WHEREAS, pur~uant to resolution passed by the City
C?Uftcil on May 2, 1977, the City Consulting Engineer has
prepared plans and specifications for Improvement W-P-SS-76-l
end has presenrad such plan~ end specifications to the Council
for epproval.
THEREFORE, BE IT :lmSOLVED BY THE CITY COUNCIL OF ~RDEN
HILS, MINNESOTA:
1. Such plans and specifications, COp~27 of Whieh are
attached hereto, and made a p?;~ hereof, ere hereby approved.

The motion for the al!opt:lon of the foregoinq resolution

SPECIAL USE J.>ERMIT--Case No. 77-45
The undersigned, Clerk-Administrator of the City of
Arden Hills, does herepy certify that this Special use Permit
is granted pursuant to the provisions of Ordinance No. 99, as
amended, the Zoning Ordinance, in accordance with a public
hearing duly held by the City's Planning Commission commencing
on Tuesday, October 4, 1977 and subsequent approval thereof by
the City Council on January 30, 1978.
permission is accordingly given to the applicant,
BARRY O'MEARA, 97 20th Avenue S.W., New Brighton, Minnesota
55112, his heirs, personal representatives, successors and
assigns, hereinafter referred to as the "Permittee", to con-
struct and operate on the parcel of land which is described in
Exhibit "A" attached hereto a four-plex as shown on the plan
received by the City on January 30, 1978 and other documenta-
tion on file with the Clerk-Administrator in the City Hall.
The parcel of land which is the subject of this Permit faces
east on Cleveland Avenue between Stowe Avenue and County Road
D and is located immediately west of the Heights of Johanna
Lake Addition. .
This Special Use J.>ermit is issued not only subject
to the Permittee's compliance with the general condition and
documentation mentioned hereinabove but also subject to his
compliance with all of the applicable requirements and condi-
tions set forth in Ordinance No. 99, as amended, the issuance
of a Building Permit for the construction of the aforesaid
four-plex, and the following special conditions:
1. The four-plex shall not exceed a height
two feet less than the duplex to the
south thereof.

2. The landscaping and the exterior of all
structures and other improvements
located on the subject parcel of land
shall be maintained and kept in good
repair in a manner commensurate with
the single-family homes in the immediate
vicinity thereof.
3. Landscaping of said parcel of land shall
be commensurate with the landscaping of
neighboring single-family homes in the
immediate vicinity thereof and shall be
reviewed and approved by the City Planner
prior to planting.
4. Permittee shall not be entitled to a
Building permit and to commence construc-
tion of the four-plex until the City
shall have first received a landscape
