RESOLUTION NO.2020-033
RESOLUTION APPROVING A MINOR SUBDIVISION FOR THE
SUBJECT PROPERTY 3235 LEXINGTON AVENUE
I
WHEREAS, City Staff received a land use application for a minor subdivision request
with the intent to build a single family detached dwelling on the resultant lot from splitting 3235
Lexington Avenue("Subject Property"); and
WHEREAS,both the Subject Property and the resulting lot to be split are conforming lots
that meet the R-2 Single and Two Family Residential District standards for minimum lot width,
length,and area requirements; and
WHEREAS, the City Council directed Staff to prepare a Land Use Application Public
Policy Notification to notify all property owners within 500 feet of Subject Property when a request
for the Planning Commission is to occur related to a land use application that does not require a
public hearing; and
WHEREAS,the City's obligation has been met where the Arden Hills Planning
Commission duly held a hearing on August 511,2020. All persons present at said meeting were
given an opportunity to be heard and present written statements;
WHEREAS, The proposed division shall conform to all requirements of the City Code of
Ordinances, which the Planning Commission has specifically made such division subject to at its
meeting at which the application for the division or consolidation is submitted; and
WHEREAS the Planning Commission considered the findings of fact provided by the City
Staff and,as such voted 7-0 in favor of the request;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota,that Hereby adopts Resolution 2020-033 approving Planning Case 20-016 for a minor
subdivision request at the Subject Property 3235 Lexington Avenue to subdivide the Subject
Property into two(2)conforming lots,based on the findings of fact and the submitted plans in the
August 24, 2020 Report to the City Council, as amended by the following conditions:
1. The applicant shall record the Minor Subdivision with Ramsey County and a copy shall
be provided to the City within sixty(60)days of the City's approval.
2. The applicant shall record any the drainage and utility easements with Ramsey County
and a copy shall be provided to the City within sixty (60)days of the City's approval.

3. The applicant shall add a twelve (12) foot wide utility and drainage easements
dedicated to the City along the right-of-way and centered on common lot lines per the
City's subdivision regulations.
4. The applicant shall pay the required park dedication fee of$6,500 prior to issuance of
a Grading and Erosion Control permit.
5. Monument stakes shall be installed to demarcate the property line between Parcel A
and Parcel B.
6. A final Grading and Erosion Control Plan shall be reviewed and approved by
engineering staff prior to the issuance of a Building Permit on Parcel B.
7. A Building Permit shall be required for the new dwelling on Parcel B.
8. A Grading and Erosion permit shall be obtained from the City's Engineering Division
prior to commencing any grading,land disturbance or utility activities.
9. Prior to the issuance of a building permit,the Developer shall be financially
responsible for 100 percent of all applicable sewer connection, sewer availability,
water connection,water availability and Metropolitan Council Sac charges.
10. A Tree Preservation Plan shall be required as part of the Building Permit application
for the new dwelling on Parcel B.
11. Any extension or relocation of City services for Parcel B shall subject to approval by
the City Engineer and all associated costs shall be the responsibility of the applicant.
12. Should Shoreline Lane need to be extended due to proposed development of parcel B,
the Applicant shall be financially responsible for 100 percent of the costs of the
extension.
