AUTHORIZING DEFERRAL OF SPECIAL ASSESSMENTS FOR
SENIOR CITIZENS AND ESTABLISHING CRITERIA FOR
DEFERRAL

WHEREAS. the City Council believes that It Is In the best
Interest of all the cItizens of the.Clty of Arden Hills to estab-
lish a procedure for the deferral of special assessments for senior
citizens where is hardship exists.
N~W. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARDEN HILLS. MINNESOTA, AS FOLLOWS:
I. Establishment of Deferral. Pursuant to MSA 9435,.193 at.
seq., special :::ssessment Installment payments payable by senior
citizens can be deferred If requested by owners and If payment ,of
such Insta II mants would create a hardship.
2. Criteria. In determining whether or not a senior cItizen
Is eligible for deferral of special assessment Installment payments,
the following criteria are established:
A. Senior cltl~ens special assessment hardship
deferral applies to special assessmants
levied after the date of the adoption of
this Resolution.
B. S~nlor cltlzan specIal assessment hardship
deferral applies to qualifying spacial '
assessments against all propertIes classi-
fied as "Homestead" pursuant to MSA Chapter
273, where one or more of the owners of
such property Is 65 years of age or older
andd It would create a hardship for the owner
or owners of the property to pay the specl al
assessment installments as they become due.

C. It shall be presumed that a hardship exists,
If:
(I) The total Income Is $10,000 or
less, or
(2) Assessment Installments, on an
annual basis, are more than 10%
of Income over $10,000. Income
will be defined to Include all
pension benefits and all ,other
Income.
(3) A II ,,.Olllne 1"'5 of the proPerty veri fy

criteria for establishing a hard-
ship by completing an application
provided by the City or the County.

D. In casas vlhere exceptional and unusual
circumstances exist, the City Council
may determine that a hardship exists
despite th~ fact that the minimum In-
come requl reman'fs of Section C (I) are
not met; such cases shall be decided by
the Councl I on a case by case basis.
3. Jnterest. Interest shall be charged on any assessment
deferred pursuant to this Resolution at a rate equal to the rate
charged on other assessments for the particular public Improvement
project the assessment Is finanCing.
4. Termination of Deferrment. The option to defer the pay-
ment of special assessments pursuant to this Resolution shall terminate

Interest, shal I become due upon the occurrence of any of the follow-
Ing events:
A. Request of property owner.
B. Death of property owner 65 yeal"s of age
or older.
C. Sale, transfer or subdivision of the
p roparty or any part the reof.
D. The CIty determines that 8 hardship
no longer exists.
