Approved: May 22, 2019 CITY OF ARDEN HILLS, MINNESOTA CITY COUNCIL WORK SESSION APRIL 15, 2019 5:00 P.M. - ARDEN HILLS CITY COUNCIL CHAMBERS CALL TO ORDER/ROLL CALL Pursuant to due call and notice thereof, Mayor David Grant called to order the City Council Work Session at 5:02 p.m. Present: Mayor David Grant, Councilmembers Brenda Holden, Dave McClung and Steve Scott Absent: Councilmember Fran Holmes (excused) Also present: City Administrator Dave Perrault, Deputy Clerk Jolene Trauba, Ramsey County Sheriff Commander Tony Waldo, Undersheriff Jeff Ramacher, CTV Executive Director Dana Healy and CTV Public and Government Coordinator Jared Wiedmeyer 1. AGENDA ITEMS A. Ramsey County Sheriff’s Office Update Commander Waldo gave a brief history of his background with the Sheriff’s Department. Undersheriff Ramacher discussed the dedicated traffic deputies and the possibility of bringing retired Deputy Kevin Otto back for six months. August 1st will start the new hands-free driving law, road construction will push more traffic to the city and State Fair parking were reasons given to consider another traffic deputy. Councilmember Scott noted that State Fair parking was much better last year due to having more no parking signs. Undersheriff Ramacher said the State Fair keeps expanding into their own parking lots, forcing people to find other places to park. Councilmember Holden said she thought it was not necessary to put State Fair no parking signs every ten feet but felt that the Sheriff’s department wouldn’t enforce it unless they did. ARDEN HILLS CITY COUNCIL WORK SESSION – April 15, 2019 2 Commander Waldo replied that enforcing no parking and giving tickets is a challenge when there isn’t a clearly visible no parking sign. It has to be made especially clear because it is temporary no parking. Councilmember Holden asked about left turns to go north onto Lexington from the Red Fox Road or Dunlap, and if having another deputy would help. She felt they had no cooperation from the Sheriff’s department because they didn’t want to stop traffic on Lexington. Undersheriff Ramacher said by adding another traffic enforcement Deputy would be able to address complaints like that in a timelier manner. He noted that he had talked to MnDOT about the situation during times there was construction happening. Undersheriff Ramacher said the goal of traffic enforcement is to change behavior, not to give tickets. He felt adding another traffic deputy during peak times would help that goal. Mayor Grant mentioned distracted driving and the new law. Undersheriff Ramacher said that distracted driving has been a factor for many years and continues to get worse. The new law will help enforcement by giving latitude in writing citations, but the new law isn’t the reason why they would like to add another traffic officer during the summer. Commander Waldo added that traffic complaints in general increase in the summer. Councilmember McClung mentioned that the last couple of years there hasn’t been a problem with visibility in the City and he hopes they continue to stop to talk to residents in the neighborhoods. Mayor Grant noted that squad cars tend to take major roads but aren’t necessarily turning into individual neighborhoods. He said it’s been a long time since he’s seen a squad in his neighborhood. Commander Waldo said they can sit in a neighborhood for long periods of time and not see anyone speeding or other types of crime, so that’s why they may tend to patrol the larger roads. They will pass the request along at roll calls. Councilmember Holden stated they are having car break-ins again in the Venus/Crystal area. Councilmember McClung said there was a string of car break-ins last year but hasn’t heard anything so far this year. He asked if the Sheriff’s department would let the Council know if they notice trends. Councilmember Holden mentioned another issue is the Cummings Park Pavilion getting broken into and vandalized. Undersheriff Ramacher said they will come up with an action plan for the pavilion. ARDEN HILLS CITY COUNCIL WORK SESSION – April 15, 2019 3 Mayor Grant told the group that as they add more deputies to the contract cities at some point they will no longer be cost effective. And the more the Sheriff’s department keeps adding the more the Council will want to see visibility. Councilmember Scott thanked Undersheriff Ramacher for arranging ride-alongs. Undersheriff Ramacher said they can be a challenge because they get so many requests, but that they will always encourage elected officials to ride along. City Administrator Perrault said the contract cities will vote on adding Deputy Otto to the summer roster on the following Thursday. Councilmember Scott said he would approve the hiring, Councilmember McClung would like it addressed in the budget and Mayor Grant agreed. Councilmember Holden wanted to think about it. Undersheriff Ramacher noted the funds would be coming out of reconciliation money already allocated for public safety. B. CTV Update CTV Executive Director Healy and Public and Government Coordinator Wiedmeyer presented an overview of new opportunities and services available from CTV including installation of new equipment, production services, webcasting, neighborhood network videos, quarterly updates, new analytics capabilities and features of CTV’s new website. An audit will be done to see Arden Hills’ equipment needs and CTV will present those findings at a future work