Ahmed Ali (“Applicant”) is seeking feedback from the City Council on flexibility for parcel access from City right-of-way, front and rear setback distances, and nonconforming lot size due to lot depth. The Concept Plan Review process is an opportunity for the City Council to provide comments and questions regarding proposed developments. A concept review is considered advisory and is nonbinding to the City and Applicant (Section 1320.14, Subd 4 of the Zoning Code). No formal action can be taken at a Work Session. A formal application will be subject to the full review process, including a public hearing with Planning Commission and City Council review. The Applicant would like Council feedback ahead of the Planning Commission meeting to allow for changes to the application if necessary. Background At the August 16, 2021 Work Session, the Arden Hills City Council first discussed selling the city-owned parcel at 3588 Ridgewood Road—now the Subject Property of this planning case. At the subsequent meeting, the Planning Commission reviewed the interest in selling the parcel for consistency with the City’s Comprehensive Plan. The City has verified that the parcel is not dedicated for a public purpose that would prohibit the sale (i.e. park land or public Page 2 of 5 improvements) or as a site for future development to meet the needs of city infrastructure or operational activities, and it was found that the sale of the Subject Property would be in compliance with the City’s Comprehensive Plan. During the discussions, the City was evaluating the parcel size based off of Ramsey County Property Records and GIS mapping as there was no Certificate of Survey on record for the Subject Property. Ramsey County Property Records have the deeded acreage as 0.31 acres (approx. 13,500 square feet). The Subject Property came from the State through the County as part of the turnback of the old Snelling Avenue corridor ROW to the City. Based on the best information available from Ramsey County, city staff initially identified that the total lot area of the parcel would be nonconforming since the minimum lot area requirement in the R-1 District is 14,000 square feet. A preliminary analysis of lot dimensions was completed as part of the Planning Commission review utilized the County’s GIS mapping in order to garner the approximate lot width and lot depth. The parcel is an irregular shape and the following table was a preliminary analysis of the lot size as it compares to the minimum R-1 District Standards: Total Lot Area Lot Width Lot Depth Zoning Code R-1 District 14,000 square feet 95 feet 130 feet 3588 Ridgewood Drive Approx.13,500 square feet (0.31 acre) Approx. 100 feet Approx. 99 feet to 115 feet Over the next year, city staff worked through the process to facilitate the sale of the Subject Property. On August 8, 2022, the City Council approved the purchase agreement for the Subject Property from Ahmed Ali and Nawal Hirsi. The purchase agreement included an acknowledgement of the Applicant’s responsibility for all costs associated with due diligence which includes the variance review due to the nonconforming lot size. As part of the due diligence via a survey, it was determined that the lot measured approximately 14,472 square feet, and would not require a variance for lot area but would require a variance for lot depth. Discussion The Subject Property is zoned R-1, Single Family Residential District. It is designated for Low Density Residential in the 2040 Comprehensive Land Use Plan. All surrounding parcels are also zoned R-1, Single Family Residential District and designated for Low Density Residential Uses in the Land Use Plan. The Applicant is requesting feedback on three variance requests ahead of the Planning Commission meeting on November 9, 2022. The variances are requesting flexibility on the location of the driveway access point, the front and rear setbacks, and the nonconforming lot size due to lot depth. Page 3 of 5 The listing agreement did specify that a variance would be necessary due to the nonconforming lot size. The real estate agent representing the City included in the listing language that the Future Buyer would need to provide documentation including, but not limited to, a Certificate of Survey, elevation renderings, and floor plans in order to verify compliance with applicable city code requirements such as setbacks, lot coverage, floor area ratio, and other design standards with the proposed development as part of the variance review process. Additionally, it was stated in the listing that a driveway would need to be established by the Future Owner and city code would require the property to be accessed via Ridgewood Road. City staff has had several conversations with Mr. Ali to assist him in preparing the variance application as well as restating the minimum city code requirements for future development of the Subject Property. Lot Size and Dimensions Section 1320 – District Provisions of the Zoning Code requires a minimum lot size of 14,000 square feet per single-family dwelling unit and a minimum depth of 130 feet. The Applicant did obtain a Certificate of Survey which verified that the total lot area of the Subject Property is 0.33 deeded acres (14, 472 square feet), but the lot depth has a mean depth of 97.4 feet. The Applicant is requesting a 32.6 foot lot depth variance to address this nonconformity in lot size. The lot size from staff’s initial analysis would require a variance prior to future development as confirmed by the City Attorney. From the recent survey completed by the Applicant, the City identified that the total lot area of the parcel is slightly larger than the property information available on the County records. City staff contacted Ramsey County and it was their direction to use the boundary dimensions and lot area