RESOLUTION AUTHORIZING TRANSFER OF POLICE
DEPAltTMENT FUNCTIONS TO RAMSEY COUNTl'
SHERIFF'S OFFICE AND APPROVING AGREEMENT
WITH COUNTY OF RAMSEY FOR LAW ENFORCEMENT
SERVICES
WHEREAS , the City Council of the City of Arden Hills
has de~ it in the public interest to transfer the law enforce-
ment functions of the City, previously administered by the City's
own Police Department, to the County of Ramsey, ,and specifically
its Sheriff's Department, because such functions can be more
efficiently and economically carried out by said 5heriff's Depart-
ment, ,and
WHEREAS, ,the City of Arden Hills is thus desirous of
contracting with the County of Ramsey to have said County, by and
through its Sheriff's Department, perform said law enforcement
functions for, and within the boundaries of, the City of Arden
Hills, ,and
WHEREAS, Sections 471.59 and 436.05 of Minnesota
Statutes, as amended, and Chapter 372 of Laws 1959,specifically
authorize the City of Arden Hills and the County of Ramsey to
contract for the County's performance of said law enforcement
functions, and
WHEREAS, the City of Arden Hills and the County of
Ramsey, by and through its Sheriff's Department, have negotiated
the terms and conditions of the County's performance of said law
enforcement services, and those terms and conditions have been
embodied in a document entitled "Agreement--Law Enforcement
Services" , ,
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Arden
Hills City Council, acting by a fourto-aa vote, that the Agree-
ment--Law Enforcement Services Ca copy of which is. attached
hereto and made a part hereof as Exhibit "A") is hereby adopted
and approved.

BE IT FURTHER RESOLVED, that the Mayor
Administrator are hereby authorized and directed
said Agreement on behalf of the City and to take
necessary to effectuate said Agreement.

BE IT FURTHER RESOLVED, that the Clerk-Administrator
of the City is hereb~ authorized and directed to forward a
certified copy of this Resolution and the executed original and
copies of the Agreement to the appropriate officials of the
County of Ramsey.

G9~, hy and between the COUNTY OF Rf\t~SEY, hereinafter
to as the "County" and the CITY OF ARDEN HillS, hereinafter
referred to as the "Municipallty~.

WITNESSETH:
WHEREAS, the parties to this Agreeme~t are desirous of con-
tracting for the performance by the County of the hereinafter described
law enforcement functions for, and within th~ boundaries of, the Munici-
pality through the Ramsey County Sheriff; and
WHEREAS, the County at Ramsey is agreeab~e to renderlng such
services on the terms and conditions herelnafter sat forth; and
WHEREAS, such contracts are'authorized and provided for by the
provisIons of Minnesota Statutes ~951, Sec. 471.59 and Sec. 436.05, and
laws 1959, Chapter 312.
NOW, THEREFORE, pursuant to the terms of the aforesaid statutes,
it is agreed as tol lows:
I. The County agr.es, through the SharIff of the County of
Ramsey, to provide patrD~ an1 police protection wlthln the corporate
limits of Municipality to th~ axtunt and In the manner hereinafter S3t
forth.
Except as otherwisB hereInafter speciflca1 Iy set forth, such
servIces shal I only encompass dut~.s and functions of the type coming
within the jurlsdictlon of ailO customarily rend<lred by -,'he Shariff of
the County of Ramsey under the statutes.

of such services and the control of personnel 50 empioyed, shal I be
under ~he jurisdiction of the County. In event of dispute between the
partIes as to the extent of the duties and functions to be rendered
hereunder, or the leve! or manner of performance of such service, the
determinatIon thereof made by the Sheriff of the County shall be final
and conciusive as between the parties hereto, provided however, that
upon notice by the Mun!cipa lty, the parties shal I negotIate theIr
differences In accordance with the provisions of paragraph ;2 hereof.
ServiCes performed hereunder shall include but not be i lmlted
to traffic law enforcement 'nclud'ng the regular use of radar as a speed
deterrent, non-traffic ordinance 'al'/ enforcement, I icense inspection
and enforcement, and the reguiar patrol of busIness and residential
areas within the Munfclpalii'y.
Services shaii be provided 24 hrs. per d~y and shal I be
performed by the number of deput!~s and other personnel budgeted for

2. To facl I itate the performance of said functions, it Is
hereby agreed that the County shat I have ful I cooperation and assls-
i'lH'ce from the ~lunlclpallty, as (,fticers, ager,ts and employees.
3. For the purpose of performing said functions, County
she!1 furnish and supply abl necessary labor, supervision, equipment,
communication fac! Iltles anc dispatching, and supplies necessary to
maintain the level of service to be rendered hereunder.
4. All Deputy Sheriffs, clerks, dispatchers and all other
personnel perform~ng duties pursu~nt to this agreement shall at all
times be considered employees of the County for al I purposes.