session. C. Part-time Customer Service Specialist City Administrator Perrault explained the request to change the current full time Customer Service Specialist position to a job share position. The position would be 1 FTE total, with each person working an average of 20 hours per week. Insurance benefits would not be offered, but PTO would be accrued. He mentioned the flexibility of having two staff trained for the position that can cover for each other. Councilmember Holden asked about management of the position. City Administrator Perrault responded that it would be handled like any supervisory relationship. He also mentioned that moving the position to a job share wouldn’t cost the City any more money in total, but potentially less by not paying insurance benefits. Councilmember McClung said it did not matter to him if the position was filled by one or two people. After further discussion, Council directed staff to bring the item forward to the next Council meeting. D. Council Request Tracker ARDEN HILLS CITY COUNCIL WORK SESSION – April 15, 2019 4 City Administrator Perrault and staff reviewed the Council Request Tracker with the City Council. It was requested to add a Timeline column, and Cummings Park Shelter Sheriff Patrol was added. 2. COUNCIL COMMENTS AND STAFF UPDATES Councilmember McClung stated that he had no issue with the old City Hall site being used for construction staging, but didn’t want to see equipment there over the winter. City Administrator Perrault noted that the second regular Council meeting in May might be cancelled. Public Works Director/City Engineer interviews will be scheduled for May 29. A list of questions will be sent to Council. Background/Discussion The Capital Improvement Plan (CIP) identifies the 2020 PMP for reconstruction of streets in the southwest corner of the City (Attachment B). To assist in preparation of the feasibility report, staff is proposing to obtain soil borings and pavement recommendations in advance of the design. In addition, pavements on Arden Oaks Drive and Arden Oaks Court have deteriorated more rapidly than anticipated due to subsurface water issues evidenced by continual water running in the gutterline and the lack of drain tile in the area. Geotechnical investigation will assist staff in scheduling improvements and determining the extent of improvements for this neighborhood. Lastly, staff is proposing 2 borings at each of the parking lots located at City Hall, Hazelnut Park, and Perry Park to assist in designing current and future projects at those locations. WSB has provided scope and fees for geotechnical services in the amount of $13,497. Staff recommends approval of a professional services agreement with WSB in the amount of $13,497.00. In this proposal, we present a description of our understanding of the project, an outline of the scope of work we are to provide, and a fee schedule and estimate of charges for our services. It is our understanding that this project consists of the reconstruction of: 2020 PMP Area; • Glenpaul Avenue from Cleveland Avenue N. to New Brighton Road • Edgewater Avenue from New Brighton Road west to its cul-de-sac • Jerrold Avenue from New Brighton Road west to its cul -de-sac • North Prior Avenue from Jerrold Avenue to West County Road D Arden Oaks Area; • Arden Oaks Drive from Snelling Avenue North to County Road E • Arden Oaks Court from Arden Oaks Drive to its cul-de-sac • City Hall Parking Lot • Hazelnut Park Parking Lot • Perry Park Parking Lot The 2020 PMP and the Arden Oaks area contain city streets that are existing urban and rural roadway alignments and are two lane bituminous roads. Typical reconstruction will generally consist of creating a standard City street with curb and gutter and new watermains. The three parking lots are bituminous paved and will be reconstructed. In regard to all the projects existing horizontal and vertical alignment will remain the same. A. Project Objectives Based upon our experience with similar projects the objectives of our geotechnical services are to perform subsurface borings, classify and analyze the soil samples, discuss groundwater issues, and prepare recommendations for utility installation, subgrade preparation and pavement sections. City of Arden Hills May 3, 2019 Page 2 B. Scope of Basic Services Based on our understanding of the project we proposed the following scope of services: 1. Site Access Based on a review of on-line aerial photos it appears that the roadways and parking lots can be accessed with our CME-55 truck mounted auger drill. We assume that traffic volumes on these residential streets are low and no special traffic control e.g. flagmen is necessary. We will utilize our drilling support truck, flashing lights and cones to allow traffic to self-regulate around our crew. 2. Bore Hole Locating and Gopher State One Call We will stake the proposed bore hole locations using a supplied site plan and existing site features as guides. Elevations at the bore hole locations will not be determined. However, if requested we can provide a survey crew to tie-in our as-drilled boring locations for an additional fee. Also, the city may provide a surve y crew to survey and elevate the as-drilled boring locations. Prior to sending a drill rig to the site WSB will contact Gopher State One Call (GSOC) and have them request public underground utility owners mark and clear our proposed bore hole locations of their utilities. If there are private underground utilities that are not located by GSOC, you must notify WSB immediately. WSB will take reasonable precautions to avoid underground facilities. 