Pursuant to due call and notice thereof, the City Council of the City of Arden Hills met in regular session at the City Hall on Monday, the 29th day of August, 1977, at 7:30 o'clock p.m. The following members were present: Crepeau, Crl chton r Hanson, Wingert, Woodburn and the following were absent: none Councilman Woodburn introduced the following resolu- tion and moved its adoption: Resolution No. 77-47 RESOLUTION RECEIVING REPORT AND PROVIDING FOR PUBLIC HEARING ON IMPROVEMENT NO. P-77-4 BE IT RESOLVED by the Council of the City of Arden Hills as follows: . 1. By resolution adopted August 8, 1977, the Council has directed the City consulting engineer to prepare a preliminary report as to the feasibility of a proposed improvement generally in the area bounded by Lexington Avenue on the east, Snelling Avenue on the west, County Road E on the north, and 1400 feet south of County Road E on the south, by the construction of bituminous surfacing, concrete curb and gutter, necessary drainaqe, right-of-way acquisition, pedestrian underpass, and necessary appurtenances. The City COnsulting Engineer was also directed to include in the report the estimated cost of the proposed improvement and as to whether such improvement should best be made as proposed or in connection with some other improvement. 'l'he preliminary report and cost estimate have been submitted and considered by the Council and are hereby approved and directed to be placed on file in the office of the City Clerk Administrator. The improvement proposed to be made in the general manner set forth in the report is designated as Improvement No. P-77-4. 2. 'l'he COuncil shall meet at the City Hall, 1450 West Highway 96, in said City, onsep+.M~l IQ ,1977, at 7:30 o'clock p.m. for the purpose of holding a p ic hearing on the proposed improvement under and pursuant to the provisions of Minnesota , . . Statutes, Chapter 429, and the Clerk Administrator is hereby authorized and directed to cause notice of the time, place and purpose of that meeting to be published twice in the official newpaper, New Brighton Bulletin, which publications shall be a week apart, and the second publication shall be not less than three days before the date of the hearing. 3. The notice shall be in substantially the followinq form: ~ NOTICE OF HEARING ON IMPROVEMENT NO. P-77-4 CITY OF ARDEN HILLS, MINNESOTA . NOTICE IS HEREBY GIVEN that the Council of the City of Arden Hills, Minnesota, will meet at the City Hall, 1450 West Highway 96, in said City, on the 19th day of SeptRmb",. , 1977, at 7:30 o'clock p.m. to hold a publIC hearing pursuant to Minnesota Statutes, Chapter 429, as amended, on proposed Improvement No. P-77-4 generally in the area bounded by Lexington Avenue on the east, Snelling Avenue on the west, County Road E on the north, and 1400 feet south of County Road E on the south, by the construction of bituminous surfacing, concrete curb and gutter, necessary drainage, right-of-way acquisition, pedestrian underpass, and necessary appurtenances. The foregoing is all substantially in accordance with a preliminary engineering report which is now on file and open to public inspection in the office of the City Clerk Adminis- trator. The cost of the improvement is presently estimated at $ 122.6 16 . The area proposed to be assessed for the improvement shall be the following parcels of property wi thin the Northeast Quarter (NE 1/4) of Section 34, Township 30, Range 23, in the City of Arden Hills, Minnesota: 25-03400-030-02 25-03400-020-03 25-03400-020-04 25-03400-030-05 and Outlots G and H, Hunter's Park Fourth Addition. All persons desiring to be heard with reference to the improvement and the area proposed to be assessed therefor may appear and be heard by the City Council at the time and place stated above. The general nature, estimated cost and area proposed to be assessed for Improvement No. P-77-4 are determined to be as stated in the foregoing notice, as fully as though the same were separately set forth and resolved herein.
