RESOLUTION No. 79-67
RESOLUTION REVISING ORIGINAL ASSESSMENT FOR
WATER IMPROVEMENT No. 68-2 AND SEWER IMPROVE-
MENT No. 14 AS TO LOTS 42 AND 43, BLOCK 28,
ROHLEDER'S HOME AND GARDEN ACRES
WHEREAS, the assessment roll for Consolidated Water
Improvement Nos. 68-2 and 68-3 (Auditor's No. 843) was adopted
by the City Council on September 28, 1970 and was certified to
the Ramsey County Auditor on october 28, 1970, and
WHEREAS, said assessment roll was amended after hearings
on supplemental assessments and reassessments conducted on
November 9 and November 10, 1970, and said amended assessment roll
was certified to the Ramsey County Auditor on December 10, 1970,
and
WHEREAS, the original assessment, as amended, for said
Consolidated Water Improvement Nos. 68-2 and 68-3 with respect to
Lots 42 and 43, Block 28, Rohleder's Home and Garden Acres, was
the sum of $1,130.00, installments of which were to be collected
along with real estate taxes payable in the year 1971 over a
period of 20 years, and
WHEREAS, the assessment roll for Sanitary Sewer Improve-
ment No. 14 (Auditor's No. 862) was adopted by the City Council
on September 28, 1970 and was certified to the Ramsey County
Auditor on November 6, 1970, and
WHEREAS, the original assessment for said Sanitary Sewer
Improvement No. 14 with respect to Lots 42 and 43, Block 28,
Rohleder's Home and Garden Acres, was the sum of $1,430.00, install-
ments of which were to be collected along with real estate taxes
payable in the year 1971 over a period of 20 years, and
WHEREAS, the owner of said Lots 42 and 43, Alexander
Chvestuik, who resides at 2300 Brookdale Drive, Minneapolis, Minne-
sota 55444, has requested that the original assessment in the case
of each aforesaid improvement be reduced because only one of said
lots is usable and buildable, the usefulness and buildability of
the other lot having been drastically impaired by the imposition
of easements thereupon in favor of Northern States Power company,
and
WHEREAS, after hearing all of the evidence adduced by
Mr. Chvestuik, the City Council has determined that Mr. Chvestuik
is entitled to the relief he has sought,

NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City
Council of the City of Arden Hills, that the original assessment,
as amended, for Consolidated Water Improvement Nos. 68-2 and
68-3 as it relates to said Lots 42 and 43, Block 28, Rohleder's
Home and Garden Acres, be reduced and revised to $630.00 from
$1,130.00 and that the original assessment for Sanitary Sewer
Improvement No. 14 be reduced and revised to $740.00 from
$1,430.00.
BE IT FURTHER RESOLVED, that the aforesaid revision be
made effective, if possible, for the installments of the afore-
said assessments due and payable along with real estate taxes
due and payable in the year 1980 and that Alexander Chvestuik,
the property owner, be given credit for all amounts he has paid
to reduce the balances of said assessments to the date hereof.
BE IT FURTHER RESOLVED, that the Clerk-Administrator
of the City of Arden Hills be and she hereby is authorized to
cause a certified copy of this Resolution to be filed with the
Ramsey County Department of Property Taxation for the purpose of
effectuating the foregoing revision.
