Guiding Plan for the B2 District On October 27, 2008, the City Council adopted the "Guiding Plan for the B2 District." Chapter 5 of that Plan included design guidelines for development and redevelopment in the B2 District (Attachment A). The purpose of these ordinance amendments is to adapt the design guidelines in the Guiding Plan for the Zoning Code, which involves integrating them with existing design standards and adding detail where needed. Due to the technical nature of a zoning code, the design guidelines in the Guiding Plan cannot be applied verbatim; however, the substance of the design guidelines is in the proposed ordinance amendments. The purpose of this memo is to help explain the proposed changes, the City of Arden Hills Planning Commission Meeting for November 5, 2008 IlAhdocsllahlAHdatalPlanninglPlanning Cases 12008M-028B2 Design StandardsV 10508-PC report-B2 Design Standards.doc Page I of 8 organization of the design standards,minor adjustments from the Guiding Plan, and other notable points. Summary of Proposed Ordinance Amendments and Additions Creating design regulations can be a challenge. While people are often in agreement about the purpose and intent of design regulations, opinions on how the standards should be applied, how detailed or flexible they should be,and what counts as"good"or"bad" design can be quite variable. Design regulations often include hard standards such as height limitations, approved building materials, minimum landscaping, etc. However, design regulations must also be flexible and promote creativity,which means that some standards will require interpretation and some open-endedness. The style of design regulations proposed in this ordinance is not meant to design each specific building; instead,these regulations are meant to create a framework for compatible design that sets boundaries but leaves options open. One of the more difficult parts of establishing design regulations is finding the balance so that design regulations are not so strict or vague to discourage development or improvement to properties. The City and future developers need a certain amount of predictability, an understanding of expectations, and some flexibility since it is impossible to predict all possible proposals beforehand. In preparing these design standards, staff reviewed standards from more than ten other cities. The City of Arden Hills expects top quality design and materials,but what constitutes top quality design and materials will change over time and varies from person to person. It is important to review design regulations from a holistic standpoint and how the regulations as a whole would impact the overall design of a site and building. When proposals come forward, it is almost certain that variations will be requested, which is not necessarily a bad thing provided it results in a better overall development. The proposed Ordinance 2008-010 amends, repeals, or adds regulations to three chapters of the Zoning Code: A. 1305.04—Definitions(new definition) B. 1320—District Provisions(new, amended, and deleted regulations) C. 1325—General Regulations (new regulations) The changes to each chapter are outlined in the below sections. 1305.04—Definitions The Zoning Code currently has definitions and regulations for"drive-in businesses"and"fast food restaurants;"however,those definitions do not quite reach to all "drive-up windows"(see 1305.04 Subd 50 and 1325.04). The underlying intent of the existing provisions is to regulate City of Arden Hills Planning Commission Meeting for November 5, 2008 I UhdocsllahUHdatalPlanninglPlanning CasesI2008W-028 82 Design StandardsW 0508-PC report-B2 Design Standards.doe Page 2 of 8 � T drive-up windows due to their impact on traffic flow,pedestrians, and building design; however, the intent does not completely match the wording in the provisions. In order to clarify the intent of the existing regulations, staff is proposing to add a definition for "drive-up windows"and extend the regulations for drive-in businesses and fast food restaurants to drive-up windows. For the time-being, this will only apply to the B2 District, but staff plans on preparing an overall fix for the other zones as soon as December. Due to public notice requirements, the current public notice for the B2 design standards does not extend to modifying regulations for the other zoning districts. However, because of the sensitivity of the B2 District, staff wanted to makes sure that the B2 District regulations were clearer. 1320—District Provisions The District Provisions chapter includes the purpose, setbacks, coverage regulations, and uses that pertain to each particular zoning district. Some zoning districts have additional special requirements that need to be met, which may include design standards that pertain to just that particular district. The special requirements for the B2 District start in section 1320.085 (Attachment B). In late 2007, the City did adopt some basic design standards for the B2 District. As part of these proposed amendments, staff is proposing to delete most of the existing design standards listed in 1320.085 and move them to a new subdivision eight in section 1325.05. We are proposing this move because it will be easier and cleaner to extend these new design standards to other zoning districts with similar intents and purposes. Staff is tentatively planning on extending these • regulations to the B-3 and potentially the B-4 zoning districts. By placing these regulations in section 1325.05 Subd 8, they will not need to be repeated again and again in section 1320 for each district. 1320.04 Subd %—Purpose The B2 District purpose was revised to better reflect the vision statement and planning and design principles on pages 1 and 2 of Chapter 5 of the "Guiding Plan for the B2 District." While the purpose may seem to be generalized, it is an important part of all zoning codes because it sets the stage for why a city is adopting a particular set of regulations. Cities can have quite a bit of leeway for adopting design and zoning regulations provided they are done so for a reason with an understandable and reasonable purpose. 1320.05—Land Use Chart The land use chart lists the permitted and conditional uses in all districts. A few uses can be approved only through a planned unit development (PUD). Many of the uses have definitions in Section 1305.04. If a use is not listed, it is automatically prohibited. Because some of the categories cover a wide variety of uses, the special provisions for some districts will prohibit certain types of uses. Multi-family housing includes condos,rental housing, and senior housing(owner or rental). Other changes include: • Hotel/motel use becomes a conditional use from a permitted use; • Theater, indoor becomes a conditional use from a prohibited use; and, • Land reclamation,mining, and vehicle-motorized, Ieasing and rentals are now prohibited. The Guiding Plan opens up the possibility for housing. A theater could be a beneficial use in the district. Land reclamation,mining, and vehicle rentals and leasing do not advance the purpose of B2 district. 1320.06—District Requirements Chart The district requirements chart lists the basic lot requirements for a development(i.e. minimum lot area, setbacks, coverage). While these provisions do set minimum City standards, it is not uncommon to provide some flexibility in the PUD process. The Guiding Plan calls for a more active, vibrant, and pedestrian focused community area. This purpose is advanced by bringing more customers and workers into the district, encouraging development closer to the street, and allowing a more efficient use of the land by increasing allowable height and building coverage. While these modified standards open up the possibility for more intensive development,the design standards in section 1325 note that a traffic study would be needed to evaluate impacts for any significant development proposal. Just because the regulations may allow for more intensive development does not mean the • City will approve it if the impacts are too great. As part of adding multi-family housing in this corridor, the maximum density is set at one unit per each 2,178 square feet of lot space,which equates to 20 units per acre. Due to land and development costs, a higher density will be needed than what is in other residential areas of the City. Density can also be a negotiating point in the PUD process. Although this is higher than in the other residential districts, the City Code does provide the possibility for 20 unit/acre density in the Civic Center district. The height limit was increased from 35 to 50 feet to allow for four story development as recommended by the Guiding Plan. Although the potential building lot coverage was increased and minimum landscape area was decreased, the Guiding Plan focuses on the