3. Subsurface Test Borings Based on the RFP, the City has requested 27 soil borings to a depth of 10 feet each on the existing alignments and parking lots. We propose to complete standard penetration test borings. In the standard penetration test borings, we will sample and record blow counts at 2 ½ foot intervals to the boreholes termination depth. If unsuitable soils (soft soils, organic soils, etc…) are encountered at the proposed boring termination depth(s), it will be necessary to extend the borings into more competent materials. This will allow us to better evaluate potential construction issues. An additional charge of $20 per lineal foot will be assessed for borings extended beyond their proposed termination depths. If the added work requires an additional mobilization to the site it will be charged at $500 per day. In Minnesota, a boring that is deeper than 15 feet is considered an environmental well and requires Well Sealing Notification and Sealing Records be submitted to the Minnesota Department of Health, along with a Notification fee. The borings are planned to depths of less than 15 feet, but if they are extended due to the presence of unsuitable soils at planned termination, than additional fees will be incurred. WSB will fill out the MDH notification and sealing record forms and sign on behalf of the owner u nless directed otherwise. City of Arden Hills May 3, 2019 Page 3 4. Schedule, Bore Hole Samples and Laboratory Testing Based on our current drilling backlog, we anticipate that we can mobilize our truck mounted auger drill to the site in 5 to 6 weeks following receipt of the signed authorization. However, our schedule changes frequently. It is our understanding that the City has placed the project priority in the following order: Hazelnut Park Parking Lot, Arden Oaks Street and Utility Imp., 2020 PMP Street and Utility Imp., and City Hall Parking Lot and Perry Park Parking Lot. Please contact us with your timing of boring results as we may be able to adjust the aforementioned schedule. Laboratory work and report preparation will take about 2 weeks following completion of the field work. It should be noted that this schedule may change based on timing of authorization, site conditions and other factors. Should our anticipated schedule change we will let you know. This estimate is based on work being completed during daylight business hours (7am to 5pm), Monday through Friday. Additional charges will apply to night or weekend drilling. Samples retrieved during drilling will be returned to our laboratory where they will be reviewed, classified using the Unified Soil Classification System (USCS) and logged under the direction of a geotechnical engineer. Select samples may be set aside for laboratory testing. We may perform routine laboratory tests on selected soil samples obtained from the exploration. This may include determinations of natural moisture content and gradations on select sand samples from the borings. Such tests will aid in determining soil classification and properties and potential behavior characteristics to help guide our recommendations. 5. Geotechnical Engineering Reports Information gathered for this project will be used to prepare three geotechnical reports (2020 PMP, Arden Oaks and the Parking Lots). The reports will summarize our findings and provide a discussion of subsurface soil and groundwater conditions encountered in our borings and how they may affect the proposed construction of utilities and pavements. The reports will also provide an estimated R-value, recommendations for subgrade preparation, pavement design thicknesses along with estimates of ground water depths/elevations, site grading, and a discussion of soils for use as structural fill and site fill. We will provide you and any identified members of your design/project team with a PDF copy of our geotechnical reports. If requested, we will also provide you with an original hard copy. This geotechnical proposal is presented for engineering services to determine the structural properties of the soil at the specified site. It does not cover an environmental assessment of the site, or environmental testing of the soil or groundwater. City of Arden Hills May 3, 2019 Page 4 6. Fee Our lump sum fee is provided below. Previously, this department also had an Associate Planner to assist the department. The Personnel Committee discussed the current makeup of the department, and agreed that additional support would benefit the department. One recommendation the Personnel Committee discussed is to upgrade the current City Planner position, Mike Mrosla, to a combination of a Community Development Manager/City Planner and hire an Associate Planner that would report to the Community Development Manager/City Planner. The Community Development Manager/City Planner would be responsible for the planning, economic development, recycling and other Community Development functions, but would hand day-to-day activities and minor planning cases to the Associate Planner. This would allow the Community Development Manager/City Planner to focus on larger more complex cases and economic development within the City. The City would still retain Bolton and Menk on an as-needed basis to assist, however, it is anticipated this would mostly entail