Public Works Director / City Engineer John Morast and Thomas Jantscher — HR Green SUBJECT: Arden Manor Park & Floral Park Improvements Budgeted Amount: Actual Amount: Funding Source: $606,000 — Floral Park $899,895 CDBG Funds, PIR — Parks $249,700 — Arden Manor Council Should Consider • 95% Design Plans for Arden Manor Park and Floral Park Project cost estimates • Play structures and amenities • Color scheme choices Background On April 12, 2021, City Council approved Resolution 2021-017 supporting the City's application for a CDBG funding opportunity for Arden Manor Park. At a Work Session on November 15, 2021, Council discussed the proposed improvements at Arden Manor Park and Floral Park Hardcourt. At the November 22, 2021 Council meeting, the PSA with HR Green was approved to design and construct Arden Manor Park and Floral Park Hardcourt. On October 24, 2022, Council approved the PSA Amendment with HR Green to add the Floral Park playground structures and park equipment to the overall project. Since then, HR Green has conducted public engagement by surveying the nearby neighborhoods and hosted an Open -House event at City Hall. Using input from the residents and of City Council, 95% Design Plans (Attachment B) along with the play structures and amenities (Slides 7 through 10 in Attachment A) have been developed. Page 1 of 3 Discussion Council should review the 95% Design Plans along with the estimated costs (Attachment C) and provide feedback to HR Green for the amenities and improvements. Council should also discuss the desired color options related to the shelters and play structures. Remaining Schedule: a'. - May 22 City Council meeting: approval to order playground and shelter equipment, approval to bid May 25 Project advertised June 5 Bid opening June 12 City Council meeting: accept low bid, award construction contract June 19 Construction contract signed, construction begins End of Oct. Construction complete Budget Impact The project funding is provided below: Funding Arden Manor Park: CDBG Program $ 189,700 City PIR - Parks $ 60,000 Total $ 249,700 Floral Park: City PIR - Parks $ 606,000 Total $ 606,000 Per CIP: Roof work $ 30,000 Play structure $150,000 Hard courts $426,000 Primary elements of improvements at each park are play structure replacement, play structure container replacement, hard court rehabilitation, trail improvements, ADA improvements, shelter improvements and other amenities. HR Green Contract $ 124,030 Arden Manor Park Construction $ 378,044 Floral Park Construction $ 397,821 Tota I $ 899,895 The estimated cost is $44,195 over the total budgeted amount for both parks. Possible impacts of this overage on future CIP projects won't be known until a draft 2024-2028 CIP is completed. Any half number between 9 and 2 can be used to score. A one (1) is given to a disqualification and requires approval of event coordinators. 5. Each team will have two "turn in" boxes, one for ribs and one for chicken. A minimum of 6 individual ribs and 6 individual thighs are to be turned in for judging. The "turn -in" boxes will be provided by event staff. 6. Garnish is optional and must follow KCBS rules for allowed garnish. 7. No marking, bending tabs, identifying marks of any kind or sculpting of the meat or "turn -in" box will be tolerated. No side sauce containers, pooling, or any other foreign objects such as foil, toothpicks or skewers are allowed in the "turn -in" box. Failure to comply with this rule will result in disqualification. 8. The public will be welcomed to visit your space and trade one ticket for one rib. (No cash taken by teams.) 9. The public will vote on their favorite rib. The team that acquired the most votes from the public (per special ticket) will win the People's Choice Rib Award, 1st 2nd & 3rd place will be awarded. 10. A team will consist of one (1) head cook and up to 6 assistants as the head cook deems necessary. Head cook must be 18 years of age or older. 2. At least ten (10) racks of ribs and eight (8) chicken thighs will be provided by the event hosts and will be distributed the morning of the event. No outside meat may be used for judging. 3. Ribs and chicken must be cooked and seasoned on site within the confines of your team's assigned cooking space. May be seasoned, sauced or not, and cooked in a manner you feel will deliver a competitive product in the time allowed. 4. Cooking may begin immediately following the meat distribution. 5. Each team should have Team Name displayed for People's Choice. 6. At their discretion, teams are encouraged to furnish tasting samples (other than ribs) to the public throughout the day. No money may be taken. 7. Wood, charcoal, pellet, or smoker type barbeques are allowed. Gas grills, electric ovens, gas, or solar ovens are not allowed. Propane will only be permitted to start fires. 8. Contestants may not dig pits and fires are not allowed on the grounds. 9. Ash and grease barrels will be available for teams to dispose of after cooking. 10. A 16' by 20' space will be assigned to each team. (We will try to accommodate more space if needed.) 11. ABSOLUTELY NO MOTORIZED VEHICLES will be allowed to remain in the contest area. Trailers MUST be removed from the tow vehicle and vehicle MUST be removed from the contest area (NO EXEPTIONS). 12. Each team is responsible for providing ALL their own supplies: tables, chairs, utensils, ingredients, etc. 13. Generators will be allowed upon event approval. They are not to disturb neighboring teams or public. No other electricity will be available. Set Up, Cleanliness, and Safety Rules: 1. Cleanliness of the cooks, assistant cooks and work space is required. 2. Pants/shorts, shirts and shoes must be worn by all team members at all times. 3. No use of tobacco products while within any contestants cooking area. 4. Each booth shall have a canopy, cover, pop up awning roof to prevent weather or debris from overhead. 