quality of green space as opposed to the quantity. The Guiding Plan calls for increased trees near the street and the landscaped areas to be more intensively landscaped and useful for visitors to a site. The front, side, and corner setbacks were reduced to allow development closer to the street as recommended by the Guiding Plan. The PUD process allows a more open conversation on building and site design. The design standards set the starting point for the discussion and list the expectations of the City. The PUD process requires a public hearing with the Planning Commission and City Council approval. In order to promote other minor improvements and upgrades to a site, certain types of changes are not considered significant modifications and are recommended to be exempt from the PUD Process. The exemptions are listed in subdivision one. This provides some flexibility so that minor changes can move forward in a timely fashion with administrative review and approval. Section 1320.085 also includes additional prohibited uses that apply to the B2 District that would otherwise be permissible under the regular land use chart in 1320.05. The newly prohibited uses include individual retail stores greater than 50,000 square feet(except for fitness clubs), tattoo parlors, and "payday" loan establishments. Approved outdoor garden centers are now permitted. As noted earlier in this memo, all drive-up windows in the 132 District are now subject to the regulations for drive-in business and fast food restaurants. Like other districts, there is a • procedure for waiving the 1,320 foot proximity requirement if certain conditions are met. Although the provisions have not been removed from this section, the City may want to consider removing the provisions for institutional housing that were adopted earlier this year. The institutional housing use only applies to the former Holiday Inn property, and that interim use cannot be extended when it expires in 2011. Removing the institutional use would make the student housing a legal, nonconforming use, which simply means they could not expand that use. They would still be subject to all other existing agreements. All other design standards in 1320.085 that were adopted in 2007 have been relocated. There is now a reference to Section 1325.05 Subd 8 for the new design standards, which are an integration of the existing design standards and the guidelines in the"Guiding Plan for the 132 District." 1325.05 Subd 8—General Regulations 4 Design Standards Although these amendments focus on the new 1325.05 Subd 8,please note that all other standards in the zoning code still apply to development proposals. For example, the other requirements already listed in 1325, which include parking, landscaping, fences, lighting, etc, still apply. The new design standards will supplement the existing regulations. A color version is available online at www.ci.arden- hills.mn.us/b2district. Purpose and Intent—As described earlier,the purpose and intent sets the stage for why the City would adopt design regulations. Application—While the purpose of these new design standards is to implement the vision in the "Guiding Plan for the B2 District,"it is also important to respect existing properties and to encourage upgrades to existing properties. However,requiring a property to conform to all design standards no matter what the scale for the proposed change could result in reluctance or refusal by property owners to do any type of upgrades due to the cost. This section allows some discretion on the part of the City to apply the design standards in accordance with the scale of a project. This would be evaluated on a case by case basis. Building Materials—The building materials section lists the types and minimum quantity of approved materials for primary and accent use. The prohibited materials are also listed. Building Design —Building design includes a great amount of flexibility;however,the substance of this section is based on the Guiding Plan. The primary purpose of this section is to prohibit long expanses of architecturally uninteresting walls and to require fagade treatments on all sides of a building visible to the public. This section promotes variety on a building. Fagade Transparency—This section focuses on requiring transparent windows on all buildings, • with a focus on the primary entrance and sides facing the street. The Plan called for 70 percent transparency on the sides with the primary entrance and facing the public street. However, there may also be a need for some windows on other sides that face public areas but are not public streets. In order to promote additional windows, the requirement was dropped from 70 percent to 50 percent but a standard of at least 20 percent windows(half of which could be simulated or spandrel glass) on the remaining sides was added. These requirements are not insignificant and adjustments may be needed in the future. Site Furnishings and Seating Areas—It is difficult for a city to require an open public gathering space on private property without a specific park dedication; however, a city can require outdoor furnishings and seating areas for restaurants for customers on the site. This section is intended to advance the civic and gathering space recommendations in the Guiding Plan. Parking—The parking regulations focus on moving parking to the rear of buildings and discouraging expansive parking lots. Specifically,parking between the street and buildings is discouraged as is parking in the side lots and between buildings. If a parking structure is constructed, the fagades visible from a public street must have similar treatments to the principal building. This is to ensure that any new • developments or uses do not overburden the roads to a greater extent and to help determine when road improvements are needed. Pedestrian and Bicycle Circulation—This section focuses on connecting businesses to sidewalks and completing the sidewalk system along County Road E and Lexington Avenue. As part of the development the property would be expected to complete the sidewalk. This section includes a notable new provision that could, at the City's discretion, allow a developer to pay the City the cost of constructing the sidewalk along the right-of-way instead of actually constructing the sidewalk. While this provision is unlikely to be used in the B2 District, it could be helpful in other districts where the sidewalk system is even less developed and constructing one small section of sidewalk may not make sense. Environmental Conservation and Sustainability—The draft 2030 Comprehensive Plan includes a chapter on environmental conservation and sustainability. This section will need additional detail in the future,but staff felt it was important to introduce it into the Zoning Code now to encourage such practices. Findings of Fact Staff offers the following findings for consideration: • l. The City Council adopted the "Guiding Plan for the B2 District" on October 27, 2008. 2. The proposed design standards are in substantial conformance with the Guiding Plan. 3. The proposed design standards would work toward implementing the recommendations in the Guiding Plan. Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to properties within the B2 District. Public Comments The City did not receive any public comments prior to releasing this report. These statements are intended to be a guide for the City,developer,architect and builder that allow flexibility, individuality and creativity. They focus on fundamental site planning and design ideas that address compatibility,visual appeal, lasting value and place-making. They emphasize the relationship to the street,density,heights,facade treatment,circulation,parking and plantings. While some of these design guidelines are discretionary and advisory, some of them may be used to amend the B-2 zoning district to achieve the long term redevelopment vision within this plan. Ideas for streetscape enhancements should be considered when the City prepares a more detailed public improvements plan,though certain improvements could be implemented by the private sector as properties redevelopment. • Vision Statement The County Road E/Lake Johanna Boulevard District will be a place where people can live,work and play. The district will be a compact,architecturally diverse,pedestrian-friendly community with a distinct identity. It will provide sidewalks and places for people to gather and socialize. Design guidelines will be followed to promote an attractive environment with lasting value. The district is dedicated to the belief that we desire to integrate nature, home,work and leisure. 30 October Guiding Plan for the B2 District 5-1 J District Design Guidelines Planningand Design Principles • 9 P The following principles are the basis for the design guidelines,reflect the community vision and will be followed through the evolution of the district. 