guidance and mentorship to the Community Development Manager/City Planner when applicable, and would not be needed for day-to-day activities. During this time, the Building Official and Building Inspector would report to the City Page 2 of 2 Administrator. This allows the flexibility of future growth for the City Planner, and to ensure a smooth planning function for the City. On June 11, 2018, the City Council approved the first payment in the amount of $270,512.93. On June 25, 2018, the City Council approved the second payment in the amount of $582,541.66. On August 13, 2018, the City Council approved the third payment in the amount of $776,494.00, which included two change orders. On September 10, 2018, the City Council approved the fourth payment in the amount of $708,716.22. On October 8, 2018, the City Council approved the fifth payment in the amount of $755,419.24, which included one change order. On November 13, 2018, the City Council approved the sixth payment in the amount of $250,390.92. On December 10, 2018, the City Council approved the seventh payment in the amount of $111,987.75, including change order No. 4. CONSENT ITEM – 2F MEMORANDUM Page 2 of 2 During construction, additional signage was needed to direct traffic to Bethel University. WSB has provided a recommendation to approve Change Order No. 5 in the amount of $2,585.22. (Attachment A). Change Order No. 5 is included as Attachment B. At this time the project is substantially complete with miscellaneous restoration and punch-list items remaining to be completed. Five percent is being withheld from the work completed in accordance with the contract documents. The eighth payment is in the amount of $16,817.74. WSB has provided a recommendation to pay the eighth voucher (Attachment A). Staff recommends that Council approve Payment No. 8 (Attachment C). With Council consideration to approve Payment No. 8 in the amount of $16,817.74, the total work certified to-date will be $3,655,663.64. It is estimated that approximately $25,000 of contract work remains to be completed for a final estimated construction cost of $3,662,960.75. While the project change orders increased the original contract amount from $3,376,269.85 to $3,871,020.19, costs associated with the change orders have been off-set with savings in the original contract. Within the additional project costs, it is estimated that approximately $225,000.00 is associated with additional paving and sub-grade correction on Old Snelling required by Ramsey County. This application was tabled to allow staff time to work with the Applicant on relocation of athletic fields, tree impact, landscaping plan, and pedestrian crossing improvements. Staff has worked with the Applicant on these items and is bringing this planning case back for further review by the City Council. The Applicant is proposing an addition totaling 76,300 square feet, including 49,000 square feet for gymnasiums and 27,300 square feet for a total of seven classrooms. Interior remodels of the existing building include 65,000 square feet. The subject property is located at 1900 Lake Valentine Road. In addition, the Applicant is proposing to reconfigure the athletic fields located south of the principal structure. The intent of the reconfiguration is to add an additional football/lacrosse practice field. The Applicant recently acquired the former First Student school bus garage located directly north of the high school at 1901 Lake Valentine Road. The previous use of the 1901 Lake Valentine City of Arden Hills City Council Meeting for May 22, 2019 P:\Planning\Planning Cases\2018\PC 18-014 - Mounds View School District - 1900 & 1901 Lake Valentine Road\Memos Reports Page 2 of 12 Road as a bus storage facility began in the 1950’s and the current building onsite was also constructed at that time. The subject property was then annexed to the City of Arden Hills from the City of New Brighton in the 1960’s. The use has operated under a Special/Conditional Use Permit. At their October 26, 2009 meeting the City Council approved a Conditional Use Permit Amendment to state that the number of buses allowed to operate and park at this subject property is limited to 150 large buses and a maximum of 175 buses from September 1 through June 15 and a maximum of 150 buses during the remainder of the year. In addition to bus parking, the previous property owner was selling parking permits to an unknown number of students for at least the last five (5) years. The existing parking lot has nine (9) lighting fixtures and the existing building has three (3) security lights as shown on the image below. The Applicant is proposing to utilize the exiting parking lot for visitor, staff and student parking. However, due to funding restraints, the applicant is proposing to make temporary improvements to the parking lot surface, including but not limited to filling potholes, sealcoating, and restriping the parking lot for more efficient car parking. In addition, the Applicant will be installing fencing around the existing motor fuel island to restrict parking and loitering under the canopy. The Applicant recognizes that ongoing maintenance to the parking lot will be required until funding is available to reconstruct the parking lot. As a condition of approval, Site Plan Review is required for the reconstruction of the parking lot. The intent of requiring Site Plan Review is to insure the parking lot is reconstructed in conformance