Approved: January 22, 2018 CITY OF ARDEN HILLS, MINNESOTA REGULAR CITY COUNCIL MEETING JANUARY 8, 2018 7:00 P.M. - ARDEN HILLS CITY COUNCIL CHAMBERS CALL TO ORDER/ROLL CALL Pursuant to due call and notice thereof, Mayor David Grant called to order the regular City Council meeting at 7:00 p.m. Present: Mayor David Grant, Councilmembers Brenda Holden, Dave McClung and Steve Scott Absent: Councilmember Fran Holmes (excused) Also present: City Administrator Dave Perrault; Public Works Director/City Engineer Sue Polka; and City Clerk Julie Hanson PLEDGE OF ALLEGIANCE 1. APPROVAL OF AGENDA Councilmember Holden requested item 5K be pulled from the Consent Calendar to be discussed as Item 6A. Mayor Grant requested Item 9A under Unfinished Business be placed on the Consent Calendar. MOTION: Councilmember Holden moved and Councilmember McClung seconded a motion to approve the meeting agenda as amended. The motion carried unanimously (4-0). 2. PUBLIC INQUIRIES/INFORMATIONAL Gregg Larson, 3377 Snelling Avenue North, congratulated new City Administrator Perrault on his new position with the City. He stated he was pleased to see this position had been filled internally. He explained he appreciated the strong financial background City Administrator Perrault had and believed this would greatly benefit the community. He questioned why the City has a contract with Mr. Joynes in an amount not to exceed $20,000. He encouraged the Council to terminate this contract and suggested these funds be used to rebuild Old Snelling Avenue, or for some other City project. ARDEN HILLS CITY COUNCIL – JANUARY 8, 2018 2 Mayor Grant explained Mr. Joynes would be helping the City with several projects that have yet to be completed, which was the reason a limited task specific contract was offered. 3. STAFF COMMENTS A. Rice Creek Commons (TCAAP) and Joint Development Authority (JDA) Update City Administrator Perrault provided an update on TCAAP stating the JDA has not meet since December 11. He noted the City was awaiting the results of the optimization study, which would be completed during the first quarter of 2018. He noted the deadline for the MDA between the County and Alatus was March 8, 2018. Mayor Grant commented about the County Road I/County Road H roundabout ribbon cutting ceremony held on site on December 18, 2017. 4. APPROVAL OF MINUTES A. Motion to Close Contract Negotiations Relating to Union No. 49 Labor Agreement MOTION: Councilmember Holden moved and Councilmember McClung seconded a motion to approve the Consent Calendar as amended and to authorize execution of all necessary documents contained therein. The motion carried unanimously (4-0). 6. PULLED CONSENT ITEMS A. Motion to Approve Development Proposal – Design and Construction Services – WSB and Associates (Johanna Marsh Park) Public Works Director/City Engineer Polka stated the 2018 Capital Improvement Plan includes $100,000 for resurfacing the tennis court at Johanna Marsh Park. A geotechnical investigation was completed in August 2016 and it was determined that the court needed to be reconstructed and due to the underlying soils, reconstruction was cost prohibitive. Staff held a neighborhood meeting with the Johanna Marsh residents and presented two playground layouts as well as receiving input on park amenities. The playground concepts were generally well received. On October 23, 2017, the City Council accepted a grant in the amount of $31,786 and authorized the purchase of playground equipment for the park. To date, the equipment has been ordered. Public Works Director/City Engineer Polka reported WSB has previously prepared three concept sketches for the park based on residents’ comments. Preliminary estimates were completed and the concept that is within a $125,000 budget was discussed. It is staff’s recommendation to approve the scope and fee with WSB. A Council work session is currently scheduled in March to discuss the park design. It would be beneficial to have WSB present at the work session to provide information on the concepts that have been considered to date. Councilmember Holden questioned why Ms. Polka could not complete the park design work for the City. Public Works Director/City Engineer Polka explained this project was a bit more complicated due to the wetlands and flood plain boundaries. She indicated she would also need assistance with the overlook area. Councilmember Holden commented the neighbors were very interested in this park having an overlook area. She questioned what the cost for this amenity would be. Public Works Director/City Engineer Polka estimated the cost to be $20,000 to $25,000. ARDEN HILLS CITY COUNCIL – JANUARY 8, 2018 4 Councilmember Holden supported the City spending an additional $25,000 for this amenity for this neighborhood park and recommended the plans for Johanna Marsh Park be amended as such. Mayor Grant supported the observation area going forward as an option for the park and recommended the overlook not exceed $25,000. Councilmember Holden stated another option would be to eliminate the park shelter in order to construct an observation area as this was being requested by the neighbors. Mayor Grant anticipated the residents would want benches in the center of the park for parents watching their children on the playground. Councilmember McClung stated what was being proposed was okay, but he did not want to have the hands of the Council tied to any specific plan. He wanted to wait and see what additional feedback would be received. Councilmember Scott indicated he supported the option of an