2. Resolution #87-4; World Peace Resolution: A representative, Nadja Birkeland,
of the Bahai Community will be present.
5. Resolutions #87-50, 51, 52; Assessment Hearings; Edgewater, Northwoods,
and Glenhill: Barry Peters will be present to discuss costs, methods of
assessment, and will answer any other questions the Council may have. The Edgewater
and Northwoods projects' assessments have been made payable over a period of six
years, rather than ten (as set forth previously by the Council); this was changed
based on the development agreements signed by the developer. Glenhill still remains
payable over a ten year period.
For your information, Mr. George Reiling was in to question his assessment for
the storm sewer portion of the Northwoods project. However, while reviewing the
development agreement the next day, as signed by a representative of Opus as well
as Mr. & Mrs. Reiling, the right to object to special assessments was waived in
the Agreement (see attached).
. Also, Barry Peters advises that, on Edgewater, Mr. Jerry McGuire would like some
of the assessments taken from the apartment building and placed on the townhomes.
Barry Peters will discuss this at the meeting. If the Council desires to do this,
it may be appropriate to have McGuire and an officer of Mardon Homes sign an
addendum to the develoment agreement stating that they mutually agree to this
arrangement; rationale for change, that the assessments as proposed are reflective
of benefits derived from the improvement, and, further that neither party will
appeal any assessments placed on the properties.
Glenhill: the only comments received on this improvement (not necessarily
connected to assessment), to date, has been the letter you received on 8/14,
from Mr. & Mrs. Stenberg, 1415 Glenhill Road, relative to lot restoration.
Consensus (from Roseville project engineer, SEH Inspector John Lee and Barry
Peters) is that the restoration job is satisfactory as is.
6. Keithson Addition: Marcel Eibensteiner has requested that his letter of
credit be "zeroed-out" for this project. It is my understanding that this cannot
be accomplished until the engineer writes a report to Council advising that the
work has been completed satisfactorily, and recommends Council acceptance of the
improvement. Barry will discuss this with you. It is my understanding, to date,
there is still some work to be done with the ditch on Highway 96, and I think
there are other engineering factors yet to be completed.
Nevertheless, the Council may wish to, if not eliminate, reduce the letter of
. c~edit from $190,347.00 in relation to the small amount of work yet to be done.

7. Round Lake Change Order: Change order, in amount of $5,022, for which
Barry will discuss the rationale.
. 8. County Road E/Pine Tree Drive Traffic Light: Ramsey County Public Works,
after their study. has determined a traffic light is not warranted in this area.
A copy of their report has been sent to Mr. William Bretsky of MSI.
9. Completion of Residential Construction: Orlyn has submitted his study on
completion of residential homes, suggesting alt~rnative methods to an approach.
(As an aside, the City I previously worked for had an ordinance providing that
the roof and building exterior of all sides of any residential building (including
garages and accessory buildings) had to be finished within 12 months of the
issuance of the building permit for all new construction, alterations, or
relocations)
10. Ordinance #249; Re: Speed Limit on Lake Johanna: Final reading of the
Ordinance limiting speed on Lake Johanna. Upon approval by Council, the Ordinance
will be submitted to the DNR, who sends it through Ramsey County. After their
approval, the Ordinance will be published, and become effective.
II. Parks Director Report: John Buckley will be present to discuss his
Agenda items.
12. Public Safety/Works Committee: Paul Malone will be out of town so will be
unable to make a presentation; however, the PS/W minutes are available. Bob Raddatz
will discuss the PS/W Committee actions. He will present a mock-up of the water
meter reading ~ard for your consideration.
. We have enclosed with your packet a copy of a letter received from another
resident (first one from Larry Erickson).who received ,a much higher meter
reading after a new meter was installed.
In both cases the readings (upon which their billing was based) were taken from
inside meters. These meters are accurate, as compared to outside meters which
are subject to climatic conditions and mechanical failures.
Although one can certainly have empathy for the homeowner who receives a
sizeable bill after a new meter is installed (or an inside meter read), the
policy in the past has been to bill in accordance with the most accurate meter
reading.
If the Council wishes to change this policy, or set guidelines, we shall address
these situations differently in the future as they arise.
13. Resolutions #87-53 & 54: The resolutions are for transfer from Don Lamb,
to Frank Green, authority to transact City business with the Roseville and Norwest
Banks, and to wire transfer funds as needed. Mr. Green will be present at the
meeting to take his Oath of Office. As suggested by Mayor Woodburn at the last
meeting, an audit will need to be done; this will be started on September 1st.
14. Treasurer's Report: Don will discuss investment, made on 9/17, of just
over $321,000.00.

