HomeMy WebLinkAbout3A, Draft 10-25-10 Regular City Council Meeting Minutes� �� EN HILLS Approved: CITY OF ARDEN HILLS, MINNESOTA REGULAR CITY COUNCIL MEETING OCTOBER 25, 2010 7:00 P.M. - ARDEN HILLS CITY COUNCIL CHAMBERS CALL TO ORDER/ROLL CALL Pursuant to due cail and notice thereof, Mayor Stan Harpstead called to order the regular City Council meeting at 7:00 p.m. Present: Mayor Stan Harpstead, Councii Members Fran Holmes, Brenda Holden, David Grant, and David McClung. Absent: None . Also present: City Administrator Patrick Klaers; Finance Director Sue Iverson; Public Works Director Terry Maurer; Civil Engineer Kristine Giga; and Recording Secretary Tina Borg. PLEDGE OF ALLEGIANCE 1. APPROVAL OF AGENDA Councilmember McClung requested Item 7B be moved to the Consent Calendar as Item 4F. MOTION: Councilmember Holden moved and Councilmember McClun� secanded a motion to Approve the A�enda as amended. The motion earried unanimouslY (5-0). 2. PUBLIC INQUIRIES/INFORMATIONAL A. TCAAP Reuse and Public Sale Update • City Administrator Patrick HIaers stated according to Deepa DeAlwis, of the MPCA, the Land Use Control Remediat Design (LUCRD) document was f nalized and approved by the MPCA and EPA earlier this month. The land use controls are now in place and are enforceable. Mr. Legare, of the General Services Administration (GSA), stated that he is still working on incorporating this language into the draft Invitation for Bid (IFB). Once he has completed drafting the Iand use restrictions into the IFB he will send the draft to the City for review and comment. Staff has sent out updates to the neighboring regarding the TCAAP property. Cleanup (VIC) program with the communities, Ramsey County, and the Metropolitan Council Ramsey County has begun the Voluntary Investigation and ARDEN HILLS CITY COUNCIL — October 25, 2010 2 2.A. TCAAP Reuse and Public Sale Update (continued) � MPCA on the parcels to be transferred to the County. It is anticipated that the process will be compiete in mid-2011. Councilmember Holden asked if the City had a copy of ihe LUCRD document. City Administrator Klaers stated that the City did not currently have a copy of this document but that staff would be obtaining one in the near future. B. Mounds View School District Presentation Mr. Jon Tynjala, Mounds View School Board Chair, presented information to the Ciiy Council regarding the 2010 Levy renewal request. He stated Mounds View public schools are a high- performing school district. He reviewed the schools test scores, community survey, the schools spending and costs. This tevy will not be an increase over the levy that is expiring but rather a renewal of the existing amount. If the levy is passed the district would be able to maintain current class sizes and programs and no new "extras" would be added. This levy will not prevent future reductions as funding conditions are unpredictable. 3. APPROVAL OF MINUTES A. September 20, ZO10, City Council Worksession Meeting Councilmember Holden requested the time in the title bar be changed to 5:00 p.m. instead of • 6:00 p.m. Councilmember Grant stated on page 3, the fourth paragraph should read: "Councilmember Grant commented he hoped that when considering any possible future repurposing of schools that Valentine Hills Eiementary would remain open as it is an asset to our City." B. September 20, 2010, Special City Council Meeting Couneilmember Holden requested on page 2, the first paragraph, the word "open" should be inserted in the second line between the words "library" and "until". C. September 27, 2010 Regular City Council Meeting Councilmember Holden requested on page l, the first Iine under TCAAP Reuse and Public Sale Update, Mr. Legare should be identified as being from the GSA. Councilmember Holmes requested on page 3, the first paragraph, after "this type of variance" insert "under the proper interpretation of the Iaw". Motion to approve Payment #2 to Blackstone Contractors of Corcoran, Minnesota, in the amount of $152,316.97 for the CP Raii Bridge Trail Improvement Project. C. Motion to adopt Resolution 2010-055 calling for a Public Hearing on November 29, 2010, regarding an issue of Revenue Bonds to be issued by the City of Bloomington on behalf of one or more affiliates of Presbyterian Homes Bloomington Care Center, Inc. D. Motion to adopt Resolution 2010-056, a resolution calling for a public hearing by the City Council on the proposed adoption of a modification to the development program for Devetopment District No. 1 and the proposed adoption of the Tax Increment Financing Plan for Tax Increment Financing District No. 4. E. Motion to accept the third quarter financial reports as presented. F. Motion to approve Ordinance 2010-011 Amending Chapter 2, Section 210.03, Subd. 1 Regular Meetings and Chapter 2, 5ection 210.03, Subd. 3, Special Meetings. MOTION: Councilmember Grant moved and Councilmember McClun� seconded a motion to approve the Consent Calendar as presented and to authorize execution of all necessary documents contained therein. NEW BUSINESS A. 2011 Pavement Management Program — Feasibility Study Civil Engineer Kristine Giga stated at the August 30, 2010 meeting, the City Council approved Resoiutian 2410-441 ordering the Feasibility Report for the 2011 Pavement Management Program (PMP} project. This project includes the foliowing roads: Amble Road, Arden View Court, Arden View Drive, Colleen Court, Dellwood Street, 3anet Court, Nursery Hill Lane, Nursery Hill Court, Wyncrest Court, Wyncrest Lane, Wynridge Drive. She outlined the project repairs including the water