calculations as shown on the official survey as this document was prepared by a licensed surveyor. They indicated that the County’s GIS map is only an inventory of tax records based upon the best available information. Certificate of Survey Page 4 of 5 Driveway Access Section 1325.06, Subd. 1 (B) – Access of the Zoning Code requires “any residential lot, which has frontage on both a local street and a collector street or a major or minor arterial (as defined by the Comprehensive Plan of Arden Hills), [to] gain access only from the local street.” The Applicant is requesting a variance from this provision to construct a future driveway off Snelling Avenue—a collector street, instead of Ridgewood Road—a local street. As proposed, the driveway off of Snelling Avenue would have a 10% slope. The Applicant has stated that from the street to the garage there is an elevation change of 20 feet which would make it a safety concern to have their driveway access off of Ridgewood Road. Structure Setbacks In the R-1 District, the minimum front and rear setback requirements are 40 feet and 30 feet, respectively. The minimum side yard setbacks on an interior lot are 10 feet on each side with a combined total side yard setback of 25 feet. The Applicant is requesting a 17 foot front-yard setback variance—abutting Ridgewood Road —to allow a future dwelling to be built 23 feet from the front property line. The Applicant is also requesting a 15 foot rear-yard setback variance—abutting Snelling Avenue—to allow a future dwelling to be built 15 feet from the rear property line. The Applicant is not requesting a side yard setback variance. This parcel by definition is considered a through lot because it has “A pair of opposite lot lines on two substantially parallel streets and is not a corner lot. On a through lot, the determination of whether the street frontage is to be considered a front yard or rear yard shall be as subject to the provisions of this Code.” Section 1325.03, Exceptions to the Minimum Requirement for All Districts states for a through lot that “The administrator may determine that one of the front yards may be deemed a rear yard and shall determine appropriate rear yard setback regulations. Factors to be considered shall include topography, location of structures on the lot, location of structures on adjacent lots, and the type of streets or thoroughfares abutting the lot.” Preliminary Analysis of factors: • There are no existing structures on the lot to be used in evaluating orientation for determining the front or rear yard. • The adjacent structure to the north faces east towards Snelling Avenue and the structure to the south faces west towards Ridgewood Road. • Ridgewood Road is a local road and as required by city code this would be the designated roadway to obtain access to the Subject Property. • In comparison to a corner lot, the city code states the shortest street lot line is the front lot line. From the analysis of city code and factors to consider on a through lot, city staff has determined the front yard of this through lot to be Ridgewood Road because it is abutting the local roadway with the shortest street lot width, and Snelling Avenue to be the rear yard as the lot line most nearly parallel and most remote to the front lot line. Before finalizing the design of a future structure on the Subject Property, the Applicant is looking to receive City Council feedback on the current variance request. The Applicant will finish the design of a future structure depending on the outcome of the variance request. The Certificate of Survey identifies the proposed house footprint would equate to 15.4% structure coverage (max allowed 25%) and 23.2% impervious (max allowed 35%). Budgeted Amount: Actual Amount: Funding Source: N/A N/A N/A Council Should Consider Council should consider a request for a Concept Plan Review for a proposed variance at 1861 Highway 96 West (“Subject Property”) to demo and rebuild a single-family residential dwelling. Katie Bach and Nate Cmiel (“the Applicants”) are seeking feedback from the City Council on the concept plan in advance of the full submission. The variance portion of the concept plan review is due to a reduced front yard setback of 28 feet versus 40 feet as required by city code. The Concept Plan Review process is an opportunity for the City Council to provide comments and questions regarding proposed developments. A concept review is considered advisory and is nonbinding to the City and Applicant (Section 1320.14, Subd 4 of the Zoning Code). No formal action can be taken at a Work Session. A formal land use application for the minor subdivision and variance will be subject to the full review process, including a recommendation from the Planning Commission prior to a final decision by the City Council. Background The Subject Property is currently developed with a single-family residential dwelling (727 SF) and detached garage (584 SF). The dwelling was constructed in 1939 and the detached garage was added in 1961. The original legal description for the subject property has a described property boundary of 1.0689-acres (46,561 SF). Between 1949 and 2014, there have been four acquisitions of land by the State of Minnesota and Ramsey County for highway right-of-way purposes. As a result of the ROW dedication, the parcel size has been reduced to 0.62-acre (27,098 SF) as shown on the survey provided. The reduction in lot area due to the dedication of ROW is primarily along the north and northeast sides of the property which is considered to be the front yard for the Subject Property. Today, the property is considered legal nonconforming with a front yard setback of 25 feet as measured from the northeast corner of the home. Page 2 of 5 The Applicants are proposing to demolish the existing structures and rebuild one principal