Drive is to improve the provider’s wireless service in the southeast quadrant of the City along County Road E between Lexington Avenue and Highway 51. Associate Planner Bachler indicated that the proposed antennas would be attached to the existing penthouse structure located on the roof of the principal building on the property. All antenna equipment would be painted with a solid color to match the color of the existing penthouse structure. The overall height of the existing building measured to the penthouse roof is 62.7 feet. The antennas would each measure eight feet in length and would not extend beyond the penthouse roofline. Verizon would lease the required roof and utilities right-of-way space from Bethel University. The applicant has submitted a letter from the Verizon engineer working on the project, wireless coverage maps, and a complete plan set. Associate Planner Bachler explained that the City previously approved a CUP in 2009 allowing for the installation of a roof-mounted monopole and antennas for Clearwire Wireless at 2 Pine Tree Drive (PC #09-020). The existing monopole extends 13 feet above the penthouse roof. The Zoning Code requires a CUP for all new antenna installations in the City. The proposed antennas would be an accessory use to the principal higher education and office uses on the property. Site Data Land Use Plan: Community Mixed Use Existing Land Use: Office, Public & Institutional Zoning: B-2, General Business District Current Lot Sizes: 19.16 Acres Topography: The property is a large, heavily wooded site, with rolling topography. Associate Planner Bachler reviewed the surrounding area and the Plan Evaluation. Associate Planner Bachler indicated that the Planning Commission must make a finding as to whether or not the proposed application would adversely affect the surrounding neighborhood or the community as a whole based on the aforementioned factors. Staff offers the following findings of fact for consideration: ARDEN HILLS PLANNING COMMISSION – July 8, 2015 3 General Findings: 1. The property at 2 Pine Tree Drive is located in the B-2 – General Business District. 2. Cellular towers and antennas are allowed as a conditional accessory use in the B-2 District. 3. The applicant has submitted documentation that addresses the use of the City’s water tower sites. This documentation indicates that neither of the water tower sites would meet the location needs to provide coverage in this area of the City. 4. The proposed antennas would be located on an existing structure. 5. The proposed antennas would be at a height of 62.7 feet. 6. The antennas would be located approximately 380 feet from the nearest property line. 7. The antennas would be painted to match the color of the structure to which they are attached. 8. The City previously approved the installation of a roof-mounted monopole and antennas on the property in Planning Case 09-020. Conditional Use Permit Evaluation Criteria: 9. The proposed plan would not have any impact on traffic or parking conditions. 10. The proposed plan will not produce any permanent noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics. 11. The proposed plan will not impact drainage. 12. The proposed plan will not impact population density. 13. The proposed antennas will likely only be visible from locations on the property and they are not anticipated to have an impact on land use compatibility with uses and structures on surrounding land or adjoining land values. 14. Park dedications are not applicable. 15. The proposed plan does not conflict with the general purpose and intent of the Zoning Code or the Comprehensive Development Plan for the City. Associate Planner Bachler stated that staff anticipates the proposed antennas will likely only be visible from locations on the property itself and not from residential properties to the east and south. The site is fairly wooded and has a rolling topography, which will provide screening of the antenna installation. Additionally, the equipment will be painted to match the color of the structure to which they will be attached further reducing their visibility. The proposed antennas are not expected to present any conflicts with land uses in the vicinity. Based on the submitted plans and findings of fact, staff recommends approval of Planning Case 15-014 for a Conditional Use Permit at 2 Pine Tree Drive. If the Planning Commission recommends approval of this request, staff is recommending the following four (4) conditions be included with the approval: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. A building permit shall be obtained for all proposed antennas and associate equipment prior to installation. 3. A Conditional Use Permit drafted by the City Attorney shall be signed by the applicant and the property owner prior to the issuance of any building permits. 4. The antennas and equipment shall be painted to match the color of the structure to which they are attached. ARDEN HILLS PLANNING COMMISSION – July 8, 2015 4 Associate Planner Bachler reviewed the options available to the Planning Commission on this matter: 1. Recommend Approval with Conditions 2. Recommend Approval as Submitted. 3. Recommend Denial 4. Table Vice Chair Hames opened the floor to Commissioner comments. The Commission had no comments or questions. Vice Chair Hames opened the public hearing at 6:42 p.m. Vice Chair Hames invited anyone for or against the application to come forward and make comment. Councilmember Woodburn reviewed several slides with the Planning Commission. He understood that Bethel University was requesting an accessory use. He discussed the differences between a principal and accessory use. He questioned if the accessory use of the 2 Pine Tree Drive site was the college itself. He recommended that the zoning definitions be reviewed by the Planning Commission. Commissioner Jones believed that Bethel University was the principal use at 2 Pine Tree Drive and that the proposed Verizon Wireless antennas would be an accessory use. There being no additional comment Vice Chair Hames closed the public hearing at 6:48 p.m. Commissioner Holewa moved and Commissioner Bartel seconded a motion to recommend approval of Planning Case 15-014 for a Conditional Use Permit at 2 Pine Tree Drive based on the findings of fact and the submitted plans, as amended by the four (4) conditions in the July 8, 2015, report to the Planning Commission. The motion carried unanimously (6- 0). B. Planning Case 15-015; Comprehensive Plan Amendment (CPA), Rezoning, and Approval of TCAAP Redevelopment Code (TRC) – City of Arden Hills – Public Hearing Mike Lamb, Kimley-Horn, discussed the work Kimley-Horn has completed to assist the City with developing the TCAAP Master Plan. He explained how public comments were used to assist in shaping and defining the Master Plan and the TRC. He then reviewed the comments received from both the public and developers. He provided comment on the length of time it would take to develop the TCAAP site to a high quality standard. Mr. Lamb stated that the Parks, Trails, and Recreation Committee had recommended the types of athletic fields and amenities that should be included within the neighborhood parks and also that these parks should be connected through a comprehensive trail network. He then discussed ARDEN HILLS PLANNING COMMISSION – July 8, 2015 5 the goals of Ramsey County for the TCAAP site. He appreciated the work of the City Planning Commission and the Energy Resilience Advisory Board (ERAB) and noted how their efforts had been incorporated into the TRC. Associate Planner Bachler provided comment on the TCAAP Regulating Plan and the proposed overall density in detail with the Commission. He then discussed the landscaping and open space requirements. Staff then commented on building design requirements and the gateway design enhancements. The recommendations made by ERAB regarding energy efficiency and sustainability were reviewed. He discussed the unique characteristics of the TRC noting that it focused on the physical form of development as the organizing principle of code. He explained that the TRC addressed the relationship between building facades and the public realm, the form and mass of buildings in relation to one another, and the scale and types of streets and blocks. It was noted that the TRC offered greater flexibility in land use and development parameters than typical zoning codes. City Planner Streff indicated that the Comprehensive Plan is a policy document that reflects the City’s value system and creates a framework for the future by providing an overall vision for the City. As a guiding tool, the Plan provides a system for measuring progress and direction for setting priorities in key areas critical to the efficient functioning of a community, such as land use, housing, transportation, and public facilities. The Comprehensive Plan is implemented through land use and development regulations, the budgeting process, and community and economic development programs. City Planner Streff explained that the Arden Hills 2030 Comprehensive Plan was officially approved in September 2009. While the Plan was being prepared, the City was also engaged in a community planning process to better define how the surplus land on the TCAAP property should be redeveloped. Since a final plan was not approved at the time the Comprehensive Plan was adopted, the Plan only included an overall vision for the redevelopment and preliminary elements of the potential reuse plan. The intent was for the City to amend the Comprehensive Plan once a final TCAAP redevelopment plan was approved so that any required data, such as future land use designations, housing densities, transportation infrastructure, and parks and open space resources, could be included in the relevant chapters of the Comprehensive Plan. City Planner Streff commented that as part of the Comprehensive Plan Amendment, a change in land use designation from Mixed Business and Mixed Residential to Neighborhood Residential, Neighborhood Transition, Town Center, Campus Commercial, Retail Mixed-Use, Office Mixed-Use, Flex Office, Public and Institutional, Utility, and Parks and Open Space is being proposed. In order to proceed with these changes, the City’s Future Land Use Map would be amended to re-designate the property to reflect the changes in land use classifications. The proposed Comprehensive Plan Amendment also includes updates to the following chapters and appendixes within the Comprehensive Plan to ensure compatibility with the TCAAP Master Plan: Chapter 5 provides a history of the former TCAAP site, the decommissioning process, and the transfer of federal land for redevelopment purposes. This chapter has been updated to provide an overview of the current master planning process, the status of the environmental