with City Code and Rice Creek Watershed standards. The Applicant is currently assessing the condition of the existing structure onsite and is in the process of getting bids to replace the roof, siding, and garage doors. In addition, the Applicant is getting quotes to paint the structure to complement the existing high school. Plan Evaluation A full evaluation of the proposal was presented to the City Council on May 13, 2019. The following paragraphs focus on the revised information submitted after the City Council meeting. Parking: Existing Proposed The school currently has an approximant enrollment of 1800 students and 172 staff. The Zoning Ordinance requires one (1) space for each school employee plus one space per 4 students or 622 parking stalls. According to the Zoning Ordinance standards the existing school is currently under parked by 105 spaces and with the proposed site improvements the overall parking onsite will significantly decrease. In order to meet the Zoning Ordinance parking requirements, the Applicant is requesting to utilize the parking lot at 1901 Lake Valentine Road. The Applicant is proposing to add 501 parking stalls on 1901 Lake Valentine Road, resulting in a surplus of 90 parking spaces. However, once the parking lot at 1901 Lake Valentine Road is reconstructed and is bought into conformance with City Code requirements, the current parking surplus will likely be reduced. Student parking in the north lot will be restricted to allow for construction contractor parking and staging until the project is complete. City of Arden Hills City Council Meeting for May 22, 2019 P:\Planning\Planning Cases\2018\PC 18-014 - Mounds View School District - 1900 & 1901 Lake Valentine Road\Memos Reports Page 4 of 12 Athletic Fields: At the May 8, 2019 Planning Commission meeting a resident from 1817 Gramsie Road presented a proposal to shift the proposed athletic field to the west. The proposed plan would reduce the amount of grading required and would limit tree loss. The Applicant was impressed with the proposal and reviewed it for feasibility. Upon review the Applicant was able to implement the majority of the plan. The resubmitted plans show preservation of 446 caliper inches or 23 trees. However, six (6) previously protected trees will need to be removed to allow for grading. The modification in the plan preserves 376 caliper inches. The image below compares the previous and revised plans. The revised grading plan shall be reviewed and approved by the City Engineer. A result of the relocating the athletic fields the tree replacement mitigation has been reduced by 376 caliper inches as shown in the table above. This reduces the overall amount of required mitigation from 1087 to 899 caliper inches. With the preservation of existing trees and the reduction in required tree mitigation the Applicant is now able to locate all replacement trees onsite. The Applicant is proposing to plant 241 deciduous trees or 719 caliper inches. In addition, the Applicant is proposing to plant 54 coniferous trees with a minimum height of eight (8) feet. Coniferous trees of this height will exceed 101 caliper inches needed to meet the 820 caliper inches required to be placed. The intend of the landscaping plan was to concentrate the tree planting in areas adjacent to residential properties in order to provide additional screening. The Applicant is also proposing to plant 255 shrubs and perennials adjacent to Lake Valentine Road. City of Arden Hills City Council Meeting for May 22, 2019 P:\Planning\Planning Cases\2018\PC 18-014 - Mounds View School District - 1900 & 1901 Lake Valentine Road\Memos Reports Page 6 of 12 Pedestrian Crossing Improvements: Staff and City consultants met with the Applicant on Wednesday, May 15, 2019, to discuss the pedestrian crossing and safety improvements on Lake Valentine Road. A number of options were discussed, including the positives and potential issues associated with each. It was determined more study is required to identify a long-term solution. The intent is to complete the study this summer and formalize construction plans prior to December 2019, with permanent solutions scheduled for construction in the summer of 2020. The City’s consultant, WSB, is reviewing the traffic study and will provide comments to be addressed by the School District’s engineer. Once the study is complete staff will provide an update to City Council. Findings of Fact The Planning Commission reviewed Planning Case 18-014 at their regular meeting on May 8, 2019. The Planning Commission offers the following findings of fact for consideration: 1. The property located at 1900 Lake Valentine Road is designed for Public and Institutional uses on the 2040 Land Use Plan map. 2. The property located at 1901 Lake Valentine Road is designated for Low Density Residential uses on the 2040 Land Use Plan map. 3. The properties located at 1900 and 1901 Lake Valentine Road are located in the R-1 Single Family Residential District. 4. The R-1 district is consistent with the existing and proposed Public and Institutional designation. 5. The Applicant has proposed a Master Planned Unit Development in order to include noncontiguous parcels as a single use. Other components of the proposal are classroom and gymnasium additions, reconfiguration of the bus parking lot and the staff and student parking lots, and reconfiguration of athletic fields. 6. The Applicant has submitted a Master and Final Planned Unit Development. 