ORDINANCE NO. 2023-011
CITY OF ARDEN HILLS
COUNTY OF RAMSEY
STATE OF MINNESOTA
AN ORDINANCE PROHIBITING SMOKING AND CANNABIS USE
WITHIN OPEN SPACE SITES
THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA, ORDAINS:
SECTION 1. Chapter 7 — Recreation Areas, Section 720 — Arden Hills Parks System,
Subsection 720.02—Definitions, is hereby amended as follows:
• Electronic Delivery Device. Any product containing or delivering nicotine, lobelia, or any
other substance,whether natural or synthetic, intended for human consumption through inhalation
of aerosol or vapor from the product. Electronic delivery device includes but is not limited to
devices manufactured,marketed,or sold as electronic cigarettes,electronic cigars,electronic pipe,
vape pens,modes,tank systems,or under any other product name or descriptor.Electronic delivery
device includes any component part of a product, whether or not marketed or sold separately.
Electronic delivery device excludes drugs, devices, or combination products, as those terms are
defined in the Federal Food, Drug, and Cosmetic Act, that are authorized for sale by the United
States Food and Drug Administration.
• Smoke. Inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe,
or any other lighted or heated product containing, made, or derived from nicotine, tobacco,
marijuana, or other plant or substance,whether natural or synthetic,that is intended for inhalation.
Smoking includes carrying or using an activated electronic delivery device.
• Cannabis flower, cannabis products, lower-potency hemp edibles, hemp-derived consumer
products. These terms shall have the meaning established in Minn. Stat. § 342.01.
THC. Tetrahydrocannabinols.
SECTION 2. Chapter 7 — Recreation Areas, Section 720 — Arden Hills Parks System,
Subsection 720.06—General Conduct, is hereby amended as follows:
Subd. 11 Tobacco and THC/Cannabis.No person shall offer for sale, smoke,vape, ingest,use
or otherwise consume any product containing tobacco, THE, cannabis flower, cannabis products,
lower-potency hemp edibles, or hemp-derived consumer products in any open space site.

SECTION 3. This Ordinance shall become effective immediately upon its passage and
publication according to law. A Summary of this Ordinance will be published in accordance with
state statute.
PASSED and ADOPTED this 11t` day of September, 2023, by the City Council of the
City of Arden Hills, Minnesota.
