CALL TO ORDER 1. PUBLIC INQUIRIES/INFORMATIONAL Members of the public are invited to remotely monitor the City Council meeting via Zoom using the below link. Members are also welcome to provide public comments during this section of the agenda via Zoom. Members wishing to provide public comment must use the "raise hand" feature in Zoom to identify themselves as wanting to make a public comment and will be called upon to provide their public comment during this portion of the agenda. Principal Engineer — Bolton & Menk SUBJECT: 2024 PMP Street and Utility Improvements Project Update Budgeted Amount: Actual Amount: Funding Source: $3,001,100 $3,000,000 (estimate) PIR, Surface Water, Sanitary, Water, Special Assessments Council Should Consider • Project update presentation provided by Bolton & Menk. Background/Discussion On August 14, 2023, City Council held an Improvement Public Hearing and adopted Resolution 2023-040 Ordering Improvement and Preparation of Plans and Specifications for the 2024 PMP Street and Utility Improvements Project. Streets proposed for Full -Depth Reclamation: • Keithson Drive from County State Aid Highway (CSAH) 96 West to 800 feet south of CSAH 96 West • Royal Hills Drive from Snelling Avenue North to Arden View Drive • Colleen Avenue from McClung Drive to Hamline Avenue North • Norma Avenue from Dawn Circle to Briarknoll Drive • Norma Avenue from Briarknoll Drive to Colleen Avenue • James Avenue from Indian Oaks Trail to Colleen Avenue Full -Depth Reclamation consists of grinding the existing pavement, shaping the generated aggregate material to raise the center crown to improve pavement drainage and repaving the roadway with 4- inches of bituminous pavement. Page 1 of 3 Streets proposed for Mill & Overlay: • Briarknoll Circle • Briarknoll Drive from Snelling Avenue North to Norma Avenue • Royal Lane from Norma Avenue to Floral Drive West • McClung Drive from Snelling Avenue North to Colleen Avenue • Colleen Circle • Arden Vista Court Mill & Overlay consists of grinding and removing the top 2-inches of existing pavement and repaving the roadway with 2-inches of bituminous pavement. This estimate includes the anticipated costs for engineering design, surveying, and construction administration as a 27% contingency, which is consistent with the 2021 PMP and 2022 PMP. In accordance with the City's Assessment policy, the preliminary assessment for the recommended improvement is calculated as: Reclamation Areas: 50% Estimated Street Project Costs = $486,800 Residential Equivalent Units = 86 Assessment Rate $5,660 Mill & Overlay Areas 50% Estimated Street Project Costs = $248,750 Residential Equivalent Units = 69 Assessment Rate = $3,605 As the project is designed and competitively bid, the calculated assessment amount will be updated leading up to the adoption of the assessment roll. The Applicant is seeking feedback from the City Council on a concept plan as potential options for future development of the 62 +/- acres to be purchased from the Federal Government. The Concept Plan Review process is an opportunity for the City Council to provide comments and ask questions regarding proposed developments. A concept review is considered advisory and is nonbinding to the City and Applicant (Section 1320.14, Subd 4 of the Zoning Code). No formal action can be taken at a Work Session. A formal application will be subject to the full review process, including a public hearing with Planning Commission and City Council review. Background The Subject Property is part of approximately 1,611 acres owned by the Federal Government and used primarily by the Minnesota National Guard as the Arden Hills Army Training Site (AHATS). The parcel shown below as the "sale area" would be 62 +/- acres. Last year, the Federal Government held an auction administered by GSA to sell the property "as is". The auction outlined that the Buyer purchasing the property would be responsible for handling all of the processes associated with the future development of the site (i.e. land use approval, demolition, permitting, etc.). The Applicant was the high bidder at the end of the auction and is completing their due diligence prior to purchase. For the concept review, the Applicant has submitted a high-level overview of two future development scenarios. The Applicant wishes to engage in a discussion with the Council in order to gauge the City's perspective of potential future vision(s) for this site regarding rezoning Page 1 of 2 to I-2 Zoning District with outdoor storage, private access easement, and extension of utilities to the site. Discussion Concept Plan Proposal The Applicant has prepared two concept layouts both guided towards industrial land uses with accessory outdoor storage in a Warehouse -Office Park development pattern. In both scenarios, the Applicant has identified an intent to seek rezoning of the 62-acres to I-2, General Industrial Zoning District. The purpose of this zoning district is to be "an area where more intensive light industrial land uses may locate and to present the least deleterious effect to adjacent, less intensive land uses." At this concept review stage, staff does not have the details necessary to complete a preliminary analysis of development scenarios as it pertains to compliance with I-2 District requirements or design standards. Address: Unassigned PIDs: Unassigned Total Acres: Approximately 62 acres EXISTING SITE DESCRIPTION Hillview is an approximately 62-acre parcel located near the corner of County Road I and Fairview Avenue (the "Property"). The Property was formerly used by the United States Department of the Army for the purpose of