structure (i.e. single family dwelling with attached garage) on the Subject Property. In considering the city code requirements and environmental features of the property, the Applicants have determined the most suitable location to rebuild would be to shift and orientate the new structure south/southeast of the current structure location. The new home location would require a variance to allow a front yard setback of 28 feet versus 40 feet as required by city code. The Applicants have indicated an intention to comply with all other applicable city code requirements which would include the zoning requirements for the R-1 Zoning District (i.e. structure coverage, FAR, impervious surface, etc.) and Shoreland regulations. Discussion Existing Conditions The Subject Property from the survey provided is a 0.62-acre (27,098 SF) parcel located on the north side of Round Lake, west of the Highway 96 and Old Highway 10 intersection. The property is zoned R-1, Single Family Residential District and is guided as Low Density Residential (LDR) in the 2040 Land Use Plan. The chart below identifies the adjacent land uses. They’ve enlisted the services of an architect to help with the design of their house plans. The Applicants have stated in their application that there are several factors of the lot that the City Council is asked to consider in reviewing the proposed variance: • Irregular lot shape causes 40’ front setback to be applied on north and northeast sides, greatly reducing buildable lot area • Current home is nonconforming (25’ setback) • Need to maintain existing driveway location and grade • Low elevation in south part of lot would restrict basement due to lake ordinary high water height • Large mature trees restrict home placement options • Guidance to allow 20’ clearance from foundation during construction • One large cottonwood will be removed For the concept review, the Applicants have submitted a Certificate of Survey identifying the proposed new house location. At this stage, the Applicants are seeking City Council feedback on the variance in advance of developing civil plans, house floor plans, and renderings. The distances as stated above are based upon the distances identified on the survey as measured from “Shoreline”. One additional item in further review of the concept plan, city staff identified using Ramsey County GIS map that the adjacent lot to the east may have a greater setback of approximately 175 feet from OHW. The City’s shoreland regulations does require new development and additions on a riparian lot to have a setback from OHW as measured in relation to adjacent lots. Example: 175 feet (adjacent parcel setback) – 10 feet = 165 feet is average Planning staff verified that the City does not have a Certificate of Survey on file for the adjacent property at 4549 Lakeshore Place. The Applicants would be required to provide evidence of the setback from OHW for the adjacent lot in order to verify compliance with Section 1330.03, Subd. 4 as part of their future land use application or apply for a second variance from this provision if their new dwelling would be less than the minimum requirement. 890 OHW elevation Approx. 175 ft. On any shoreland lot where the adjacent lots have existing dwellings that exceed the minimum setback from the OHW level, the shoreline setback for a new dwelling unit or an addition to an existing dwelling unit shall not be less than the average of the setbacks from the OHW level for such adjacent dwellings minus ten (10) feet subject to the following: A. In no case shall the new structure or addition be within the minimum setback from the OWH level as stated in Section 1330.03 Subd 1. B. In no case shall the new structure or addition be nearer to the OHW level than the nearest adjacent structure. C. The minimum structure setback in Section 1330.03 Subd. 1 shall be used for the adjacent lot when calculating the setback if an adjacent lot is: 1. Vacant; 2. The existing home was built in 1939 by Frank Cmiel, Nate’s grandfather, and has housed 5 generations of the Cmiel family. We love the property location and setting on Round Lake, and want to continue maintaining the family home here, but the house is in need of major updates to bring it to modern standards for comfort, energy efficiency, and safety. After assessing many options and consulting with an architect, we have determined that renovation/expansion of the existing structure is not practical, and instead that a tear-down and rebuild is the only practical and cost- effective way to achieve a modern family home, built with newer energy efficient construction materials and methods. One of the most desirable features of our property is the many mature oak, maple, spruce, and cottonwood trees which were planted by family members many years ago and now provide shade, screening, foliage, and wildlife habitat. One of our top priorities is to preserve as many trees as possible when considering the placement and design of our new home. After brainstorming and reviewing concepts with an architect, we have determined that a variance against the front setback requirement will most likely be necessary due to the unique irregular lot shape, tree placement, and elevations on the property which restrict options for new home placement. The new home proposal is in keeping with the character of the neighborhood, where the closest neighboring homes are non-conforming to the 40’ front setback required by the city zoning code. In fact, the new home proposal results in moving the house further back than the existing structure, and generally meets the 40’ setback requirement, in keeping with the spirit of the zoning code. One of the most desirable features of our property is the many mature oak, maple, spruce, and cottonwood trees which were planted by family members many years ago