7. The Master PUD is generally consistent with the requirements of the City Code. 8. Where the plan is not in conformance with the City Code, flexibility has been requested by the Applicant and/or conditions have been placed on an approval that would mitigate the nonconformity. 9. Flexibility through the PUD process has been requested in the following areas: planting island coverage, tree replacement, building height, and wall signage. 10. The proposed development plan exceeds the minimum requirements of the City Code in the following areas: lot size, building coverage, landscape coverage, setbacks, street trees, perennials and shrubs, tree selection, lighting, screening, location and number of parking stalls, aesthetics and freestanding signs. 11. The Master PUD is in conformance with the draft Arden Hills 2040 Comprehensive Plan, as proposed to be amended. The properties at 1900 and 1901 Lake Valentine Road are zoned R-1, Single Family Residential. Compatible uses such as educational campuses are also intended for this zoning district. With the applied conditions, the application is not anticipated to create a negative impact on the immediate area or the community as a whole. Redlined Conditions of Approval: At their May 13, 2019 meeting the City Council directed staff to review and revise the conditions of approval. Below are the redlined original conditions of approval from the May 13, 2019 meeting. 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to the plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. Prior to the issuance of a Grading and Erosion Control permit, the Applicant shall enter into a PUD Development Agreement with the City. The Development Agreement shall outline conditions of approval, required securities and fees, and sequence of events. 3. A letter of credit equal to or 125% of the cost of the required landscaping must be submitted to the City prior to issuance of a Grading and Erosion Control permit. 4. Prior to the issuance of a Grading and Erosion Control permit, staff shall review and approve the final landscaping plan. 5. Prior to the issuance of a Grading and Erosion Control permit, the Applicant shall determine if they will be adding 562 caliper inches of additional trees on the site, off-site or provide cash in lieu of replacement. 6.4. A Site Plan Review application shall be required for the reconstruction of the parking lot on PID 21302334005. 7.5. Any use of the existing building on the on PID 21302334005 other than cold storage will require an amendment to the approved PUD. The existing structure shall comply with City Codes Chapter 14 and any other use of the building shall meet all applicable codes. 8.6. Overnight vehicle storage is prohibited. All overnight vehicle storage shall be stored in indoors. 9.7. No exterior storage shall be permitted onsite. 10.8. All light poles shall be a maximum of 25 feet in height, including base, and shall be shoebox style, downward directed, with high-pressure sodium or LED lamps and flush lens. Other than wash or architectural lighting, attached security lighting shall be shoebox style, downward directed with flush lens. In addition, any entry lighting under canopies shall be recessed and use a flush lens. Shields shall also be added as directed by the City. 11.9. All rooftop or ground mounted mechanical equipment shall be hidden from view with the same materials used on the building in accordance with City Code requirements. 12.10. Prior to the issuance of a Grading and Erosion Control permit, trees or tree areas that are to be preserved shall be visibly marked and City-approved tree protection fencing or other methods shall be installed and maintained at the critical root zones of the trees to be protected. The location of the fencing shall be in conformance with the approved tree preservation plan and approved by staff in writing. 13.11. The Applicant shall be responsible for obtaining any other permits necessary from other agencies, MPCA, Rice Creek Watershed District, etc. prior to the start of any site activities. All disturbed boulevards shall be restored with sod. 15.13. The Applicant shall be responsible for protecting the proposed on-site storm sewer infrastructure and components and any existing storm sewer from exposure to any and all stormwater runoff, sediments and debris during all construction activities. Temporary stormwater facilities shall be installed to protect the quality aspect of the proposed and existing stormwater facilities prior to and during construction activities. Maintenance of any and all temporary stormwater facilities shall be the responsibility of the Applicant. 16.14. The Applicant shall be responsible for obtaining a land disturbance Grading and Erosion Control permit from the City’s Engineering Division prior to the commencement of any land disturbance activities. 17.15. Heavy duty silt fence and adequate erosion control around the entire construction site shall be required and maintained by the Developer during construction to ensure that sediment and storm water does not leave the project site. 18.16. Prior to the beginning of the 2019-2020 school year, the Applicant shall stripe a minimum of 334 parking stalls in parking lot located on PID 213023340005. Parking stalls dimensions shall be 9 feet by 18 feet. 19.17. Prior to the issuance of a Grading and Erosion Control permit, the School District shall provide the City in writing how they will staff the pedestrian crossing during student arrival and release for City staff and the Ramsey County Sheriff shall review and approveal. the pedestrian crossing plan prior to August 1, 2019. The School District shall implement any and all recommendations made by the City and/or the Sheriff prior to the start of the 2019-2020 school year. 20.18. Prior to the issuance of a Grading and Erosion Control permit the Engineering Department shall approve the Final grading, utility, stormwater and right of way improvement plans. 