S462.358, Subd. 4, requires that no conveyance of land be allowed to be filed or recorded if it has not been first approved by the municipality in which it is located and in which subdivision regulations are in force, and WHEREAS, pursuant to a Resolution (File No. 1815280) adopted by the Board of County Commissioners of Ramsey County, Minnesota, on November 15, 1971, the Ramsey County Auditor and Register of Deeds were instructed to comply with the mandate of N.S.A. SS462.351 through 462.364, and in particular S462.358, and the construction given those sections by the Ramsey County Attorney, and accordingly are not to allow the filing or record- ing of conveyances that do not comply with the subdivision regula- tions of Ramsey County municipalities, and . WHEREAS, the City of Arden Hills has heretofore on March 27, 1967 adopted a Subdivision and Platting Ordinance lOrdinance No. 98~ the most recent amendment ofwhich--Ordinance No. 175, adopted by the Arden Hills City Council on October 29, 1973--provides for the City Council's approval of any minor sub- division or consolidation of unplatted tracts of land after certain requirements designated therein have been met, and WHEREAS, on March 11, 1974 the City Council of the City of Arden liillsapproved the subdivision and consolidation of the following described unplatted tracts of land, located within the City of Arden liills, Ramsey County, Minnesota: PARCEL A The West 435.06 feet of the South 100.0 feet, except the West 33 feet for Snelling Avenue, of tIle NW 1/4 of the NW 1/4, Section 22 I Township 30N, Range 23W, and l;'ARCEL B The West 361. 5 feet of the North 16.5 feet, except the West 33 feet .,- . for Snelling Avenue, of the SW 1/4 of the NW 1/4, Section 22, Township 30N, Range 23W, and . WHEREAS, the Arden Hills City Council desires to inform the offices of the Ramsey County Auditor and Register of Deeds about this consolidation so that in the event the owner of the consolidated parcel or tract of land in the future attempts to convey any part thereof, without first obtaining approval of the Arden Hills City Council as required by said Ordinance No. 98, as it now exists and may hereafter be amended, such approval to be appropriately indicated on the deed~l of conveyance, such offices will not allow such deed (601 of conveyance to be filed or recorded, NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City Council of the City of Arden Hills that the offices of the Ramsey County Auditor, now known as the Department of rroJ)>erty Taxation, and Register of Deeds be and they hereby are advised of the consolidation of the above-described unplatted tracts of land and are hereby requested not to allow the filing or record..,. ing of any deed~l of conveyance of any part of such consolidated tract of land unless and until such deed(sl shall have been first approved by the Arden Hills City Council, pursuant to the provisions of its rlatting and subdivision Ordinance (Ordinance No. 98, as it now exists and may hereafter be amendedl, such approval to be indicated in an appropriate manner on the ~ace of such deed ~ 1 . BE IT FURTHER RESOLVED, that to effectuate the pro- v~s~ons of this Resolution, the Clerk-Administrator be and she hereby is instructed to cause certified copies hereof to be filed, with respect to the above-described unplatted lots, with the offices of the Ramsey County Auditor, now known as the Depart"" ment of Property Taxation, and Register of Deeds.