main repairs, sanitary sewer repairs, storm sewer and water quality improvements/ modifications as well as the estirnated project costs. Staffhas corrzpleted the report and presenting it to the Council as a draft. The project area has three types of properties; single-family homes, tax-exempt properties, and multi-family/townhomes. The City's Assessment policy does not address multi-family/townhome or R-3 dwellings. Additional direction is being requested regarding the assessments of the multi-famiIyitownhouse (R-3) properties. ZDlI Pavemerrt Management Program — Feasibility Study (continued) � three options with the report for assessing the multi-famiiy/townhome properties that will receive benef t from the propased improvements. These options are: 1. Percentage based on a vehicle trip calculation which would be equal to 60% of the assessment rate for a single-family unit; 2. Assess the multi-family unit for only their portion of the improvements or the improvements on their streets; 3. Assess ali units equai and assess all properties at the same rate. After the City Council decides which of the three options should be used for an assessment methodology, Staif will finalize the report and then formally submit the report to the Council at the November 8, 2010 meeting along with a resolution receiving the Feasibility Report and setting the Pubiic Hearing for December 13, 2410. Mayor Harpstead stated this project is in his neighborhood so he will abstain from voting on any matters relating to this project. Counci(member Holmes stated the City had a public hearing for Presbyterian Homes on December 13. She suggested having the public hearing for this project at a different meeting. Civil Engineer Giga stated she would check into November 29 to be sure the City could meet the legal notification requirements and schedule the public hearing for this meeting if possible. Councilmember Holden stated she would like ta have this public hearing before January in order to ensure the City is able to go out for bids early. In the past this has proven advantageous for the . City and residents. She stated she would be open to having a special meeting if necessary. Councilmember Grant stated he woutd also be open to a special meeting if necessary. Councilmember Holden asked what the life expectancy would be for this road since this project wiIl be a bituminous reclamation rather than a reconstruction. Civii Engineer Giga stated the City had done a bituminous reclamation project in the Briarknoll neighborhood in 2Q07. The Iife expectancy for this type of road is 20 to 25 years versus 12 to 15 years for a mill and overlay. She stated she would Iook into this project and provide the assessment figures to the CounciI. The cost for recIamation is more than doing a mitl and overlay but is less than it would be to do a full reconstruction. She explained that the reclamation process was a futl depth replacement of the pavement. It is replacing the street without digging up all the ald material, Ieaving existing curb and gutter in place. Councilmember Holden asked if the removal of the landscaped island in the cul-de-sac on Arden View Court was built into the cost estimate at this time. Civil Engineer Giga stated that complete removal of isIand is not included but modifications to the size of the island are incIuded. Councilmember Holden asked if making the cul-de-sacs on Karth Lake smaller was included in � the cost estimate. If the pavement area is reduced there would be less asphalt but this would be offset by the turf restoration that would occur. Councilmember Holden expressed concerns with making the cul-de-sacs smaller. This would increase the length of the driveways and may create problems for some residents. Civil Engineer Giga stated this is something that wili be looked into in more detail. Public Works Director Terry Maurer stated he had asked for this change to be included in the project. If the Council does not want to present this as an option at the public hearing it can be removed from the project. Councilmember Holden asked if the grit chamber was included in the cost estimate. Civil Engineer Giga stated this was included in the cost estimate. Councilmember Holden asked when the property division for 1225 Amble would take effect. Civil Engineer Giga stated the home on this property has been demolished and the owners have • 180 days to complete the process of replatting this lot. This process should be complete about the same time as the assessment hearing is scheduled to occur. Councilmember Grant asked if the Council would be considering a choice of curb for Amble Road. The residents in this area have expressed that they would prefer to not have a curb installed. Mayor Harpstead stated the recommendation of Staff had been to not install a curb on Amble Road. Councilmember McClung clarified there would not be a curb installed on Amble Road due to the analysis by Staff that this would not be required for this road. Councilmember Holden thanked Matt Woodruff for the well-written feasibility study. Councilmember Holmes asked if all the other roads in the proposed project currently have curbs and gutters. Civil Engineer Giga stated Amble Road was the only road that did not currently have curb and gutter in the project area. Councilmember Holmes stated in reviewing the three options presented for assessing the multi- � family/townhome property, Option 1 presented a problem. If all the property in a project area were muiti-family homes and the City only collects 60% of the full assessment amount then the City