manufacturing and testing ammunition. The Property was improved with buildings, roads, and specialized infrastructure that was constructed in the 1940s and 1950s and is in various stages of disrepair. The Property is located in the northwest corner of Arden Hills city limits with easy access to U.S. Highway 10, County Highway 96 and Interstate 35W and is bounded by the Ardens Hills Army Training Site on the north, east, and south and the Rice Creek Corridor on the west. Maplewood Development, Inc. and it's affiliate, Belair Sitework Services, Inc., will undertake to demolish older, existing, abandoned buildings which are all past their useful life and are no longer being utilized by the United States Government. Additionally, sitewide environmental remediation work will be undertaken under permit with the Minnesota Pollution Control Agency (MPCA). This preparatory work is estimated to take 4-6 months. Site topography is generally flat on the subject site, but it is surrounded by significant elevation and natural environmental changes along its' perimeter, with a man-made berm on the south edge of the property to the north and natural grade changes to the west and south, including natural wetlands which provide significant separation from all developed areas and, specifically, separation from future proposed development to the south and east. Ramsey County Parks owns property to the west and there are plans to improve that area with trails and perhaps, other Park - related facilities. The site will be accessible through an Easement granted by the United States Government to Ramsey County as Grantee and to the Hillview Property Owner as Sub -Grantee. This 100' wide Easement dictates that a private road is to be constructed, maintained, and operated by the parties to the Easement Agreement, in perpetuity. The width of the Easement allows for municipal services to be constructed to serve both properties from County Road I south to both sites, but the question of where Sewer and Water can best serve these properties must be addressed now. The Consulting Engineer for the Developer, Alliant Engineering, has reached out to the City of Arden Hills Public Works Department, as well as the City of Shoreview Public Works Director, to determine the most feasible, least intrusive, and easily maintained source and system for this connection. There are two possible sources that will be illustrated during Concept Review for consideration by the Council, as this is the key component in determining the developability of the site. LAND USE AND ZONING DESIGNATIONS The development Property is guided for the following land use within the City's 2040 Land Use Plan: P/OS Park & Open Space In spite of the current open space zoning on the Hillview parcels, we believe that the proposed development plan is consistent with the City of Arden Hills goals for the property and is the highest and best use for this site in particular. The following is a summary of primary project elements currently proposed: • Creation of an Office -Warehouse Park with a variety of Buildings and Uses as shown. • Infrastructure turn lane improvements to County Road I, if necessary. • Construction of an Access Road to be Operated and Maintained by Joint Agreement with Ramsey County. • Wetland buffer creation in accordance with requirements where necessary. • Extension of sanitary sewer and water main for this development and Ramsey County Parks. • Installation of stormwater management facilities to provide volume control, water quality and rate control for runoff from the new development. • Extension of public trailways and sidewalks for pedestrian connectivity to the Park. • Comprehensive development landscape plan with perimeter landscaping. PROPOSED DEVELOPMENT PLAN It is the applicant's intent to provide a Warehouse -Office Park development consistent with the City of Arden Hills goals for this area and input provided by City Staff. As such, the current application proposes for the re -zoning of the subject property to I-2 under the City's current Zoning classifications. This will provide the flexibility necessary to attract businesses that require needed parking and storage for transportation related equipment and ancillary materials. The current concept submittals provide for a window into possible scenarios for several buildings on the site, but flexibility is needed to attract the variety of Tenants required to make this a successful Business Park for not only today's Users, but for future Tenants whose needs keep evolving. The Concept submittal includes building elevation examples from RJ Ryan Construction, Inc., a Master Builder of Industrial Warehouse Buildings throughout the Twin Cities Metropolitan Area. RJ Ryan will lead the Vertical Construction efforts on this site, when possible, to help ensure consistency with the Architectural theme of the project. LANDSCAPING AND SCREENING: This project proposes a variety of landscaping finishes around each building as well as a landscape buffer along the perimeter of the site. Tree and plant species will be varied to provide adequate diversity across the site. TIMING/PHASING/STAGING The entire site will be mass graded in one phase to allow for the remediation of all contaminants, mass correction of soils for proper compaction prior to placement of footings, and the creation of the storm water basins prior to any off -site discharge. Construction of the Buildings will likely be completed in multiple phases based on market demand. Prior to construction, each building plan will be brought before the Council to review compliance with City standards. Demolition and Mass Grading