RESOLUTION DETERMINING THAT AN ENVIRONMENTAL
IMPACT STUDY IS UNNECESSARY IN CONNECTION WITH
CONSTRUCTION AND INSTALLATION OF ROADWAY AND
UTILITIES FROM SOUTHERLY RIGHT-OF..,WAY LINE OF
PROPOSED NURSERY HILL COURT TO NORTHERLY
RIGHT-OF-WAY LINE OF AMBLE ROAD AS PROPOSED IN
THE KARTH LAKE WEST IMl'ROVEMENT
WHEREAS, the Honorable Sidney P. Abramson, Judge of Ramsey
County District Court, by Findings of Fact, Conclusions of Law,
and Order, dated June 25, 1979 ordered the City of Arden Hills to
determine whether an environmental impact study under Section
l16D.04 of Minnesota Statutes, as amended, is necessary for the
construction of the access route from the southerly right-of-way
line of proposed Nursery Hill Court (in the proposed subdivision
"Karth Lake West") to the northerly right-of-way line of existing
Amble Road, a 60' x 132' portion of which crosses undeveloped
property owned by Mr. and Mrs. Charles O. Amble, and the taking
of which was deemed necessary and authorized by law in said Order
of Judge Abramson, and
WHEREAS, Section l16D.04, Subd. 1, provides in pertinent
part as follows--
"Where there is a potential for significant environ-
mental effects resulting from any major governmental
action . . . such action shall be preceded by a
detailed statement prepared by the responsible
agency . . . on: (al the environmental impact of
the proposed action. . .", and
WHEREAS, said proposed access roadway will be a "local
street" as that term is defined in Section 22-3 of the Arden Hills
Code, and its construction in no manner constitutes a "major
governmental action" nor has the potential for significant
environmental effects, and

WHEREAS, Section l16D.04, Subd. 2, authorizes the Minnesota
Environmental Quality Board to promulgate rules and regulations
setting forth categories and guidelines as to those instances in
which environmental impact statements are required to be prepared
for new and existing actions, and
WHEREAS, the City's proposed action in constructing said
access roadway and installing utilities therein falls nowhere
near any of the mandatory categories for the preparation of
environmental assessment worksheets and environmental impact state-
ments as those categories are set forth in the rules and regula-
tions promulgated by the Minnesota Environmental Quality Board,

NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council
of the City of Arden Hills that the City's proposed action in
constructing the aforesaid access roadway and installing utilities
thereunder in connection with the Karth Lake West improvement
project in no manner necessitates or warrants the City's prepara-
tion of an environmental assessment worksheet or an environmental
impact statement.
~ BE IT FURTHER RESOLVED, that the Clerk-Administrator be and
she hereby is authorized and directed to forward certified copies
of this Resolution to Judge Sidney P. Abramson, Judge of Rsmsey
County District Court, and to Mr. Charles R. Bartholdi, attorney
for Charles O. Amble and Marlys R. Amble.
Passed by the Arden Hills City Council this 25th day of
June, 1979.
