Council may discuss and provide further direction on the response letter received from Ramsey
County Commissioner Frethem regarding Tony Schmidt Regional Park and unsafe access
concerns.
Background
The Council directed staff to draft a letter in October 2020 to Ramsey County Commissioner
Frethem regarding unsafe access concerns at Tony Schmidt Regional Park. Staff did so, and the
Council has since received a reply from Commissioner Frethem. This discussion provides
Council with the opportunity to discuss the letter and give any further direction to Staff.

The Council should provide further direction on moving forward with potential regulations regarding
infill development.
Background
City Council previously directed staff to work on potential revisions to address redevelopment of
existing residential lots (infill development). Demolition of existing residential units and lot
splits within established neighborhoods are an issue impacting numerous developed communities
within the metropolitan area. The most common concerns with these types of projects are loss of
neighborhood character, the bulk and height of new dwellings, spacing between dwellings, loss
of mature trees, construction impacts, and drainage. The City o f Arden Hills receives on average
three (3) to five (5) residential demo and rebuild permits per year. Any new residential dwellings
must meet the existing standards below and are reviewed during the plan review process
(attachment A).

Discussion:
City code currently has numerous standards to regulate single-family redevelopment. Staff is
looking for Council direction and feedback on the following items.
1. Section 1305.04 of the City Code defines building height as “the vertical distance from
the average elevation of the grade along a face of a building to the highest point of the
roof surface of flat roofs, the deck line of mansard roofs, or the average height between
the eaves and the highest ridge of gable, hip, or gambrel roofs.” These measurements are
illustrated in the drawing below. Code currently requirements a max height of 35 feet
measure to the midpoint.

Should the maximum height be measured to the top or ridgeline of the proposed single-
family dwellings within the R-1 and R-2 districts? Yes/No

The following plan review report represents a comprehensive code record for the
project outlined below. In addition, this report contains a compilation of current
(2015 Minnesota Residential Code) code violations and/or project specific conditions
which require plan revisions, corrections or further clarification by the proper design
authority prior to construction authorization or permitting for this project. Please

necessary revised plan sheets or specifications, copies of relevant addenda(s),

PLAN REVIEW SCOPE:
The construction documents for the project described above have been reviewed for
substantial compliance with the 2015 Minnesota Residential Code. The following
(attached) nonstructural comments, based on the 2012 International Residential
Code, as amended by the 2015 Minnesota Residential Code, shall be resolved before
construction authorization is issued. The applicant must respond by letter of
verification and submittal of revised construction documents, addenda’s, or change
order’s, or with the additional submittal of required shop drawings that clearly
identify that said corrections have been made as required by this plan review report.

This building code plan review does not include the review of structural, state fire
codes, electrical and/or plumbing installations, site grading or civil work,
landscaping, septic designs, well construction, or other site utilities. Local municipal
City/County zoning and/or fire codes have also not been included as part of this
review. Separate review, approval, and/or authorizations must be obtained for this
work.
This plan review report is a “nonstructural” code analysis based on the current 2015
Minnesota Residential Code. Although every attempt has been made to identify code
issues or concerns for proper and necessary change, the project designer(s), the
building contractor(s), and the property owner(s) are ultimately responsible for
providing for complete code compliance and maintaining minimum construction
standards for the safeguarding of life or limb, health, public welfare, and property.
Comments contained within this report shall not be construed to relieve from, lessen
the responsibility, or grant authorization for work in violation of any laws or
ordinances of the State of Minnesota, or of this jurisdiction.
In accordance with state law, prior to excavation or grading on any site, utilities
must be located. Call Gopher State One Call at 1-800-252-1166 (651-454-0002
local) as soon as possible to schedule utility locations for this site. [Minnesota
Statute 216D.01 to 216D.07]
Site grading, landscaping, utility installations, erosion control measures, etc., must
all be completed as approved by the City Engineering Department and Planning
Commission without alteration. Deviations from previously approved plans must be
checked and approved by the Engineering Department and/or the City Planning