remediation being undertaken on the site, and the expected construction schedule for public utilities and roadways and private development ARDEN HILLS PLANNING COMMISSION – July 8, 2015 6 Chapter 6 outlines the City’s policies regarding land use. This chapter evaluates existing land uses and sets a vision for how the community should change over time. The Future Land Use Map and land use classifications have been updated to include the land use districts identified in the TRC. The section on development capacity and net residential density has also be revised to reflect the forecasted number of residential acreage and units for the TCAAP site. Chapter 7 provides information on the City’s current housing stock, existing housing issues, such as diversity and affordability, and projected future housing needs. This chapter has been updated to included information on the projected household forecast numbers for the City based on the Metropolitan Council’s regional forecast for 2040, and the expected number of housing units and different types of housing products that will be accommodated on TCAAP. Chapter 9 discusses the existing regional and local park and recreation system and the proposed upgrades to the City’s parks and pathways. This chapter has been updated to include the proposed trail improvements and required public parks and open spaces for the TCAAP redevelopment. Updates were also made based on the approved 2013 Rice Creek North Regional Trail Corridor Master Plan. Chapter 11 evaluates the City’s existing transportation system, looking at issues such as traffic volumes and capacity, relevant transportation studies, and multimodal transportation. The chapter also proposes a future transportation system plan. A detailed traffic study was completed as part of the TCAAP AUAR and a summary of this study has been included in Chapter 11. Road construction and improvements to be completed in conjunction with the TCAAP redevelopment have been incorporated into the future transportation system plan. The multimodal transportation section has been updated to include the Metropolitan Council’s current consideration of extending the A-line BRT (Bus Rapid Transit) route to TCAAP. Chapter 13 summarizes the separate management plans the City has in place for water supply, sanitary sewer, and stormwater. The public facilities management plans have been updated as needed to include the recommendations from the approved AUAR. This chapter includes an overview of the proposed regional stormwater management plan for the TCAAP development. Appendix E discusses the existing and future sanitary sewer plans for the City. This appendix outlines the existing sanitary sewer system, intercommunity services, sewer volume forecast, sanitary sewer service districts, projected sewage flows, individual sewage treatment systems, infiltration/inflow, and the proposed capital improvement program to complete the sewer improvements. Appendix H in the Comprehensive Plan outlines all zoning districts within the City. In order to update the Comprehensive Plan the new zoning districts proposed in the TRC have been included in Appendix H. City Planner Streff noted that the proposed Comprehensive Plan Amendment (CPA) will be contingent on final approval from the Metropolitan Council. In this case, the Metropolitan Council will make the final determination on the CPA, though they provide great deference to the City as long as the proposed land use change does not have a negative impact on a regional system (i.e. transportation, sanitary sewer, and regional parks). The designated review period for ARDEN HILLS PLANNING COMMISSION – July 8, 2015 7 CPA applications is 60 days. Once the Metropolitan Council completes their review, they will notify the City of their decision. City Planner Streff stated the City must also allow adjacent governments, affected special districts, and affected school districts up to 60 days to review the proposed amendment. This waiting period allows interested agencies to review and comment on the amendment before the Metropolitan Council review. Given these requirements, the City expects to receive the final determination from the Metropolitan Council for the Comprehensive Plan Amendment in November of 2015. City Planner Streff reported that in order to formally adopt the TCAAP Master Plan within the City’s governing documents, the following items included in Planning Case 15-015 require approval: • Comprehensive Plan Amendment to reflect the policies and goals included in the separate components of the TCAAP Master Plan. • Rezoning of the 427-acre TCAAP parcel based on the zoning designations included in the Regulating Plan Map. • Zoning Code Amendment to adopt the TCAAP Redevelopment Code as Section 1380 of the Arden Hills Zoning Code. City Planner Streff explained that the Planning Commission must make a finding as to whether or not the proposed Comprehensive Plan Amendment, Rezoning, and TCAAP Redevelopment Code (TRC) meet the City’s vision for the area or if these changes would adversely affect the surrounding neighborhood or the community as a whole. Staff offers the following eight (8) findings of fact for this proposal: General Findings: 1. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to develop and maintain a land use pattern that strengthens the vitality, quality, and character of the residential neighborhoods, commercial districts and industrial areas, while protecting the community’s natural resources to develop a sustainable pattern for future development. 2. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to develop TCAAP in a way that accommodates a mix of land uses that is sensitive to the natural environment, economically sustainable and a benefit to the community. 3. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to promote the development, redevelopment and maintenance of a viable, innovative, and diverse business environment that serves Arden Hills and the metropolitan area. 4. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to develop and maintain a strong, vital, diverse, and stable housing supply for all members of the community. 5. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to enhance the health, safety, and well-being of all who live, work, and play in the City. 6. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to create a comprehensive, maintained, and interconnected system of parks, pathways, and open spaces, as well as a balanced program of recreational activities for residents of all ages, incomes and abilities. ARDEN HILLS PLANNING COMMISSION – July 8, 2015 8 7. The proposed CPA, Rezoning, and TRC advance the City’s Comprehensive Plan to preserve, protect, and restore the community’s natural resources, including open spaces, lakes, wetlands, other significant natural features, and historic resources. 8. The proposed TRC implements the vision for a walkable, mixed-use, resilient, and vibrant TCAAP development. City Planner Streff stated that staff recommends approval of Planning Case 15-015 for a Comprehensive Plan Amendment, Rezoning, and adoption of the TCAAP Redevelopment Code (TRC) as Section 1380 of the Zoning Code, as presented in the July 8, 2015, Report to the Planning Commission. City Planner Streff reviewed the options available to the Planning Commission on this matter: 1. Recommend Approval as Submitted. 2. Recommend Approval with Additional Comments. 3. Recommend Denial. 4. Table. Vice Chair Hames opened the floor to Commissioner comments. There were no comments or questions from the Commission. Vice Chair Hames opened the public hearing at 7:26 p.m. Vice Chair Hames invited anyone for or against the request to come forward and make comment. Ramsey County Commissioner Jim McDonough, 815 Montana Avenue, St. Paul, discussed the County’s thoughts on TCAAP. He looked forward to seeing the TCAAP site dramatically improved in the near future. He had some concern with the City’s proposed density and encouraged the Planning Commission to consider increasing flexibility in the TRC to allow for 1,700 units. It was the County Board’s feelings that the increased flexibility in density would attract national developers. He explained that the A-Line BRT was not proposed to extend to the TCAAP property at this time; however, the Metropolitan Council is considering this extension. He stated he would continue to work on this issue with the Metropolitan Council. Ramsey County Commissioner McDonough discussed the importance of private development. He stated that he was a strong supporter of creating 4,000 jobs on the TCAAP site. This will be accomplished through long-term investment. He provided comment on the strength of Minnesota’s work force. He appreciated the joint work that has been done by the City and County to date. It was his hope that the City and the County could move forward together with a strong shared vision for TCAAP. Commissioner Zimmerman questioned what type of additional housing units the County wanted to see on the TCAAP site in order to reach 1,700 units. ARDEN HILLS PLANNING COMMISSION – July 8, 2015 9 Ramsey County Commissioner McDonough wanted to see additional life-cycle housing, work force housing and affordable housing on TCAAP. He did not have a recommendation as to which type of housing should be added, but wanted to see a wide range of housing types. Commissioner Holewa asked if 1,700 units were needed for the Metropolitan Council to extend the A-Line BRT route to TCAAP. Ramsey County Commissioner McDonough stated this density would get the TCAAP site closer to the Metropolitan Council’s minimum requirements. Commissioner Holewa inquired what the County Commissioner wanted from the Planning Commission. Ramsey County Commissioner McDonough encouraged the Planning Commission to increase the density on TCAAP in order to increase the flexibility for future development. Vice Chair Hames noted that the Planning Commission was a recommending body only and indicated that the final decision would rest with the City Council. Commissioner Bartel asked how the County arrived at the 1,700 number. Ramsey County Commissioner McDonough reported that the AUAR prescribed this number and the transit piece was another factor. He provided further comment on how a strong work force, increased density, and transit were interconnected. Jim Ostlund, 1576 Royal Hills Drive, noted that he lived less than 1/3 of a mile away from TCAAP. He supported the increased density as recommended by Ramsey County. He indicated that he volunteered on ERAB and believed that additional density would improve the economics of the TCAAP development. Lyle Salmela, 1480 Arden Vista Court, believed the goal for TCAAP was to develop mixed land uses that were sensitive to the natural environment, economically sustainable, and a benefit to the