5. Surface area in food prep area shall be cleaned using only disposable sanitary cloths or wipes. 6. All cooking grills, smokers and food prep areas shall be positioned out of reach or access to public. 7. Each cooking booth shall have a waste can plastic bagged lined. 8. No good kept in coolers shall be submerged in water. Must be kept at safe food temperatures based on Food and Drug Requirements. 9. No motorized vehicles are allowed in cooking booth areas. Food trucks or delivery personnel will be allowed based on prior approval from the Ribs for the Ribbon Committee. 10. All unloading shall be completed no later than 8:00 am the morning of the event. 11. Each team shall supply its own ice and water. Hand wash stations will be available onsite for public use. 12. At the PTRC Meeting on April 18, 2023, the Committee made the following motions: A motion was made by Committee Member Poelzer and seconded by Committee Member Nelson that PTRC recommends the City Council accept a $5,000 donation and volunteer work from Boston Scientific for the purpose of building dog agility equipment at Perry Park. Chair Hinton amended the motion to say the City should accept the donation and the equipment be installed on the side of the park that might become the large dog area if it were split, and they look at community input on whether they'd like the park split into large and small dog areas. Committee Member Rogers seconded the amendment. The motion passed unanimously. Page 1 of 2 Committee Member Poelzer researched equipment that would fit within the donation's budget with the City's regular play equipment vendor, Minnesota Wisconsin Playground. One suggestion that was offered for consideration was their Bronze Package (detailed in Attachment A). However, the total cost of this package is $5,523.00, including freight fees (detailed in Attachment B). Lastly, the Bronze Package includes some equipment selections and color selections that need to be discussed and decided upon in the future. The final equipment selections have not yet been discussed by PTRC. Discussion If this donation and volunteer work is accepted by Council and used on Perry Dog Park equipment, initial comments from Public Works would note that upkeep and maintenance would be the responsibility of the City as once the equipment is installed, the City would take ownership. INTRODUCTION The city council is being asked to consider the adoption of ordinance no. 1o16 to amend section 3o8 regarding youth representatives on the human rights commission. Section 3o8 of the city code establishes the human rights commission and outlines their role, composition, and terms. Section 3o8.020 outlines how many members can be on the commission, including youth representatives. The commission has had youth representatives since 1996. The rules for them have changed a few times since then. Below is a summary of each ordinance amendment: Ordinance 659, approved June 17, 1996 — Added language to allow for one student representative to serve as a non -voting member Ordinance 668, approved April 7, 1997 — Amended the language to give the student representative voting rights. Added language that requires them to be a high school sophomore, junior or senior and attend two meetings before being appointed Ordinance 812, approved March 19, 2007 — Amended the language to allow for multiple student representatives with no voting rights. Added language that allows student representatives to be non-residents. Was amended due to the city council requesting student representatives from both Mounds View and Irondale high schools. The bikeways and trails committee, environmental quality committee, and parks and recreation commission also allow for student representatives. DISCUSSION The commission currently has three youth representatives from both Mounds View and Irondale high schools. Since 2007, they have had a mix of residents and non-residents serve as youth representatives. Earlier this year, the human rights commission discussed the youth representatives and their voting role. They are recommending that the city council approve ordinance no. lo16 amending section 3o8.020 to allow for youth representatives to have voting privileges and be non-residents. Below is a summary of their discussion from their March 1 and 22 meetings. Voting rights The majority of youth representatives, current and past, have been highly committed and engaged and provide an important point of view for the commission's discussions and programs. Given this, the commission agreed that they should be able to vote on actions that they are providing guidance on. Residency requirements Three high schools serve Shoreview: Roseville High School, Mounds View High School, and Irondale High School. For Roseville and Irondale, the majority of the students are not Shoreview residents. However, a youth representative from them is still providing a voice for the entire student body. This is important for the commission as they try to create programs that will reach high school students. Since it is important to the city that our youth representatives are from high schools that serve Shoreview, the commission felt that they should not be required to be residents. This is similar to the economic development commission in terms of business representatives. A business representative does not need to be a resident as long as they work for a Shoreview business. Number The commission would like to have two to three student representatives at all times. Given this, they would like to increase their membership to nine to eleven. RECOMMENDATION It is recommended that the city council adopt ordinance no. 1016, amending chapter 300, council and administration, section 308, human rights commission. ATTACHMENTS