1. Be more urban than suburban in terms of density,building height, parking and fagade treatments. 2. Include several types of land uses such as office,housing,retail or service businesses and,possibly,job-intensive light industry. 3. Face residential,office and retail buildings toward the public street to the extent possible. 4. Insist on a high quality of design in buildings and public improvements. S. For office or residential buildings,strive to locate as much of the parking as possible in structures,under buildings or to the rear of buildings. For commercial sites,strive to locate at least some of the building(s)between the street and the surface parking area. 6. Provide a generous amount of landscaping;pay attention to the details of lighting,signage,materials and fixtures. 7. Encourage walking and bicycling through physical improvements, streetscape and building placement. 5-2 Guiding Plan for the B2 District 20 October `a District Design Guidelines Place Entrances � 41 The eastern and western entrances to the district should be announced by special landscaping, signs,lighting and/or art. Those entrance locations are defined as(west)the immediate vicinity of the eastern Minnesota Highway 51 ramps and(east)the Lexington Avenue intersection with County Road E. mil W ' I I , t" Arrival The vicinity of the intersection of County Road E and Pine Tree Drive — should be demarcated as the visual center of the district through use of landscaping and lighting. Street Name West of Lexington Avenue,County Road E should receive the supplementary name of Lake Johanna Boulevard,which could be used in addition to the County Road E name. The City of Shoreview should be encouraged to also apply this local moniker to County Road E from Lexington Avenue to Victoria Street. Space Defined To the extent possible, locate future buildings so as to define some spaces in which people feel comfortable walking or sitting. Orient doors and windows toward those spaces. Avoid locating buildings in a field of parking. Whenever feasible,require that windows on the first floor of a building be made of transparent glass. 20 October Guiding Plan for the 132 District 5-3 District Design Guidelines • Street Improvements County Road E/Lake Johanna Boulevard should be improved as follows ' i to create a sense that this is a special place in Arden Hills: ■ Convert the shared left-turn lane to a landscaped median with protected left-turn lanes. • Add a row of trees along both sides of the road between the curb and the sidewalk. • Replace the street light poles and light with new equipment. Refer also to the description in Chapter 4,Land Use and Public Improvements,in this guiding plan. I 'ill u III Business Signs Business signs should be restrained and in proportion with the wall of the building. Back-lit signs with individual letters are preferred over plastic panels. Freestanding signs along the public street should be monument style rather than pole style. 5-4 Guiding Plan for the B2 District 20 October District Design Guidelines Land Uses Types of Land Use Allow a wide range of land use types throughout the district on each site and,potentially,within each building. On sites bordering County Road E, allowable land use may include corporate or professional office buildings,build-to-suit offices,medical offices,multiple-family housing, lodging, eating and drinking businesses,and retail or service businesses. Multiple-family housing would be medium-to high-density buildings with interior hallways as opposed to townhouses;either rental or owned; I yy general market or seniors. Retail or service businesses should be scaled to serve the local trade area that includes Arden Hills, Shoreview and northern Roseville. On sites presently occupied by industry along the north side of County Road E,redevelopment may include certain industrial operations that have a high density of jobs,no outdoor storage and little or no heavy- truck traffic. Every land use should be of the type that generates property tax revenue. (Please also refer to the Illustrative Guiding Plan sketch on page 4-1 1, which more clearly indicates the shape, coverage and relationships of the buildings and open space suggested above.) 5-6 Guiding Plan for the B2 District 20 October District Design Guidelines Building Height and Size The B2 District should be visually distinct from the rest of Arden Hills and clearly express that distinction. It should grow to be a visual,social and psychological center of Arden Hills. It should an intensely developed part of the community,and that density should foster increased walking. The way in which buildings relate to the public street is one of the key aspects of creating a sense of place and identity. Building placement and height should serve to enclose and define the edges of County Road E, making it somewhat of an outdoor room. Building Setbacks To support walking and enhance a sense of place,buildings should be set close to the public street rather than being separated from the street by parking. A landscaped space between the sidewalk and the building " . approximately 20 feet wide would be appropriate. Encourage that at least 50 percent of the largest building on each site occupy the street frontage at the"build-to"line. • Coordinate building architecture to try to create active spaces in side yards rather than just parking or service functions. Building Height Most new office,residential or mixed-use buildings are anticipated to be _ in the height range of two to four stories. Buildings exclusively devoted to retail and service businesses are expected to be one story. Commercial building(s)taller than one story would be desirable on the northern end of Arden Plaza to compensate for the difference in elevation between the road and the site. At a minimum, a raised parapet wall is needed there to shield rooftop equipment from views from the road. A"second story expression"technique(exterior facade only) could also be used. Buildings taller than four stories may be considered northwest of County Road E,where the tallest buildings and greatest intensity of land coverage should be guided. Building height may be limited by the effect of the project on traffic circulation,which will be assessed during the review process. 20 October Guiding Plan for the B2 District 5-7 r District Design Guidelines ✓ Y r 51 s k #�, Future residential buildings could be three or four stories in height, include parking under the building or in a structure, and be located along the street with space for trees and other landscaping behind the public sidewalk. Building mass should be broken with materials, setbacks, window patterns and balconies. Parking • Parking areas or structures for office or residential buildings that are E in close vicinity to County Road E or Lexington Avenue should be „ ¢ located behind(preferably)or beside the building. • Allow parking between buildings to the extent that parking in the side yard accounts for no more than 50 percent of parking on the site. • Sufficient parking should be provided to accommodate the reasonable hourly peak on a given site. Parking should be shared among buildings on a site to reduce the land devoted to parking. Hourly variations among different types of land use should be considered when estimating parking demands. • Provide on-street parking along Pine Tree Drive and Harriet Avenue. Demarcate on-street parking bays with pedestrian"bump-outs"at driveway or street intersections. • Green islands and trees should be incorporated into parking lots to increase their visual appeal. Certain service businesses such as a fitness center may exceed that figure. Quality Exterior Building Materials 1 Buildings should be constructed of materials that are enduring, timeless and well-detailed. • Exterior building materials should be primarily face brick,stone, decorative concrete plank,transparent glass and/or metal (as an accent and trim material). Other high-quality materials that increase the variety and appeal of buildings may be considered as accents. • Metals should have a matte finish and neutral or earth tone colors. Metals that are used for exterior walls should have visible corner moldings and trim. wAl, % - Undesirable materials include wood except as an accent material, mirrored or tinted glass especially on the first floor, simulated brick or stone,vinyl or aluminum siding,concrete blocks,materials that r have no pattern or relief especially when applied to large walls, materials that represent corporate colors or trademarks,brightly colored metal roofing or canopies,pre-cast tilt-up walls, and synthetic awnings particularly when illuminated from the rear. Exterior Building Design • Buildings should be articulated,especially with windows and doors, to reduce their apparent