community. He provided the Commission with a handout and suggested that building orientation only apply to commercial buildings. He reviewed several language changes within the TRC that addressed building orientation, building materials and encouraged energy efficiency. He believed that water should be considered Open Space as it was an asset to the TCAAP site. Mr. Salmela suggested that Chapter 12 of the Comprehensive Plan, which addresses Environmental Conservation and Sustainability, should be updated as part of the Comprehensive Plan Amendment. He explained he assisted in rewriting this Chapter in 2008. He believed that TCAAP should be mentioned in Section 12.2 along with the ERIF. He provided further comment on the LEED certified building variability proposed within TCAAP. It was his opinion that Jackson Meadows was a great development for the City to style TCAAP after. It was his hope to that TCAAP would have high quality architectural design. There being no additional comment Vice Chair Hames closed the public hearing at 7:59 p.m. ARDEN HILLS PLANNING COMMISSION – July 8, 2015 10 Commissioner Bartel asked how many acres on TCAAP would be developed for residential housing units. Associate Planner Bachler stated that 151 acres were zoned for residential uses. Commissioner Bartel indicated that with 1,431 proposed units on 151 acres this created a density of approximately 9+ units per acre. He asked how this compared with the remainder of Arden Hills. Associate Planner Bachler reported that staff had looked at several neighborhoods in Arden Hills and that the average gross density ranged from 1.75 to 3 units per acre. Commissioner Bartel summarized that the proposed density on TCAAP was three times higher than the density of all other Arden Hills neighborhoods. He inquired what research the City had done to come up with the proposed 1,431 units. Associate Planner Bachler explained that the City Council met with multi-family and single family residential developers while drafting the TRC. He stated that the feedback from the development community influenced the residential density ranges included in the TRC. Commissioner Bartel questioned what the potential negative impact would be to increase the density from 1,431 to 1,700 units. He asked why the Council had put a cap on the density. Associate Planner Bachler noted that the Alternative Urban Areawide Review (AUAR) completed for TCAAP reviewed two development scenarios: the Zoning Scenario, which included up to 1,500 residential units, and the Maximum Development Scenario, which included up to 2,500 residential units. The AUAR proposed infrastructure improvements to serve the needs of either scenario. He indicated that the total number of 1,431 units was based on the maximum density allowed in each residential zoning district. Commissioner Holewa understood that density was one of the most discussed issues by the City Council. He stated that a few Councilmembers wanted less density, while others wanted more and 1,431 units was the compromise. Commissioner Zimmerman questioned how the City would adjust the density in the future if a master developer wanted to build 1,700 units on TCAAP. City Planner Streff commented that if a developer wanted to increase the density beyond 1,431 units, a Comprehensive Plan Amendment (CPA) would be required in order to support the developer’s proposed development. He stated that this CPA would be reviewed and approved by the Planning Commission, City Council, and the Metropolitan Council. Commissioner Zimmerman inquired if the 1,700 units was necessary for BRT. City Planner Streff stated the Metropolitan Council was having a conversation to see if it was feasible to extend the A-Line to TCAAP. He reported that staff was unaware of the number of units needed to secure the extension of this line. ARDEN HILLS PLANNING COMMISSION – July 8, 2015 11 Ramsey County Commissioner McDonough commented that 1,700 units was not the focus of Metropolitan Council. However, there were a certain number of units that the Metropolitan Council was interested in seeing before they would invest in infrastructure within TCAAP. He encouraged the City to consider 1,700 units as this would make the development more competitive to receive additional transit lines when compared to other developments in the metro area. Commissioner Bartel questioned how long it would take to amend the Comprehensive Plan to allow a developer to construct 1,700 units. City Planner Streff stated this was a lengthy process and estimated that this would take at least 120 days given the Metropolitan Council review process. Vice Chair Hames indicated the recommendation was to approve the document as presented by staff. She believed that the research that went into the document and the proposed density levels should stand. She again reviewed the density levels for the remainder of Arden Hills. Commissioner Bartel appreciated the comments that were voiced this evening, but he supported the density levels as recommended by staff and the City Council. Commissioner Holewa suggested that Paragraph E be added to Section 1.1 in the TRC, as outlined in the public comments he provided in Attachment M. He read the paragraph in full for the Commission. Vice Chair Hames discussed the prime amenities that were available on the TCAAP site, such as the beautiful landscape, the wildlife corridor and its location in the metro area. Commissioner Jones supported additional flexibility with regard to density. He understood that a BRT line would not be built on day one, but would be considered over time. Commissioner Zimmerman moved and Commissioner Jones seconded a motion to recommend approval of Planning Case 15-015 for a Comprehensive Plan Amendment, Rezoning, and Adoption of the TCAAP Redevelopment Code (TRC) as Section 1380 of the Zoning Code, as presented in the July 8, 2015, report to the Planning Commission, with the public hearing comments forwarded to the City Council for consideration. Commissioner Zimmerman encouraged the City and the County to continue its conversations. He wanted to see the two bodies come together to form a united front as this development continues to move forward. Commissioner Holewa supported 1,700 units on TCAAP. Vice Chair Hames explained that the Jackson Meadows development has received some unwanted attention from the public and has experienced some surveillance issues, both of which should be noted for the record. The motion carried unanimously (6-0). ARDEN HILLS PLANNING COMMISSION – July 8, 2015 12 UNFINISHED AND NEW BUSINESS None. REPORTS A. Report from the City Council Councilmember Woodburn updated the Planning Commission on City Council activities from the May 26, 2015, Regular Meeting. The City Council unanimously approved Planning Case 15- 009 and Planning Case 15-012, both of which received a recommendation for approval from the Planning Commission on May 6, 2015. Planning Case 15-009 was a request from Bethel University for a Conditional Use Permit Amendment for the construction of a soccer facility building on the Ona Orth Athletic Field complex. Planning Case 15-012 was a request from Caribou Coffee for a PUD Amendment to allow for the construction of a drive-thru lane and pick-up window at their store located at 3673 Lexington Avenue North. Councilmember Woodburn indicated that the City Council voted to deny (4-1, Holmes) Planning Case 15-008 for a PUD Amendment for the installation of accent lighting at the Holiday service station at 1920 W. Highway 96. The City Council determined that even though the intensity of the light source would be mitigated if a dimmer module were to be installed, as recommended by the Planning Commission, the contrasting color and extent of light along the full length of all sides of the canopy and building roof line would still maximize visibility and distraction to neighboring residential properties. The Planning Commission unanimously recommended approval of this case at their meeting on May 6, 2015. Councilmember Woodburn reported that at the June 29, 2015, City Council Regular Meeting, the City Council unanimously approved Planning Case 15-010 for a Minor Subdivision at 3517 Siems Court. The subdivision will allow the property owner to sell a 5,540 square foot portion of land to the adjacent property owner at 3535 Siems Court. This case was reviewed by the Planning Commission on May 6, 2015, and received a unanimous recommendation for approval. B. Planning Commission Comments and Requests None. C. Staff Comments None. The proposal involves the development of a sit-down restaurant called Tavern Restaurant on the future Lot 1, Arden Plaza 2nd Addition on Lexington Avenue south of the Walgreens pharmacy. Background The City approved a Master PUD for the Arden Plaza retail center in 2009 (Planning Case 09- 011). This site is situated at the southwest corner of the County Road E and Lexington Avenue intersection and is approximately 11 acres in size. The approved plans included the demolition of an existing office complex and the phased redevelopment of the site to be completed in three stages. A total of 97,035 square feet of retail and commercial building space was approved under the original PUD. For each successive phase of the redevelopment, the property owner is required to submit a Final PUD plan to verify general conformance with the Master PUD and to provide more detailed development plans for the phase to be implemented. The Master PUD was amended in 2011 (Planning Case 11-016) to include a revised subdivision plan and updated final development plans for the existing Walgreens Pharmacy. Phase I of the Master PUD was completed in 2012, and included the construction of the Walgreens building, modifications to parking and circulation within the retail center, and the construction of stormwater basins required for the proposed build-out of the site. Approval of the Final Plat was conditioned on building improvements that are now under construction by Arden Plaza, LLC. Planning Case 15-002 also included modifications to the retail center parking lot and an increase in the Phase III building footprint. The new plat is titled Arden Plaza 2nd Addition, and Lot 1 within the plat is proposed for the Tavern Restaurant development. The Master PUD specifically identifies the Lexington Avenue site where the Tavern Restaurant development is proposed as Phase III. It should be noted that Phase II of the Master PUD has not yet been completed. Phase II will include the development of the parcel on County Road E adjacent to the Walgreens pharmacy for a 6,000 square foot retail or restaurant use. Arden Plaza, LLC continues to market this site to potential buyers and tenants. 