are anticipated to begin Spring 2024 with the first phase of utilities and streets completed by October 2024. Vertical construction is anticipated to begin late 2024 with a full build out of the community taking place over two to four years. Background/Discussion The Public Works Maintenance Workers are proposing to define winter hours as the first full week of November to the last full week of March (potential snow plow event times). Summer hours defined as days outside of winter hours. The current Public Works schedule is summer hours (between Memorial Day and Labor Day) Monday — Thursday, 6:30am to 4:OOpm and Fridays 6:30am to 10:30am; normal hours Monday — Friday 7:OOam to 3:30pm. Each day, outside of the half -day on Fridays for summer hours, the crew has scheduled downtime of 1 hour from noon to 1pm. The Public Works Maintenance Workers also propose to reduce the scheduled downtime to 1/2 hour, from noon to 12:30pm. The result of this change would adjust the end of workday time to 3:30pm for summer hours and 3:OOpm for winter hours. Day care facilities for over ten (10) persons shall be considered as accessory uses for houses of worship and schools within all residential districts if located in the principal building. Subd. 3 Home Occupations. Home occupations are allowed as either accessory uses or conditional uses depending on the characteristics of the operation. A. All home occupations shall comply with the following conditions: 1. It shall not result in traffic, parking, noise, light, fumes and odors to such an extent that it is noticeable that the property is being used for non-residential purposes. 2. It shall be conducted entirely within the dwelling. 3. There is no exterior evidence of the home occupation. 4. It does not require any special entrances to the dwelling. B. Class I Accessory Home Occupations. 1. Home Occupations will be permitted as accessory uses if they meet the conditions stipulated in the home occupation definition and following conditions: a) The business is engaged only by the occupants of the premises; b) The business activity does not occupy more than twenty-five (25) percent of the gross floor area of the dwelling; c) There will be no patrons visiting the premises; d) It requires no delivery of products other than those delivered by private passenger vehicle. 2. Applicants for Class I Accessory Home Occupations shall be required to obtain an Accessory Home Occupation Permit from the City prior to engaging the activity. Review by the Planning Commission and City Council is not required. Application forms as prescribed by the Administrator shall be accompanied by the following information: a) A photograph of the residence; b) A floor plan indicating the floor area to be used by the home occupation along with a tabulation of the total floor area and the floor area to be used for the home occupation; c) A statement describing the home occupation and the compliance with the required conditions; and, d) A copy of the state or county license or permit if such a license or permit is required by the state or county for the proposed home occupation. 1325.02 Accessory Uses C. Class II Conditional Accessory Home Occupations. 1. Home occupations may be allowed by Conditional Use Permit as regulated in Section 1355.04 Subd 3 if they meet the conditions stipulated above for all Home Occupations and the following conditions: a) The primary business activity shall be conducted by an occupant of the residence; b) One person not residing in the residence may be employed to assist in the business activity; c) It does not occupy more than thirty-three (33) percent of the floor area of the dwelling; d) It has a limited number of patrons visiting the premises; e) Off-street parking for no more than two (2) additional vehicles other than those required by the occupants shall be permitted. On -street parking shall not be used to satisfy required parking; and, f) It requires delivery of products to the premises no more than once per day. 2. Applicants for Class II Conditional Accessory Home Occupations shall follow the procedures prescribed in the Conditional Use Permit section of Appendix A, Procedure Manual. The application shall be accompanied by the information required for Class I Home Occupations in Section 1325.02 above and a site plan showing any additional parking or other modifications to the site required to accommodate the home occupation. A copy of any required State or County license or permit as discussed in Class I Home Occupations shall be submitted prior to the issuance of a Conditional Use Permit, however, evidence that the proposed Home Occupation meets all the requirements for State or County licenses or permits shall be submitted with the Conditional Use Permit application. 3. In reviewing applications for Class II Conditional Accessory Use Permits for Home Occupations the City shall consider criteria which affect the appropriateness of a particular use in the location proposed, as discussed in Section 1355.04 Subd 3 and Appendix A, Procedural Manual. Subd. 4 Accessory Outdoor Display and Sales. A. Outdoor display and sales shall only be permitted as an accessory use on a property where the principal use is either Retail Sales and Services or Service Station. B. An Administrative Permit shall be required from the Community Development Department to allow outdoor display and sales of goods. The Community Development Department shall review a site plan and specifics of the proposed outdoor display and sales area and may issue the permit, subject to, but not limited to, the following requirements: 1. The total display and sales area shall be determined based on the following formula: a. For properties with a principal building of 15,000 square feet or less in size, the permitted display and sales area shall be a maximum of 300 square feet. 2 1325.02 Accessory Uses b. For properties with a principal building greater than 15,000 square feet in size, the permitted display and sales area shall be two percent of the base area of the principal building, but not to exceed 1,000 square feet. 2. Merchandise shall be stacked and/or arranged neatly on a hard surface and may be up to six feet in height. 