observation overlook area. MOTION: Councilmember Holden moved and Mayor Grant seconded a motion to Approve the scope and fee with WSB in the not-to-exceed amount of $33,000 for the design and construction services for Johanna Marsh Park. Councilmember McClung asked what would happen in March if the neighborhood did not support the proposed observation overlook area. Public Works Director/City Engineer Polka reported she would work with the neighborhood groups between now and March to gain feedback on the overlook area. Councilmember Holden commented that this was not a negotiation process with the neighborhood. She explained that the City took feedback from the neighbors and would now be designing a City park based on this feedback, but in the end, this was a City park that had to be paid for and maintained by the City. Councilmember Scott encouraged City staff to incorporate both the playground and the overlook into the park in order to meet the needs of both groups. Councilmember Holden requested further information on why the City was spending money on design services with WSB. Public Works Director/City Engineer Polka explained WSB would be completing a survey for the wetlands, would have to comply with all ADA requirements to ensure the playground was accessible, in addition the soil conditions would be addressed. The motion carried 3-1 (McClung opposed). 7. PUBLIC HEARINGS ARDEN HILLS CITY COUNCIL – JANUARY 8, 2018 5 None. 8. NEW BUSINESS None. 9. UNFINISHED BUSINESS A. Option to Close Contract Negotiations Relating to Union No. 49 Labor Agreement This item was approved on the Consent Calendar. 10. COUNCIL COMMENTS Councilmember Scott stated he attended the Bethel Trail Neighborhood Meeting in December. He reported there was a good turnout at this meeting. Councilmember Scott noted he attended the Breakfast with Santa held in December sponsored by the City. Councilmember Scott congratulated City Administrator Perrault on his new position. Councilmember Holden requested the information from the Sheriff’s Department within the Administrative Report include only Arden Hills. Councilmember Holden asked when the Council would be reviewing the utility rate study. City Administrator Perrault stated this would be addressed by the Council at their Tuesday, January 16 work session. Councilmember Holden requested staff provide the Council with an update on upcoming agenda and work session items. Mayor Grant congratulated City Administrator Perrault on his new position and Director Polka on becoming an Arden Hills employee. Background Per the signed employment agreement between the City Administrator and the City of Arden Hills, the City Administrator is choosing to opt out of the Public Employee Retirement Association (PERA) Pension Plan and instead receive the Employer and Employee contributions into an ICMA deferred compensation account. This is allowed under State statute, but requires formal approval by the City Council. This has no budget impact on the City as the rates (7.50% for Employer and 6.50% for Employee, future rates may change as State statutes change) are identical to the PERA contributions. Authorize a proposal from West Shore Services, Inc. in the amount of $4,600.00 to remove equipment from the two existing siren locations that will no longer be in use. Background This information was presented to the City Council at the work session held on August 21, 2017. The outdoor warning sirens in Arden Hills are activated using a system that is now over 30 years old. The equipment used to send the activation signal (the encoder) is located in the Emergency Communications Center (ECC) and is owned by Ramsey County. The equipment at each of the four siren sites in Arden Hills that is used to receive the activation signal is owned by the City. The encoder in the ECC could fail at any time and the only reliable source for parts is a backup controller. To minimalize the risk of failure, Ramsey County has established a target date of April 30, 2018 to decommission the old system. Discussion In order for the City to upgrade to new equipment that will communicate with the County system, funding was identified in the CIP for replacement of just the radio system (Attachment A) in the amount of $28,000. As shown on Attachment B – Existing Siren Locations, the current sirens do not cover the entire City. Ramsey County hired Federal Signal to prepare a sound propagation model, which shows that by upgrading the system, City coverage could be attained by installing two upgraded signals (Attachment C) located at 4250 Old Highway 10 and Arden Place/Snelling Place. Not only would this improve coverage, but the City could upgrade the existing AC only system with no battery backup to an AC/DC system that would provide battery backup in the event of a power outage. (“WSS”) and Buyer for the sale of the products and services described in WSS’s quotation and any subsequent purchase order shall consist of the terms herein. This Agreement constitutes the entire agreement between WSS and Buyer regarding such sale and supersedes all prior oral or written representations and agreements. This Agreement may only be modified by a written amendment signed by authorized representatives of WSS and Buyer and attached hereto except that stenographic and clerical errors are subject to correction by WSS or upon WSS’s written consent. WSS objects to and shall not be bound by any additional or different terms, whether printed or otherwise, in Buyer’s purchase order or in any other communication from Buyer to WSS unless