HomeMy WebLinkAbout81-069 . 4 . .. \ STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF ARDEN HILLS RESOLUTION No. 81-69 A RESOLUTION DECRYING LACK OF NOTICE TO PROPERTY OWNERS OF PROPERTIES NEAR A PROPOSED RESIDENTIAL FACILITY FOR THE HOUSING OF MENTALLY HANDICAPPED PERSONS WHEREAS, the City of Arden Hills was duly notified by the Minnesota Department of Public Welfare of the proposed use of 1385 Cummings Lane in Arden Hills as a group home for mentally handicapped young adults pursuant to Section 245.821, and WHEREAS, the City of Arden Hills mistakenly assumed that the Department of Public Welfare would also provide written notice to the owners of properties located within a 350 foot radius of 1385 Cummings Lane so that they could participate in the determination by the Department of whether the residence at 1385 Cummings Lane would be suitable for group home purposes, and WHEREAS, A.C.R. Homes, Inc., the applicant for a license to operate the group home at 1385 Cummings Lane, did not notify any of the owners of properties in proximity to 1385 Cummings Lane of the various hearings before the Department of Public Welfare, Metropolitan Council and the Ramsey County Board which were necessary in order for it to receive a license to operate a group home at 1385 Cummings Lane, and WHEREAS, the neighbors of 1385 Cummings Lane--because of the lack of notice not only from the City of Arden Hills but also from the Department of Public Welfare, the Ramsey County Board and Metropolitan Council--have been effectively stripped of any voice in the determination of whether or not 1385 Cummings Lane and the neighborhood within which it is located are suitable for a group home, NOW, THEREFORE, the City Council of the City of Arden Hills--by unanimous vote of all of the Council members--does hereby decry its own failure and the failure of the Department of Public Welfare, the Ramsey County Board and Metropolitan Council to provide written notice to the owners of properties located in proximity to 1385 Cummings Lane of the proposed use and licensing thereof as a group home for mentally handicapped young adults and hereby sincerely requests that the Department of Public Welfare, Ramsey County Board and Metropolitan Council--in the future-- notify the owners of properties within a 350 I radius of the property proposed to be devoted to group home purposes of any hearings to be conducted by such agency with respect to such proposed use. BE IT FURTHER RESOLVED, that the Clerk-Administrator be and she hereby is authorized and directed to provide certified copies of this Resolution to the Department of Public Welfare, Ramsey County Board and Metropolitan Council and any other agencies involved in the decision-making process with respect to not only group homes for mentally handicapped but also group homes for physically disabled, mentally ill, chemically or . . . . - " otherwise dependent persons, and correctional facilities, and to the City of Arden Hills' appropriate legislative representatives.
