A RESOLUTION APPROVING AGREEMENT WITH
COUNTY OF RAMSEY FOR LMI ENFORCEMENT
SERVICES FOR THE YEAR 198~

WHEREAS, pursuant to Reso!utlon No. 77-75, adopted on
27, 1977, the CIty Councl R of the City o'f Arden HI ~ Is
~uth~rlzed the transfer of Its polIce department functlons'to
the Ramsey County Sheriff's office and approved an Agreement for
law enforcement services for the calendar year 1978; and
WHEREAS, the City of Arden HIDls is desirous of contract-
Ing again wIth the County of Ramsey to have said County, by and
through Its Sheriff's Department, continue to perform such law
enforcement functions for, and within the boundaries of, the City
of Arden HI lis during the calendar year 198R, and
WHEREAS, the County of Ramsey has submitted to the City
of Arden Hills a document entltNed "Agreement--lavl Enforcement

Services" for the caNendar year ~98ij which Is Identical In ain
respects to the orlginaN Agreement between the City of Arden HI~ls
and the County of Ramsey with the exceptIon that:
I. Paragraph 7 has been amended to clarify

2. A provision relat!ng to the transfer of
personal property by the City to the
County was deleted, and
WHEREAS, the City Council of the City of Arden Hills

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Arden HI I is

BE IT FURTHER RESOLVED, that the mileage charge be estimated
at 35 cents per mile Instead of 40 cents per mile, resulting in a "
a98R es',imated- cost for Arden HI a is of $233,220.
BE IT FURTHER RESOLVED. that the mayor and Clerk-Administrator
are hereby authortzed and directed to execute said Agreement on behalf
of the City and to take all steps necessary to effectuate said
Agreement.
BE RT FURTHER RESOLVED, that the Clerk-Administrator of the
City Is hereby authorized and directed to forward a certified copy
of this Resolution and the executed original and copy of the Agreement
with the above-referenced provision added thereto, to the appropriate
oftlcla~s of the County of Ramsey.

THIS AGREEMENX, made and entered into this
day of

19_, by and between the COUNTY OF RAMSEY, hereinafter referred to as the
"County" and the CITY OF ARDEN RILLS, hereinafter referred to as the
""iunicipalitv".
WITNESSEm:
WHEREAS, the parties to this Agreement are desirous of contracting
for the performance by the County of the hereinafter described law enforcement
functiona for, and within the boundaries of, the Municipality through the
Ramsey County Sheriff; and
WlIEREAS, the County of Ramsey is agreeable to rendering such
services on the terms and conditions hereinafter set forth; and
'~EAS, such contracts are authorized and provided for bv the
provisions of 11innesota Statutes 1957, Sec. 471.59 and Sec. 436.05, and
La,,TS 1959, Chapter 372.
NOW, THEREFORE, pursuant to the terms of the aforesaid statutes,
it is agreed as follows:
. 1.' The County ar.rees, through the Sheriff of the County of
Famsey, to provide patrol and police protection within the corporate
limits of ~lunicipality to the extent and in the manner hereinafter set forth.
Except as otherwise hereinafter specifically set forth, such
services shall only encompass duties and functions of the type coming
within the jurisdiction of and customarily rendered by the Sheriff of the
County of Ramsey under the statutes.

The rendition of such service, the standards of performance,
the discipline of officers, and other matters incident to the performance
of such services and the control of personnel so employed, shall 'be

under the jurisdiction of the County. In event of dispute between the
parties as to the extent of the duties and functions to be rendered
hereunder, or the level or manner of performance of such service, the
I
determination thereof made by the Sheriff of the County shall b~ final

and conclusive as between the parties hereto, provided however, tltat
upon notice by the Municipality, the parties shall negotiate their
differences in accordance with the provisions of paragraph 11 hereof. .
Services performed hereunder shall include but not be limited
.
to traffic law enforcement inCluding the regular use of radar as a speed
deterrent, non-traffic ordinance law enforcement, license inspection
and enforcement, and the regular patrol of business and residential
areas within the Municipality.
Services shall be provided 24 hours per day and shall be
performed by the number of deputies and other personnel budgeted for
in the herein attached Exhibit "A".
2. To facilitate the performance of said functions, it is
hereby agreed 'that the County shall have full cooperation and assistance
from the Municipality, its officers, agents and employees.
3. For the purpose of performing said functions, County shall
furnish and supply all necessary labor, supervision, equipment, communication
facilities and dispatching, and supplies necessary to maintain the level of
service to be rendered hereunder.
4. All Deputy Sheriffs, clerks, dispatchers and all other
personnel performing duties pursuant to this agreement shall at all times
be considered employees'of the County for all purposes.