specifically agreed to by WSS in writing. Prior courses of dealing between the parties or trade usage, to the extent they add to, detract from, supplant, or explain this Agreement, shall not be binding on WSS. This Agreement shall be for the benefit of WSS and Buyer only and not for the benefit of any other person. Termination. This Agreement may be terminated only upon WSS’s written consent. IF WSS shall declare or consent to a termination of the Agreement, in whole or in part, Buyer, in the absence of a contrary written agreement signed by WSS, shall pay termination charges based upon expenses and costs incurred in the assembly of its products on in the performance of the services to the date such termination is accepted by WSS including, but not limited to, expenses of disposing of materials on hand or on order from suppliers and the losses resulting from such disposition, plus a reasonable profit. In addition, any products substantially completed or services performed on or prior to any termination of this Agreement shall be accepted and paid for in full by Buyer. In the event of a material breach of this Agreement by Buyer, the insolvency of Buyer, or the initiation of any solvency or bankruptcy proceedings by or against Buyer, WSS shall have the right to immediately terminate this Agreement, and Buyer shall be liable for termination charges as set forth herein. Price/Shipping/Payment. Depending on product purchased, prices are F.O.B. UNIVERSITY PARK, IL and/or ALLENDALE, MI. Buyer shall be responsible for all shipping charges. If this Agreement is for more than one unit of product, the products may be shipped in a single lot or in several lots are the discretion of WSS, and Buyer shall pay for each such shipment separately. WSS may require full or partial payment or payment guarantee in advance of shipment whenever, in its opinion, the financial condition of Buyer so warrants. WSS will invoice for product upon shipment to Buyer and for services monthly as completed. Amounts invoiced by WSS are due 30 days from date of invoice, except that payment terms for turn-key sales of products and services are 10% of total contract mobilization fee due with Buyer’s order. Invoice deductions will not be honored unless covered by a credit memorandum. Minimum billing per order is $75.00. Risk of Loss. The risk of loss of the products or any part thereof shall pass to the Buyer upon delivery thereof by WSS to the carrier. Buyer shall have sole responsibility for processing and collection of any claim of loss against the carrier. Hold Harmless. Buyer, shall hold WSS harmless from and shall indemnify WSS against any claim, liability, loss or damage, including the attendant costs of litigation, arising out of or directly related to any contract entered into with a customer of the Buyer or potential customer, provided expressly that the claim, liability, loss or damage is caused by or directly related to: (i) the use of the Products; (ii) the Services provided by the Buyer; (iii) any act or omission of the Buyer related to any claim of infringement of any intellectual property rights of third parties; and (iv) for any violation by the Buyer of any laws or applicable regulations governing the use or sale of the Products or Services of the Buyer, which is brought against WSS relating to the activities of WSS contemplated by this Agreement. This provision shall apply ONLY if Buyer is notified of such matter described herein by the WSS within five (5) business days of WSS’s notice of such matter, regardless of form of notice or knowledge. Buyer reserves all rights to directly defend itself in any such proceedings, and shall have the absolute right to direct the defense of WSS with respect thereto. WSS shall hold the Buyer harmless and shall save, defend and indemnify the Buyer against any and all claims, demands, liabilities, suits and other proceedings, including any resulting costs of defense and damages, which arise out of or occur as a result from the conduct of WSS, including, but not limited to, misrepresentations regarding the Products or Services provided by WSS, breach of contract, breach of his duties hereunder and engaging in misleading or deceptive sales practices. WSS shall have the absolute right to direct and control its defense of any such matter arising as a result of the same. Taxes. Price quotes by WSS do not include taxes. Buyer shall pay WSS, in addition to the price of the products of services, any applicable tax (however designated) imposed upon the sale, production, delivery or use of the products or services to the extent required or not forbidden by law to be collected by WSS from Buyer, whether or not so collected at the time of the sale, unless valid exemption certificates acceptable to the taxing authorities are furnished to WSS before the date of the invoice. Delivery. Although WSS shall in good faith endeavor to meet estimated delivery dates, delivery dates are not guaranteed but are estimated on the basis of immediate receipt by WSS of all information required from Buyer and the absence of delays, direct or indirect, as set forth in paragraph 29 herein. Returns. Buyer may return shipped product to WSS only upon WSS’s prior written consent (such consent to be in the sole discretion of WSS) and upon terms specified by WSS, including prevailing restocking and handling charges. Buyer assumers all risk of loss for such returned product until actual receipt thereof by WSS. Agents of WSS are not authorized to accept returned product or to grant allowances or adjustments