wouid not be collecting enough to cover the full residential amount. The City's assessment policy does not cover how to assess muIti-family property and the City should be careful not to set ARDEN HILLS CITY COUNCIL — October 25, 20I0 6 7. The � � Y Y assessment is based on the increased value to the property and Option 2 does the best in assessing the value increase fairly. Option 3 gives the same value of the improvements to a multi-family property and this is not necessarily the case. A single-family home will benefit more for the improvements. She stated she would support Option 2. Conncilmember Grant stated he would agree with Option 2. CounciImember McClung stated he also agrees that Option 2 is the most equitable way to proceed and most closeiy follows the City's assessment poiicy. Councilmember Holden pointed out that following the City's assessment policy would mean that Option 3 is the most effective way to proceed. The assessment policy states everyone pays for their share of the improvements and Option 3 divides these improvements equally among all the properties receiving the benefits. Councilmember Holmes stated the assessment policy references single-family homes only. A multi-family property woutd not receive the same value increase from the improvements that a single-family property would. Councilmember Holden stated a multi-family dwelling would have an increased amount of � traffic in an area and this would increase the wear and tear on a road versus an area that only had single-family hornes. Mayor Harpstead stated the Council would need to come to a consensus for this project and revisit the City's assessment policy at a future time to establish a policy for multi-family dwellings. It was the consensus of the Council to follow Option 2 for the assessment of the multi- family/townhome (R3) properties in the project area. Public Works Director Maurer stated the final report would follow Option 2 for the assessment of the multi-family properties. ResoIution 2010-052 Disapproving Municipal Consent for I-694/TH51 Mn/DOT Improvement Public Works Director Terry Maurer stated Mn/DOT is proposing an improvement project for the interchange of I-694CTH 51 in Arden Hills. In June, Mn/DOT submitted a Mn/DOT approved layout to the City and requested City approval (Municipal Consent) of the layout. On August 9, 2010, the City Council held the public hearing for this project. Following the August 9 public hearing, Staff met with Mn/DOT and Ramsey County to review comments heard from the City Council and residents of Arden Hills. Staff requested additional information from Mn/DOT based on the comments made at the public hearing as well. At the September 20, 2010 work session the City Council asked Staff to prepare some possible conditions for a Municipal Consent resolution. At the October 18, 2010 work session the conditions were reviewed and some minor changes were requested by the City Council. All of the changes made to the conditions by the City Council have been made with the exception on Condition #8. This condition has not been changed because there currently does not appear to be 13 feet of area outside of the road on each side for a detached trail so the condition has been left to request an appropriate area for a ten foot trail on the west side. Following the pubiic hearing hetd on August 9, 2010, the City has 90 days or until November 7, 2010, to approve/disapprove the layout. � MOTION: Councilmember Holden moved and Councilmem6er McClun� seconded a motion to Approve Resolution 2010-052 Disapproving the Final Lavout of I- 694lTH51 with the Conditions presented. Councilmember Holden stated in Exhibit A, Item 2, the word "possible" should be removed. She asked wha determined the beginning and ending points of the noise walis. Public Works Director Maurer stated the construction of the noise wails would be dependant on the City committing to a portion of the funding for these wails. If the City does not commit to the funding then the noise watls would not be installed. The beginning and ending points have been established based on the amount of funding requested but these points are not shown on the proposed layout. If the City commits to funding these walls then the word possible can be removed. A separate resolution approving the funding can be done if the City chooses. Mr. Mark Lindeberg, Project Manager for Mn/DOT, stated the beginning and ending points for the wall had been established and the location had been part of previous exhibits. MOTION: Mavor Harpstead moved and Councilmember McClung seconded a motion to eliminate the word "possible" from the first sentence in Item 2 in Exhibit A. The motion carried unanimously (5-0). � Councilmember Holden asked for clarification regarding the additional fill referenced in Item 3, Exhibit A. ARDEN HILLS CITY COLTNCIL — October 25, 2010 8 � 8. A. Resolution 2010-052 Disapproving Municipal Consent for I-694/T�I51 Mn1DOT Improvement (continued) � Public Works Director Maurer stated this item outlined the City's request that any fill generated by the project be used to construct berms within the project area and "additional fll" is referencing any excess fill. The City is requesting this excess fill be used for berming west of the project area. Councilmember Grant stated the Council had talked about having a tra.il on both sides of Snelling Avenue. He asked why this request was not reflected in Item 8, Exhibit A. Public Works Director Maurer stated Staff had been out to the area and there does not appear to be enough width to accommodate this