21.19. The Applicant, Ramsey County Sheriff and City staff shall review traffic and pedestrian operations annually. The Applicant shall implement improvements recommended by the City Engineer. 22.20. Prior to the issuance of a Grading and Erosion Control Permit, all items identified in the March 5, 2019 Engineering Review Comments memo shall be addressed. All comments shall be adopted herein by reference. 23.21. The proposed mascot wall sign may be externally illumined and shall be approved by Planning staff in writing. Internal illumination is prohibited. The proposed mascot sign shall not exceed 53 square feet. Final location of the proposed mascot wall sign shall be approved in writing by Planning staff. 24. Findings and recommendations of the March 19, 2019 Traffic memo from Wenck shall be implemented. 25.22. A Planned Unit Development Agreement shall be fully executed prior to July 31, 2019. the prior to the issuance of a Grading and Erosion Control Permit. 26.23. The Applicant shall be financially responsible for 100 percent of all Lake Valentine Road street improvements. These improvements include but shall not be limited to: turn lanes and other access improvements, trail and sidewalk improvements, pedestrian signal, signage and striping modifications, and drainage and utility improvements. The Applicant shall preform an analysis of how many trees the parking lot and surrounding land on PID 21302334005 can accommodate and reserve the said number of trees from 562 caliper inches required to be replaced. 28. After site grading has been completed, the Applicant shall work with the adjacent property owners to ensure any screening concerns are addressed. Any trees planted shall count towards the 562 caliper inches required to be replaced. Council Shall Consider: 1. Comprehensive Plan Amendment The Planning Commission voted to recommend approval (5-0) of Planning Case 18-014 for an amendment to the 2040 Comprehensive Plan Land Use Map from the Low Density Residential designation to the Public and Institutional designation subject to the following condition: 1. Approval of the Comprehensive Plan Amendment is subject to approval by the Metropolitan Council. 2. Planned Unit Development The Planning Commission voted to recommend approval (5-0) of Planning Case 18-014 for a Master and Final PUD at 1900 and 1901 Lake Valentine Road be subject to the following conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to the plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. Prior to the issuance of a Grading and Erosion Control permit, the Applicant shall enter into a PUD Development Agreement with the City. The Development Agreement shall outline conditions of approval, required securities and fees, and sequence of events. 3. A letter of credit equal to or 125% of the cost of the required landscaping must be submitted to the City prior to issuance of a Grading and Erosion Control permit. 4. A Site Plan Review application shall be required for the reconstruction of the parking lot on PID 21302334005. 5. Any use of the existing building on the on PID 21302334005 other than cold storage will require an amendment to the approved PUD. The existing structure shall comply with City Codes and any other use of the building shall meet all applicable codes. 6. Overnight vehicle storage is prohibited. All overnight vehicle storage shall be stored in indoors. 7. No exterior storage shall be permitted onsite. 8. All light poles shall be a maximum of 25 feet in height, including base, and shall be shoebox style, downward directed, with high-pressure sodium or LED lamps and flush lens. Prior to the issuance of a Grading and Erosion Control permit, trees or tree areas that are to be preserved shall be visibly marked and City-approved tree protection fencing or other methods shall be installed and maintained at the critical root zones of the trees to be protected. The location of the fencing shall be in conformance with the approved tree preservation plan and approved by staff in writing. 11. The Applicant shall be responsible for obtaining any other permits necessary from other agencies, MPCA, Rice Creek Watershed District, etc. prior to the start of any site activities. 12. All disturbed boulevards shall be restored with sod. 13. The Applicant shall be responsible for protecting the proposed on-site storm sewer infrastructure and components and any existing storm sewer from exposure to any and all stormwater runoff, sediments and debris during all construction activities. Temporary stormwater facilities shall be installed to protect the quality aspect of the proposed and existing stormwater facilities prior to and during construction activities. Maintenance of any and all temporary stormwater facilities shall be the responsibility of the Applicant. 14. The Applicant shall be responsible for obtaining a land disturbance Grading and Erosion Control permit from the City’s Engineering Division prior to the commencement of any land disturbance activities. 