RESOLUTION ABATING 1973 INSTALLMENTS
OF ASSESSMENTS DUE ON GRAY FOX ROAD
AND ON DUNLAP STREET AND AUTHORIZING
APPLICATION FOR ABATEMENT OF 1973
TAXES DUE THEREON.
WHEREAS, by roadway easement dated July 28, 1971,
a copy of which is attached hereto and made a part hereof as
Exhibit "A", the City of Arden Hills, a municipal corporation
located in Ramsey County, Minnesota, acquired the strips of
land legally described therein for roadway purposes, which
strips of land were subsequently improved for such purposes
during the year 1971, were exclusively used for such purposes
by the public prior to the year 1972, and are known as Gray
Fox Road and Dunlap street, and
WHEREAS, because of certain title problems inVOlving
an interest of the State of Minnesota in one of these strips
of land (Gray Fox Road), the City of Arden Hills subsequently
acquired fee title to these two strips of land by means of
Quit Claim Deeds dated respectively April 24, 1973 and May 14,
1973, copies of which are attached hereto and made a part
hereof as Exhibits "B" and "C", and
WHEREAS, said strips of land are identified in the
Ramsey County Department of Property Taxation respectively as
Code Nos. 25-02700-160-78 and 25-02700-170-78, hereinafter
referred to respectively as "160-78" and ",170-78", and
..
WHEREAS, strip No. 160-78 is subject to assessments
heretofore placed thereon by the City of Arden Hills in
connection with the construction of the following improvements:
Sanitary Sewer No.1 (Aud. No. 152; D.P. No. 34), Sanitary
Sewer No. 3 tAud. No. 200; D.P. No. 38), and Sanitary Sewer
No. 6 tAud. No. 317; D.P. No. 44), the assessment rolls for
which were adopted respectively on September 9, 1960, October
12, 1961, and November I, 1963, and were certified to
the Ramsey County Auditor respectively on October 26, 1960"
November 17, 1961, and December 2, 1963 for the purpose of
including installments thereof to be collected along with real
estate taxes commencing respectively in the years 1961, 1962,
and 1964, and
WHEREAS, strip No. 170.-78 is subject to assessments
heretofore placed thereon by the City of Arden Hills in connection
with the construction of the following improvements: Sanitary
Sewer No.1 tAud. No. 152; D.P. No. 34) and Sanitary Sewer No,
3 tAud. No, 200; D.P. No. 38), the assessment rolls for which

were adopted respectively on September 9, 1960 and October 12, 1961
and were certified to the Ramsey County Auditor on October 26, 1960
and November 17, 1961for the purpose of including installments
thereof to be collected along with real estate taxes commencing
respectively in the years 1961 and 1962, and .
WHEREAS, with respect to strip No, 160-78, the 1973
installments of assessments for Sanitary Sewer Nos. 1, 3, and
6 were respectively $1.68, $5.22, and $49.36, and, with respect
to strip No. 170-78, the 1973 installments of the assessments
for Sanitary Sewer Nos. 1 and 3 were respectively $1.48 and
$4.56, all such installments being due and owing in the year
1973 with subsequent installments also being due, and
WHEREAS, the 1973 real estate taxes, including the
aforesaid installments, due on strip Nos. 160-78 and 170-78
are in the amounts of $273,72 and $36.48 respectively, and
WHEREAS, it is desirable that the aforesaid assess-
ments on said strips of land, including the installments thereof
due for the year 1973, be abated and that the Clerk-Administrator
make application for the abatement of the 1973 real estate taxes
thereon,
NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City
Council of the City of Arden Hills that the entire assessments
existing against the aforesaid strips of land, including the
installments thereof due for the year 1973 and subsequent install-
ments, be and they hereby are in all things annulled, canceled
and aha ted. .
BE IT FURTHER RESOLVED, that the Clerk-Administrator
be and she hereby is authorized and directed to submit a certified
copy of this Resolution to the Ramsey County Department of Property
Taxation for the purpose of showing the abatement of said assess-
ments upon its records.
BElT FURTHER RESOLVED, that the Clerk-Administrator be
and she hereby is authorized and directed to prepare and submit
to the Ramsey County Department of Property Taxation an Applica-
tion for Relief praying that the existing 1973 real estate taxes
against the aforesaid strips of land be annulled, canceled and
abated.

THIS Il'lDEN".tiJRE made this ~day of July, 1971, by and between
Roberts Construction, Inc., a Minnesota corporation, of the County of Ramsey
and state of Minnesota, party of the first part, and the Village of Arden
Hills, a municipal corporation, party of the second part, WITNESSETH:
That said party of the first part in consideration of the sum of
One ($1.00) Dollar and other good and valuable consideration, to it in
hand paid by said party of the second part, the receipt whereof is hereby
acknowledged, does hereby grant, bargain, sell and convey unto said Village
of Arden Hills, party of the second part, its successors and assigns,
Forever, a right-of-way hereinafter described over and across the lands of
the undersigned for a public road:
The East 60 feet of the West 360.4 feet of the E~ of the
SEi of Section 27, Township 30 North, Range 23 West lying
northerly of a line being parallel and distant 25 feet
northerly of the following described liner: beginning at
a point on the east line of said Section 27 distant
1322.1 feet south of the east quarter CQrner of said
Section 27, thence run westerly along aline at right
angles to said east line of said Section 27 for.1133
feet and there terminating; subject to Kowalski Road,
now known as Red Fox Road;
Together with a strip 60 feet in width which lies within
30 feet on each side of the following described line:
beginning at a point on the east line of said Section 27
distant 1327.1 feet south of the east quarter carner of
said Section 27, thence run westerly along a line at right
angles to said east line of said Section 27 for 1133 feet
and there terminating; subject to Lexington Avenue and
subject to the interests of the State of Minnesota.
TO HAVE AND HOLD THE SAME, together with all hereditaments and
appurtenances thereunto belonging, or in anywise appertaining, to the
said party of the second part, its successors and assigns, Forever.