sa!arlas, wages. or other compensation to any County p~rsonnel porform-
ing services hereunder for said Municipality, and the County hereby
assumes said liabilIties.
Except as herein otherwIse specified, the Municipality shall
not be Ii ab Ie for compansat;lon or indemnity to any County employee for
1 n.iury or s i c~ness arising out of his employment, and the County hereby
. agrees to hold harmless the Munlclpal ity against any such claim.
5. The MuniclpaHty, Its officers and employees, shaH not
be deemed to assume any liability for the intent!onal or negligent
acts of the County or the County's employees performing services pursuant
to this Agreement, and the County Shall hold the Municipality, Its
off I cers and emp! oyees harm less f rom and s ha i I defend the !.'un Ie lpa II ty.
Its officers and employ~es, against any claim for damages arising from
the performance of this Agreement.
6. This Agreement shp;1 ~ commence January ::3, ,q18 , and
shal! be In effect until Dec3mber 31, !976. Ei'rher party mllY terminate
this Agreement upon ninety I~OI' days written notice to the other party.
In this event, the property listed in the herein attached Exhibit "8"
or Its functional or general equivalents, Shall be returned to

the Municipality.
7. The Municipality agreen to pay the County the cost of
performing all services covered by this Agreement. Costs shal! Include
salaries of employees engaged in perf0rming said services, II prO rata
of vacation and sick leave, c;upervisil'n of such employees ",hi Ie so
employed, the Public Employees Retiren3nt Contribution and Workmen's
Compensation Premiums, Genera! Overheld, includIng indirect expenses
and supplies, Radio Unit expense, Hea th and Welfare expense, and
Police Professional Llabi Ilty Insuran'~ upon which, In addition to the
County, the Munlclpaflty shall be namld Insured,

hereto ~nd made a part hereaf as Exhibit "A". "Costs" as used herel"
shall not lnc~uda items of ax pense attributable to services or facill-
t'es normally provided or available to all cities within the County as
part of the County's obligation to enforce State Law, and it is specifi-
ca! Iy agreed that said services and facil ities shail remain available
to the Municlpa~lty, notwithstanding the Agreement, and further, that
the Agreement shel! not take the place of said services and facilities.
Exact figures for shift mijeage wi II be furnished by the
Sheriff to the Budgeting and Accounting Division of the County Adminis-
trator's Office for computation purposes. Actual computation of appli-
cable costs hereunder shal' be mada by the Budgeting and Accounting
Division of the County Administrator's Office and payment therefore
~hell be made on Its monthly statement, payable to the Ramsey County
Department of Property Taxation.
It Is understood that a cost estimate for each su~ceedins
calendar year's services ~i'i be furnished to the Municipality no later
than August I, and if accepted by the Municipal ity no later than October
15, shall be incorporated by reference in the proposed Agreement for
the succeeding year.
8. It is understood that prosecut~ons for violations of
ordinance or state statute, together with disposition of all fines
collected pursuant thereto,ih~11 be in accordance with the Ramsey
County MunicIpal Court Act, 14innasota Statute, Chapter 488A.
9. Tha Ramsey County Sheriff's offica shall submit to the
Municipality monthly activity reports detailing the activities of the
Sheriff's Office within the Gity. Said reports shal I cbntaln at le3st
the following information: hi les petrol led, hours patrolled, number of
calls answered, number of tickets issued.

to the Sheriff's department.
II. the Muntcipa,ity shall transfer to the Ramsay County
Sheriff the goods and Items listed in Exhibit "8" which is attached
hereto and made a part hereof.
12. It is understood between the Partlos hereto that upon
. lloTlce given by either Party, negotiations wi II be undertaken for the
purpose of revising, adding or striking any of the provisions of this
contract which it appears are in dispute, are ~nworkable, or are
lrilufflcient as herein set ~orth; and that such changes, if any, when
agreed to, will be entered by supplemental contract, which sh~11 have
the same effecT as though it had bean orlginally a provision of this
Agreement.
13. it Is further understood that thIs Agreement shall take
effect upon being approved end executed by both parties hereto. The
County agrees to notify the Municipality forth~lth upon said approva~
by the Board of Commissioners.
14. This Agreement shall be affective as of January i, 1978.
IN WITNESS WHEREOF, the City of Arden Hills, by resolution
d~ly adopted by its Governing Body, has c~used this Agreement to be
signed by its Meyor and Clerk Administrator and the seal of the Munlci-