15. Heavy duty silt fence and adequate erosion control around the entire construction site shall be required and maintained by the Developer during construction to ensure that sediment and storm water does not leave the project site. 16. Prior to the beginning of the 2019-2020 school year, the Applicant shall stripe a minimum of 334 parking stalls in parking lot located on PID 213023340005. Parking stalls dimensions shall be 9 feet by 18 feet. 17. Prior to the issuance of a Grading and Erosion Control permit, the School District shall provide the City in writing how they will staff the pedestrian crossing during student arrival and release for City staff and the Ramsey County Sheriff review and approval. The School District shall implement any and all recommendations made by the City and/or the Sheriff prior to the start of the 2019-2020 school year. 18. Prior to the issuance of a Grading and Erosion Control permit the Engineering Department shall approve the Final grading, utility, stormwater and right of way improvement plans. 19. The Applicant, Ramsey County Sheriff and City staff shall review traffic and pedestrian operations annually. The Applicant shall implement improvements recommended by the City Engineer. 20. Prior to the issuance of a Grading and Erosion Control Permit, all items identified in the March 5, 2019 Engineering Review Comments memo shall be addressed. All comments shall be adopted herein by reference. 21. The proposed mascot wall sign may be externally illumined and shall be approved by Planning staff in writing. Internal illumination is prohibited. The proposed mascot sign shall not exceed 53 square feet. Final location of the proposed mascot wall sign shall be approved in writing by Planning staff. I was not able to attend the council meeting last evening. I realize that the meeting is in "recess", to be continued on May 22nd, 2019. I have many concerns and hope they will be taken into account and addressed. It was mentioned that the school construction plans were first introduced to the city in November or December. The neighbors were first notified on February 4th for a meeting on February 12th to discuss the plans for school improvements and school safety. At that time it was revealed to all that the school district was still in the process of signing the final paperwork to acquire the bus property at 1901 Lake Valentine Road. The use for the property was presented as adding over 500 parking spaces for staff and students. This was quite a surprise and the way they were going to implement that plan was not satisfactory. Since that first presentation, the plans have been changed many times. I attended the Planning Commission meetings on April 3rd and on May 8th and told of some of my concerns; safety of staff and students crossing, the zoning change and its implications, but also of the tearing up of the green space and removal of trees on the east side of the existing bus building and and the digging into the berm and removal of so many trees on the north and east of the building to use as a water retention pond. I feel the school district is moving forward too fast on the property that at this time they do not even have the money in the budget for improvements and are not sure when they will have the money. I would hope they would do soil testing before any digging is involved as it was a bus garage that dealt with repair, oil changes and diesel fuel on that property. If they fix the pot holes and surface, re-stripe this year, that seems to be all that is in the budget. Once funds are secured approvals are made, etc. then further improvements should be addressed. The next concern is one I just realized about 3:00am is the new bus parking on the school side. All the buses will be moved farther east, nearer to the houses on Lake Valentine Road. All for the convenience of those dropping off and picking up students,etc. As Mayor Grant mentioned, most buses are diesel. They emit a terrible smell and are much louder than gas vehicles. The buses the large part of the school year will be sitting and idling while waiting for the students, especially in cold weather. They will be entering and/or leaving the driveway thirty feet from my house across the road and idling while waiting to turn into or out of the driveway. As they pull away, it is loud. As neighbors, we don't need more noise and smell. Help! I am for keeping the bus loop as it is and the existing parking lot as it is, thus regaining some of the lost spaces there for staff and students, Eliminate digging up the area east of bus garage and area to the north and east of the garage and place the water retention pond on the north side of the bus lot along Hwy 694. Background/Discussion A watermain break was repaired last winter on County Road E just west of Goodwill. Due to the timing of the repairs, a temporary patch was installed upon completion of the watermain repairs. The roadway is in need of a permanent patch as the temporary patch is in poor condition and a danger to motorists. Ramsey County has requested that the City complete the repairs as soon as possible. Staff has scheduled the contractor, Klein Underground, LLC to complete the patching and has received a quote of $18,562.50 to complete the work. Staff recommends that the Council authorize payment to Klein Underground, LLC in the amount of $18,562.50.