1. Overview of Request Hemisphere Restaurant Partners has requested a Final PUD for Phase III of the Arden Plaza Master PUD to develop Lot 1, Arden Plaza 2nd Addition for a sit-down restaurant. The Master PUD Site Plan shows Phase III being developed as a 20,136 square foot retail building. The proposal by Hemisphere Restaurant Partners would result in an overall lower density development on the site than what was originally approved for Phase III. The development plans are in substantial conformance with the Master PUD plans. Hemisphere currently operates three Tavern Restaurants in the Twin Cities metro, with locations in Edina, Woodbury, and Blaine. The proposed Tavern Restaurant in Arden Hills would be similar to these other restaurants and would provide a relaxed but up-scale atmosphere. The development would include the restaurant building, which would have a footprint of 9,500 square feet, and an attached 3,050 square foot outdoor patio area for seasonal seating. The proposed site design orients the restaurant towards the other buildings within the Arden Plaza retail center. The main entrance is located at the southwest corner of the building and features a prominent tower structure comprised primarily of transparent glass. Sidewalks have been provided to create safe pedestrian connections with the public sidewalk on Lexington Avenue as well as the internal sidewalks between the Walgreens pharmacy and the retail center. The building façades would be comprised of stucco with accents of stone and wood. Each side of the building would include a minimum of 20 percent transparent window coverage. A variety of shade and ornamental trees, shrubs, and perennial plantings would be focused around the perimeter of the building and patio area and would also provide screening of the kitchen and utility areas. Planned Unit Development (PUD) Process: The Planned Unit Development process is a tool that provides additional flexibility for development that an underlying zoning district would not otherwise allow. For example, a PUD may make exceptions to setbacks, lot coverage, parking requirements, signage, building materials, or landscaping requirements. It is intended to overcome the limitations of zoning regulations and improve the overall design of a project. While the PUD process allows the City to negotiate certain aspects of the development, any conditions imposed on the PUD must have a rational basis related to the expected impact of the development. A PUD cannot be used to permit uses that would not otherwise be permitted in the underlying zoning district. If a PUD is comprised of multiple lots, it is often treated as one continuous development. The development as a whole would be expected to meet the landscaping, stormwater, and other similar requirements. For example, one property in the PUD may have 60 percent building coverage, but the development as a whole may not exceed 50 percent building coverage to maintain conformance with the underlying zoning district. In order to maintain shared amenities, such as parking spaces, access drives, and stormwater ponds, the development is required to create a legal entity to manage and maintain the shared facilities. 3. The site as a whole is expected to conform to the structure and landscape coverage requirements for the B-2 District while individual lots within the PUD may exceed the underlying zoning requirements. The maximum structure coverage permitted in the B-2 District is 45 percent. A total of 92,748 square feet of building area is approved in the Master PUD divided across the five lots, as shown in the table below. The Tavern Restaurant building would measure 9,500 square feet in size. This compares to the Phase III building footprint in the approved Master PUD, which was permitted to be up to 20,136 square feet. The proposal would result in an overall reduction in structure coverage within the retail center to 83,671 square feet, or 17.4 percent of the total area of the site. Properties in the B-2 District must maintain a minimum landscape coverage of 20 percent. With the reduction in the Phase III building size, the total landscape coverage for the retail center would increase. Under the approved PUD, a minimum of 112,781 square feet is required to be maintained as landscaping. The proposal would result in an increase in landscape coverage to 123,628 square feet, or 25.8 percent of the total area. Setbacks The minimum setbacks for a principal structure in the B-2 District are 20 feet in the front yard and rear yard, and 10 feet in each side yard. The internal lot lines within the retail center are less of a concern since the site operates as an integrated planned unit development. For this proposal, the primary concern is the setback from the public right-of-way along Lexington Avenue. The table below provides the setbacks for the proposed Tavern Restaurant. The building would be in conformance with all setback requirements. Landscaping - Section 1325.05, Subdivision 1 A Master Landscape Plan for the retail center was approved in Planning Case 09-011. For each successive phase of the PUD, the developer is required to install the landscaping improvements shown in this plan. The proposed tree plantings for the Tavern Restaurant match the Master Landscape Plan, with six shade trees along the north side of the main driveway, three shade trees along Lexington Avenue, and eight ornamental trees on the site itself. As a condition of approval for Planning Case 15-002, the Arden Plaza property owner is required to complete the landscaping improvements within the main parking lot as shown in the Master Landscape Plan prior to the issuance of a Certificate of Occupancy for the Phase III building. Arden Plaza, LLC plans to complete these required improvements in the fall of 2015. The applicant is aware of this previously approved condition. Minimum Caliper Inches The Zoning Code requires that a minimum amount of caliper inches be provided based on the gross square footage of the building. The caliper inches required is calculated by dividing the gross building square footage by 320. In this case, 29.7 caliper inches of trees are required for the site. The Landscape Plan for the Tavern Restaurant includes 34.5 caliper inches of tree plantings. A total of 1,667 square feet of plantings for the site is required based on this provision. The applicant has proposed 4,261 square feet of perennial plantings, or 25.6 percent of the total landscape coverage area. Planting Islands The Zoning Code requires that ten percent of a parking area be occupied by planting islands that include one tree and are a minimum of 150 square feet in size. The approved Master PUD provides for 9.5 percent planting island coverage across the entire shared parking area for the retail center. No additional planting islands are required for the Phase III development under the approved Master PUD. Tree Selection The proposed Autumn Blaze Maple, Greenspire Linden, and Snow Crab trees are appropriate for urbanized locations and should grow well in their proposed locations. B. Lighting – Section 1325.05, Subdivision 3 The Zoning Code requires lighting to be arranged to direct light away from adjacent lots and public streets. The source of illumination must be hooded, concealed, or controlled so that only the intended site is illuminated. A Lighting Plan for the entire retail center was approved in Planning Case 09-011. The plan includes parking lot lighting and pedestrian and landscaping ornamental lighting along common walkways. In the project narrative, the applicant notes that the overall site lighting will provide most of the exterior lighting needed for the Tavern Restaurant. The lighting proposed for the Tavern Restaurant is primarily accent lighting: bollards would be used to provide additional illumination at the entrance; decorative lighting would be mounted on the stone piers around the outdoor patio area to illuminate this space; and uplighting along the west and north building walls would highlight the stone accenting. The architectural plans included in Attachment E indicate the location and design of the accent lights, which would conform to the Zoning Code requirements. Staff did not request a photometric analysis at this time because only minimal accent lighting is proposed and the site is at a substantially lower elevation than Lexington Avenue. The City can request a photometric analysis if there are concerns about the impact of site lighting on adjacent public roadways or residential properties. Screening – Section 1325.05 Subd. 4 The building will be serviced by roof-mounted mechanical operating equipment. The applicant has provided illustrations showing the approximate location of equipment on the roof and the view of the site from Lexington Avenue (Attachment E). The Zoning Code requires that roof- mounted equipment be screened from view of adjacent streets. The applicant has acknowledged that this equipment will either be screened with a durable material or painted to match the adjacent wall structure. D. Fence Regulations - Section 1325.05, Subdivision 4 As part of the development plans the existing retaining wall along Lexington Avenue will be reconstructed. A 42-inch tall ornamental metal fence would be installed at the top of the retaining wall for safety purposes. The Zoning Code restricts the height of fences to no more than six feet. Section 1325.05 Subd. 8 – B-2 District Design Standards Building Materials At least 75 percent of exterior building materials are required to be brick or tile masonry, stone, decorative concrete plank, or transparent glass. Accent materials may include metal, wood, split faced block, stucco, or EIFS. Approximately 40 percent of the total façade area of the building would be stucco. For secondary materials, stone would comprise 21 percent, transparent glass 21 percent, and wood 15 percent of the total façade area. Stucco would primarily be used on the upper portion of the building walls above the metal roof and on the kitchen portion of the building. A higher percentage of stone, wood, and transparent glass would be used on the bar and dining portions of the building. The applicant has addressed the use of stucco as the primary building material in the project narrative. Stucco is being proposed in this case to provide a more neutral building material that will help accentuate the stone and wood materials. Also addressed in the narrative is the application process that would be used for the stucco material to ensure its long-term durability. The explanation provided addresses the two primary concerns staff has regarding this material, which are aesthetics and durability. Staff is supportive of the building materials included in the plans and believes it will result in a more visually interesting building than if the design standards were strictly followed in this case. Building Design The building design section