size and create visual interest from the street. Long blank exterior walls should not be allowed. • Building volume should be broken with recesses and projections e�+ such as porches,dormers and bays that create shadows and add Vt visual interest. Volume m ay also be broken with multiple roof and ridge lines perpendicular to one another or offset to avoid single roof ' lines. ■ Facades of commercial buildings should be designed to convey the impression of a series of individually-constructed small storefronts. Windows should be made of transparent glass and recessed at least one inch rather than being flush with the fagade. • Awnings or overhangs should be provided at entryways to provide shelter from the sun and rain. • Exterior lighting for parking lots and buildings should not be excessive and should be directed at their intended purposes. • Any multi-level building should distinguish the ground floor level from the upper floors by use of these techniques: an intermediate cornice line,difference in building materials or details, awnings trellis or arcade,special window details,or brick corbels or quoins. A strong base and top for multi-story buildings should be established; middle layers should be simpler. Detail should be an integral part of the architecture rather than a series of applied elements. �r•n • Mechanical systems and service areas should be integrated into in the architecture of the buildings. Garbage and recycling containers should be fully enclosed and integrated into the architecture of the rl buildings. • Business signs should be architecturally compatible with the style, composition,materials,colors and details of the building and should , be an integral part of the building. Signs should be incorporated into the facades of the buildings rather than extending past the roof line and should not project more than 12 inches beyond the plane of the fagade. Retail business wall signs should be located in a position above the front window that is located consistently among stores. Backlit signs should not be allowed on the street side of new buildings with 100 feet of a public street. Pylon,rooftop and portable changeable message signs should not be used. • Franchise architecture identified with a particular chain will be discouraged unless it is architecturally integrated into the district and approved building materials are used. Every commercial building should offer opportunities for some degree of gathering. Spaces should be created to encourage interaction and gathering. In Arden Plaza,there should be an attractive and functional outdoor - seating area or two near businesses that offer eating and drinking. Public art should be used near the district focal point,the Pine Tree Drive intersection,and possibly other locations. Sloped Roofs shall be utilized on all principal and accessory structures. Roofing materials and design shall be consistent with those found in the adjacent residential neighborhoods outside the neighborhood business district. F. Exterior Materials shall include only face brick, stone, glass, or natural wood products. All walls shall be treated with the same exterior materials. G. Lighting shall adhere to the requirements in Section 1325.05 Subd 3. Lighting shall not be pennitted to wash the building, except for accent lighting to delineate the main entryway into the building. Security and parking lot lighting shall be on pedestals not to exceed fourteen (14) feet in height. H. Trash shall be fully screened in a masonry enclosure or shall be stored within the principal structure. I. Vending Machines shall be located on the interior of the principal structure. J. Bicycle Racks shall be provided in an area that is convenient to the main entryway into the building. K. Sidewalks shall be provided adjacent to all public rights-of-way. L. Gateways, where applicable, should be incorporated into the layout of the . site. The 1985 Parkway System Feasibility Study and the Comprehensive Plan provide additional guidance on the incorporation of gateways. t( 1320.085 ecial Requirements for the B-2 General Business District. The B-2 General Business istrict enc mpasses the primary commercial gateway into the City. Accomplishing the purpose of the - istrict requires particular concern for the design of buildings, site features (such as landscaping, lighting, and signage), site layout, building materials, and site design. The traffic and visual impacts from new developments and redevelopments must be evaluated to help ensure the long-tern viability and success of the B-2 General Business District. Subd. 1 Procedure. The following procedures shall apply to all new construction, modification of a building(s), and modification of a property within the B-2 District: A. The application and the administrative and review procedure established in Section 1355.04 Subd 3 and Subd 5, Conditional Use Permit and Site Plan Review, and in Appendix A, Procedural Manual, shall be followed for all development(s) that: 1. Involves new building construction or alterations that increase the capacity or square footage of the building; 2. Modifies a building's exterior but does not conform to the provisions in this Section as determined by the Zoning Administrator; Section 1320—District Provisions Adopted:November 13,2006 Page 14 of 41 i City of Arden Hills Chapter 13 Zoning Code 3. Modifies the site or use in such a way that notably increase traffic • and/or alters traffic patterns as determined by the Zoning Administrator and engineer designated by the City; 4. Reduces parking spaces below the minimum requirement for the uses on the property; 5. Adds more than ten (10)parking spaces; 6. Reduces the net landscaped area; 7. Installs additional lighting poles or lighting sources (but not replacement of existing lighting fixtures). B. Modifications to building or properties not listed in above one through seven shall not require a conditional use permit or site plan review unless the change is deemed significant by the Zoning Administrator or Building Official. C. The prescribed procedures or standards in this Section may be modified by the City Council to allow planning flexibility and to encourage cooperative dialogue between the applicant and the City. Subd. 2. Permitted uses (as specified in the Land Use Chart, Section 1320.05, for the B- 2 District) that occupy existing buildings do not require a conditional use permit except in those cases where Section 1320.01 Subd 9.A.1-7 apply. Subd. 3. Conditional uses (as specified in the Land Use Chart, Section 1320.05, for the B-2 District)require an approved conditional use permit prior to occupancy. Modifying a building or site as listed in Section 1320.085 Subd 1.A.1-7 shall also require a conditional use permit and site plan review. Subd. 4. Interim uses (as specified in the Land Use Chart, Section 1320.05, for the B-2 District) require an approved interim use pen-nit prior to issuance of an occupancy or building permit. Modifying a building or site as listed in Section 1320.085 Subd 1.A.1-7 shall also require a conditional use permit and site plan review. Added April 28, 2008 Subd. 5. Planned Unit Developments. To further accomplish the stated purpose of the B-2 District, developers are encouraged to plan their sites in the spirit of the purpose and intent of the Planned Unit Development provision in Section 1320.14. If a Planned Unit Development application is submitted, the Planned Unit Development proposal shall identify modifications to the standard zoning requirements otherwise applicable to the site and the reasons why the modifications would be in the public interest and would be consistent with the purpose of the B-2 District. New construction and redevelopment of properties shall • adhere to the following design requirements. A. Building Exteriors, Site Features, and Site Development. (i) The arrangement, geometry, massing, materials and colors shall work to create a high quality development that is responsive to existing buildings, site features, and site design on adjoining sites in the district. (ii) Exterior building materials shall be primarily of brick, stone, glass or any combination thereof, except trim and other accessory or decorative features may be metal, wood, or EIFS. (iii) Sheet metal, corrugated metal, and plain flat concrete block (painted or not) shall not be permitted as exterior finishes. (iv) Design elements on all sides of a building shall be compatible with the front elevation and/or adjacent buildings. Architectural elements such as, but not limited to, windows, shutters, awnings, doors, masonry exterior veneers, cornice detailing, window casings, and other architectural details should demonstrate consistency on all sides of the structure that are reasonably visible to the general public. Plain flat walls shall not be permitted when viewable from the