HomeMy WebLinkAbout2020-024 'It kD EN HILLS CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 2020-024 RESOLUTION ALLOWING FLEXIBILITY FOR LOCAL BUSINESSES DURING LOCAL EMERGENCY FOR COVID-19 WHEREAS,on March 17, 2020,the Governor's Executive Order 20-04 temporarily closed restaurants, bars, and other places of public accommodation; and WHEREAS the Governor is beginning to loosen restrictions on businesses, g restaurants,bars and other places of public accommodation; and WHEREAS,the City wants to make temporary accommodations for businesses that can open in compliance with the Governor's directives; and WHEREAS, these temporary accommodations may include allowing flexibility with respect to the City Code or other regulations; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, Minnesota, that local businesses may request temporary approval from the City Administrator, or their designee, to operate in outdoor spaces adjacent to their normal location that would normally be prohibited by City Code or require a variance if the following conditions are met by the business: -Compliance with all the Governor's guidance regarding safe business operations including a social distancing plan. -Safe pedestrian flow must be maintained. -ADA guidelines are observed. -Cannot conflict with any building codes or requirements. -If portions of a parking lot are being used, safe pedestrian and traffic flow must be maintained. Adequate parking spaces must be maintained. A substantial barrier must divide outdoor space being used for customers and traffic flow. -Public Safety response must not be infringed upon. -The proposed outdoor space will not be on City property or right-of-way. -If the business is not the property owner, the business must receive written consent of the property owner to use the proposed space. -Expansion or use of outdoor space is on a case-by-case basis and will be reviewed by City Staff. -The City will not charge to review requests by businesses for city staff time, but any expenses incurred by the City, such as, electrical inspections, will be passed on to the applicant. If a restaurant or bar wants to utilize outdoor space and serve alcohol it must comply with the above requirements and: -Alcoholic drinks must be consumed on premise. -The outdoor area must be contiguous to the building and contained, an updated map must be provided to City Staff showing where the consumption would take place. -Must provide an updated certificate of insurance regarding liability coverage extending to an outdoor space. -Must comply with all other local and state regulations regarding alcohol sales and consumption. The temporary authority given to staff to review any requests that come in would be until restaurants can resume normal operations or further Council direction is received.
