STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF ARDEN HILLS -e RESOLUTION No. 80-$~ A RESOLUTION VACATING PORTIONS OF STATE TRUNK HIGHWAY No. 51 RIGHT-OF-WAY LYING EASTERLY OF RIDGEWOOD ROAD, WESTERLY OF SNELLING AVENUE, AND SOUTHERLY OF LAKE JOHANNA BOULEVARD AND U. S. HIGHWAY No. 10 WHEREAS, the Arden Hills City Council by Resolution No. 79-54, passed on September 24, 1979, initiated proceeding under Section 412.851 of Minnesota Statutes, as amended, to determine whether it would be in the public interest to vacate all or any part of that portion of State Trunk Highway No. 51 lying easterly of Ridgewood Road, westerly of Snelling Avenue, and southerly of Lake Johanna Boulevard and U. S, Highway No. 10 which is des- cribed in Exhibit nAn attached to said Resolution, and WHEREAS, the Clerk-Administrator of the City of Arden Hills published in the New Brighton Bulletin on January 10, 1980 and January 17, 1980 a Notice of Public Hearing on the proposed vacation of said portions of. State Trunk Highway No. 51 and also caused copies of said Notice of Public Hearing to be posted for a period of at least two (2) weeks, commencing January 10, 1980, at the Arden Hills City Hall, Tony Schmidt Park, and the Penny's Supermarket at Arden Plaza, three of the most public places in the City of Arden Hills, and WHEREAS, a public hearing before the City Council was con- ducted on Monday, January 28, 1980 and continued on March 10, 1980, and WHEREAS, the City Council, after the close of the public hearing on March 10, 1980, unanimously deemed it to be in the public interest to vacate that portion of the State Trunk Highway No. 51 right-of-way shown on the Georgi-Schmidt & Assoc;,'Inc. survey of December 12, 1979 which lies north of a line perpendicular to Snelling Avenue beginning at the arc on Ridgewood Avenue as such line is sketched on said survey and dated March 10, 1980, subject to preparation of a legal description thereof by Georgi- Schmidt & Assoc., Inc., and ~. WHEREAS, by survey dated April 25, 1980 and revised on June 11 and June 19, 1980, the City Council has now been given a legal description which satisfactorily complies with its decision on March 10, 1980, NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City Council of the City of Arden Hills, four-fifths (4/5ths) of the members of the Council--namely, Mayor Crepeau and Councilmen Hanson, Woodburn and Crichton--voting in favor of this Resolution, that it is in the public interest of the City of Arden Hills to vacate the por- tions of State Trunk Highway No. 51 hereinafter described. . . BE IT FURTHER RESOLVED, that the following portion of State Trunk Highway No. 51 is hereby vacated: All that part of Government Lot 1, Section 34, T30N, R23W, which lies Southerly of a line 43 feet south and parallel to the North line of said Section 34, northerly ofa line 288.99 feet south and parallel to the said North line, southwesterly of a line parallel to and distant 100 feet southwesterly of the centerline of State Trunk Highway No. 51 (Snelling Ave.) and easterly of the following des- cribed lines: Commencing at a point on the North line of said Section 34 distant 967.17 feet East of the Northwest corner of said Section 34, said point being on the centerline of said State Trunk Highway No. 51; thence West (assumed bearing) 300,98 feet along said North line of Section 34; thence S 13019' E 44.19 feet to a point 43 feet south of the said North line, said point being the point of beginning of the lines to be herein described; thence continuing S 13019' E 113.42 feet; thence on a curve to the left 43.84 feet, delta angle of 41005'40", radius of 61.12 feet; thence S 54024t40" E 157.39 feet; thence on a curve to the right 108,27 feet, delta angle of 72046', radius of 85.25 feet to a point on the Northeasterly line of the Plat of Arden Hills and there terminating. BE IT FURTHER RESOLVED, that the Clerk-Administrator is hereby authorized and directed to cause a certified copy of this Resolution to be recorded in the office of the Ramsey County Recorder and to prepare and cause to be presented to the Land Records Division of the Ramsey County Department of Property Taxation and recorded in the office of said County Recorder a Notice of Completion of Vacation Proceedings as required by Sec- tion 412.851 of Minnesota Statutes, as amended. ~:iL Passed by the City Council of the City of Arden Hills this ~~ day of June, 1980. STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF ARDEN HILLS ~OTICE OF COMPLETION OF VACATION PROCEEDINGS TO WHOM IT MAY CONCERN: PLEASE TAKE NOTICE, that on September 24, 1979, the City Council of the City of Arden Hills by Resolution No. 79-54 initiated a proceeding pursuant to Section 412.851 of Minnesota Statutes, as amended, to determine whether it would be in the public interest to vacate certain portions of Stat~ Trunk Highway No. 51 which is situated in the City of Arden Hills, County of Ramsey, and State of Minnesota. Said proceeding culminated in a Resolution vacating a certain portion of said State Trunk Highway No. 5l--Resolution No. 80.1t, adopted by the Arden Hills City Council on June 30, 1980 by four-fifths (4/5ths) of the members thereof. A certified copy of said Resolution which identifies in detail the particulars of said vacation proceeding, states the time of completion thereof, and describes the real estate and lands affected thereby is attached hereto, made a part hereof and is incorporated by reference herein as Exhibit "A". This Notice is made by the Clerk-Administrator of the City of Arden Hills in compliance with the requirements of Section 412.851 of Minnesota Statutes, as amended.