with respect to Buyer’s account. Inspection. Buyer shall inspect the product immediately upon receipt. All claims for any alleged defect in WSS’s product or deficiency in the performance of its services under this Agreement, capable of discovery upon reasonable inspection, must be fully set forth in writing and received by WSS within 30 days of Buyer’s receipt of the product or WSS’s performance of the services. Failure to make any such claim within said 30 day period shall constitute a waiver of such claim and an irrevocable acceptance of the product and services by Buyer. Limited Warranty. WSS warrants each new product to be free from defects in material and workmanship, under normal use and service, for a period of two years from the delivery to Buyer (one-year for informers and all software products, five years of 2001 & ECLIPSE Series siren head). During this warranty WSS will provide warranty service for any unit which is delivered, shipping prepaid by the Buyer, to a designated warranty service center for examination and such examination reveals a defect in material and/or workmanship. WSS will then, at its option, repair or replace the product or any defective part(s), or remit the purchase price of the product to Buyer. This warranty does not cover travel expenses, the cost of specialized equipment for gaining access to the product, or labor charges for removal and re-installation of the product for warranty service at any location other WSS’s designated warranty service center. This warranty shall not apply to components or accessories that have a separate warranty by the original manufacturer, such as, but not limited to, radios and batteries, and does not extend to any unit which has been subjected to abuse, misuse, improper installation or which has been inadequately maintained, not to units with problems due to service or modification by other than a WSS warranty service center. WSS will provide on-site warranty service during the first 60 days after the completion of the installation when WSS has provided a turn-key installation including optimization and/or commissioning services. THERE ARE NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. West Shore Services – Sales Agreement Terms and Conditions 2014 Page 2 of 2 Remedies and Limitations of Liability. Buyer’s sole remedy for breach of warranty shall be as set forth above. IN NO EVENT SHALL WSS BE LIABLE FOR ANY LOSS OF USE OF ANY PRODUCT, LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, NOR SHALL WSS’S LIABILITY FOR ANY OTHER DAMAGES WHATSOEVER ARISING OUT OR OF CONNECTED WITH THIS AGREEMENT OF THE MANUFACTURE, SALE, DELIVERY OR USE OF THE PRODUCTS OR SERVICES EXCEED THE PURCHASE PRICE OF THE PRODUCTS OR SERVICES. Patents. WSS shall hold Buyer harmless, to the extent herein provided, against any valid claim by any third person or infringement of any United States Patent by product manufactured by WSS, but if Buyer furnished product of system design specifications to WSS, Buyer shall hold WSS harmless against any infringement claim consisting of the use of product manufactured by WSS in accordance with Buyer’s products or system design or in combination with product manufactured by Buyer or others. In the event that any product manufactured by WSS is held to infringe any patent and its use is enjoined by any competent court of law, WSS, if unable within a reasonable time to secure for Buyer the right to continue using such product, either by suspension of the injunction, by securing for Buyer a license, or otherwise, shall, at its own expense, either replace such product with non- infringing product, either by suspension of the injunction, by securing for Buyer, a license or otherwise, shall, at its own expense, either replace such product with non-infringing product or modify such product so that it becomes non-infringing, or accept the return of the enjoined product and refund the purchase price paid by Buyer less alliance for any period of actual use thereof. WSS makes no warranty that its product will be delivered free of a valid claim by a third person of infringement of the like and Buyer’s remedies for such a claim will be limited to those provided in this paragraph. Assignment and Delegation. Buyer shall not assign any right or interest in this Agreement, nor delegate the performance of any obligation, without WSS’s prior written consent. Any attempted assignment or delegation shall be void and ineffective for all purposes unless made in conformity with this paragraph. Severability. If any term, clause or provision contained in this Agreement is declared or held invalid by a court of competent jurisdiction, such declaration or holding shall not affect the validity of any other term, clause or provision herein contained. Installation. Installation shall be by Buyer unless otherwise specifically agreed to in writing by WSS. Governing Law and Limitations. This Agreement shall be governed by the laws of the State of Michigan. Venue for any proceeding initiated as the result of any dispute between the parties that arises under this Agreement shall be either the state of federal courts in Kent or Ottawa County, Michigan. Whenever a term defined by the Uniform Commercial Code as adopted in Michigan is used in this Agreement, the definition contained in said Uniform Commercial Code is to control. Any action for breach of this Agreement or any covenant or warranty contained herein must be commenced within one year after the cause of action had accrued. Receiving Product and Staging Location. Buyer is