Building Comments:
1.NOTE: The work of this permit may require compliance with the US EPA’s Lead-
Based Paint Rule pursuant to 40CFR745.82. It is the responsibility of the permit
applicant to verify compliance with US EPA’s rules before starting work. Contact the
US EPA Region 5 Office at 312-886-6003 or at epa.gov/lead.
1. Separate plumbing and mechanical permit applications and plan reviews are
required as applicable. The City of Arden Hills reviews all plumbing and
mechanical plans and performs all plumbing and mechanical inspections for work
in its jurisdiction.
2. Separate application for electrical inspections is required with inspection and
approval by Pete Tokle, Electrical Inspector, 763-754-2983, office hour’s
weekdays between 7:00 AM and 8:30 AM. Electrical inspection applications are
available at the customer service counter at Arden Hill City Hall, 1245 West
Highway 96, Arden Hills, MN. 55112, 651-792-7800. 1
3. Post building address using 4 inch minimum height legible numbers, no script, in
contrasting color to the building and in a location plainly visible from the street or
road fronting the building.
4. Setbacks from all sides must be verified prior to pouring of any footings and or
foundation.

5. Prior to start of any excavation or construction, approved erosion control
methods must be in place.
6. Pursuant to Minnesota Statutes , section 15.41, The building permit or copy
of shall be kept on site of work until the completion of work.
7. Verify center foundation footing. Point load locations need to have block grouted
solid to a minimum depth of three block courses. All damaged block to be
repaired.
8. Contractor to obtain permit to demolish existing building.
9. Parking is extremely limited on and around building site. Provide documentation
to the City detailing notification of neighbors, contractors and others as to how
parking will be maintained in an orderly fashion to minimize disruption to
neighboring properties and the community in general.
10. Concrete foundation walls shall be selected and constructed in accordance with the
provisions of Section R404.1.2. Concrete foundation walls shall be laterally
supported at the top and bottom in accordance with R404.1. Provide poured wall
documentation for inspectors’ reference. Supporting engineering must be on site prior
to pouring!
11. Vapor retarders pursuant to IBC Section 1405.3 and continuous air barrier
pursuant to Minnesota Energy Code Section C402.4 or ASHRAE 90.1 Section
5.4.3.1 must be provided and indicated on the construction documents.
Demonstrate Compliance.
a. Confirm a gas permeable material in accordance with MR 1303.2401 subp 2
is provided on the prepared subgrade under all floors pursuant to MR
1303.2402 subp 1.
b. Confirm that all potential entry routes for radon gas are sealed according to
subp A-E pursuant to MR 1303.2402 subp 4.
c. Radon vent pipes routed through unconditioned spaces shall be insulated with
a minimum R4 pursuant MR 1303.2402 subp 5.
d. Confirm all radon vents pipes are identified with at least 1 label on each story
and in attics pursuant to MR 1303.2402 subp5.
12. R402.1.1 MN2015 Energy code
Insulation, waterproofing, and fenestration criteria of the building thermal
envelope shall meet the requirements of Table R402.1.1 based on the climate
zone specified in Chapter 3, and the requirements contained in Section R402.2.
Cast-in-place concrete and masonry block foundation walls shall be waterproofed
according to IRC Section R406 and the following requirements:
1. The waterproofing shall extend from the top interior wall edge, across the top
of the wall, and down the exterior wall face to the top of the footing. If a full
width, closed-cell material is installed to create a seal between the sill plate
and the top of the foundation wall, the installation is deemed to meet the
requirements for the top of the wall waterproofing.

