A RESOLUTION AUTHORIZING RELEASE OF COUNTY ROAD E
ROADWAY AND UTILITY EASEMENT
WHEREAS, the City of Arden Hills (the "City") has for
fourteen (14) years been the holder of a perpetual roadway and
utility easement created in an instrument dated May 8, 1967 and
recorded in the office of the Ramsey County Register of Deeds on
October 2, 1967 in Book 2093, Ramsey County Records, Page 640 as
Document No. 1708908 which encumbers the South 50 feet of the
North 93 feet of the following described parcel of land owned by
DeCoster Company ("DeCoster"), a Minnesota corporation:
The North 268 feet of the West 148 feet of the East
495 feet of the Northwest 1/4 of the Northeast 1/4
of Section 34, Township 30 North, Range 23 West,
Ramsey County, Minnesota, subj ect to an easement
for road purposes over the North 43 feet thereof
and subject to an easement for ingress and egress
over the West 41 feet thereof, and
WHEREAS, DeCoster is selling said parcel of land to a
third party, and both DeCoster and the third party wish said
parcel to be released from said easement, and
WHEREAS, the City has never used the easement for the
purposes intended and granted and there is no longer any reason
for said easement,
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council
of the City of Arden Hills that the aforesaid easement be
released and extinguished and that the Mayor and Clerk-
Administrator be authorized and directed to execute an instrument
releasing and extinguishing the easement.
BE IT FURTHER RESOLVED, that the Clerk-Administrator be
and she hereby is authorized and directed to furnish certified
copies of this Resolution to DeCoster and to the third party
purchasing DeCoster's parcel.