responsible to receive, store and protect all products intended for installation purposes, including, but not exclusively, siren equipment, poles, batteries, and installation materials. Materials received in cardboard containers must be protected from all forms of precipitation. Additionally, Buyer is to provide a staging area of an appropriate size for installation to work from and to store equipment overnight. Installation Methods & Materials. Installation is based on methods and specifications designed and intended by WSS to meet or exceed all national, state, and local safety and installation codes and regulations. Design changes required by Buyer may result in additional charges. Radio Frequency Interference. WSS is not responsible for RF transmission and reception affected by system interference beyond its control. Installation Site Approval. Buyer must provide signed documentation to WSS such as the “WARNING SITE SURVEY” or a document with the equivalent information, that WSS is authorized to commence installation at the site designated by Buyer before WSS will commence installation. Once installation has started at an approved site, Buyer is responsible for all additional costs incurred by WSS for redeployment of resources if the work is stopped by Buyer of its agents, property owners, or as the result of any governmental authority or court order, or if it is determined that installation is not possible at the intended location, or the site is changed for any reason by the Buyer. AC Power Hookup. Buyer is responsible to coordinate and pay for all costs to bring proper AC power to the electrical service disconnect installed adjacent to the controller cabinet, unless these services are quoted by WSS. All indoor installations assume AC power is available with 10 feet of the installation location. Permits & Easements. Unless specifically quoted, buyer is responsible for obtaining all required easements and/or permits, along with any fees required for installation. Soil Conditions Clause. In the event of poor site conditions including but not limited to rock, cave-ins, high water levels, or inability of soil to provide stable installation to meet manufacturers specifications, WSS will direct installation crews to attempt pole installation for a maximum of two (2) hours. Buyer approval will be sought when pole installation exceeds two (2) hours and WSS cannot obtain approval in a timely manner to proceed with extra work. Contaminated Sites. WSS is not responsible for cleanup and restoration of any installation sites or installer equipment where contaminated soil is encountered. WSS will not knowingly approve installation at any site containing contaminates. Buyer must inform WSS when known or suspected soil contaminates exist at any intended installation site. Site Cleanup. Basic installation site cleanup include installation debris removal, general site cleanup, and general leveling of affected soil within 30’ of the pole. Additional Site Restoration quotes are available. Waste Disposal. Buyer is responsible for providing disposal of all packing materials including shipping skids and containers. Work Hours. All installation quotes are based on the ability to work outdoors during daylight hours and indoors from 7 AM to 7 PM Monday through Saturday. Work restrictions or limitations imposed by Buyer or its agents may result in additional charges being assessed to Buyer for services. Project Reporting. Installation & Service Progress Reports will be provided on a regular basis, normally every week during active installation, unless pre-arranged otherwise by mutual agreement. Safety Requirements & Compliance. WSS requires that all employees and subcontractors follow applicable laws and regulations pertaining to all work performed, equipment utilized and personal protective gear common to electrical and construction site work performed in the installation of WSS equipment. Additional safety compliance requirements by Buyer, such as, but not limited to, additional training or testing, may result in additional charges assessed to Buyer for the time and expenses required to comply with the additional requirements. Project Delays. WSS shall not be liable in any regard for delivery or installation delays or any failure to perform its obligations under this Agreement resulting directly or indirectly from change order processing, acts or failure to act by Buyer, unresponsive inspectors, utility companies and any other causes beyond the direct control of WSS, including acts of God, weather, local disasters of any type, civil or military authority, fires, war, riot, delays in transportation, lack of or inability to obtain raw materials, components, labor, fuel or supplies, or other circumstances beyond WSS’s reasonable control, whether similar or dissimilar to the foregoing. Background/Discussion A portion of the funding source for the Old Snelling Trail and County Road E2 Trail Improvement is Municipal State Aid (MSA) funds. Since the proposed street section with added curb and gutter is not wide enough to support on street parking on the west side of Old Snelling Avenue and the south side of County Road E2, MnDOT requires a resolution from the City banning parking in order to utilize MSA funding. Attached are Resolutions 2018-007 and 2018- 008, prepared in the format that MnDOT suggests, stating the City will ban on street parking on these roadway segments. Staff would recommend adoption of the resolutions. The shed is setback approximately 42 feet from the front property line along Edgewater