Dear Ms. Blomberg:
As we discussed on the phone, on November. 25 the Arden Hills Council
approved having the Park Fui.,, be a recipient of funds derived from the
pull-tab operation at the Blue Fox Inn, subject to approval by the
City Attorney.
On December 16, the Council concurred with the attorney's recommendation
that we obtain a letter from You stating that:
1. The City Park Fund is a recipient of some of the proceeds derived
• from your operation at the Blue Fox Inn.
2. The City is not a partner or a Joint venturer with St. Joseph's.
3. The City is in no manner involved in conducting the pull-tab opera-
tion.
4. St. Joseph's agrees to indemnify, defend and hold the City harmless
against any and all claims which might be asserted against the City
or accrue to it as a result of being the recipient of funds from the
pull-tab operation.
Lastly, the letter should state that St. Joseph's understands that the
City is becoming involved as a recipient of proceeds from the Blue Fox Inn
pull-tab operation conducted by St. Joseph's in reliance upon representa-
tions made by St. Joseph's.

At the meeting on April 8th, the Arden Hills Council
unanimously approved the gambling license for St.
Joseph's Society for the Little Sisters of the Poor
at Blue Fox-Inn, 3833 N. Lexington Ave. The Council
also waived the thirty-day waiting period so that
sales could begin immediately.

Re: Pull-Tabs at Blue Fox Inn
Dear Charlotte:
At your request, I have reviewed Chapter 349 of
Minnesota Statutes to determine whether the City is a valid
recipient of funds derived from a pull-tab operation to be
conducted on the premises of the Blue Fox Inn and what, if any ,
responsibility or liability the City will have in connection with
such operation as a result of its being a recipient of such
funds.
Section 349. 11 of Minnesota Statutes , as amended, says
that the purpose of Chapter 349 is, among other things , " . . . to
provide for the use of net profits only for lawful purposes. "
The term "lawful purpose" is defined in Section 349. 12 , Subd. 11
to include, in pertinent part, " . . . lessening the burdens borne
by government or voluntarily supporting, augmenting or
supplementing services which government would normally render to
the people . . . " . The term, however, does not include
the erection or acquisition of any real property, unless the
board specifically authorizes the expenditures after finding that
the property will be used exclusively for one or more of the
purposes specified in this clause. " Section 349 . 15 provides that
profits from a pull-tab operation may be utilized only for
"lawful purposes" as authorized at a regular meeting of the
conducting organization.
In light of the foregoing, the City may be the
recipient of proceeds from the pull-tab operation so long as
those proceeds are to be used to lessen the burdens of government
or in supporting, augmenting or supplementing services which

government normally renders. Query whether the City ' s placement
of the proceeds in its Parks and Recreation Fund fits within this
"lawful purpose" . It could be argued, I suppose , that the monies
deposited in the Parks and Recreation Fund will be used for the
erection or acquisition of real property , and, therefore, the
monies derived from the pull-tab operation would not be used for
a "lawful purpose" . I think that the more persuasive argument is
that the placement of monies in the City ' s Parks and Recreation
Fund will lessen the burdens borne by the City and augment and
supplement the recreation services which it renders to its
citizens . The acquisition of real property for parks out of the
Fund would be an indirect, not direct, use of the funds derived
from the pull-tab operation.
Acting conservatively, the City may wish to obtain the
written approval from the Minnesota Charitable Gambling Control
Board of its use of the proceeds from the pull-tab operation.
• The "lawful purpose" exception mentioned above (i.e. , "lawful
purposelldoes not include the erection or acquisition of real
property) can be overcome if the Board authorizes the expenditure
and placement of funds as the City proposes.
As to whether the City will be responsible or liable
for the operation, I could find nothing in Chapter 349 which
creates any liability for the City. It is merely a recipient of
the proceeds. It will not be conducting the operation.
Again , if the City wishes to be cautious , it perhaps
should obtain a letter from St. Joseph' s Society for the Little
Sisters of the Poor which states that the City is merely a
recipient of some of the proceeds derived from St. Joseph' s
pull-tab operation at the Blue Fox Inn , is not a partner of
St. Joseph' s or a joint venturer with it, and is in no manner
involved in conducting the pull-tab operation. The letter should
also state that St. Joseph' s agrees to indemnify, hold harmless
and defend the City against any and all claims , suits, actions ,
judgments , charges and fees , including attorneys ' fees and costs ,
which in any way might be asserted against the City or accrue to
it as the result of its being a recipient of funds from the
pull-tab operation. Lastly , the letter should state that
St. Joseph' s understands that the City is becoming involved as a
recipient of proceeds from the pull-tab operation conducted by
St. Joseph' s in reliance upon the representations made by
St. Joseph' s in the letter.