includes several requirements. At least 50 percent of the largest building on each site is required to be constructed at the front setback line of 20 feet. In this case, the building would be located 36.2 feet from the front setback line. Given the elevation difference between Lexington Avenue and the development site, there are existing conditions that prevent the applicant from satisfying this requirement. The building would include façade treatments, such as window openings and architectural details, along all four sides of the building. Additional visual interest has been added through façade modulation and variation of the structure roof heights. A metal canopy roof above the primary entrance would provide protection for pedestrians. Building Color The proposed building colors are white, brown, gray, and beige. These colors are in conformance with the design standard requirements. Window and Door Openings For commercial buildings, at least 50 percent of the first level façade that fronts a public street must be comprised of transparent windows or doors. In this case, the Lexington Avenue façade is required to meet this standard. At least 20 percent of all other façades that are reasonably visible from the public right-of-way must include window or door openings. On these façades, simulated windows may be used on service areas. This standard would apply to the northern and southern building façades. The following table outlines the proposed window and door transparency for the four sides of the building. The City is allowed to grant a proportional reduction in the transparent window requirement on a public street façade if additional transparent glass is used elsewhere on the building. Staff is supportive of the proposed transparency coverage given that the Lexington Avenue façade will not be very visible from the roadway and that transparency coverage has been increased on the remaining three sides of the building. Additionally, the City is allowed to reduce the transparency standards for buildings with a use that does not readily allow windows. The kitchen space takes up a large percentage of the building footprint and it would be difficult to provide transparent windows on this portion of the building. Architectural detailing and landscaping have been provided in these areas to add visual relief. Site Furnishing and Seating Areas Benches and decorative plantings are required near the primary entrance of all buildings. Planting beds are proposed on the west and south side of the building adjacent to the primary entrance. Two benches have also been included on the site plan near the building’s entrance. The proposal includes a seasonal outdoor patio for up to 106 seats. The patio area would include plantings and a decorative fence around the perimeter. Screening The Zoning Code requires that trash equipment and containers be fully enclosed and integrated into the architecture of the building. The trash service area for the restaurant would be located entirely internal to the building. Landscaping A minimum of one tree planting is required along the right-of-way for every 40 feet of street frontage. The approved Landscape Plan in the Master PUD includes a total of 15 street trees along County Road E and Lexington Avenue. As part of the Phase III development, three shade trees on Lexington Avenue will be installed as shown in the Master Landscape Plan. Parking The design standards discourage placing parking between the street right-of-way and a building. No more than 50 percent of parking on a site may be placed in the side yards. The proposed parking for the Tavern Restaurant would be located at the rear of the site. No parking would be located between the public right-of-way and the building. Pedestrian Circulation Sites must be designed to accommodate the safe mobility of pedestrians to and within the site. The proposed site plan includes a sidewalk in front of the primary building entrance that connects to the sidewalk network internal to the retail center and the public sidewalk on Lexington Avenue. Crosswalk striping has been provided across drive aisles for pedestrian safety. As part of the approval of the Master PUD, the City required that a public sidewalk along the entire length of the site on Lexington Avenue be completed during Phase III. Staff has included as a recommended condition of approval that these sidewalk improvements be completed prior to the issuance of a Certificate of Occupancy for the restaurant. Bicycle Parking For commercial properties, one bicycle parking space is required for every 20 automobile parking spaces. However, a minimum of two bicycle parking spaces are required. In this case, given the ten parking spaces on the site, two parking spaces for bicycles would be required. The applicant has included one rack for two bicycles on the west side of the building close to the primary entrance. The proposed bicycle parking satisfies the City’s requirements in terms of its design and location. City of Arden Hills Planning Commission Meeting for August 5, 2015 P:\Planning\Planning Cases\2015\PC 15-016 - Arden Plaza - Final PUD Phase III\Memos_Reports_15-016 Page 10 of 16 Section 1325.055 – Tree Preservation A Tree Preservation Plan was included in the Master PUD approved in Planning Case 09-011. All requirements of the tree preservation ordinance were met by this proposal. The Tree Preservation Plan includes the removal of three trees on the north side of the Lexington Avenue entrance drive, which will be completed as part of the Phase III development. The trees will be replaced by six Greenspire Linden trees consistent with the Master Landscape Plan. Section 1325.06 – Requirements for Parking, Loading and Circulation Parking requirements are determined by the type of land use proposed for a site. For restaurant uses, one parking space is required for every two seats. The Tavern Restaurant would include 256 permanent indoor seats, along with approximately 106 seasonal outdoor patio seats. The Zoning Code does not distinguish between permanent indoor and seasonal outdoor seating for restaurant uses. Based on the required ratio, 181 parking stalls would need to be provided. Staff believes it would be appropriate to consider a lower parking requirement for the outdoor seating considering this will only be a seasonal use. The development proposal includes the construction of ten parking stalls on the lot, as shown in the Master PUD. However, an existing Reciprocal Easement Agreement that covers the separate lots within the retail center provides for shared parking across the entire site. With the completion of Phase III and the additional Arden Plaza parking lot improvements, there would be a total of 405 parking stalls in the retail center that could be used by Tavern Restaurant customers. The majority of these stalls would be within 400 feet of the entrance to the restaurant. At the time of full build-out, the PUD will include 440 parking stalls overall. In the project narrative, the applicant discusses how shopping centers typically rely on a ratio of 4.0 stalls per 1,000 square feet of gross leasable area to determine parking needs. This is supported by a study completed by the National Parking Association and the Urban Land Institute, titled Dimensions of Parking, which recommends 4.0 – 4.5 stalls per 1,000 square feet of building space in shopping centers with total square footage of less than 600,000. According to the Parking Generation study completed by the Institute of Traffic Engineers (4th Edition), the average peak parking demand for shopping centers ranges from 2.04 to 2.94 vehicles per 1,000 square feet of gross building area, depending on the day of the week. At the 85th percentile, the study showed demands ranging from 2.39 to 3.90 vehicles per 1,000 square feet of building area. The 405 parking stalls that would be provided by the completion of Phase III equates to a ratio of 4.96 stalls per 1,000 square feet of gross building square footage. Based on the shared parking provided through the Reciprocal Easement Agreement, the design layout of the parking lot, and the studies discussed above, staff believes that 405 parking stalls will be adequate to accommodate demand following the completion of Phase III. Going forward, staff would recommend that the City evaluate future parking needs for the Arden Plaza retail center based on the ratio recommended in the Dimensions of Parking study of 4.0 – 4.5 stalls per City of Arden Hills Planning Commission Meeting for August 5, 2015 P:\Planning\Planning Cases\2015\PC 15-016 - Arden Plaza - Final PUD Phase III\Memos_Reports_15-016 Page 11 of 16 1,000 square feet of building space. This will allow for an easier evaluation of parking needs for Phase II of the Master PUD and any future redevelopment on the site. Staff anticipates that with the completion of Phase II the parking ratio on the site would be approximately 5.25 stalls per 1,000 square feet of building space. 2. Chapter 12 – Sign Code The permitted amount of wall signage in Sign District 5 is 80 square feet per business establishment. The applicant has proposed a total of 78 square feet of wall signage for the Tavern Restaurant divided between two signs. One sign would be located on the building wall facing Lexington Avenue and would measure 38.5 square feet. The second sign would be installed on the west façade adjacent to the primary entrance and would measure 39.5 square feet. 3. Traffic Study and Transportation Improvements A traffic study was completed in 2007 to evaluate the full build-out of the Arden Plaza retail center. An additional study was completed in 2008 in conjunction with the B-2 District Guiding Plan that looked at the redevelopment of Arden Plaza in addition to other development opportunities along the County Road E corridor. The Phase III development proposal is in substantial conformance with the development scenarios evaluated in these traffic studies and an additional study was not requested at this time. The application does not propose any alterations to the internal circulation plan as shown in the previously approved Master PUD. As part of the City’s approval of the Master PUD in 2009, Arden Plaza was required to construct certain transportation improvements. One condition was that the development of Phase III would be contingent on the construction of a traffic signal located 650 feet west of the County Road E and Lexington Avenue intersection. This traffic signal was proposed as part of the transportation improvements included in the Guiding Plan for the B-2 District. The signal was recommended in part based on the assumption that the Holiday Inn site north of Arden Plaza would be redeveloped into a 95 apartment unit building and a 120,000 square foot office building. The 2007 Arden Plaza traffic study