public right-of-way or public areas. • (v) Buildings containing office and retail uses shall maintain twenty percent (20%) minimum window coverage on each floor that faces a street or public open space. Mirror glass/fagade glazing/spandrel glass/faux windows shall not constitute more than fifty percent (50%) of the required window area. (vi) The City Council will make the final determination on the compatibility and consistency with these design provisions. B. Fences. (1) No barbed wire, razor wire, or spikes allowed. (ii) Fences must blend into the landscape and minimize corrosion. Wood, brick, stone or wrought iron is encouraged. If chain link is allowed by the City Council, it must have black or dark green vinyl coating. (iii) All other requirements of Section 1325.05 Subd 4 must be followed. . C. Screening. Section 1320—District Provisions Adopted:November 13,2006 Page 16 of 41 City of Arden Hills Chapter 13 Zoning Code (i) All mechanical equipment, whether roof-mounted or ground- • mounted, shall be completely screened from view of adjacent properties and public streets, or designed to be compatible with the architectural treatment of the principal building. Wood screening shall not be permitted. (ii) Trash and recycling equipment and materials shall be screened from public view and adjacent properties with an enclosure that is constructed of the same materials and colors as the principle building. Wood fencing shall not be permitted. (iii) Loading docks shall be screened from public view or integrated into the building's architecture so as to reduce their visual impact. Subd. 7 Lighting. Exterior lighting shall be provided for the safety and convenience of occupants and visitors. A. A lighting plan shall be submitted that shows location,type of illumination and design. A photometric analysis of site and building shall be submitted for City approval with all new construction or redevelopment projects. B. Exterior lighting shall be consistent in type, design, scale, and color to create unity in the B-2 District. High-pressure sodium lighting and other • similar types of lighting color may be required by the City to promote a unified lighting color throughout the B-2 District. Other lighting colors may be considered during the City review process. C. The source of illumination shall be hooded, concealed or controlled in a manner so as not to unnecessary glare on adjoining lots, buildings, streets or highways. D. Light washing of buildings and accent lighting may be permitted through the City review process provided that it does not negatively impact residential areas or traffic safety and is complementary to the district as a whole. Subd. 8 Pedestrian Circulation. All new development and redevelopment within the District shall install pedestrian improvements in accordance with the City of Arden Hills Comprehensive Plan and any other supplementary sidewalk or trail plans. Other pedestrian sidewalks and trails may be required by the City. A. Site design shall facilitate pedestrian connections and mobility within and between building, sites, and uses by providing clear visual indicators through door placement, signage, and integrating landscaping components. B. The city may require bike racks; racks must be placed to not impede . pedestrian circulation. Internal sidewalk systems shall connect with adjacent planned or developed public sidewalks or trails. Subd. 9 Drainage/Water Management Plan: A plan must be submitted with each project or lot development in the B-2 District. The plan must be approved by the Rice Creek Watershed District, other agencies as required, and the engineer assigned by the City. Two or more Iots or projects may coordinate their plans for their mutual benefit. Subd. 10 Prohibited Uses. Some land uses are not compatible with the stated purpose of the B-2 District. The following uses are therefore prohibited: A. Open sales, rental or storage lots, including but not limited to cars, buses, trucks, motorcycles, bicycles, recreational vehicles, trailers, boats, mobile homes, machinery, lumber, building materials, and similar items. The B-2 General Business District encompasses a primary gateway into the City. The aesthetic and transportation impacts from new developments and redevelopments must be evaluated to help ensure the long-term viability and success of the B-2 District. Accomplishing the purpose of the B-2 District requires particular concern for the design of buildings, site features (such as Iandscaping, lighting, and signage), site layout, building materials, site design, and other related design elements. To that end, new development and redevelopment shall conform to the standards in this and related sections and shall be guided by the "Guiding Plan for the B2 District," which was adopted by the City Council on October 27, 2008. In reviewing and approving land use applications, the City Council shall make the final determination on the compatibility and consistency with all provisions in this and related sections of the Zoning Ordinance. Subd. 1 Procedure. To further accomplish the stated purpose of the B2 District, the following procedures shall be used: A. Proposals for new construction, redevelopment of a site, and significant modifications to existing sites shall use the Planned Unit Development (PUD) process. The PUD proposal shall identify any requested modifications to the zoning requirements and from the "Guiding Plan for the B2 District" as well as the reasons why the modifications would be in the public interest and would be consistent with the purpose of the B-2 District. Applicants are encouraged to utilize the PUD Concept Plan Review process. Conditional use permits may also be required for uses list in Section 1320.05. B. Conditional Use Permits, Site Plans, and other development agreements that were approved for development sites before November 24, 2008, shall remain in effect but shall use the Planned Unit Development Process for future site amendments. C. The following items shall not be considered significant modifications to an existing site and shall be exempt from the PUD process but shall be subject to administrative review and approval: 1. Internal alterations to buildings that do not result in a change to the building height, roof line, or footprint unless the changes will have a notable increase in traffic and/or parking needs as determined by the Community Development Director or their designee; 2. Replacement, maintenance, or repair of existing materials, including exterior finishes, signage, landscaping, and parking lots; 4 f ORDINANCE NO.2008-010 3. Minor modifications to the exterior of a buildingor a site that substantially tantially conforms to the design standards in Section 1325.04 Subd 7 and has no discernable impact on traffic as determined by the Community Development Director or their designee; D. The provisions in this Section may be modified by the City Council to allow planning flexibility and to encourage cooperative dialogue between the applicant and the City. Minor improvements to existing uses should be encouraged without costly upgrades or complete changes to a site. Subd. 2 Uses. A. Permitted uses (as specified in the Land Use Chart, Section 1320.05, for the B-2 District) that occupy existing buildings do not require a conditional use permit prior to occupancy. Other city permits may be required. B. Conditional uses (as specified in the Land Use Chart, Section 1320.05, for the B-2 District) require an approved conditional use permit prior to occupancy. Other city permits may be required. C. The following land uses are not compatible with the stated purpose of the B-2 District and shall be prohibited: 1. Individual retail businesses larger than 50,000 square feet except for Sports and Fitness Clubs. 2. Open sales, rental or storage lots, including but not limited to cars, buses, trucks, motorcycles, bicycles, recreational vehicles, trailers, boats, mobile homes, machinery, lumber, building materials, and similar items. Approved open air garden centers shall be exempt. 3. Mini-storage facilities. 4. Tattoo parlors and establishments offering "payday" loans. 5. Outdoor bulk storage buildings, including but not limited to, forest, metal, concrete, agricultural and petroleum products, chemicals and similar products. 