RESOLUTION DELETING ASSESSMENT FOR WATER
I~PROVEMENT Nos. 77-5 and 78-2 AS TO
pARCEL NO. 25-01600-200-53
W~EREAS, the assessment roll for Water Improvement
No. 77-5 and ]8-2 (Auditor's No. 1943) was adopted by the City
Council on AU$ust 21, 1979 and was certified to the Ramsey
County Auditor on September 24, 1979, and
waEREAS, the assessment for said Water Improvement
No. 77-5 and ]8-2 (Auditor's No. 19.3) with respect to said
Parcel No. 25~01600-200-53 was the sum of $1,398.27, install-
ments of which were to be collected along with real estate taxes
payable in the year 1980 over a period of 20 years, and
~EREAS, the owners of said Parcel No. 25-01600-200-53,
JAMES CALIGUIaE AND MARGARET M. CALIGUIRE, 1737 McMenemy Road,
Maplewood, Minnesota 55117, have requested that the assessments
in the case ot each of the aforesaid improvements be deleted be-
cause said pa~cel has no access and is virtually unbuildable due
to existence ~f easements thereon in favor of Northern States
Power'Company, and
WlEREAS, after hearing all of the evidence adduced by
Mr. and Mrs. Caliguire. the City Council has determined that
they are entitled to the relief they have sought,
N(JW,THEREFORE, BE IT HEREBY RESOLVED, by the City
Council of the City of Arden Hills, that the assessment for Water
Improvement No. 77-5 and the one for Water Improvement No. 78-2
as they relat~ to said Parcel No. 25-01600-200-53 be deleted,
annulled and cancelled.
BE IT FURTHER RESOLVED, that the aforesaid deletion be
made effective, if possible for the installments of the aforesaid
assessments d~e and payable along with real estate taxes due and
payable in the year 1980.
~," '. BE IT FURTHER RESOLVED, that the Clerk-Administ r'atCll!:'
of the City of Arden Hills be and she hereby is authorized to
cause a certified copy of this Resolution to be filed with the
Ramsey County Department of Property Taxation for the purpose of
effectuating the ,foregOing deletion.