did not indicate that a new signal would be warranted. At the time, Ramsey County also did not support the traffic signal due to spacing between the Lexington Avenue intersection and the proposed signal. City staff discussed the Phase III development plans with the Ramsey County Public Works Department and a letter from the County addressing traffic control on County Road E has been included in Attachment F. The letter notes that the County Road E improvements now under construction include a dedicated left-turn lane to serve Arden Plaza and restricted turns from the property to the north. The County believes that these initiatives will adequately serve the expected traffic and that a traffic signal at Arden Plaza is not needed at this time. The City will continue to monitor traffic operations along County Road E and additional transportation improvements may be required for Phase II of the Arden Plaza Master PUD. Building Official The City Building Official has reviewed the submitted plans and did not have any comments at this time. Ramsey County Public Works Department The Ramsey County Public Works Department has reviewed the plans and provided staff with comments in the letter dated July 9, 2015 (Attachment G). Lake Johanna Fire Department The Lake Johanna Fire Marshal has reviewed the plans and provided staff with his comments in the letter dated July 13, 2015 (Attachment G). Final plans shall be subject to approval by the Fire Marshall prior to the issuance of a building permit Rice Creek Watershed District Rice Creek Watershed District (RCWD) is currently reviewing a permit application for the development proposal. Rain gardens on the north and east sides of the site have been added to address on-site stormwater management requirements. A RCWD permit will be required prior to the issuance of any development permits. Findings of Fact Staff offers the following seventeen (17) findings of fact for consideration: 1. Hemisphere Restaurant Partners has requested approval of a Final PUD for Phase III of the Arden Plaza Master PUD on Lot 1, Arden Plaza 2nd Addition. 2. The original Master PUD for the development was approved in Planning Case #09-011. Subsequent PUD Amendments were approved in Planning Case #11-016 and Planning Case #15-002. 3. A Preliminary Plat for Arden Plaza 2nd Addition was approved in Planning Case #15-002. Final Plat approval was conditioned on building improvements currently under construction by Arden Plaza, LLC. 4. The applicant has proposed a 9,500 square foot restaurant building with an attached 3,050 square foot outdoor patio area. 5. The development proposal is in substantial conformance with the approved Arden Plaza Master PUD and the site improvement requirements contained therein. 6. The Arden Plaza retail center and Phase III development site are located in the B-2 General Business District. The City has adopted the Guiding Plan for the B-2 District that outlines future development principals for the area. 8. The Final PUD for Phase III is in substantial conformance with the Guiding Plan for the B-2 District. 11. The Final PUD for Phase III is in conformance with the requirements of the City’s Sign Code. 12. The Final PUD for Phase III is in conformance with the City’s Comprehensive Plan. 13. The PUD process allows for flexibility within the City’s regulations through a negotiated process with a developer. 14. Where the plan is not in conformance with the City’s Zoning Code, flexibility has been requested by the applicant and/or conditions have been placed on an approval that would mitigate the nonconformity. 15. Flexibility is needed from the standards in the City’s Zoning Code in terms of the proposed exterior building materials, building design, and parking requirements. 16. The proposal exceeds the standards in the City’s Zoning Code in terms of perennial plantings and window transparency coverage. 17. The application is not anticipated to create a negative impact on the immediate area or the community as a whole. Recommendation Based on the submitted plans and findings of fact, staff recommends approval of Planning Case 15-016 for a Final PUD for Phase III of the Arden Plaza Master PUD at 3527-3557 Lexington Avenue North. If the Planning Commission votes to recommend approval of Planning Case 15- 016, staff is recommending the following sixteen (16) conditions of approval: 1. The Developer shall continue to abide by the conditions of all previous Master PUD Agreements, permits, and reviews, except as hereinafter amended. 2. The project shall be completed in accordance with the submitted plans as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and the City Council. 3. The Developer shall obtain a building permit within one year of the Final PUD approval or the approval shall expire, unless extended by the City Council prior to the approval’s expiration date. Extension requests must be submitted in writing to the City at least 45 days prior to the expiration date. 4. A Development Agreement shall be prepared by the City Attorney and subject to City Council approval. The agreement shall be executed prior to the issuance of any development permits. Prior to the issuance of a building permit, a copy of any necessary supplemental declaration between Hemisphere Restaurant Partners and Arden Plaza, LLC addressing site operation issues, such as driveway maintenance, shared parking, and drainage, shall be provided to the City. 7. The Developer shall submit a financial surety in the amount of 125 percent of the estimated costs of site improvements including grading, utilities, and paving, prior to the issuance of any development permits. The financial surety shall be in the form of a letter of credit issued by a FDIC-insured Minnesota bank, and be in a form acceptable to the City. The purpose of the letter of credit is to ensure that site improvements are completed in the event that the developer defaults on the Development Agreement. 8. The Developer shall submit a cash escrow in the amount of 25 percent of the estimated costs of site improvements including grading, utilities, and paving, prior to the issuance of any development permits. The escrow will be used for City costs related to review, approval, and inspection of site improvements or any costs incurred by the City in the event of a developer default. 9. The Developer shall submit a financial surety in the amount of 125 percent of the estimated costs of landscaping prior to the issuance of any development permits. The financial surety shall be in the form of a letter of credit issued by a FDIC-insured Minnesota bank. The purpose of the letter of credit is to ensure that landscaping is completed in the event that the developer defaults on the Development Agreement. The City will hold the letter of credit for two years after the installation of landscaping. The letter of credit should not expire during the two-year period. 10. The Developer shall submit a cash escrow in the amount of 25 percent of the estimated costs of landscaping prior to the issuance of any development permits. The escrow will be held by the City for two years after installation of landscaping and used for City costs related to review, approval, and inspection of landscaping, or developer default. 11. Final construction plans shall be subject to approval by the Building Official and Fire Marshall prior to the issuance of a building permit. 12. The Developer shall provide the City with a copy of the Rice Creek Watershed District permit for the project prior to the issuance of any development permits. 13. Final grading, drainage, utility, and site plans shall be subject to approval by the City Engineer and City Planner prior to the issuance of a Grading and Erosion Control Permit or other development permits. 14. The Developer shall obtain a right-of-way permit from Ramsey County for the sidewalk construction along Lexington Avenue. 15. Prior the issuance of a Certificate of Occupancy for the Phase III building, the six-foot wide concrete sidewalk along Lexington Avenue shall be constructed in its entirety as shown on the PUD Master Site Plan. 16. All mechanical equipment, whether ground-mounted or roof-mounted, shall be screened from ground-level view of public streets. Wood screening shall not be permitted. Additional Review Comments (Ramsey County Public Works Department, Lake Johanna Fire Department) 1 Project Narrative The Tavern Grill Restaurant and Bar - Arden Plaza Arden Hills, MN July 6, 2015 July 24, 2015 Revised History Arden Plaza, LLC submitted and received approval of a Planned Unit Development (PUD) in 2009, with a revised pharmacy development plan and recorded plat in 2011, followed by final construction plans of Phase 1 improvements in 2012. The 2009 approved master plan included 97,035 sf of retail/commercial buildings (including a 3,917 sf mezzanine for the Frattallone’s Hardware store offices) and had originally subdivided the parcels into four lots. In 2011, two of the lots in the northeast corner were combined and platted as a single lot, for a development of a Walgreen’s pharmacy, thus 3 lots were officially platted in 2011 showing four building masses involving the Arden Plaza Plat. Phase 1 Construction of the Arden Plaza site included the Walgreen’s building and parcel (Lot 1 in the northeast corner), and included the implementation of the four required storm water rain gardens (bio-filtration basins) for the full development, along with modified parking and circulation improvements involving the northeast parcel. In 2015, an Amended PUD, Platting, and Conditional Use Permit(Frattallone’s Garden Center) was approved by the City reflecting the request to further subdivide the larger Lot 3 parcel(existing strip mall) into three new lots, primarily for Frattallone’s to own their own site and to create a separate development pad along Lexington. This new plat, which is in process of being recorded, is being identified as Arden Plaza 2nd Addition (Lot 1-3). Lot 1(Tavern Grill restaurant) is the future development parcel along Lexington Avenue, and is the area being proposed by this application. Lot 2 is the existing strip mall with related general parking, access drives, and regional storm pond, while Lot 3 is the Frattallone’s Hardware site. The Amended PUD provided some parking reductions and building square footage reallocations, based on the completed Phase 1 Improvements(Walgreen’s) Final Planned Unit Development(PUD) This application is specifically involving the final development plan for Lot 1, Block 1, Arden Plaza 2 nd Addition(Lexington Avenue parcel), involving a sit down restaurant called Tavern Restaurant. The intent of the Final PUD is to verify general conformance of the development plans to the previous approved 2015 PUD. Notable variations are highlighted below. Use and size