6. Manufacturing or processing that generates hazardous waste without a valid Hazardous Waste Generator's license from the Ramsey County Public Health Department. Subd. 3 Special Regulations for Drive-up Windows, Drive-in Businesses and Fast Food Restaurants. Section 1325.04 of the Zoning Ordinance specifies additional 5 ORDINANCE NO.2008-010 requirements for drive-in businesses, fast food restaurants, and automobile service stations. For the purposes of the B2 District, these regulations shall also apply to drive-up windows. The provision whereby the proximity requirement of one thousand three hundred and twenty(1,320) feet between drive-in businesses, fast food restaurants, and drive-up windows may be waived if the following conditions are met as determined by the City Council: A. The architectural treatment, circulation plan, and signage system of such businesses shall be designed to visually and functionally integrate the building and the site on which it is located. B. The applicant shall submit a circulation plan that demonstrates that the use will not interfere or reduce the safety of non-motorized movements, specifically pedestrian and bicyclists. C. Requested modifications to the provisions in section 1325.04 shall be stated in writing along with an explanation of why the modifications would be in the public interest and would be consistent with the purpose of the B-2 District. Subd. 4 Institutional Housing. The standards in section 1325 shall be met. Requested modifications from these provisions shall be stated in writing along with reasons why the modifications would be in the public interest and would be consistent with the 6 ORDINANCE NO.2008-010 purpose of the B-2 District. Please note the building and site design standards in section 1325.05 Subd 8. 1325.05 Design Standards. The standards established in this section are designed to encourage a high standard of development by providing assurances that neighboring land uses and neighboring properties will be compatible. The standards shall also apply to all future development and shall apply to existing development where so stated. Before any applications for development or construction under the City Code are approved, it shall be determined that the proposal will be in conformance with these standards unless a deviation has been granted. It shall be the responsibility of the applicant to demonstrate such conformance. Revised April 28, 2008. Subd. 8 Additional Design Standards for New Development, Redevelopment, and Modifications to Existing Sites in the B2 District. Unless preempted by the standards in this section, all other zoning provisions shall apply: A. Purpose and Intent. The purpose of these additional design standards is to promote a high level of architectural, landscaping, and site design in this business district of Arden Hills. The City seeks to create a unified, harmonious, and high- quality environment to foster a distinct, positive, and successful image for the • City. The criteria by which new development, redevelopment, and site modifications in this District shall be judged are as follows: 1. Consistency with provisions of the comprehensive plan and other guiding plans as amended from time to time; provisions of the zoning ordinance and subdivision ordinance; and all other applicable regulations. 2. Use of appropriate materials, lighting, textures, colors, and architectural and landscape forms to create a unified, high-quality design concept for each site that is compatible with adjacent and neighboring structures and functions. 3. Creation of unified site designs, each with a sense of internal order, that provide desirable environments for site users and visitors and the community as a whole and that consider all site elements. 4. Provision of safe and adequate access from public streets to sites giving ample consideration to the location and number of access points, the safety and convenience of merging and turning movements, and traffic management and mitigation. 5. Provision of on-site vehicular, bicycling, and pedestrian circulation by way of interior drives, parking areas, pathways, and walkways adequate to handle anticipated needs and to safety buffer pedestrians and cyclists from 7 ORDINANCE NO.2008-010 motor vehicles. Ample consideration shall be given to the width of interior drives, internal traffic movement and flow, separation of pedestrian, cycling, automobile; and delivery traffic, and the safe, convenient, and practical arrangement of parking spaces. B. Application. The standards in this Section should apply only to the building or site elements being developed or altered (i.e. a proposal for changes to a building would be required to meet only those standards that pertain to buildings while changes to a parking area would be required to meet the standards for parking areas but not for buildings). The design standards shall be applied proportionately to the degree of change proposed. Upon recommendation from the Planning Commission, the City Council may waive specific design standards based on the scale of the project. The City Council shall make the final determination on the compatibility and consistency with the design standards. C. Architectural Style and Building Character. Evaluation of the appearance of a project shall be based on the quality of its design and on its relationship to its surroundings. Site characteristics to be evaluated for this purpose include, but are not limited to, building and landscaping materials, colors, textures, shapes, massing, building components, height, roof-Iine, and setback. Monotony of design, both within projects and between projects and its surrounding, is • prohibited. Variation in detail, form, and arrangement shall provide visual interest. Architectural style should not be restricted. D. Building Materials. Buildings shall be constructed of materials that are enduring, timeless, and well-detailed. , 1. At least seventy-five percent (75%) of the exterior building materials shall be of brick, stone, decorative concrete plank, transparent glass or any combination thereof. 2. Trim and other accent or decorative features may be metal, wood, or EIFS. Other high-quality materials that increase the variety and appeal of buildings may be considered as accents. Metals shall have a matte finish and neutral or earth tone colors. Metals that are used on exterior walls shall have visible corner moldings and trim. 3. Prohibited materials shall include simulated brick or stone, vinyl or aluminum siding, sheet metal, corrugated metal, concrete blocks, materials that have no pattern or relief when applied to large walls, brightly colored metal roofing or canopies, and pre-cast tilt-up walls. Undesirable materials include extensive use of mirrored or tinted glass on the first floor and materials that represent corporate colors or trademarks that are not in conformance with approved building materials. 8 ORDINANCE NO.2008-010 E. Building Design. The arrangement, geometry, massing, materials and colors shall work to create a high quality development that is responsive to existing buildings, site features, and site design on adjoining sites in the district. 1. At least fifty percent (50%) of the largest building on each site shall be constructed at the front setback line. 2. Fagade treatment shall be carried around all sides. Architectural elements such as, but not limited to, windows, shutters, awnings, doors, masonry exterior veneers, cornice detailing, window casings, and other architectural details should demonstrate consistency on all sides of the structure that are reasonably visible to the general public. Plain flat walls shall not be permitted when viewable from the public right-of-way or public areas. 3. To avoid long unbroken expanses and to increase visual interest from the street, buildings of more than 40 feet in width shall be divided into smaller increments (between 20 and 40 feet) through articulation of the facades to convey the impression of individually-constructed small storefronts or, in the case of housing, housing units. This can be achieved through the combination of the following techniques: a. The use of windows and doors; b. Fagade modulation—stepping backward or forward or extending a portion of the fagade; C. Vertical divisions into storefronts with separate display windows and entrances; d. Recesses and projections such as porches, dormers and bays that create shadows and add visual interest; e. Variation in the rooflines by using multiple roof and ridge lines perpendicular to one another, offsetting single roof lines, stepped roofs; f. Providing a lighting fixture, trellis, tree, or other Iandscape feature with each interval. 4. Awnings or overhangs shall be provided at entryways to provide shelter from the sun and rain. The awnings shall be opaque so as not to create a glowing effect with lights under the awnings. Awnings shall be constructed of durable, protective, and water repellant material; however, plastic or fiberglass awnings shall not be permitted. 9 ORDINANCE NO.2008-010 5. Any multi-level building shall distinguish the ground floor level from the upper floors by use of any or a combination of these techniques: an intermediate cornice line, difference in building materials or details, awnings trellis or arcade, special window details, or brick corbels or quoins. A strong base and top for multi-story buildings shall be established; middle layers shall be simpler. Detail shall be an integral part of the architecture rather than a series of applied elements. 