Avenue and 55 feet from the secondary front property line on Ridgewood Road. The shed is currently used to store a riding lawnmower, snow blower, and other yard tools. The applicant has noted that the one-stall garage does not provide adequate space to store this equipment and that the shed was placed in the front yard due to a steep slope along the eastern and southern sides of the property that presents safety concerns for using a riding lawnmower. Plan Evaluation A full evaluation of the proposal was presented to the Planning Commission on January 10, 2018. The staff report to the Planning Commission on this case is provided in Attachment F. Additional Review City Engineer and Building Official The City Engineer and City Building Official have reviewed the request and do not have any additional comments at this time. Findings of Fact The Planning Commission reviewed Planning Case 17-028 at their regular meeting on January 10, 2018. Draft minutes from the meeting are included in Attachment G. The Planning Commission offers the following findings of fact for consideration: 1. The property at 1504 Edgewater Avenue is located in the R-1 Single Family Residential Zoning District. 2. The lot is 20,473 square feet in size with approximate dimensions of 102 feet in width by 200 feet in depth. 3. The property currently consists of a single family dwelling with an attached garage and two accessory structures. 4. The property owner recently installed a new accessory storage shed in the front yard of the property measuring 64 square feet in size with dimensions of 8 feet by 8 feet. Section 1325.01, Subd. 3 of the Zoning Code states that accessory structures shall not be located nearer the front lot line than the front yard setback line for the principal structure to which it is accessory. 7. Section 1325.01, Subd. 7 of the Zoning Code allows the City Council to approve a deviation from the accessory structure location requirement when exceptional and unusual circumstances exist on the property through the Site Plan Review process. 8. The existing conditions on the property meet the minimum lot coverage requirements for properties located in the R-1 Zoning District. 9. The accessory storage shed does not exceed the height limit of 15 feet for accessory structures. 10. Detached accessory structures up to 728 square feet are permitted structures in the R-1 Zoning District. 11. Properties used primarily for residential uses are permitted up to two accessory structures. There is one additional shed located on the property for a total of two accessory structures. 12. The accessory storage shed is located outside of the 100-year flood plain, wetlands, and easements. 13. The lot provides adequate space and reasonable slopes and features to allow the accessory storage shed to be located in the rear yard of the property to comply with the Zoning Code location requirements. 14. The existing conditions of the property are not exceptional or unique and do not justify a deviation in the Zoning Code location requirements for accessory structures. Recommendation The Planning Commission discussed the request and determined that there was adequate space and reasonable slopes to place the shed in the rear yard of the property and to comply with the Zoning Code location and setback requirements for accessory structures. The Planning Commission voted to recommend denial (5-0) of Planning Case 17-028 for a Site Plan Review at 1504 Edgewater Avenue, based on the findings of fact in the January 22, 2018, Report to the City Council. Notice and Public Comments Notice of the application was prepared by the City and mailed to property owners within 1,000 feet of the subject property. Staff has received comments from the property owners at 3201 Ridgewood Road and 1505, 1535, 1557, and 1575 Edgewater Avenue expressing their opposition to the request. Copies of the correspondences can be found in Attachment E. Two residents spoke at the Planning Commission meeting on January 10, 2018 regarding this planning case. One resident commented that the shed could not be placed in the rear yard of the lot as it was heavily wooded and that the property was unique with a large front yard. The other resident indicated that they were concerned with the aesthetic impact of the shed on the neighborhood and that approving the request would set a precedent. Draft minutes from the meeting are included in Attachment G. Deadline for Agency Actions The City of Arden Hills received the completed application for this request on November 6, 2017. Pursuant to Minnesota State Statute, the City was required to act on this request by January 5, 2018 (60 days), unless the City provided the petitioner with written reasons for an additional 60 day review period. The applicant was notified on December 13, 2017 of the City’s request for an additional 60-day review period. Pursuant to Minnesota State Statute, the City must now act on this request by March 6, 2018. The City may, with the consent of the applicant, extend the review period beyond the initial 120 days. Discussion The Zoning Code states that deviations from the location requirements for accessory structures may be permitted after Planning Commission review and City Council approval of a site plan with documentation showing the exceptional and unusual circumstances justifying the proposed deviation. In evaluating this request, the Planning Commission should consider whether there are circumstances that are exceptional and unique to the property at 1504 Edgewater Avenue that justify the proposed