RESOLUTION NO. 71-21
BE IT RESOLVED, by the Village 60unci I, That
the Vi I lage Forester shal I conduct an emergency inspection
of all trees ....hich remain in the Vi Ilage of Arden Hi lis,
which were marked as diseased ....ith oak wilt at the 1970
oak wi It survey conducted by the University of Minnesota.
If after the emergency inspection as author-
ized by the provisions of Ordinance No. 102, the Forester
finds that the danger of the infestation of other trees
from a diseased tree or trees is imminent, he shall notify
the property owner by certified mail of the existence of
the nuisance and shal I further notify the property owner
that the nuisance must be abated within a specified time,
not less that 5 days from date of mai I ing such notice.
Such other and additional notice may be given the property
owner as appears reasonable and prudent to the Forester
under the circumstances as then existing. The Forester
shall immediately report such action to the Counci I, and
after exptration of the time set forth in the notice, he
may abate the nuisances by having the diseased trees cut
down and hauled away.
The costs incurred by the Vi I lage shal I be
assessed against the property on which the trees ....ere
removed, in accordance with the provisions of Ordinance
No. 102.