2. If the walls are exposed to the exterior environment, the waterproofing
system shall have a rigid, opaque, and weather-resistant protective covering
to prevent degradation of the waterproofing system. The protective covering
shall cover the exposed waterproofing and extend a minimum of 6 inches
(152 mm) below grade. The protective covering system shall be flashed in
accordance with IRC Section R703.8.
R402.1.1.1 Integral foundation insulation requirements Any insulation assembly
installed integral to the foundation walls shall be manufactured for that intended
use and installed according to the manufacturer’s installation instructions.
R402.1.1.2 Exterior draining foundation insulation requirements Any insulation
assembly installed on the exterior of the foundation walls and on the perimeter
of slabs-on-grade that permits water drainage shall:
be made of water-resistant materials manufactured for that intended use;
be installed according to the manufacturer’s installation instructions; comply
with either ASTM C578, C612, or Cl029, as applicable; and
have a rigid, opaque, and weather-resistant protective covering to prevent the
degradation of the insulation’s thermal performance. The protective covering
shall cover the exposed exterior insulation and extend a minimum of 6 inches
(152 mm) below grade. The insulation and protective covering system shall be
flashed in accordance with IRC Section R703.8.
R402.1.1.3 Exterior non-draining foundation insulation requirements Any
insulation assembly installed on the exterior of the foundation walls or on the
perimeter of slabs-on-grade that does not permit bulk water drainage shall: 1.
be made of water-resistant materials manufactured for that intended use; 2. be
installed according to the manufacturer’s installation instructions; 3. comply with
either ASTM C578 or C1029, as applicable; 4. be covered with a 6-mil
polyethylene slip sheet over the entire exterior surface; and 5. have a rigid,
opaque, and weather-resistant protective covering to prevent degradation of the
insulation’s thermal performance. The protective covering shall cover the
exposed exterior insulation and extend a minimum of 6 inches (152 mm) below
grade. The insulation and protective covering system shall be flashed in
accordance with IRC Section R703.8.
13. 1/2” anchor bolts must be embedded 7” into concrete or grouted cells of masonry
units and spaced not more than 72” O.C. and with-in 12” of every corner and
splice. If approved anchor straps are used, they must be spaced as per
manufactures instructions.
14. Provide copy of Geotechnical reports of soils to building dept. for review.
15. R403.1.3.1,2,4 Floating (monolithic) slabs for free standing structures must
have a thickened edge slab design with a minimum of 12” below finished grade
around perimeter. Slabs over 1000 sq. ft. require engineering to be submitted at
time of plan review.
16. R408. A minimum of a 6 mil vapor retarder to be placed directly beneath
concrete slabs on grade.
17. R404.1.4 Floor framing blocking to be in accordance with Section R404.
a. R404.1.4 Blocking shall be full depth and three joist spaces in. See table
R404.1(1) for blocking spacing. sheathing shall be fastened to blocking in
accordance with Table R602.3(1). [MN Section 404.1 #4]

18. Enclosed accessible space under stairs shall have walls, under-stair surface and
any soffits protected on the enclosed side with ½ inch gypsum board pursuant to
R302.7
19. A final inspection of the completed work is required before this space can be
occupied. Moving personal belongings and furniture into the structure or area is
prohibited until then.
20. SAC and WAC charges to be paid in full before issuance permit.
21. Decorative gas heating appliances require a separate mechanical permit and
inspections.
22. Contractor must maintain proper clearances of combustible materials and
insulation at chimneys and gas fireplaces.
a. R603.7 Jack and King Studs
23. The number of jack and king studs installed on each side of a header shall compl
a. with Table 603.7(1). King and jack studs shall be of the same dimension
b. and thickness as the adjacent wall studs. Headers shall be connected to king
studs in accordance with Table R603.7(2).
24. R802.10.1 Truss Design Drawings. Engineered roof and floor truss design
data sheets and layouts shall be available for review by the Building Inspector at
the time of the scheduled framing inspection(s). Design data must indicate uplift
loads at each roof truss bearing. Mechanical connectors designed for the uplift
forces on the trusses will be installed at the truss bearings. Install all lateral
bracing indicated on the design data. Provide solid blocking for all load points to
the foundation.
25. Provide accessible attic access with a minimum rough framed opening of 22
inches by 30 inches and with minimum unobstructed headroom of 30 inches.
26. Ice and water barrier shall be installed under the roofing starting at the edge of
the eave and extended up the roof to a line a minimum of 24 inches inside the
exterior wall line of the building. In lieu of on-site inspection, provide photos of
ice and water barrier installation for review by the Building Inspector at the time
of the scheduled framing inspection(s).
27. Roof slopes between 2/12 and 4/12 can use shingles but require double
underlayment installed pursuant to IRC R905.2.7 or continuous ice and water
barrier.
28. Roof slopes of 4/12 and above may use standard asphalt roofing applications with
ice and water barrier installed under the roofing starting at the edge of the eave
and extended up the roof to a line a minimum of 24 inches inside the exterior
wall line of the building. In lieu of on-site inspection, provide photos of ice and
water barrier installation for review by the Building Inspector at the time of the
scheduled framing inspection(s).
29. Roofing materials other than asphalt shingles requires approval by the Building
Official before installation.
30. Roof ventilation is required at enclosed attics and rafter spaces where ceilings are
applied directly to the underside of roof rafters. Ventilation will be provided at
not less than 1 square foot of net free ventilation area for each 150 square feet
of the area of the space ventilated.

