RESOLUTION No. 77-JI
A RESOLUTION VACATING PORTIONS
OF CONNELLY AVENUE
.
WHEREAS, the Arden Hills City Council by Resolution
No. 75-39, passed on August 25, 1975, initiated a proceeding
under Section 412.85l of Minnesota Statutes, as amended, to
determine whether it would be in the public interest to vacate
the hereinafter described portions of Connelly Avenue situated
in the City of Arden Hills, County of Ramsey and State of
Minnesota, and
WHEREAS, the Clerk-Administrator of the City of
Arden Hills published in the New Briqhton: BUll.etin on November 6
and l3, 1975 a Notice of Public Hear~ng on the proposed vacation
of portions of Connelly Avenue and also caused copies of said
Notice of Public Rearing to be posted for a period of at least
two (2} weeks, commencing November 4, 1975, at the Arden Hills
City Hall, Lake Johanna Elementary School and the refreshment
stand at Lake Johanna Beach, three of the most public places in
the City of Arden Hills, and
WHEREAS, a public hearing before the City Council was
conducted on Monday, November 24, 1975 commencing at 7:35 o'clock
P.M., and
WHEREAS, no one appeared to oppose 'the proposed vacation,
and Mr. George Withy, President of W. R. Shaw Lumber Co., one of
the abutting property owners, voiced his approval of the proposed
vacation, and

WHEREAS, the City Council, after the close of the public
hearing at 8:25 o'clock P.M., unanimously deemed it to be in the
public interest to vacate the portions of Connelly Avenue herein-
after described contin,ent upon Cll the City's acquisition of a
right-of-way connecting the southeasterly terminus of Connelly
Avenue with County Road E without having to pay any compensation
therefor, (2l resolution of title problems concerning an approxi-
mately 55 foot by 80 foot strip of land partially lying in the
right-of-way of the southeasterly terminus of Connelly Avenue and
the proposed right-of-way to be acquired, (3} resolution of the
, grading, landscaping and parking proposals of Flaherty's Arden
Bowl, .Inc., one of the abutting property owners, and '(4} reserva-
tion of the City's sewer mains and pipes located in the portions
of Connelly Avenue to be vacated, and
WHEREAS, the City Council has deferred passage of this
Resolution pending satisfaction of the first three contingencies
listed in the preVious paragraph hereof, and

WHEREAS, said contingencies have now been s,atisfied,

NOW, THEREFORE, BE IT HE:REBY RESOLVED, b;r the City
Council ot the City of Arden Hills, four-fifths (4/5 ths 1 of the
members of the Council--nanJely, Councilmen Hanson, Wingert and
Woodburn and Acting Mayor Crichton CMayor Crepeau being absentl--
voting in favor of this Resolution, ,that it is in the public
interest of the City of Arden Hills to vacate the portions of
Connelly Avenue hereinafter described to facilitate the better
flow and circulation of traffic to and from the businesses
situated along Connelly Avenue.
BE IT FURTHER RESOLVED ,that the following portions of
. Connelly Avenue are hereby vacated:
PORTl'ON NO. 1
That part of an easement for roadway purposes (now
called Connelly Avenuel as established in Easement
Document No. l55796l dated February lO, 1962 and
filed on March 7, 1962 in Book 1780, Page 113 in
the office of the Ramsey County Recorder lying
Westerly of a line hereinafter called Line "X"
beginning at the intersection of the West line of
the East 843.88 teet of the SW l/4 of the SE 1/4
of Section 27, Township 30'North, Range 23 West, in
Ramsey County, Minnesota and the South line ot said
Connelly Avenue; thence Northwesterly on Line "x"
(said Line "X" fo:olls an angle of 47"47'36" with the
South line of said Connelly Avenue as measured from
West to Northwestl to the North line of said
Connelly Avenue and said Line "x" there terminating.
PORTION NO." 2
That portion of a circle ot a radius of 45 feet
lying Southerly of the 60 foot wide roadway estab-
lished in said Document No. 155796l, the centerline
of which is described as follows:

Commencing Southeasterly trom Point "A",
as said Point "A" is established in said
Document No. l557961, ,at an angle of
78013' (as measured from South to Eastl
a distance of 265'.54 feet to_a point
hereinafter called Point "C"; thence
Southeasterly at said angle of 78013'
approxi1nately 71 teet to a point on the
West line of the East 482 teet of the
SW 1/4 of the SE 1/4 ot Section 27, Town-
ship 30, Range 23 which is 313.35 feet
North of the South line of said SW 1/4,
the center of which circle is described as follows:
Commencing at said Point "C"; thence Southeasterly
27.61 feet at an angle of 31"54'28" to the right,
as measured from the extension of the line from
said Point "A" to said Point "C", and there ter-
minating.

PORTION NO. 3
A circle of a radius of 45 feet whose center is co-
incident with Point "B", as said Point "B" is estab-
lished in said Document No. 155796l.
BE IT FURTHER RESOLVED, that the perpetual underground
sewer easement rights which the City of Arden Hills acquired in
an Easement, dated February lO, 1962 and filed in the office of
the Register of Deeds in and for Ramsey County, Minnesota, on
March 7, 1962 in Book 1780, Ramsey County Records, Page 118, as
File No. 1557962, in and to the portions of connelly Avenue
hereby vacated are hereby reserved and retained by the City of
Arden Hills in perpetuity.
BE IT FURTHER RESOLVED, that the Clerk-Administrator
is hereby authOrized and directed to cause a certified copy of
this Resolution to be recorded in the office of the Ramsey County
Recorder and to prepare and cause to be presented to the Land
Records Division of the Ramsey County Department of Property Taxa-
tion and recorded in the office of said County Recorder a Notice
of Completion of Vacation Proceedings as required by Section
4l2.851 of Minnesota Statutes, as amended.
