Motions to approve, table, or deny the following:
• Resolution 2021-067 Declaring a Vacancy on the City Council
All items require a simple majority unless otherwise noted.
Discussion
Councilmember Dave McClung passed away on December 1, 2021 thus creating a vacancy on the
City Council. This vacancy will need to be filled by Council appointment until an election is held.
Since more than two years remain in the unexpired term, a special election will be held at the next
regular City election (November 2022). The appointed person shall serve until the winner of the
special election term begins on January 1, 2023.
The attached resolution will officially declare the vacancy, and Staff will move forward with the
recruitment process. Unless otherwise directed by Council, Staff will be accepting applications
through December 29th and interviews will take place the first week of January.

STATE OF MINNESOTA RESOLUTION NO. 2021-067
RESOLUTION DECLARING A VACANCY ON THE CITY COUNCIL
WHEREAS, on December 1, 2021, City Councilmember Dave McClung passed away; and
WHEREAS, under Minn. Stat. § 351.02 an elected office becomes vacant on the death of
an incumbent; and
WHEREAS, more than two years remain on Councilmember McClung’s unexpired term;
and
WHEREAS, pursuant to Minn. Stat. § 412.02 subd. 2a, the Arden Hills City Council is
required to fill the vacancy on the City Council by appointment until the qualification of a successor
elected at a special election to fill the unexpired portion of the term held on or before the next
regular City election.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden
Hills:
1. A vacancy is declared to exist on the City Council created by the death of
Councilmember McClung.
2. Pursuant to Minn. Stat. § 412.02 subd. 2a, the Council will appoint a person to fill the
vacancy until the qualification of a successor elected at a special election to fill the
unexpired portion of the term held on or before the next regular City election.