6. Franchise architecture identified with a particular chain shall be discouraged unless it is architecturally integrated into the district and conforms to these design standards. 7. Entrances shall have convenient access to the street frontage and to parking serving the use. For those properties along County Road E, access to the street frontage shall be given priority where feasible. F. Fagade Transparency. 1. Fifty percent (50%) of the first level fagade that includes the primary store entrance and/or faces a public street shall be made of transparent windows and doors that are recessed at least one inch rather than being flush with the fagade. If the building is a one story design and the first floor elevation exceeds twelve (12) feet, then only the first twelve (12) feet shall be included in calculating the fagade area. 2. At least twenty percent (20%) of the remaining sides shall be window coverage, half of which may be simulated windows (i.e. spandrel glass). If additional transparent glass is used on the remaining sides, the City may consider a proportional reduction in the transparent window and door requirement on the primary store entrance and/or public street fagades: 3. For buildings with a use or function that does not readily allow windows (e.g. cooler or freezer areas, mechanical rooms, security areas, storage areas) the transparent window standards may be reduced at the discretion of the City Council. However, the architectural detailing must be provided by the use of upper level windows, which may include the partial use of simulated windows, or architectural detailing that provides arches, patterning, recesses, and shadowing that provide aesthetic interest. Architectural detailing may include such things as change in materials, change in color and other significant visual relief provided in a manner or at intervals in keeping with the size, mass, and scale of the wall. 10 ORDINANCE NO.2008-010 G. Building Color. Colors shall be harmonious. Building colors shall consist of muted colors with low reflectance. Recommended colors include browns, grays, tans, beiges, and dark or muted green, blues, and reds. Bright or brilliant colors and sharply contrasting colors may be used for only accent purposes occupying a maximum of five percent (S%)of building facades. H. Fences. Fences shall blend into the landscape, be compatible with other materials used on site, and be made of a material that minimizes corrosion. Finished and treated wood, brick, stone or wrought iron is encouraged. I. Signs. 1. Business signs shall be architecturally compatible with the style, composition, materials, colors and details of the building and should be an integral part of the building. Signs shall be incorporated into the fayades of the buildings rather than extending past the roof line and should not project more than twelve (12) inches beyond the plane of the fayades. Retail business wall signs shall be located in a position above the front window that is located consistently among stores. 2. All other provisions in Chapter 12, Sign Code, shall apply. J. Site Furnishings and Seating Areas. 1. Site furnishings shall be provided based on the scale of the project. The site furnishings may be spread out on the site or clustered to provide a more formal area. Placing site furnishings near landscaped areas is encouraged. These areas may be shared by multiple tenants on a property or adjacent properties and may include tables, chairs, benches, plantings, and other outdoor amenities such as a plaza. These areas shall be maintained for year round use. Creativity is highly encouraged. These spaces shall be connected to the sidewalk system. 2. Benches and decorative plantings shall be provided near the primary entrance of all buildings on a site. 3. Restaurants shall include a functional outdoor seating area with tables, chairs, plantings, and access to the restaurant. 1. No outdoor seating shall be permitted in any portion of the public sidewalks where normal pedestrian traffic flow is obstructed. 11 ORDINANCE NO.2008-010 • 2. The outdoor seating area shall not be used for exterior storage when the area is not in use. While such area is in operation, all tables and chairs shall be kept in a clean, sanitary condition. 3. These areas shall be distinguished with decorative fencing and/or plantings. 4. If alcoholic beverages are served, the establishment shall take reasonable steps to insure that alcoholic beverages are consumed only by patrons of the establishment who are of age. All other provisions related to the license to serve alcohol shall apply. K. Screening. 1. Trash and recycling equipment, materials, and containers shall be fully enclosed and integrated into the architecture of the buildings. 2. All mechanical equipment, whether roof-mounted or ground-mounted should be integrated into the architecture of the building. It shall be completely screened from the ground-level view of adjacent properties and public streets. Wood screening shall not be permitted. 3. Truck docks and delivery areas shall face away from the public street and • shall be integrated into the architecture of the building. L. Landscaping. A generous amount of plant material and landscaping shall be used on all new development and redevelopment sites. Office parking areas shall include a generous amount of perimeter and internal landscaping. Parking structures shall be visually softened with plantings. A minimum of one tree shall be placed along the right-of-way every forty(40) feet. The tree shall not interfere with the roadway and shall be on private property. M. Parking. 1. Placing parking between the street right-of-way and a building shall be discouraged. 2. No more than fifty percent (50%) of the parking on a site may be between buildings or in the side yards. 3. Sufficient parking shall be provided to accommodate the reasonable hourly peak on a given site. Shared parking is encouraged to reduce land devoted to parking. Hourly variations among different types of land use may be considered when estimated parking demands. 12 ORDINANCE NO.2008-010 4. Plantings shall be used to soften and shade parking lots and parking structures. Parking and service areas shall be visually screened from street views with plantings and architectural treatments. 5. Parking lot islands shall be used to distribute large parking fields into separate "outdoor" rooms that have visual relationship to the buildings they serve. Parking lot islands shall be planted with trees or include infiltration basins and plantings. Entry drives shall be defined by trees and shrubs. 6. A concrete curb shall be provided around the periphery of all parking lots and access roads, except where the City Engineer determines that a curb would impede drainage. 7. Parking adjacent to streets should be screened from views with landscaping, including but not limited to trees, hedges, flowers and other bushes and/or decorative masonry walls. Berms shall be discouraged. 8. Parking structures that are visible from off the site shall display an integration of building materials building form, textures, architectural motif, and building colors with the principal building. No signs other than • directional signs shall be permitted on parking ramp facades. N. Traffic Study. A traffic study shall be required for all new developments, redevelopments, and significant modifications to existing sites unless waived by the City Council. O. Lighting. Exterior lighting shall be provided for the safety and convenience of occupants and visitors. 1. A lighting plan shall be submitted that shows location, type of illumination and design. A photometric analysis of site and building shall be submitted for City approval with all new construction or redevelopment projects. 2. Exterior lighting shall be consistent in type, design, scale, and color to create unity in the B-2 District. High-pressure sodium lighting and other similar types of lighting color may be required by the City to promote a unified lighting color throughout the B-2 District. Other lighting colors may be considered during the City review process. 3. Exterior lighting for parking lots and buildings shall not be excessive and shall be directed at their intended purposes. 13 ORDINANCE NO.2008-010 4. Lighting under a gasoline station canopy shall not be directly visible from the street but shall be recessed into the canopy or otherwise shielded. 