3. The display and sales area shall be located adjacent to the principal building and on the side of the principal building with the main entrance. No merchandise shall be permitted to be displayed on Service Station islands. 4. The display and sales area shall not obstruct pedestrian access on the site, whether from parking areas to the building entrance or from the public street to the building entrance. S. The display and sales area shall not occupy or obstruct on -site parking spaces. 6. The type of merchandise displayed shall be limited to items which require an outdoor location, such as plants or fuel, and any items which because of large volume or weight are housed outdoors, such as vending machines, salt, or landscaping materials. 7. Outdoor display and sales areas shall be screened when located within 200 feet of a residentially zoned property. (added 3/28/16) Subd. 5 Accessory Commercial Recreation - Outdoor. A. Commercial Recreation -Outdoor shall only be permitted in the B-2 General Business District. B. An Administrative Permit shall be required from the Community Development Department to allow outdoor recreational activities. The Community Development Department shall review a site plan and specifics of the proposed outdoor recreation area and may issue the permit, subject to, but not limited to, the following requirements: 1. The Subject Property shall not be located immediately adjacent to a residentially zoned property. 2. All commercial recreation - outdoor related activity must cease by 10 PM on weekdays and weekends. 3. The location of the outdoor commercial recreation area needs to be contiguous to the principal building and shall be a contained space with a defined perimeter of either decorative fencing, retaining walls, and/or plantings. 4. The permitted commercial recreation - outdoor area shall not exceed 1,500 square feet. (added 4/24/2023) Subd. 6 Lower -Potency Hemp Edible Sales. A. Lower -Potency Hemp Edible Sales shall be a Conditional Accessory use only permitted in the B-2 General Business, B-3 Service Business, B-4 Retail Business, NB Neighborhood Business and GB Gateway Business Zoning Districts where the principal use is Retail Sales & Service, Restaurant, or Service Station, the business has a liquor or tobacco license issued by the City, and when such accessory use is clearly incidental to the principal use.. 3 1325.02 Accessory Uses B. Applicants for Conditional Accessory Lower -Potency Hemp Edible Sales shall follow the conditional use permit procedures prescribed in Section 1355.04, subd. 3, and Appendix A, Procedure Manual. Roof -mounted solar energy systems -shall be subject to the Building Code to ensure the system meets the wind load standards for the roof and to ensure ready roof access in the event of a fire or other safety occurrence whereby roof access is needed. b. The surface area of ground -or pole -mounted systems shall be factored as part of the maximum lot coverage by structure and shall not exceed the regulations of the underlying zoning district. c. The surface area of ground- or pole- mounted systems shall be treated as impervious coverage as regulated for each zoning district. If the soil under the panel array(s) contains vegetative ground cover, the Zoning Administrator may consider allowing additional impervious coverage. Allowed impervious coverage may be increased by up to ten percent above maximum lot coverage for the zoning district provided 100 percent of the excess is accounted for by an approved ground- or pole -mounted solar energy system: d. Ground- or pole -mounted systems shall be counted as an accessory structure. 5. Plan Approvals. All solar energy systems shall require the issuance of a building permit. a. Applications that meet the requirements of this policy shall be granted zoning approval by the Zoning Administrator. Plan approval by the Zoning Department does not indicate compliance with Building Code or Electric Code. b. A building permit application for a solar energy system shall be accompanied by scaled horizontal and vertical elevation drawings. The drawings must show the location of the system on the building, or on the property for a ground- or pole -mounted system, including the property lines. 1. For all roof -mounted systems other than a flat roof the elevation drawings shall show the highest finished slope of the solar collector and the slope of the finished roof surface on which it is mounted. 2. For flat -roof applications a drawing shall be submitted showing the distance to the roof edge and any parapets on the building and shall identify the height of the building on the street frontage side, the shortest distance of the system from the street frontage edge of the building, and the highest finished height of the solar collector above the finished surface of the roof. 5 1325.02 Accessory Uses c. All solar energy systems shall meet approval of local building code officials, consistent with the State of Minnesota Building Code, and solar thermal systems shall comply with HVAC-related requirements of the Energy Code. d.