and now provide shade, screening, foliage, and wildlife habitat. One of our top priorities is to preserve as many trees as possible when considering the placement and design of our new home. After brainstorming and reviewing concepts with an architect, we have determined that a variance against the front setback requirement will most likely be necessary due to the unique irregular lot shape, tree placement, and elevations on the proper ty which restrict options for new home placement. The new home proposal is in keeping with the character of the neighborhood, where the closest neighboring homes are non - conforming to the 40’ front setback required by the city zoning code. In fact, the new home proposal results in moving the ho use further back than the existing structure, and generally meets the 40’ setback requirement, in keeping with the spirit of the zoning code. Public Works Director / City Engineer SUBJECT: Floral Park Improvements Budgeted Amount: Actual Amount: Funding Source: $606,000 – Floral Park $TBD PIR – Parks Council Should Consider • Moving forward with the Floral Park Improvements • Replace existing park shelter • Amending HR Green contract for professional services Background/Discussion The Floral Park playground structure was built in 2001, through the City’s Park Maintenance Management Plan, park equipment is to be considered for replacement on a 20-year cycle. Within the 2023-2027 CIP, Floral Park is programmed for improvements in 2023. City staff has inspected Floral Park, Council should review Attachment B which provides pictures for reference. Also, within the 2023-2027 CIP, the shelter at Floral Park is budgeted to be replaced. Recommended Improvements: Replace the play structure: The structure will be 22 years old in 2023, through inspection there are visible signs of deterioration of the protective rubber coating around the structure. The mulch and the containment timbers are beginning to rot. City staff has received some complaints from users of the equipment that they would like to see repairs or replacement. Rehabilitation of the bituminous trail loop: About 1000-feet of trail are recommended by staff to rehab by reclamation and paving. Looking at the history of maintenance activities, this trail segment received a slurry seal about ten years ago to extend the useful life. Through inspection, Page 2 of 3 City staff has determined that the trail’s current condition is beyond simple preservation methods and needs a full rehabilitation with new pavement. Shelter replacement: The existing shelter roof is damaged from an incident with Public Works maintenance equipment, poor placement of the shelter has the roof overhanging the path. The structure has a poor roof design, the sheets are corrugated horizontally which collects fallen leaves, branches and holds water which then accelerates the structure to rust and is a maintenance nuisance. Staff recommends replacing with a 16’ x 16’ structure, similar to Attachment C. The new structure would reuse the existing concrete pad, it would be shifted away from the trail and the extra concrete pad space would be ideal to add grills. Water Source: Currently, the Community Gardens utilize water barrels as a water source that Public Works routinely fills. City staff has received comments that an alternate water source such as a pumping well is desired. Staff received a quote to install a well which came to about $25,000 to $30,000. The well depth would have to be about 160-feet to 200-feet deep which means it would take about 40 pumps before water emerged. The other option staff would look into is to tap into the existing watermain off of Royal Lane, this option would be reviewed during design. These are a few of the improvements City Staff recommends, other improvement ideas will be gathered from residents through surveys and an open-house event. Staff is requesting Council discuss moving forward with improving Floral Park with the anticipated timeline of being constructed in 2023. On November 22, 2021, Council approved a professional services agreement (PSA) with HR Green to provide the design and public engagement for the Floral Park Hardcourts. Staff has asked HR Green to submit a proposal to amend the existing PSA to include the improvements as presented in this item. The proposal to add on the Floral Park Improvements is $51,803. With Council direction, the PSA amendment would be put on consent for approval at the next regular council meeting. Background The City currently has a vacancy for a Recreation Supervisor, and is currently in the process of trying to fill the position. A verbal update will be given regarding the status of this position at the worksession. Having the vacancy creates some short-term gaps for staffing, while other departments have been doing a great job of assisting with ongoing functions some decisions will need to occur around ice rink staffing and winter programming. The City typically puts out its Winter Recreation Guide in mid-November, this allows both City Staff and residents to plan appropriately. The 2021/22 Recreation Guide is attached for reference. We could delay the Winter Recreation Guide to later in November or even early December, but we still need to plan appropriately and want to be able to provide a realistic level of service. In working with the Public Works Department, as Recreation technically falls under their purview, Staff is seeking direction from Council either to go ahead and make these decisions administratively or have Council provide further direction on winter programming. Ice Rink Staffing Pre-COVID, the City would work to staff four ice rinks: Hazelnut, Cummings, Perry and Freeway Park. The staffed hours would typically be 4:30 pm to 8:30 pm Monday thru Friday, 12:00 pm to 8:30 pm on Saturday, and 1:00 pm to 7:00 pm on Sundays (Cummings was only staffed on Fridays and the weekend). Depending on the number of seasonals available to work, the City would have hired between eight and ten people to work as ice rink attendants. Their duties include unlocking and locking the warming houses, turning the lights on and off, shoveling rinks, and other maintenance duties for the warming house. For 2020/1, we did not hire any rink attendants and put Page 2 of 3 picnic tables near the rinks and a porta-potty for use. For 2021/2, we did hire ice rink attendants but they worked limited hours and access to the warming houses were limited, too. The rinks typically open in December and close mid-February, but it is weather dependent. Currently, we only have three applicants for the rink attendant positions, the posting closes November 30th. None of the current applicants appear to be returnees from previous years. While getting enough applicants is part of the issue, the other piece is the training and supervising of these seasonal staff. Ideally, we’ll have the new Recreation Supervisor on-board by mid-November and they could take over these duties, but they’ll be learning the job along with the new seasonals. Lastly, our previous Recreation Supervisor anecdotally noted we have had issues with rink attendants previously, such as, not locking the buildings, not showing up for shifts, or leaving the rink lights on. Staff has discussed options and is considering the following (staff recommends either the first or second option): -Not having the warming houses open and putting picnic tables and porta-potties out for people that use the rink. The negative is obviously the warming houses won’t be open for the public to use, the benefit is we do not need to manage additional seasonal staff and then would also not need to order the temporary warming house Hazelnut Park (approx. $5,000 to $6,000). -Another option considered is having a Public Works Seasonal employee during the winter. They could act as a roving ice rink attendant, opening the warming houses, turning lights on, shoveling the rinks. This person could also assist with flooding rinks and other winter duties, such as, City Hall snow removal and trail plowing. This would be contingent on the seasonal working a different schedule (afternoons/nights and weekends), and if they were absent a day we may not open the warming houses. If we were to go this route and hire someone for about four months it would cost around $11,520, the typical total ice rink attendant cost is around $10,000. -The last option discussed is proceeding with the normal rink attendant plan and try to hire enough attendants and schedule them accordingly. Staff will do our best to accommodate and schedule accordingly, but we’ll need to be clear in the rec guide and other publications that warming houses will be open based on staffing, and we cannot guarantee availability. Winter Recreation Programming The other item needing discussion on is winter programming, this mostly comes down to timing of communication and getting a new Recreation Supervisor hired. We have reviewed programming and believe we can continue with many of the outside instructor led classes, such as, fencing, yoga, dance, etc. However, the programming that requires seasonal hiring, training, and oversight present an issue. Again, while we are hopeful we’ll have a Recreation Supervisor on-board by mid- November, we still need to work on the development of programming that starts the beginning of January. This mainly consists of before and after school programming, camps, one-time events (snowshoeing), and ice skating lessons. If we are going to continue these programs, we would need to start looking for seasonals late October and early November; however, we would need to identify and have these programs planned for a Winter Rec Guide. It should be noted for the before and after school programming, Shoreview runs programming at Island Lake and we typically share their info in our Rec Guide, but we run the program at Valentine Hills. If we didn’t offer one it would only be the Valentine Hills program, assuming Shoreview lets us continue to advertise their Page 3 of 3 program at Island Lake. Also, it should be noted that the we did not hold any winter after school programs in 2022 as they did not meet the minimum requirement of six participants. For ice skating, we had 17 participants this past winter. Staff would recommend we forego the classes this winter that we cannot effectively plan for, such as, before and after school programming at Valentine Hills and skating lessons but we would continue with the outside instructor led classes. We would also not plan on holding events, such as, gingerbread house decorating, letters to Santa, or breakfast with Santa. For reference Attachment B and Attachment C give a listing of the classes from November through March, Attachment B is classes that were held while Attachment C is classes that were cancelled likely due to low enrollment but could have been for other reasons. Please be aware that it is likely the November and March months might be picking up fall and spring classes, winter classes typically start in December, January, or February. Once Staff is able to make decisions regarding programming, or Council gives sufficient direction, we can craft the Winter Recreation Guide. Depending on offerings, we may make this Winter Rec Guide a smaller insert into the newsletter or it could be a standalone mailing. Budget Impact There will be a budget impact on the General Fund as all Recreation revenues and expenditures flow throw the General Fund, but exact impacts will not be known until decisions are made on programming. It should be noted that winter programming does not represent a significant portion of the budget, as most programming happens in the summer months.