Ordinance 1016 K CITY OF SHOREVIEW ORDINANCE NO.1016 AN ORDINANCE AMENDING SECTION 308, HUMAN RIGHTS COMMISSION The Shoreview City Council ordains that Section 308 of the Shoreview Municipal Code is amended to read as follows (New language is underlined and highlighted red; strieken text is prepesed fer eleletien): 308 Human Rights Commission 308.020 Establishment and Composition. There is hereby reestablished a Human Rights Commission of the City of Shoreview. The Commission shall be composed of nine (9) to eleven (11� members and shall be advisory to the City Council. The City Council may, at its own discretion, appoint two U to three (3) youth representatives with full voting_ privileges. Youth representatives must be -a high school sophomores, juniors, or seniors and attend two regular meetings before being appointed. Background At the December 20, 2021 Work Session meeting, the City Council suspended the Economic Development Commission (EDC) due to inactivity of projects for the commission and limited resources of staff in the Community Development Department to facilitate the group. The EDC in 2021 had three active members. Council indicated the EDC could be resumed when there were projects identified and a Senior Planner onboard. With the hiring of a Senior Planner, Staff is seeking direction from the Council to resume the EDC and begin solicitation to recruit new members. In 2022, two of the three members opted not to be reappointed to the EDC due to conflicting commitments. Rob Williams was reappointed in 2022 to a three year term until 2025. Staff has confirmed that Commissioner Williams is still interested in participating in the EDC. City code states "the EDC shall be comprised of nine members and membership may be open to any resident or non-resident affiliated with an Arden Hills business who is interested in the business climate and economic development direction of the City. There shall be at least four (4) Arden Hills residents represented on the Commission." The City Council should also discuss appointment of a Council Liaison for 2023. Meetings have been scheduled for the 4tn Wednesday on Even Months at 7:30 AM. Based on the Council direction, Staff would plan on potentially holding a Page 1 of 2 meeting in August since this would allow time for recruitment and appointment of new members in June and July. The role of the Economic Development Commission is to facilitate positive interaction with the business community and advise the City Council and the Economic Development Authority on economic development, redevelopment and related community development issues. Background The City Council requested this be added to a worksession for discussion. Traditionally, the Mayor and City Administrator have worked on setting the agenda. Also, at the beginning of a meeting, Council has the opportunity to amend the agenda as needed. Council may want to discuss if any changes should be made, and how it should be formalized. If Council wants a written policy prepared, Staff can draft one and have it available for approval at the next Council meeting. Staff did reach out to a few surrounding cities on their process, a summary of their processes is below: • Shoreview: formal policy, items must be submitted to the City Manager by Tuesday the week prior to the meeting. • Mounds View: informal policy, Council generally adds future items at a worksession with the support of at least one other Councilmember, needs a simple majority for future discussion. Mayor has exception to add items as needed. • New Brighton: informal policy, Staff driven. • White Bear Township: no formal policy. • Falcon Heights: formal policy, Mayor or two Councilmembers may add an item with at least eleven days notice. All requests from Mayor or Council must first be reviewed at a Council workshop before being placed on a regular meeting. Page 1 of 2 Below is an example of Falcon Heights' language regarding agenda setting: Council and Commission agendas shall be established by the City Administrator or his/her designee. Future agenda items requested by a Council Member or Commission Member shall be discussed during a regular and/or workshop meeting and will be determined by the majority of the Council or Commission. In order to focus the Council meetings on consideration of policy issues and to maintain an open forum for public discussion, questions which focus on the policy aspects of agenda items should be at the Council meeting rather than administrative details. Any clarifications or technical questions that can be readily answered should be handled before the meeting. Council Members are encouraged to submit their questions on agenda items to the City Administrator as far in advance of the meeting as possible so that staff can be prepared to respond at the Council meeting. Background Per City Code, we do not generally allow signs to be placed in the right of way for commercial advertising. There are exceptions when it comes to signs for events, such as, open houses and garage sales. Signs that often appear along roadways for commercial purposes (i.e. We Buy Ugly Houses or Moving Services) are not allowed. In the past, our code enforcement officer will pick a designated time each week and pull prohibited signs. However, if a sign is placed after they pull signs, it could sit out for a week without being pulled. There is also the issue of jurisdiction, most signs are placed on County roadways and not City roadways. City Staff can pull signs from County ROW or complaints could be forwarded to the County for handling. Council should provide some direction on how often they would like signs pulled, and how to handle signage on non -City roads. Keeping in mind, the more proactive we are about pulling signs and the more Staff we involve, the more it will detract from other City business.
