Extract of Minutes of Meeting'
of City Council
City of Arden Hills
Ramsey County, Minnesota
Held; August 18, 1980
Pursuant to due call and notice thereof, a special' meeting
of the City Council of the City of Arden Hills, Minnesota was
duly held in the City Hall in said City on Monday, the 18th ,
day of August, 1980, at 7:30 o'clock p. m.
The following members were present: Mayor Crepeau and
Councilmen Hanson, Wingert and WoodburnJ and the following
was absent: Councilman Crichton.
Also in atiendance were: Charlotte McNiesh, City Clerk
Administrator; Donald Christoffersen of Short,. Elliot and
Hendrickson, Inc., City Consulting Engineer; Donald.:Lamb,
City Treasurer; and Peter S. Popovich of Peterson, Popovich,
Knutson & Flynn, City Bond Consultant.
The city. Clerk Administrator presented an affidavit showing
publication of Notice of Hearing on the proposed assessment for
Improvement No. SS-W-P-ST-78-4 in the New Brighton Bulletin on
July 31, 1980, which affidavit was examined, found satisfactory,
and ordered placed'on file. The Clerk Administrator also'
exhibited a Certificate of Mailing Notice of Hearing to all
affected property owners.
MAYOR CRE:PEAU: At this 'time I will ask our City Engineer,
Mr. Don Christoffersen to briefly explain the improvement;
MR. CHRISTOFFERSEN: The improvement consists primarily
of serving the McClung's First Addition, and consists of sanitary

sewer and sanitary sewer services, water services, streets,
and drainage. The streets include concrete curb and gutter and
bituminous surfacing.
MAYOR CREPEAU: Mr. Popovich, our fiscal consultant, would
you briefly explain the financing.
MR. POPOVICH: This improvement was petitioned f0r by
100% of the pr0perty' owners so it wasn't necessary to have the
normal feasibility hearing. The total cost of the . improvement
ended up at $76,982.62. There are 11 lots inVGlved so 'that
figure was divided byll'to bring the per lot assessments as
follows: $2,193.36 for .sanitary seweri $538.07 for Water
servicei and $4,266.99 for the street and storm sewer, for a
total of $6,998.42 a lot. It's really a unit charge.They~re
all assessed a like amount since they're part of the subdivision.
We have sold no bonds. The matter has been financed
internally, but now we have to make the assessment so you.will
have to come up with an assessment that the people will pay.
We're recounnending it be spread over a 20-year.peri0dwith 8%
for the assessment carrying charge. If we had issued bonds, the
new law permits you to have 1% over the bond issue interest.
For example, Roseville just .sold bonds at 7.63% which means
they could charge 8.63%. If you haven't sold any bonds, you're
limited to 8%.
MAYOR CREPEAU: The meeting is open to comments.
MR. Me CLUNG: I have no objections. I am satisfied with
the work and I feel that the amount is the correct amount.
MAYOR CREPEAU: Very well. If there are no changes I. will
entertain a motion to adopt the resolution confirming the

councilman Woodburn then introduced the following
resolution and moved its adoption:.

BESOLUTION NO.
RESOLUTION ADOPTING' AND CONFIRMING
ASSESSMENTS FOR IMPROVEMENT NO. SS-W-P-S'l'-78-4
BE IT BESOLVED by the City Council of theCity of.Arden
Bills, Minnesota, as follows:
1. The amount proper and necessary to be specialiy
assessed at this time for Improvement No. SS-W-P-ST~78-4 against
every assessable lot, piece or parcel of land affected thereby
has been duly calculated upon 'the basis. of benefits'" without
regard to cash valuation, in accordance with the provisions of
Minnesota Statutes, Chapter 429, as amended, and notice has
been duly mailed and published, as required by law,' that this
Council would meet to hear, consider and pass upon all objec-
tions, if any, and said proposed assessment has at,alitimes
since its filing been open for public inspection, and an oppor-
tunity has been given to all interested persons.to present
their objectionS, if any, to such proposed assessments.
2. This Council, having heard and considered all objec-
tions so presented, and being fully advised in the premises,
finds that each of the lots, pieces and parcels of land .enumer~
ated in the proposed assessment was and is specially"benefited
by the constructiOn of said improvement in not less 'than the
amount of the assessment set opposite the description of each
such lot, piece and parcel of land, respectively,a:ndsuch
amount so set out is hereby levied against each of. the respec-
tive lots, pieces and parcels of land therein.
3. The proposed assessments are hereby adopted and con-
firmed as the proper special assessments for each of said lots,
pieces and parcels of land, respectively, and the assessment
against each parcel, together with interest at the rate of 8%
per annum accruing on the full amount thereof from time to time
unpaid, shall be a lien concurrent with general taxes .upon such
parcel and all thereof. The total amount of each such assess-
ment shall be payable in equal annual principal installments
extending over a period of twenty (20) years, the first of
said installments, together with interest on the entire assess-
ment from the date hereof to December 31, 1981, to be payable
with general taxes for the year 1980, collectible in 1981, and
one of each of the remaining installments, together with one
year's interest on that and all other unpaid 'installments, to
be payable with general taxes for each consecutive year there-
after until the entire assessment is paid.

4. Prior to certification of the assessment to the County
Auditor, the owner of any lot, piece or parcel of land assessed
hereby may at any time pay the whole or at least 50% of such
assessment, with interest to the date of payment, .to'the City
Treasurer, but no interest shall be charged if such payment is
made within 30 days after the date of this resolution.
5. The City Clerk Administrator shall, as S00n as may be,
prepare and transmit to the County Auditor a certified'd~plicate
of the assessment roll, with each installment and interest on
each unpaid assessment'set forth separately, to be extended
upon the proper tax lists of the County, and the County Auditor
shall thereafter collect said assessments in the manner provided
by law. .
The motion for the adoption of the foregoing resolution
was duly seconded by Councilman Wingert, and upon vote being
taken thereon, the following voted in favor thereof: Al11 and
the following voted against the same: None1 whereupon said
resolution was declared duly passed and adopted.

County, Minnesota, do hereby certify that I have carefully
compared the attached and foregoing extract of minutes of a
special me~ting of the Council of said City held on the 18th

office, and the same is a full, true and complete transcript
therefrom insofar as the same relates to Improvement No.