deviation. The principal structure is situated close to the southwest corner at the high point of the property, which has an elevation of approximately 904 feet. The property slopes away from the dwelling to approximately between 886 and 888 feet along Ridgewood Road and Edgewater Avenue. Based on the topographical data, the steepest areas of the property appear to be along the eastern side of the property adjacent to the dwelling and in the southeast corner. The topography of the property limits the locations where an accessory structure could be located behind the front façades of the dwelling and on flat ground. The property owner notes in their application that it would be potentially dangerous to place the shed in the rear yard because the steep slope makes it difficult to back a lawnmower in and out of the shed. Location of Principal Structure Since the property is a corner lot, accessory structures must be located behind the front façades of the home along Edgewater Avenue and Ridgewood Road. The dwelling is setback approximately 105 feet from the Edgewater Avenue property line and approximately 30 feet from the Ridgewood Road property line. The remaining rear yard area where an accessory structure could be placed and meet side and rear setback requirements is approximately 30 feet by 55 feet in size. Neighborhood Appearance One of the main reasons the Zoning Code prohibits the placement of accessory structures between residential dwellings and a public street is to maintain a neighborhood characteristic of open front yard areas free of structures. The storage shed in the front yard is visible from adjacent properties and vehicles driving on Edgewater Avenue and Ridgewood Road. Staff has received emails from two residents in the neighborhood expressing their concerns about the visual impacts of the shed in its current location (Attachment E). Proposed Motion Language The findings of fact provided do not directly support a recommendation for approval or denial. The Planning Commission will need to provide additional findings that support the reason for recommending approval or denial of this case. Staff would note that the Planning Commission may choose to place conditions on a recommendation to approve as well. 1. Planning Case 17-028; Site Plan Review – 1504 Edgewater Avenue – No Public Hearing Required City Planner Bachler stated the applicant has requested a Site Plan Review in order to keep an existing 8-foot by 8-foot, or 64 square foot, accessory storage shed recently installed at 1504 Edgewater Avenue. The City does not require property owners to obtain a permit for accessory structures less than 120 square feet in size and no permit was issued for the shed. The shed is located in front of the single-family dwelling on the property between Edgewater Avenue and the home. The shed is setback approximately 42 feet from the front property line along Edgewater Avenue and 55 feet from the secondary front property line on Ridgewood Road. The Zoning Code prohibits the placement of accessory structures on non-lakeshore lots between a public street and a dwelling. City Planner Bachler indicated the shed is currently used to store a riding lawnmower, snow blower, and other yard tools. The applicant notes that the one-stall garage does not provide adequate space to store this equipment and that the shed was placed in the front yard due to a steep slope along the eastern and southern sides of the property that presents safety concerns for using a riding lawnmower. Site Data Land Use Plan: Low Density Residential Existing Land Use: Single Family Detached Residential Zoning: R-1: Single Family Residential Current Lot Sizes: 20,473 square feet (0.47 acres) Topography: The property has a fair amount of grade change as the lot slopes from the southwest corner to the east and the north City Planner Bachler reviewed the surrounding area and the Plan Evaluation. Staff offered the following Findings of Fact for review: 1. The property at 1504 Edgewater Avenue is located in the R-1 Single Family Residential Zoning District. 2. The property currently consists of a single family dwelling with an attached garage and two accessory structures. 4. The property owner recently installed a new accessory storage shed in the front yard of the property measuring 64 square feet in size with dimensions of 8 feet by 8 feet. 5. Section 1325.01, Subd. 3 of the Zoning Code states that accessory structures shall not be located nearer the front lot line than the front yard setback line for the principal structure to which it is accessory. 6. Section 1325.01, Subd. 7 of the Zoning Code allows the City Council to approve a deviation from the accessory structure location requirement when exceptional and unusual circumstances exist on the property through the Site Plan Review process. 7. The accessory storage shed is setback approximately 42 feet from the font property line along Edgewater Avenue and approximately 55 feet from the secondary front property line along Ridgewood Road. 8. The existing conditions on the property meet the minimum lot coverage requirements for properties located in the R-1 Zoning District. 9. The accessory storage shed does not exceed the height limit of 15 feet for accessory structures. 10. Detached accessory structures up to 728 square feet are permitted structures in the R-1 Zoning District. 11. Properties used primarily for residential uses are permitted up to two accessory structures. There is one additional shed located on the property for a total of two accessory structures. 