i. Exception: Ventilation area may be reduced to 1 square foot for each
300 square feet provided 50%, but not more than 80%, is located at
least 3 feet above the eave vents with the balance of the required
ventilation provided by eave vents, or provided a vapor barrier having
a transmission rate not exceeding 1 perm is installed on the warm side
of the ceiling.
31. A minimum of 1 inch air space shall be provided between the insulation and the
roof sheathing at the location of the roof vent. Insulation shall not block the free
flow of air.
32. In lieu of on-site inspection, provide photos of ice and water barrier installation
for review by the Building Inspector at the time of the scheduled framing
inspection(s).
33. Kick-out flashing is required on new construction and only when re-siding.
34. Verify with engineered lumber manufacturer that structural members and
supports are designed to support all loads imposed on engineered lumber.
35. Sill plates in contact with concrete or masonry are required to be decay resistant
treated lumber.
36. Comply as applicable with IRC R602.10.6.2 requirements for alternate braced
wall panels adjacent to door and window openings at the braced wall line
containing the garage door openings.
37. Framing inspection will follow completion of mechanical, electrical and plumbing
rough in inspections. Framing and insulation inspections may be combined with
prior approval of the Building Official.
38. Draft stopping is required in floor and ceiling systems exceeding 1000 square
feet. Draft stopping shall divide the space into approx. equal areas.
39. Install approved fire blocking and/or draft stopping at all penetrations in fire
separation walls and all penetrations between floor levels, at attics, at concealed
spaces and at mechanical chase openings.
40. R302.6 Dwelling / Garage separation. The garage shall be separated as
required by table R302.6. Separation must be maintained from residence to
garage with not less than 1/2 gypsum board on the garage side of structural
members supporting the floor/ceiling assemblies or garage ceiling. Structural
members include, but are not limited to walls, columns, beams, girders and
trusses.
41. R402.2.1 Ceilings with attic spaces. When section R402.1.1 would require R-38
in the ceiling, R-30 shall be deemed to satisfy the requirements for R-38
wherever the full height of uncompressed R-30 insulation extends over the wall
top plate at eaves.
42. R317.1 Protection of wood and wood based products from decay shall be
provided in the following locations by the use of naturally durable wood or wood
that is preservative-treated in accordance with AWPA U1 for the species, product,
preservative and end use. Preservatives shall be listed in Section 4 of AWPA U1.
a. Wood joists or the bottom of a wood structural floor when closer than 18
inches (457 mm) or wood girders when closer than 12 inches (305 mm) to
the exposed ground in crawl spaces or unexcavated area located within the
periphery of the building foundation.