5. Light washing of buildings and accent lighting may be permitted through the City review process provided that it does not negatively impact residential areas or traffic safety and is complementary to the district as a whole. P. Pedestrian and Bicycle Circulation. Pedestrian and bicycle improvements shall be installed in accordance with the City of Arden Hills Comprehensive Plan and the local guiding plan and shall be in conformance with the following: 1. Site design shall facilitate pedestrian connections and mobility within and between building, sites, and uses by providing clear visual indicators through door placement, signage, striping, raised pathways, and integrating landscaping components. Other features or materials may be considered that enhance and provide a safe pedestrian experience. 2. A sidewalk shall link the primary entrance of each building on site with the public sidewalk network. In the event a building is subdivided into multiple separated tenant spaces, a sidewalk must link the primary entrance of each separated tenant space with the public sidewalk network. 3. Bike racks shall be required near the primary entrances of all buildings. 4. Internal sidewalk systems shall connect with adjacent planned or developed public sidewalks or trails. 5. The grades of all walks, parking spaces, terraces, and other paved areas shall conform to the requirements of the Americans with Disabilities Act. 6. Where there is new building construction or renovation where the renovation value is thirty percent (30%) or more of the pre-renovation value of the structure, a minimum six foot concrete sidewalk adjacent to or in all rights-of-way shall be provided. The location of the sidewalk shall be prescribed by the Public Works Director. The new sidewalks shall connect to sidewalks on adjacent properties if they exist. At the discretion of the City Council, the property owner may, in lieu of constructing the sidewalk, pay the City an amount equal to the cost of constructing the sidewalk to satisfy the obligations of this section. Said payment shall be used by the City to further maintain and construct the pathway system within the City. 7. When there is more than one building on a site, a sidewalk must link the primary building entrances of each building to one another. 14 ORDINANCE NO.2008-010 Q. Drainage/Water Management Plan: A plan must be submitted with each project or lot development in the B-2 District. The plan must be approved by the Rice Creek Watershed District, other agencies as required, and the engineer assigned by the City. The provision whereby the proximity requirement of one thousand three hundred and twenty(1,320) feet between drive-in businesses, fast food restaurants, and drive-up windows may be waived if the following conditions are met as determined by the City Council: A. The architectural treatment, circulation plan, and Sig alae system of such businesses shall be designed to visually and functionally integrate the building and the site on which it is located. B. The applicant shall submit a circulation plan that demonstrates that the use will not interfere or reduce the safety of non-motorized movements, specifically pedestrian and bicyclists. C. Requested codifications to the provisions in section 1325.04 shall be stated in writing along with an explanation of why the modifications would be in the public interest and would be consistent with the purpose of the B-2 District. 8 0 RED LINE VERSION OF CHANGES TO 1320 • Subd. 4 Institutional Housing. Pending pletion of the Givy's B 2 Zening Distr-iet Planning , _ existing hotel-motel use may be used for institutional housing upon approval of an Interim Use Permit provided that all of the following f requirements are met: Added April 28, 2008 A. Conformance with Section 1355.04 Subd 7 of the Zoning Code; B. The building to be used for institutional housing meets applicable building and fire codes as determined by the Fire Marshal and Building Official; C. Each room that has occupants on an overnight basis shall have bathroom facilities within the room; D. The capacity of the building shall not be exceeded; E. The institutional housing shall only be used for student or faculty housing. Rest homes, hospitals, sanatorium, nursing home, convalescent homes, and orphan homes shall not be permitted. F. A regularly scheduled shuttle shall be provided to and from the college or campus for which the institutional housing is being used; • Subd. 5 Design Standards. Before any applications for development or construction under the City Code are approved, it shall be determined that the proposal will be in conformance with these standards unless a deviation has been granted. Unless preempted by the standards in this section, all other zoning provisions shall apply: • 9 RED LINE VERSION OF CHANGES TO 1320 A. Purpose and Intent. The purpose of these additional design standards is to promote a high level of architectural, landscaping, and site design in this business district of Arden Hills. The City seeks to create a unified, harmonious, and high- quality environment to foster a distinct, positive, and successful image for the City. The criteria by which new development, redevelopment, and site modifications in this District shall be judged are as follows: 1. Consistency with provisions of the comprehensive plan and other guiding plans as amended from time to time; provisions of the zoning ordinance and subdivision ordinance; and all other applicable regulations. 2. Use of appropriate materials, lighting, textures, colors, and architectural and landscape forms to create a unified, high-quality design concept for each site that is compatible with adjacent and neighboring structures and functions. 3. Creation of unified site designs, each with a sense of internal order, that provide desirable environments for site users and visitors and the community as a whole and that consider all site elements. 4. Provision of safe and adequate access from public streets to sites giving ample consideration to the location and number of access points, the safety and convenience of merging and turning movements, and traffic management • and mitigation. 5. Provision of on-site vehicular, bicycling, and pedestrian circulation by way of interior drives, parking areas, pathways, and walkways adequate to handle anticipated needs and to safety buffer pedestrians and cyclists from motor vehicles. Ample consideration shall be given to the width of interior drives, internal traffic movement and flow, separation of pedestrian, cycling, automobile; and delivery traffic, and the safe, convenient, and practical arrangement of parking spaces. B. Application. The standards in this Section should apply only to the building or site elements being developed or altered (i.e. a proposal for changes to a building would be required to meet only those standards that pertain to buildings while changes to a parking area would be required to meet the standards for parking areas but not for buildings). The design standards shall be applied proportionately to the degree of change proposed. Upon recommendation from the PIanning Commission, the City Council may waive specific design standards based on the scale of the project. The City Council shall make the final determination on the compatibility and consistency with the design standards. C. Architectural Style and Building Character. At that meeting the City Council expressed a number of concerns and unanimously voted to table the item to the next meeting to give Staff the opportunity to make revisions and address the issues that were raised. At their October 27, 2008, meeting the City Council once again reviewed the revised draft plan and unanimously voted to accept it. • The Planning Commission reviewed this plan at their October 1, 2008, meeting and also unanimously recommended acceptance of it. The next step in the project is to approve the design guidelines for the B2 District. The City Council reviewed the following planning related items at their October 27, 2008, meeting. PC# 08-025—Boston Scientific PUD Amendment and Site Plan Review The City Council unanimously voted to approve Boston Scientific's request to construct a nitrogen tank, vaporizer, and related equipment on the north end of their campus at 4100 Hamline Avenue. A Condition of approval was added to the request that required the installation of bicycle racks at the location. Based on discussions with the City Attorney, it was not possible to require the construction of a sidewalk as a condition of approval at this time. The Planning Commission unanimously recommended approval of this item at the October 1, 2008, meeting. Planning Case 08-024, the Preliminary and Final Plat for Christensen Estates has been extended at the request of the applicant for nine months. The Planning Commission's recommendation for approval will stand and the project will go to the City Council for approval before the nine month extension has expired. The City Council held two TCAAP related work sessions on October 13 and 15 to discuss the roadways and infrastructure of the master plan, as well as naming parks and amenities.