request. There is adequate width to provide for a trail on the west side. The proposed trail widths could be changed to reflect the smaller area but Staff had understood that the width of the bridge was expected to remain the same. Councilmember Holmes stated Item 4, Exhibit A, should also reference the traffic flows and modeling should take the railroad crossing into account. This crossing does cause delays in traffic because of trains coming through the area during high traffic times. MOTION: Mavor Harpstead moved and Councilmember Grant seconded a motion to amend Item 4, Exhibit A, the phrase "including the railroad crossin� on Lexington Avenue" be added at the end of the first sentence. The motion . carried unanimously (5-0). Councilmember Holmes clarified there would be a signal on County road F and Snelling Avenue and there would be no cost to the City for this signal. Public Works Director Maurer stated this was correct. The document references this signal as proposed at this time because it has not been constructed yet. Councilmember Holmes stated the proposed project impacts two major corporations in Arden Hills, Boston Scientific and Land O'Lakes. She asked if a condition could be added that these corporations be included in the negotiations. Public Works Director Maurer stated Staff has sent the proposed draft language to the cities of Shoreview and New Brighton. He stated this could also be sent to Boston Scientific and Land O'Lakes for comment. At this time Staff has not heard from either corporation. CounciImember Grant requested Mounds View also be included in receiving a copy af the resolution. Councilmember Holden stated in the past Mn/DOT has achieved significant cost savings by lessening project improvements through Arden Hills and this "cheapening" has been on the backs of Arden Hills residents. � ARDEN HILLS CIT'Y COUNCIL — October 25, 2010 9 8. A. Resolution 2010-D52 Disapproving Municipal Consent for I-694/THSI Mn/DOT � Improvement (continued) Councilmember Grant asked if language should be added to Item 8, Exhibit A, to indicate the City does not want the bridge to be narrowed. Public Works Director Maurer stated this language could be added. Councilmember Grant stated at this time it was not necessary to add any language. The amended motion was called to a vote. The motion carried unanimously (5-0). 9. COUNCIL COMMENTS AND REQUESTS Councilmember Holmes thanked Mark Lindeberg and Wayne Norris from Mn/DOT for attending the meeting and working with the City. Councilmember Holmes stated she has received an e-mail from a resident concerning problem that occurred with his address. She stated the City and County need to address the prohlem that there are addresses in the City that are not on maps, or are known by more than one name, or are . not known by those individuals that are responsibie for dispatching emergency services. She also stated the speed limit in the area of Lake Valentine Road and Old Highway 10 needs to be assessed. The speed limit is 45 mph and this is too fast for pedestrians and children in this area City Administrator Klaers stated this can be brought to the Council at a future work session and he will also be meeting with the Fire Chief on this topic. Also, the contracted cities (Sheriffls Department) group will be meeting later in the week and can discuss this issue at that time. Counciimember Grant asked for an update on the construction progress on the trail on Lexington Avenue and the CP Rail Bridge. Pubiic Works Director Maurer stated the concrete has been poured on the trail on Lexington Avenue. This project is expected to be completed earIy next week. The contract will remain open untii next year so the City can assess the vegetation that will be planted. The CP Rail project will be completed by mid-November. The contractor has had an issue with the anchors and needs to install more than what was originally planned. The trait should be ready to pave in about a week to ten days. Councilmember Grant stated the Council had requested a study be done on SneIling Avenue North, south of Lindy's. He asked if this study had been completed and if it included the Rice Creek Water shed. � ARDEN HII,LS CITY COUNCIL — October 25, 2010 10 9. Council Comments and Requests (continued) PubIic Works Director Maurer stated this would be brought to the Councii at a December work session. Rice Creek Watershed Bridge is included as well as a matrix of improvements that could be done to the road and trails. The study will also include the agencies that would need to be involved and other studies that may need to be done. Counciimember Grant stated he had received an e-mail from a resident about the bituminous surface separating and coming off in layers on Tiller and Cannon. He asked that Staff look into this area. He aiso stated there was also concern about the Highway 96 Trail on the south side, by Royal Hills, not being packed enough. He stated he had looked at this and it appears this azea did not get a seal coat. He asked that Staff also look into this area. Public Works Director Maurer stated he would look into these areas. Councilmember Hoiden stated the Council had not seen any water quality surveys for a whiie. She asked that these be brought to the Council. She also requested a financial report on Celebrate Arden Hills. City Administrator Klaers stated he would get this information for the Council. Councilmember McClung stated he would not be at the November I 8 meeting. ADJOURN MOTION: Councilmember Halden moved and Mavor Harpstead seconded a motion to adiourn.