b. All wood framing members that rest on concrete or masonry exterior
foundation walls and are less than 8 inches (203 mm) from the exposed
ground.
c. Sills and sleepers on a concrete or masonry slab that is in direct contact with
the ground unless separated from such slab by an impervious moisture
barrier.
43. The ends of wood girders entering exterior masonry or concrete walls having
clearances of less than 1/2 inch (12.7 mm) on tops, sides and ends.
44. Wood siding, sheathing and wall framing on the exterior of a building having a
clearance of less than 6 inches (152 mm) from the ground or less than 2 inches
(51 mm) measured vertically from concrete steps, porch slabs, patio slabs, and
similar horizontal surfaces exposed to the weather.
45. Wood structural members supporting moisture-permeable floors or roofs that are
exposed to the weather, such as concrete or masonry slabs, unless separated
from such floors or roofs by an impervious moisture barrier.
46. Wood furring strips or other wood framing members attached directly to the
interior of exterior masonry walls or concrete walls below grade except where an
approved vapor retarder is applied between the wall and the furring strips or
framing members.
47. R317.1.5 Exposed glued-laminated timbers. The portions of glued-laminated
timbers that form the structural supports of a building or other structure and are
exposed to weather and not properly protected by a roof, eave or similar
covering shall be pressure treated with preservative, or be manufactured from
naturally durable or preservative-treated wood.
Stairs
48. IRC Stairway minimum clear width is 36 inches. Maximum tread rise is 7 3/4
inches and minimum tread run is 10 inches. The dimensions of any one treads
run or riser shall not vary from the dimensions of any other treads run and rise
by more than 3/8 inch. Stairways having four or more risers shall have at least
one handrail. The handrail grip shall be placed not less than 34 inches or more
than 38 inches above the nosing of the stair treads. The handrail grip shall not
be less than 1 1/4 inches and not more than 2 inches in cross-sectional
dimension or the shape shall provide an equivalent gripping surface. The
handrail grip shall have a smooth surface with no sharp corners. Handrail grip
ends shall start at a point directly above the top riser of a flight to directly above
the lowest riser of the flight. The handrail ends shall be returned or terminated
in newel posts or safety terminals. Hand grip shall extend not more than 4.5
inches into the minimum clear width of the stairway. Handrails adjacent to a wall
shall have a space of not less than 1.5 inches between the wall and the handrail.
49. There shall be a floor or landing at the top and bottom of each stairway. The
width of the landing shall not be less than the width of the stairway served. Every
landing shall a minimum dimension of 36” inches measured in the direction of
travel. [R311.5.4:]
i. Exception: A floor or landing is not required at the top of interior
flight of stairs, including stairs in an enclosed garage, provided a door
does not swing over the stairs. A flight of stairs shall not have a
vertical rise larger than 12’ feet between floor level or landings.
50. R303.7 Stairway illumination. All interior stairways shall be provided with a
means to illuminate the stairs, including the landings and treads. Interior stairs

shall be provided with and artificial light source located in the immediate vicinity
of each landing of the stairway.
51. Fasteners used in pressure preservative and fire-retardant-treated wood shall be
hot dipped galvanized steel, stainless steel, silicon bronze or copper.

52. R703.2 Weather-resistive barrier: One layer of No. 15 asphalt felt, free from
holes and breaks, complying with ASTM D 226 for Type 1 felt or other approved
water-resistive barrier shall be applied over studs or sheathing of all exterior
walls. Such felt or material shall be applied horizontally, with the upper layer
lapped over the lower layer not less than 2” inches. Where joints occur, felt shall

