ORDINANCE NO. 2019-005 <br />CITY OF ARDEN HILLS <br />RAMSEY COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING CHAPTER 3, LICENSES AND <br />REGULATIONS, SECTION 350, TOBACCO PRODUCTS, SUBSECTION <br />350.06, PROHIBITED SALES OF THE ARDEN HILLS CITY CODE <br />REGARDING PROBITED SALES <br />THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA, ORDAINS: <br />SECTION 1. Chapter 3, Licenses and Regulations, Section 350, Tobacco Products, <br />Subsection 350.06, Subd. 2, Prohibited Sales, is hereby amended as follows: <br />350.06 Prohibited Sales. <br />It shall be a violation of this section for any person to sell or offer to sell any licensed products as <br />follows: <br />Subd. 1 No person shall sell any licensed product to any person under the age of 21. <br />A.Age Verification. Licensees must verify by means of government-issued photographic <br />identification that the purchaser is at least 21 years of age. Verification is not required for a <br />person over the age of 30. That the person appeared to be 30 years of age or older does not <br />constitute a defense to a violation of this subsection. <br />B.Signage. Notice of the legal sales age and age verification requirement must be posted <br />at each location where licensed products are offered for sale. The required signage, which will be <br />provided to the licensee by the city, must be posted in a manner that is clearly visible to anyone <br />who is or is considering making a purchase. <br />Subd. 2 After December 31, 2019, no person shall sell or offer for sale any flavored products. <br />Subd. 3 By means of any type of vending machine. <br />Subd. 4 By means of self-service methods whereby the customer does not need to make a <br />verbal or written request to an employee of the licensed premises in order to receive the licensed <br />product and whereby there is not a physical exchange of the licensed product between the <br />licensee, or the licensee's employee, and the customer. <br />Subd. 5 By means of "loosies" as defined in 350.02 Definitions.
