RESOLUTION INITIATING VACATION OF
SERVICE DRIVE ADJACENT TO HAMLINE AVENUE NORTH
LYING SOUTH OF THE WESTERLY TERMINUS OF
TILLER LANE PURSUANT TO SECTION 412.851 OF
MINNESOTA STATUTES, AS AMENDED
WHEREAS, Section 412.851 of Minnesota Statutes, as
amended, permits a municipal council to initiate a proceeding to
vacate any street, alley, public grounds, public way, or any part
thereof, and
WHEREAS, the City Council of the City of Arden Hills
desires to determine whether it would be in the public interest
to vacate the service road lying easterly of and adjacent to
Hamline Avenue North and southerly of the westerly terminus of
Tiller Lane,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Arden Hills, a quorum thereof being present, a proceeding
pursuant to Section 412.851 of Minnesota Statutes, as amended, be
and it hereby is initiated in order to determine whether it would
be in the public interest to vacate the service road described in
the second recital hereof.
BE IT FURTHER RESOLVED, that the City Engineer be and he
hereby is authorized and directed forthwith to prepare the
necessary legal description of the aforedescribed service road.
BE IT FURTHER RESOLVED, that the Clerk-Administrator and
the City Attorney, after the City Attorney I s receipt of the
aforesaid legal description from the City Engineer, be and they
hereby are authorized to cause a notice of a public hearing to
determine the public interest in said vacation to be published in
the New Brighton Bulletin and to be posted in at least three (3)
of the most public places in the City, for at least two (2) weeks
prior to the date of said public hearing, all in accordance with
the provisions of Section 412.851 of Minnesota Statutes, as
amended.
BE IT FURTHER RESOLVED, that the Clerk-Administrator be
and she hereby is authorized and directed to cause certified
copies of this Resolution to be served upon those owners of
properties abutting the aforedescribed service road.