53. Safety glazing is required as applicable in windows located in hazardous
locations pursuant to the 2015 MSBC, Section R308.4 Hazardous locations, and
shall meet the acceptance criteria of ANSI/DASMA 108.
54. R308.4.2 Glazing adjacent doors. Glazing in an individual fixed or operable
panel adjacent to a door where the nearest vertical edge of the glazing is within a
24-inch arc of either vertical edge of the door in a closed position and where the
bottom exposed edge of the glazing is less than 60 inches above the floor or
walking surface shall be considered a hazardous location.
55. R308.4.5 Glazing and wet surfaces. Glazing in walls, enclosures or fences
containing or facing hot tubs, spas, whirlpools, saunas, steam rooms, bathtubs,
showers and indoor or outdoor swimming pools where the bottom exposed edge
of the glazing is less than 60 inches measured vertically above any standing or
walking surface shall be considered a hazardous location. This shall apply to
single glazing and all panes in multiple glazing.
i. Exception: Glazing that is more than 60 inches, measured
horizontally and in a straight line, from the water’s edge of a bathtub,
hot tub, spa, whirlpool, swimming pool.
56. Table R402.1.3 New windows and exterior doors must be a maximum of U-0.32
or less.
57. R312.2 Window Fall Protection: Window fall protection shall be provided in
accordance with Section R312.2.1 and R312.2.2.
58. R312.2.1 Window Sill: In dwelling units, where the lowest part of the opening
of an operable window is located more than 72 inches above finished grade or
surface below, the lowest part of the window opening shall be 36 inches above
the finished floor of the room in which the window is located. Operable sections
of windows shall not permit openings that allow passage of a 4 inch diameter
sphere where such openings are located within 36 inches of the finished floor.

attics, and every sleeping room shall have at least one operable emergency

c. MN R310.1.1 Minimum Opening Area. All emergency escape and rescue
openings shall have a minimum net clear opening of 5.7 square feet.
d. MN R310.1.2 Minimum Opening Height. The minimum net clear opening
height shall be 24 inches.
e. MN R310.1.3 Minimum Opening Width. The minimum net clear opening width
shall be 20 inches.
f. MN R310.1.4 Operational Constraints. Emergency escape and rescue
openings shall be operational from the inside of the room without the use of
keys, tools or special knowledge.
59. R312.2.2 Window Opening Control Devices.
a. Window opening control devices shall comply with ASTM F 2090. The window
opening control device, after operation to release the control device allowing
the window to fully open, shall not reduce the minimum net clear opening
area of the window unit to less than the area required by Section R310.1.1.
60. Smoke Detectors and Carbon Monoxide Alarms Effective August 1, 2008,
single family dwelling and every multifamily dwelling unit shall be provided with a
minimum of one approved (UL2034) and fully operational carbon monoxide alarm
installed within ten (10) feet of each sleeping room. If sleeping rooms are
located on separate floors additional carbon monoxide alarms would be necessary
within ten feet of these areas.
61. Install smoke detectors in all new and existing sleeping rooms and in all areas
giving access to sleeping rooms. In new and existing construction each level and
the basement shall have a smoke detector. Primary power for required smoke
detectors will be from the building wiring and shall be equipped with a battery
backup. Smoke detector alarm shall be audible in all sleeping rooms.
i. Exception: Required smoke detector alarms in areas of existing
buildings where the wall and/or ceiling finish has not been removed or
where there is no above ceiling access may be solely battery operated.
PLUMBING / MECHANICAL
62. Plan review for building only, plumbing & mechanical will be done when
submitted for permit.

the lower level is lower that the manhole cover in the street.

505.1 Domestic systems.
a. Where domestic range hoods and domestic appliances equipped with down
draft exhaust are located with-in dwellings, the hoods and appliances shall
dis-charge to the outdoors through ducts constructed of galvanized steel,
stainless, aluminum, or copper. The ducts shall have smooth inner walls and
shall be air tight and equipped with a back draft damper. Domestic kitchen
exhaust hoods ducted to the outdoors shall have make-up air provided
according to the Minnesota Rules, part 1346.0501. Refer to part
1346.6010 for Table C-1, “Recommended Capacities for Domestic Kitchen
Exhaust Hoods”.
70. 505.2 Make up air required
a. Exhaust hood systems capable of exhausting in access of 400 C.F.M. shall be
provided with make-up air at a rate of approximately equal to the exhaust
rate. Such makeup air systems shall be equipped with a means of closure and
shall be automatically controlled to start and operate simultaneously with the
exhaust system.
71. Drain tile is not addressed on plans. Verify that existing drain tile is functional,
and provide new drain tile system to sump or daylight as needed.
72. Dryer venting typically has a maximum straight run of 35’. Deduct 5’ for each
ninety degree bend and 2’-6” for every 45 degree elbow. Verify that dryer units
selected conform with this requirement or are designed for extended length runs
as per [M] 614.6.5.1
DECK
73. Please note that these are general comments regarding the current condition of
the exterior decks. These comments may not be all inclusive and cover all areas
of concern. City staff recommends the condo association consult with an engineer
on how best to support the deck systems.