12. The accessory storage shed is located outside of the 100-year flood plain, wetlands, and easements. City Planner Bachler stated the findings of fact provided do not directly support a recommendation for approval or denial. City Planner Bachler deferred this question to the applicant. Chair Thompson stated this was not a Public Hearing, but she opened the meeting for comments from the public. ARDEN HILLS PLANNING COMMISSION – January 10, 2018 3 Senay Kindler, 1536 Edgewater Avenue, offered her support for the shed. She explained the applicant would not be able to put the shed in the rear yard of the lot as it was heavily wooded. She indicated this was a unique lot with a large front yard that could accommodate the shed. Kathryn Reyerson, 3201 Ridgewood Road, stated she sent an email to the City with her concerns. She feared a precedent would be set if this request were approved. She did not want to see a proliferation of requests coming before the City if the item were approved. She expressed concern with the aesthetics of the neighborhood and how it would be impacted by having a shed in the front yard. She recommended the Planning Commission require the applicant to follow City Code. Chair Thompson requested the applicant respond to what the shed was made out of. Carrie Martinson, 1504 Edgewater Avenue, reported the shed was made out of maintenance- free durable plastic. She explained she would be willing to plant shrubs around the shed if this assisted with addressing the aesthetics concerns. Commissioner Lambeth reported the zoning code prohibits the placement of accessory structures between the façade of a house and the public street. He stated the current shed violates City Code. He explained that four neighbors have already expressed their displeasure with the appearance and location of this shed, which meant the shed was a source of discontent. He understood that the rear yard was not an option for the shed, which left the Planning Commission with few options for this request. He stated one option would be to deny the Planning Case because it violates zoning code and was not in keeping with the character of the neighborhood. He noted another option would be to approve the Planning Case with conditions, which would require screening or landscaping. Commissioner Jones stated the shed was currently in the front yard, which was against City Code. While he could sympathize with the homeowner, he explained this was another case where the applicant was requesting approval after the fact. He indicated he could support moving the shed to the rear yard, but would not support its placement in the front yard. Commissioner Jones moved and Commissioner Bartel seconded a motion to recommend denial of Planning Case 17-028 for a Site Plan Review at 1504 Edgewater Avenue, based on the findings of fact in the January 10, 2018 Report to the Planning Commission, and the following additional findings of fact: 1. Accessory structures are not to be located between the façade of a house and the public street. 2. The property does not have unusual or unique circumstances that justify a deviation in the shed placement. Commissioner Lambeth discussed the topography and steep slope that was located on the property. He anticipated the shed could be located in the rear yard with a bobcat. The project includes widening US 10, providing a slip ramp from the US 10 service road to Highway 96, providing both right in and right out access from the service road to US 10, and construction of 20-foot high noise walls. Discussion MnDOT is requesting City approval (municipal consent) for the project under Minnesota Statutes 161.162 through 161.167 (Attachment B). As outlined in Attachment A, the City has certain responsibilities with regard to municipal consent of the project, the first of which is scheduling a public hearing. On September 11, 2017, the City Council adopted Resolution 2017- 028 ordering a public hearing to be held on October 23, 2017. The City Council held the Public Hearing after a presentation by MnDOT staff and received the following comments from the public: • Council should consider the whole corridor and how it is affected. • Traffic from Highway 10/ Highway 96 is exiting onto Snelling Avenue at high speeds. More noise abatement should be considered along Highway 96. UNFINISHED BUSINESS – 9A MEMORANDUM Page 2 of 2 MnDOT gathered additional noise readings along Lakeshore Place and Old Highway 10 in the vicinity of US 10/Highway 96. The readings did not show significant increases in volumes from the original study. Staff also submitted a letter to MnDOT with additional concerns (Attachment C) regarding the height of the noise wall, impacts to the Big Ten Tavern, service road entrance design, existing water main and snow plowing concerns. MnDOT’s response is included in Attachment D. Since the Public Hearing, MnDOT has received input from affected property owners and completed the voting for the noise wall. A majority of voting points received were in favor of construction of both of the noise walls (north of the access to the service road and south of the access onto US 10); therefore, the walls are proposed with the US 10 project. The layout has also been revised due to input from the Big 10 Tavern owner. A right turn from the service road to US 10 has been added. The noise wall has also been modified to allow for a better view of the Big 10 Tavern property. Staff has a meeting scheduled with MnDOT on January 18th to discuss the potential noise wall/watermain conflict and proposed resolution.
