STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILLS RESOLUTION NO. ?$~C:U RESOLUTION RE 191 ACRE SCHMIDT PARK SUPPLEMENT AND DRAINAGE CORRIDOR PRO- POSED BY RAMSEY COUNTY PARKS AND OPEN SPACE COMMISSION · WHEREAS, the Ramsey County Parks and Open Space Commission has proposed to acquire a 191 acre corridor of land which stretches from Schmidt Park on the south to the intersection of Interstate Highways 35 Wand 694 on the north for the purposes of controlling the surface water runoff and lake overflow from this corridor and surrounding land to Rice Creek, providing a valuable resource for environ- mental education, correcting the hydrological problems associated with Lake Johanna, complementing the existing recreational facilities at Schmidt Park, preserving and protecting the corridor's natural character not only for its scenic and aesthetic value but also for its value as an excellent habitat and refuge for wild life in a rapidly devel- oping municipality, and developing multi-purpose trails throughout the corridor to connect the three schools, library, two playgrounds, and existing County Park located adjacent thereto, and WHEREAS, Section 1, Subd. 4 of Chapter 950, Laws of 1971, provides that the Ramsey County Parks and Open Space Commission shall not acquire any right, title, or interest in or to real property designated by it for parks, open space, or recreational purposes, or to develop the same without first obtaining approval of the governing b09Y of the municipality in which said property is located, and . . . . . ... " .; WHEREAS, said Commission now solicits the approval by the Vi Ilage Counci I of the Vi Ilage of Arden Hi lis of its proposal to acquire and develop the tracts of land which comprise the 191 acre Schmidt Park Supplement and Drainage Corri dor, NOW, THEREFORE, BE IT RESOLVED by the Councl I of the Vi I lage of Arden HI lis that the proposal of the Ramsey County Parks and Open Space Commission to acquire and develop the tracts of land which comprise the 191 acre Schmidt Park Supplement and Drainage Corridor be and it hereby Is approved, subject to the following conditions and limitations: I. That the Commission adhere to and abide by the official policy guidelines adopted by it on October 30, 1972 In File No. 12-B, Resolution No. 1-10, as modified or amended by It In Its Resolution No. 1-16 (File No. 12l, adopted on December 18, 1972, and In particular the eight guidelines or assurances set forth in said Resolution No. 1-16; 2. That the Counci I of the Village of Arden HI lis retain the irrevocable right to withdraw approval as to any tract(sl of land within the Corridor for the acquisition of which the Commission is offering compensation which the Council considers Inadequate; 3. That the Commission obtain the approval of Councl I of the Vi Ilage of Arden Hills be- fore al lowing the operation and use of motor- ized vehicles within the boundaries of the Corridor; and 4. That the Commission acquire an easement over and across, rather than the fee title to, those tracts of land which are designated In the proposal to provide access to Lake Johanna and legally described as fol lows: AI I that part of lot 5, Block I, Wecks Addition, that part of the West 769.13 feet of Government Lot I, that part of the vacated portion of Johanna Boulevard, and that part of lot I, of Hackney Park Plat 2, lying Southerly of the existing and traveled Boulevard and Southwesterly of a line commencing at the Intersection of the East Ii ne of sa i d pa rt of Gove rn- ment Lot I and the Southerly line of said boulevard; thence South on said East line 55.26 feet; thence Southeast at an angle -2- . ' . ~.. ;,; . . of 3P to the left to the lake shore for the beginning of the first described line1 thence re- turn Northwesterly on the same angle and extension thereof to said Southerly boulevard line for terminus, and lying Northeasterly of a line and extensions thereof beginning on the Northerly line of and 55 feet from the most Westerly corner of said Lot,11 thence to a point on the southerly line of and 27 feet from the most Souther:LY cor- ner of said Lot 1 and there terminating. BE IT FURTHER RESOLVED, that the Mayor and Clerk-Adminis- t ator be and they hereby are authorized and dire~ to cause c rtified copies of this Resolution to be forwarded to the ey COunty Administrator, the Ramsey County Parks and Open Space Commission, and such other offices as may be deemed nec- essary for the purpose of carrying out the provisions hereof.