75. Lumber with-in 18” of the ground must be rated for ground contact.
76. If bottom of framing is with-in 36” or less of the ground a framing inspection
must be scheduled and pass prior to covering of structure.

stone or masonry veneer. Porch Outer joists and headers or beams must be let-in
to house framing and blocked solid to top of foundation.
84. Deck tension ties must be installed as per manufactures specs.
85. If deck guard railings are removed they will need to comply with current code.If
stairs are modified in any way including re-covering, they must not exceed the
max. 7 3/4” rise and tread of 10” and must be inspected.
86. Verify decking material is a listed and approved material installed to
manufacturer’s specifications.
87. Beams for exterior deck will require engineering due joist length and spacing of
post.
88. Verify with inspector prior to calling for a footing inspection. Footing “A” as
designated on red line plans is XX” minimum bell, and footing “B” (interior) is
minimum XX ” bell
Energy
89. Considerable square footage is being added to the existing home. Provide
documentation by the mechanical contractor on their letter head showing that the
project will met the energy code requirements for heating and cooling.
90. Before issuance of a certificate of occupancy a completed final HVAC acceptance
testing certification form has to be submitted to the City for approval. (see
attached form).
91. At time of final inspection, a blower door test and its results are required

results of the test shall be signed by the party conducting the test and provided to
the code official. Testing shall be performed at any time after creation of all
penetrations of the building thermal envelope.
93. If a duct sealant such as Aero Seal is used, a certificate from the installer is
required at final mechanical inspection.
Submit documentation that the new construction meets the state energy code.
Preferably the Energy Efficiency Compliance Certificate.
A separate mechanical permit is required to be obtained by your mechanical
contractor. A letter from that Mechanical contractor with their letter head is
required, detailing that they have run the calculations that show that the current
heating plant is sufficient to meet the requirements of the energy code for the
existing home and the new addition.

The complete contents of swimming pools are seldom discharged. Outdoor
swimming pools are usually discharged only at the summers’ end. The quality
of swimming pool water is typically good with few concerns for discharging
the water. One concern that must be addressed is the presence of chlorine in
the water. Chlorination must be stopped several days in advance of

discharging pools. Allowing the water to age without chlorine addition enables
the chlorine to dissipate. Testing the chlorine content with the test kit
(standard pool equipment) will give you the chlorine content of the water. In
most instances, three to four days will be sufficient to eliminate chlorine from
the water.
98. It is recommended that swimming pool water, free of chlorine, be discharged
to the ground surface (i.e. lawn). The discharge should be directed onto a
vegetated surface to encourage infiltration. The discharge should not flow
onto any other persons’ property or create nuisance conditions. If the
discharge flow is to occur across bare soil areas, care should be taken to
prevent soil erosion. This can be done in several ways. The flow rate can be
reduced to prevent erosion (use a small diameter hose), additional piping or
hose can be placed over the erosive area to prevent soil/water contact,
and/or sod can be laid in the bare area.

The City Council shall provide staff with guidance on the proposed chicken ordinance language.
Background
At its November 16, 2020 Work Session, the City Council discussed chicken survey results. At
that time the City Council directed staff to start drafting ordinance language. Staff has been
focused on research and fact gathering.
Discussion:
Staff is looking for Council direction on the following items.
1. What is Council’s expectations on approval timelines for amending the animal
ordinance to allow for the keeping of chickens? Staff is under the impression that the
goal to implement an ordinance was to be completed by March 2021.
2. In previous discussions Council has stated they favor limiting the number of hens to
three (3). Is this still the case? Yes/No
3. Should chicken coops or chicken runs be permitted in any area of the yard besides the
rear yard? Yes/No
4. At previous work session it was mentioned that the coops shall be located close to the
principle (dwelling) structure to assist in screening and maintenance. What is council

