EESOLUTION ESTABLISHING :POLICIES EE
LAND USE AND CONTROL MEASURES IN
FLOOD PLAIN AREAS
WHEREAS, the City of Arden Hills has heretofore adopted
and is enforcing its Building Code (Ord. No. 93, as amended) and
its Subdivision and Platting Ordinance (Ord. No. 98, as amended),
and
WHEREAS, Section 301(a) of the Uniform Building Code,
the terms and provisions of which are incorporated by reference
in Section 3 of Ord. No. 93, prohibits any person, firm or corpora-
tion from erecting, constructing, enlarging, altering, repairing,
improving, moving or demolishing any building or structure without
first obtaining a Building Permit for each building or structure
from the Building Inspector, and .
WHEREAS, Section 302(a) of the Uniform Building Code
provides that the Building Inspector must examine all plans and
specifications filed by the applicant prior to issuance of said
Building Permit, and
WHEREAS, Section 7(3) of Ord. No. 98, the platting and
Subdivision Ordinance, provides that no preliminary plan will be
approved for subdivision which covers an area subject to periodic
flooding or which contains extremely poor drainage facilities
unless the subdivider agrees to make improvements which will, in
the opinion of the City Engineer, make the area completely safe
for occupancy and provide adequate street and lot drainage,

NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Arden Hills as follows:
1. That the Building Inspector shall review all
Building Permit applications for new construction or substantial
improvements to determine whether proposed building sites will be
reasonably safe from flooding. If a proposed building site is in
a location that has a flood hazard, any proposed new construction
or substantial improvement (including pre-fabricated mobile homes)
must (Ube designed or modified and anchored to prevent flotation,
collapse, or lateral movement of the structure, (ii) use construc-
tion materials and utility equipment that are resistant to flood
damage and (iii) use construction methods and practices that will
minimize flood damage; and
2. That the City Engineer and City Planning Commission,
as mandated by Section CD) of Ord. No. 98, shall review all preliminary
plans of proposed subdivisions and determine whether (1) all such
preliminary plans are consistent with the need to minimize flood
damage, (ii) all public utilities and facilities, such as sewer, gas,

electrical, and water systems are located, elevated and constructed
to minimize or eliminate.flood damage, and Ci.iil adequate drainage
is provided so as to reduce exposure to flood liazards, and the City
Council sliall not approve such preliminary plaOl!I unless and until
it lias determined that the foregoing criteria have been met; and
3. Tliat upon recOIllInendation by the City Engineer, the
City Council shall require new or replacement water supply systems
and/or sanitary sewage systems to be designed to minimize or eliminate
infiltration of flood waters into the systems and discharges from
the systems into flood waters, and require on s.ite waste disposal
systems to be located so as to avoid impairment of them or contamina~
tion from them during flooding.