of the building is most notable. The current proposed use is a 9,500 SF sit down restaurant with a 3,050 SF outdoor patio versus the previous approved 20,136 SF retail building, along with the service area moving from the south end of the building to the north. This 10,636 SF building reduction has also reduced impervious surface. The restaurant has 256 permanent seats, along with approximately 106 seasonal outdoor patio seats. Parking has remained the same at 440 spaces(4.53/1000sf) for the shopping center, but since the proposed use has changed to a restaurant, the parking ratio requirements tend to be different than straight retail. Previous City Staff parking calculations assumed 107 parking spaces associated with the 2 20,136 SF building. This is based on 16,109 retail floor space(80% of total, which excludes storage, bathrooms, and similar space) at 1 space per 150 sf. Restaurant parking is calculated to be around 128 spaces, based on 1 space per 2 seats for the permanent seating, which is a difference of 21 spaces. Code does not address seasonal outdoor seating as part of the requirements, and believe that recent restaurant developments in the City of Arden Hills has not included these within their parking requirements. Industry thoughts are that seasonal outdoor seating does not necessary translate to increased customers, but generally helps reduce wait times for the customer. The goal of a Planned Unit Development and related shared parking(through the Reciprocal Easement Agreement) is to help navigate some flexibility for the mixed tenant use, so as not to focus on specific individual code requirements, but to look at the development as a whole and what is needed. In this case we have noted a few things to consider involving parking. First, the individual parking ratio requirements for each use seems to be a little high compared to neighboring communities. Reviewing adjacent Roseville and Shoreview, there seems to be some notable differences. ·Roseville: Retail=1/325 gross sales floor, General Merchandiser=1/500 gross sales floor, Restaurant= 1/3 seats. Some districts allowing 20% general parking reduction and also offer some different transit reductions. ·Shoreview: Retail=1/181 gross sales floor, Restaurant=1/3 seats. Noted that Target has reduced its parking to below 4.2/1000sf to allow for a new pad development along Lexington Avenue. ·Crystal: Shopping Center = 1/300 to 1/250 gross floor area for multi-tenant shopping centers of 10,000sf or greater. Second, shopping centers across the country have identified that the actual need for parking is typically less than city requirements. It is not uncommon, for shopping centers to focus on a good tenant mix of users with varying peak times throughout the day, often times identifying parking ratios closer to 4.0/1000 or below, as supported by ITE-Parking Generation, 4 th Addition for Shopping Centers(not in December). Target stores are going through this same parking reduction, to allow for additional pad developments, which has dropped their parking ratio significantly(Shoreview=4.14/1000, West St. Paul=3.72/1000). In summary, the Arden Plaza shopping center owners feel that their center is over parked and have requested less parking required to better suit their specific needs, thus the parking difference is viewed as not as an issue. Existing Conditions and Removals The property has completed the Phase 1 construction improvements in 2012, and has updated the current existing conditions from the past as-built surveys, along with new 2014 survey data of the existing retail area and Frattallone hardware store demising wall. Generally the new improvements will remove the old wood retaining wall, existing parking lot, Lexington Avenue public sidewalk, storm sewer, and existing trees. Site Plan Similar to the PUD, the proposed parking remains at 10 spaces, including 3 handicap, along the west side of the property. The building is smaller but located in a similar location, with the service area relocated 3 from the south side of the building to the north. Sidewalks and pedestrian circulation are similar, including the 6’ public sidewalk reconstruction along Lexington Avenue. It is noted that the Fall of 2015, Frattallone’s is planning construction of their Garden Center improvements, along with related Arden Plaza LLC implementing their parking lot island and sidewalk additions. Grading, Erosion Control Plan, and Stormwater Design Grading and erosion control is similar to the PUD. The reduced building foot print has allowed most of the grade transition to be sloped, with a retaining wall(and ornamental fence as required) along the east side. Rice Creek Watershed District(RCWD) has indicated that new storm water requirements have been implemented in December of 2014 and that the site has to conform to the new rules, thus the existing rain garden systems may not be adequate. New rain gardens along the east and north sides of the site has been added to address some of the new requirements. Application for RCWD approval and permit will be submitted during a similar time frame as with the City’s submittal. The Reciprocal Easement Agreement and related Maintenance Agreement defines shared storm water use and maintenance responsibilities. Utilities Utilities for the site are similar to the PUD. Water and sanitary stubs are already provided on the north end of the property and the existing 27/30” trunk storm sewer will be located outside the proposed building area, which will also require the related storm sewer easement to be modified. Other utilities, like gas, electric, telephone, etc are in the area and final location will be coordinate the utility providers. Landscaping The site will be lawn grass along the perimeters, along with a nice design of perennial and shrubs in the rain gardens and building/patio perimeter. The trees match the PUD, with 6 shade trees along the south main driveway, 3 shade trees along the east perimeter, and 8 ornamental trees along the west and north sides of the building. Building and Use The proposed use is a sit down restaurant, currently proposed to be named The Tavern Grill. This is an upscale restaurant and bar, open for lunch and supper during the hours of 11:00am-12:00midnight, serving salads, steaks, pasta, shrimp, chicken, burgers, sandwiches, flatbread pizza, and other items. It will have 256 permanent seats, and an outdoor patio with approximately 106 seasonal seats. The building is a one story, multi-height, flat roof structure reaching 24’ to the top of the highest parapet, along with an entry tower with a pitched roof slightly above. The perimeter of the dining section has a lower sloped canopy roof to provide sun relief and an open concrete patio with accent beams and columns surrounded by ornamental fence and columns, along with a two sided indoor/outdoor bar. The building is about 9,460sf with an interior trash room on the north end, with the patio area being around 3,100sf. 4 Building design style is fairly sleek and modern with a variety of heights and materials. The façade is primarily stucco with accents of stone, wood, and trellis, along with a good mix of glass in the southwest entry tower and dining areas. A material wall area calculation spreadsheet is provided, describing each wall portion, for further evaluation. There are two wall signs located on the building. The main sign, is on the west wood façade(back of bathrooms), where the wood texture and accent landscaping will add some interest. The second sign, is on the east stucco façade(kitchen/service) facing Lexington Avenue. There is no additional parking or pedestrian pole lighting on site, and would utilize adjacent parking lot lights for proper light coverage. The restaurant will have seasonal/landscape lighting, but primary exterior lighting would be attached to the building, ground-mounted (bollards and uplights), or under the canopy. TAVERN RESTAURANT – EXTERIOR MATERIALS AND TRANPARENCY As part of the larger Arden Plaza PUD, the Tavern Restaurant is designed for primary access from the development site while providing a street presence along Lexington Avenue. The entry tower at the southwest corner provides convenient access from the parking area and is visible from Lexington Avenue and the main driveway into the development. The exterior patio enlivens the side facing Lexington. A new retaining wall along the east property line accommodates the grade change from Lexington down to the project site. Service access to the kitchen area is on the north side, away from the primary public areas of the site. Due to the location and orientation of the building site relative to the Arden Plaza Development and Lexington Avenue, all four sides of the building are visible from the public right-of-way and/or from the parking area and adjacent parcels. Therefore, all elevations of the building are finished to the same extent. Exterior materials were selected for durability as well as for promoting a signature image for the Tavern. Stone is used at the entry as vertical accents, and as a base at the perimeter of the dining areas and kitchen. Wood accent walls define the restroom projection adjacent to the entry and the spaces between trellises at the patio. A sloped standing seam metal roof at the perimeter of the dining areas and bar serves to break up the massing. Abundant landscaping visually ties the building to the site, and is an added amenity at the patio area. Areas and percentages for each material are documented in the Wall Area Calculations. Windows are located along the perimeter of the dining areas, with round accent windows at the bar booth area. The bar itself has a large glass bifold window which can be opened during the summer months for an indoor/outdoor bar arrangement. The glass entry tower contrasts with the solidity of the adjacent stone and wood accent walls, and serves as a point of emphasis. In most cases, the amount of glazed area per wall exceeds the 20% minimum; this helps to alleviate the absence of glazing at the kitchen, where it would be impractical. Specific glass percentages are included in the Wall Area Calculations. The remainder of the exterior, including the parapet walls above, is stucco. Stucco serves as a neutral backdrop to keep the emphasis on the stone, wood, metal and glass, and to tie everything together. The 5 stucco finish is a 3-coat application over metal lath, with 2 layers of Grade D building paper as the weather barrier/drainage plane. Joints at openings and at the base of the stucco where it meets the stone below, and also just above grade, will be flashed to prevent water from penetrating the weather barrier and to allow for any moisture that gets behind the exterior finish material to drain out. Building signage occurs on the east and west sides. The “T” circle