thoughts on the language below from the City of Lakeville? The city of Bloomington
has similar language.
“The coop and run shall be located closer to the principal dwelling upon the property
to which the administrative permit is issued than any other residential dwelling on an
abutting property.”
5. Should chicken coops or chicken runs be required to maintain a minimum setback
from adjacent dwellings? Yes/No - If yes, staff will do GIS analysis to determine
necessary setbacks and will share those findings at a future meeting.
6. A common theme in the survey comments was the need for screening. Should
fencing and/or landscape screening be required? Yes/No
7. Upon review of other municipalities code, some cities require applicants to read to
"Recommendations for Municipal Regulations of Urban Chickens (2010)"
(Attachment A) or similar publications approved by the City prior to the issuance of a
license or permit. Does Council support this type requirement? Yes/No
8. Should applicants be required to submit a plan for maintaining adequate coop
temperature? Below is sample language from Lakeville. Yes/No
“Prior to issuance of an annual license, the prospective annual license holder must
provide a plan for maintaining an adequate temperature in the coop for safety of the

HISTORY
It
is
important
to
understand
how
chickens
live
in
the
wild
and
to
provide
them
with
an
environment
that
meets
those
instinctive
physical
and
psychological
needs
as
closely
as
possible.
Chickens
are
all
descended
from
Tropical
Jungle
Fowl
are
adapted
to
living
in
a
natural
habitat
that
is
spacious,
richly
vegetated,
diverse
and
warm.
This
presents
a
particular
challenge
in
a
small
urban
setting
in
a
cold
climate
like
Minnesota.
Flocks
have
a
highly
developed
social
structure
and
depend
on
each
for
companionship
and
security.
Naturalists
have
observed
that
they
can
recognize
and
remember
180
other
individual
flock
members.
They
are
ground
dwelling
birds.
Most
are
capable
of
low
flight
in
short
distances,
smaller
birds
can
fly
higher
and
farther.
In
the
wild
they
roost
in
trees
at
dusk
before
they
sleep
or
to
escape
predators.

hide
their
nests
in
cavities
in
the
ground.
The
majority
of
their
waking
hours
are
spent
active,
wide

and

The City Council is asked to provide staff feedback and direction on the Planning Commission
Onboarding Policy.
Background
At its October 19, 2020 work session staff and the city council discussed the Planning
Commission - Zoning Approvals and Plan Review Guide. During the meeting staff stated that
they were creating an onboarding policy for new commissioners. Attachment A is the proposed
draft policy. The intent of the policy to provide an outline for staff when onboarding a recently
appointed commissioner. The goal of the policy is to provide new commissioners with the
necessary information to succeed at their position.
Discussion:
Staff is looking for Council direction and feedback on the attached Planning Commissioner
Onboarding Policy.

Onboarding Planning Commission Policy
Policy Statement:
The Arden Hills Community Development Department is committed to equipping recently
appointed Planning Commissioners with the necessary information to assist them in succeeding
at fulfilling the function of the City's Planning Agency.
Scope:
This policy is intended to guide staff when onboarding a recently appointed Planning
Commissioner.
Procedure for Onboarding Planning Commissioners:
It is the planning staff’s responsibility to host an orientation session within one (1) month after
appointment and prior to the commissioner’s first Planning Commission meeting. During that
meeting staff shall outline their roles and responsibilities of being a Planning Commissioner. They
should also be provided with the resource materials needed to succeed, such as, local ordinances,
maps, etc.
Provided below is a list of items that should be covered in the orientation sessions:
1. Brief review of the community’s Comprehensive Plan.
2. Review the pyramid of discretion.
3. Explanation of the structure and workings of the zoning ordinance.
4. Review of the subdivision regulations.
5. Discussion of other land use controls enforced in the community (shoreland management).
6. Review of commission agendas and minutes.
7. Review samples of Planning Commission reports/memos.
8. Review policies on conflict of interest and Minnesota Open Meeting Law.
9. Tour of the community.