Excellt as otherwise provided, the !,:unicinality shall not be called
upon to assume rmy liability ~or the direct payment o~ e:ny salaries,

wages, or other compensation to any County nersonnel performing services
hereunder ~or said Municipality, and the County hereby assumes said liabilities.
Except as herein otherwise specified, the Municipality shall not be
liable for compensation or indemnity to rmy County employee ~or injury or
sickness arising out 01' this employment, and the County hereby agrees to hold
harmless the Municipality ags.inst SJr!' such claim.
5. The Municipality, its officers and employees, shall not be deemed
to assume any liability ~or the intentional or negligent acts o~ the County
or the County's employees performing services pursuant,to this Agreement, and
the County shall hold the Municipality, its o~ficers and employees harmless
~rom and shall de~end the l!unicipality, its officers and employees, against
any claim for damages arising from the performance o~ this AE;reement.
6. This Agreement shall commence January 1. 1981 ,and shall be in
ef~ect until December 31, 198] . Either party may terminate this Agreement
upon ninety (90) days written notice to the other party. In this event, the
property listed in 'lihe herein attached Exhibit "B" or its :functional or
general equivalents, shall be returned to the \Iunicipality.
7. The )~unicipality agrees to pay the County the actual cost 01'
performing all services covered by this agreement. Costs shall include
salaries 01' employees engaged in performing ssid services, including a pro
rata 01' vacation and sick leave, mileage, uniforms, public employees
retirement contributions, ,worker's compensation insurance premiums, general
overhead, including indirect expenses and supplies, radio unit expense,
health and welfare expense, and police professional liability insurance
upon which, in addition to the County, the municipality shall be a named
insured.

The proposed costs ~or calendar year 1981 are as set forth in the
~ Budget Estimate. prepared by the C'ounty. which is attached hereto
and made a part hereof as Exhibit "A". Costs as used herein shall not
include items 01' expense attributable to services or facilities normally
provided or available to all cities within the County as part 01' the
County's obligation to enforce State law.
Actual computation 01' applicable costs hereunder shall be made by
the Ramsey County Budget and Accounting office based on information provided
by the Sber1~1' and payment therefor shall be made by the municipality on the
County's monthly statement.
An estimate 01' said costs for 1981 , and for succeeding years in the
event this agreement is extended. shall be furnished by the County to the
municipality no less than one month prior to the commencement 01' the contract
term. Said estimate shall be made for the limited purpose 01' better enablin/l.'
the municipality to estimate its budget. It is understood by the parties to
this agreement that said estimates shall in no way prevent the County from
Charging its actual costs.
8. It is understood that prosecutions for violations 01' ordinance
or state statute, together with disposition 01' all ~ines collected pursuant
thereto, shall be in accordance with the Ramsey County ~unicipal Court Act.

9. The Ramsey County Sheri~~'s of~ice shall submit to the
Municipality monthly activity reports detailing the activities o~ the
Sheri1'~'s o1'~ice Within the C'ity. Said reports shall contain at least the
~ollowing information: Miles patrolled, hours patrolled, number o~ calls
answered, number o~ tickets issued.

10. Since the 'I.ayor is the Chief Law Enforcement Officer of
the ~unicipality, either he or his designate shall act as liaison 'to
the Sheriff's department.

ll. It is understood between the Parties hereto that upon
notice given by either Party, negotiations will be undertaken for the
purpose of revising, adding or striking any of the provisions of this
contract which it appears are in'dispute, are unworkable, or are
insufficient as herein set forth; and that such changes, if any, 'When
agreed to, 'Will be entered by supplemental contract, wich shall have
the same effect as though it had been originally a provision of' this
Agreement.
12. It is further understood that this Agreement shall take
effect upon being approved and executed by both parties hereto. The
County agrees to notity the Municipality forthwith upon said approval
by the Board of Commissioners.
13. This Agreement shall be effective as of
1/1/81

adopted by its Governing Body, has caused this Agreement to be signed 'by