logo on the east side serves to identify the Tavern brand to people walking or travelling along Lexington Avenue. The main sign near the entry utilizes the “T” circle logo, and also includes the full name of the restaurant. Total sign area is 78 square feet – 38 square feet for the “T” circle logo on the east side, and 40 square feet for the complete sign near the entry. Both signs are backlit. Exterior lighting is primarily accent lighting, as the overall site lighting will provide most of what is needed. Bollards will be used to provide additional illumination outside the entry. The patio will include lights mounted on top of the 3’ high stone piers between fencing at the perimeter. Uplights mounted on the ground in the landscape areas immediately adjacent to the building will highlight the vertical stone accent walls. A security light (wall pack) will be mounted above the service area on the north side. B-2 Design Standards Flexibility There are two areas where the project is asking for flexibility to the B-2 Design Standards, but still follow the spirit of the design intent. ·Stucco material is more than the 25% maximum, but is used as more of an accent material that includes better construction techniques for improved longevity. The design of the building with this material fits a nice design blend that seems appropriate for the overall look of the building and in the spirit of providing good diversity of desired materials. ·Building transparency is not at the 50% minimum level facing public streets. Due to the building being significantly below the street level in elevation, and primary kitchen wall(no windows) being on this side, it was the intent to provide more glass along the other facades to compensate for the lack of visibility that a person who observe from Lexington Avenue. Background/Overview of Request Boston Scientific is requesting a Site Plan Review to relocate the existing day care facility managed by New Horizon from the north side of Building 9 to the east side of Building 10. The relocation of the facility is needed in order to facilitate the planned interior remodel and reconfiguration of the space within Building 9 to accommodate an expanded area for distribution and final packaging. The new facility and expansion in Building 10 will allow the day care to comply with current state regulations. The existing day care within Building 9 has approximately 7,500 square feet of interior space and includes a fenced outdoor play area of 2,400 square feet. The new facility proposed in Building 10 includes 8,500 square feet of interior space and a 3,150 square foot fenced outdoor play area. Three (3) infant rooms, two (2) toddler rooms, three (3) pre-school rooms, and an indoor play area now required for muscle development will be constructed inside the new day care facility. A new building entrance, sidewalk, stoop, and ramp will also be constructed to provide direct access to the proposed day care facility. Based on this mix of uses, 6,432 parking spaces would be required for the office component and 219 parking spaces for the manufacturing activities. Parking at the time of full build-out will be provided at 6,651 spaces. Boston Scientific is currently providing 2,808 existing stalls and has identified 1,091 “proof of parking” spaces on their Campus Master Plan. If the Site Plan Review for the relocation of the day care facility and outdoor play area is approved the eleven (11) spaces being removed from the east side of Building 10 will be restriped along Innovation Way. The current number of employees on the Arden Hills campus is approximately 2,200 and Boston Scientific has acknowledged that the existing parking satisfies the parking demand. 4. Flood Plain, Wetlands, and Easements The proposed location of the outdoor play area is outside of any flood plains, wetlands, or easements. 5. Additional Review A. Building Official The Building Official reviewed the plans for the project and had no additional comments. B. City Engineer The City Engineer reviewed the proposal and stated that a Grading and Erosion Control Permit is needed for this project. C. Rice Creek Watershed District The Rice Creek Watershed District has reviewed the submitted plans and has indicated that a permit is not required for projects that involve a land disturbance of less than 10,000 square feet. The total area of disturbance is estimated at 5,500 square feet. Findings of Fact The Planning Commission must make a finding as to whether or not the proposed application would adversely affect the surrounding neighborhood or the community as a whole based on the aforementioned factors. Staff offers the following nine (9) findings of fact for this proposal: 1. The applicant has requested approval of a Site Plan Review for the relocation of the day care facility and outdoor play area at 4100 Hamline Avenue North. 2. The Boston Scientific Campus is a conforming use in the I-1 Limited Industrial Zoning District and operates under an approved PUD Overlay District. 3. The proposed and existing uses are permitted uses in the I-1 District. 4. The proposed outdoor play area would total 3,150 square feet in size. In order to screen the existing electrical transformer just north of the outdoor play area, five (5) new shrubs will also be planted. 8. A black ornamental fence six (6) foot in height will be used around the outdoor play area. 9. The proposal is not expected to adversely impact the surrounding neighborhood or the City as a whole. Staff Recommendation Based on the submitted plans and findings of fact, staff recommends approval of Planning Case 15-017 for a Site Plan Review to relocate the day care facility and outdoor plan area from Building 9 to Building 10 at 4100 Hamline Avenue North. If the Planning Commission recommends approval of this request, staff recommends that the following six (6) conditions be included with the approval: 1. That the project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. That the applicant shall continue to abide by all previous agreements, as amended by the conditions of approval of this application. 3. That a building permit and grading and erosion control permit shall be obtained for the proposed project. 4. That the outdoor play area shall be 3,150 square feet in size and enclosed with an ornamental fence six (6) feet in height. 5. That the sidewalk connection across Innovation Way shall align in a perpendicular manner to provide for safe pedestrian movements. 6. That the outdoor play area shall not be constructed within any Drainage and Utility Easement. Proposed Motion Language 1. The relocation will help facilitate the planned interior reconfiguration of existing distribution and manufacturing space and allow the expansion of the day care to comply with current state day care guidelines. The existing day care is approximately 7,300 SF of interior space located at the north east corner of the ground floor of Building 9, with a fenced exterior play area to the north. The relocated facility will be approximately 8,500 SF and contain the same child care program of three infant rooms, two toddler rooms, and three pre-school rooms with the addition of a new indoor play area now required for large muscle development. The new facility will be located in the central area of the east side of the ground floor of Building 10. A new fenced exterior play area will also be built along the east side of the day care. A new building entrance directly into the day care will require a new concrete stoop with a ramped concrete side walk for accessibility. Approximately 5,550 SF of bituminous and sidewalk will be removed to allow for the installation of 3,125 SF of resilient exterior play surface and 1,880 SF of concrete side walk for a net decrease of 550 SF of impervious surface. The existing fence and play equipment will be removed from the current exterior play area (approximately 3,000 SF). Three new 3” boulevard trees matching the existing species will be planted along Innovation Way. Five new shrubs will be planted to screen the existing electrical transformer. The day care relocation and bituminous removal will eliminate 11 existing parking stalls adjacent to the east side of the building. The north curb cut in the existing dive through configuration will be eliminated. The eleven eliminated stalls will be added to the 125 stalls currently stripped along innovation way making the total 136 spaces. We are proposing to leave the 50 stalls as striped both sides of the road, south of Boston Scientific Drive; leaving as striped the 55 stalls along the east side of the road north of the enclosed walkway crossing. In the area north of Boston Scientific Drive and south side of the enclosed MEMORANDUM Day Care Relocation July 6, 2015 Page 2 walkway crossing we propose to relocate/restripe the 20 current spaces from the east side of the road to the west side of the road and add the 6 spaces because of the elimination of the north drive curb cut. This will provide parent drop-off spaces directly adjacent to the new 8 foot wide concrete side walk along the day care zone. The Rice Creek Watershed District does not require Stormwater Management or Erosion & Sedimentation Control permits for projects that involve less than 10,000 square feet of impervious surface (Rule C: 2.(a)) or disturbance of vegetative cover (Rule D: 2.(a., 2)). The proposed project will include elimination of 550 square feet of impervious surface, since the construction replaces an existing paved area. Disturbance of vegetated areas will be only that needed for excavation of new stoop foundation and sidewalks. The Planning Commission reviewed these items on July 8, 2015, and recommended approval. July 20, 2015, City Council Work Session At the Work Session on July 20, 2015, the City Council discussed existing regulations in the Zoning Code on outdoor sales and exterior storage uses. The City Council directed staff to research how other cities in the metro area regulate these uses and to report back at a future meeting with recommendations. This topic will also be discussed at a future Planning Commission Work Session. July 27, 2015, City Council Regular Meeting The City Council approved Planning Case 15-014 for a Conditional Use Permit (CUP) at 2 Pine Tree Drive. The CUP request from Verizon Wireless was for the installation of 12 panel antennas on the existing Bethel University building on the property. This case was reviewed by the Planning Commission on July 8, 2015, and received a unanimous recommendation for approval. Rice Creek Commons Update The City Council approved the TCAAP Redevelopment Code and the Comprehensive Plan Amendment on Monday, July 13, 2015. The Comprehensive Plan Amendment has been submitted to adjacent municipalities and affected jurisdictions for the 60-day review process.