l6.(A) Resolution #87-49: Calling for Public Hearings on Delinquent Utility
Bills, Diseased Tree Removal and Roseville WateL Connection: This Resolution
. ratifies action taken (by phone) calling for the hearing (on 9/14) f or all
delinquent utility accounts, for diseased tree removal ,and for the two affected
property owners for a Roseville water connection. The Notices were mailed
on August 26th; as of this date there are 78 delinquent utility accounts (total
$35,579.04), and 7 diseased tree notices being mailed (total $492.19).
16. (B) 1987 Salaries: I have prepared a memo for the recommended 1987 non-union
salaries (as previously discussed with you), and have submitted the IUOE memo
accepting the City's offer for our Public Works employees' 1987 salaries.
Resolution #87-55 should be adopted to accept the Public Works employees contract; the
non-union salaries may be approved by motion.

1. Budget Calendar: As a reminder, following is the calendar of budget
meetings:
Mon., August 31 Council receives preliminary budget and tax levy.
Thur., September 10 Finance Committee reviews proposed budget (Council
invited to sit in on meeting).
Mon. , September 17 Finance Committee recommendations to Council,
Department Heads.
Mon., September 28 Budget and tax levy approved by Council.
The proposed 1988 Budget, and levy, will be submitted to you on Monday,
so you have an opportunity to review it prior to our meetings.
2. Pavement Management Plan: Barry Peters and two additional representatives
. from SEH met with Bob Raddatz and I on August 26th to discuss the preliminary
findings of the Study. Barry will discuss this with you on Monday night, and
will be requesting a date for Council workshop (as concluded by Council on
8/10 was necessary) to review the Study.
3. No Parking - Mounds View School: The Council, in May of '87, requested
this parking situation be reviewed again by Council prior to commencement
of the 87/88 school year. This is brought up in case there are specifics
you would like staff to address at this time.
4. 1415 Arden Oaks Drive: As you may know, we have received several calls
of concern about the property at 1415 Arden Oaks Drive, i.e., the length
of time for completion and the condition of the yard. The attached letter
was sent to Mr. Foster on 8/20; on 8/26 he called and agreed to send a
letter indicating a timetable within which the work can be accomplished
(when this is received a copy will be sent to you). Mr. Grant Wishert,
1424 Arden Oaks Drive, is particularly concerned.
5. County Road I: We have received the attached letters from Shoreview and
LJVFD, in response to our request for their preference for an alternate
route for County Road I. The school district has not responded. When the
school district response has been received, this will be placed on our
Agenda again.

4. Miscellaneous: It is my understanding Frank Herbst is scheduled to return
to duty the second week in September.
. Jim Lynden is in Europe for two weeks; he will return on September 10th.
Rob Plunkett will be available to the City, if needed.
Mr. Lynden advises on the Hamline/96 Property, that the third party,
GP-BAJR, INC. (representing Daybridge) wishes to hold their approval
until the building permit has been issued for the daycare facility.
They are working with Orlyn now; he advises he will be ready to write
a letter of approval as soon as he talks with SEH about of couple of
drainage items.
5. New Finance Position: I have attached the information which was requested
during our meeting in May, when we discussed the new finance director
position. Two alternatives have been presented for Council consideration.
A position description, as requested, is also attached.
I would be pleased to answer any questions you may have, and am available
for discussion of the position at anytime.
6. Lot 13, Tiller & Dellwood: Attached are letters received relative to this
Lot. We have also attached a letter forwarded to Mr. Bear and Cathy Iago has
updated information relative to the snow fence and real estate sign on the
property.
7. Investigation Report: For your information, attached is a form which
. Commander Bergeron has prepared for purposes of investigating liquor
and gambling applicants. We do, currently, request an investigation for
liquor licenses (and renewals), and I believe it will be proposed (in our
new charitable gambling ordinance) that an investigation be made of managers
of charitable gambling organizations.
As you may recall, the Council at an earlier date, approved provision for
a fee of $100 for investigations (liquor and charitable gambling)

RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR
NORTHWOODS IMPROVEMENTS
IMP~OVEMENT-N~. SS-W-P-ST-86-1
BE IT RESOLVED by the City Council of the City of Arden
Hills, Minnesota, as follows:
L The amount proper and necessary to be specially assessed
at this time for Improvement No. SS-W-P-ST-86-1 against every assessable
lot, parcel or tract of land (the "parcel") affected thereby has been duly
calculated upon the basis of benefits, without regard to cash valuation,
in accordance with the provisions of Minnesota Statutes, Chapter 429, as
amended, and notice has been duly mailed and published, as required by
law, that this Council would meet to hear, consider and pass upon all
objections, if any, and said proposed assessment has at all time since its
filing been open for public inspection, and an opportunity has been given
to all interested persons to present their objections, if any, to such
proposed assessments.
. 2. This Council, having heard no objections (none having
been made), and being fully advised in the premises, finds that each of
the parcels enumerated in the proposed assessment was and is specially
benefited by the construction of said improvement in not less than the
amount of the assessment set opposite the description of each such parcel,
respectively, and such amount so set out is hereby levied against each of
the respective parcels therein.
3. The proposed assessments are hereby adopted and
confirmed as the proper special assessments for each of said parcels
respectively.
4., The assessment against each such parcel of land,
together with interest thereon at the rate of eight percent (8%) per annum
accruing on the full amount thereof until paid in full, shall be a lien
concurrent with general taxes upon each such parcel and all thereof. The
total amount of each such assessment shall be payable in equal annual
principal installments extending over a period of six (6) years, the
first of such installments, together with interest on the entire
assessment from the date hereof to December 31, 1988, to be payable with
general taxes for the year 1987, collectible in 1988, and one of each of
the remaining installments, together with one year's interest on that and
all other unpaid installments, to be payable with general taxes for each
consecutive year hereafter until the entire assessment is paid.

5. Prior to certification of the assessment to the Ramsey
. County Auditor, the owner of any parcel assessed hereby may at any time
pay the whole or at least fifty percent (50%) of such assessment, with no
interest to the date of payment, to the City Treasurer, but no interest
shall be charged if such payment is made within thirty (30) days after the
. date of this Resolution.
6. The Clerk Administrator shall, with due dispatch,
prepare and transmit to the Ramsey County Auditor a certified duplicate of
the assessment roll, with each installment and interest on each unpaid
assessment set forth separately, to be extended upon the proper tax lists
of Ramsey County, and said County Auditor shall thereafter collect such
assessments in the manner provided by law.

WHEREAS, Developer has requested that the City prepare a
feasibili ty report (the "Feasibility Report" ) to determine the
estimated cost and design of certain public improvements to be
constructed in the Subdivision consisting of storm sewer,
sanitary sewer, water and street (including curb and gutter)
which are generally shown on the grading and utility plan, dated
October 28, 1985, which was prepared by Developer, a copy of
which is attached hereto and made a part hereof as Exhibit "B",

WHEREAS, the City has not as yet completed the Feasibility
Report and the Developer requires that the final plat of the ~

Subdivision be executed by the City prior to closing its purchase i

the Subdivision provided payment of the cost of preparation of
the Feasibility Report and the cost of the installation of the

and promises contained herein and other good and valuable
consideration, the receipt and sufficiency of which is hereby

~ l. Provisions of City Code Applicable. All of the

provisions of the Arden Hills City Code including particularly
those set forth in Chapter 22 thereof are incorporated herein by
reference, and tpe Developer's violation of any of the provisions
of the Code shall be considered to be a breach of this Agreement,
2. Improvements Necessary. Section 22-10 of the Arden
Hills Code specifies what improvements must be made by or on
behalf of the Developer in connection with the subdivision of a
tract of land, Section 22-10(b) declares as a policy of the City
that the improve~ents in connection with the plat be installed as
soon as practicable after final approval of the plat by the City
Council, Accordingly, time is of the essence subject, however,
. to climatic and seasonal conditions,
Certain of the improvements to be undertaken and completed
in connection with the Subdi~ision shall be the obligation of the
Developer and certain of them shall be the obligation of the
City. Those improvements to be made by the Developer shall

Block 1 of the Subdivision by the City, In the event that the
Developer is to install the City Improvements, then Developer
shall be obligated to reimburse the City for all reasonable
expenses incurred by the City arising out of the Project
(including but not limited to expenses incurred in the prepara-
tion of the Feasibility Report) to the date of the City's receipt
of Developer's notice of its intention to do the City Improve-
ments itself rather than to have the City do them and all of
Developer's requirements as to the Developer Improvements set
forth in the next Section hereof shall be applicable to its
. installation of the City Improvements. Accordingly, if the
Developer has opted to do the entire Project, all of the provi-
sions of the next Section hereof shall be deemed to create
obligations upon Developer in its performance of the Project.
3. Developer's [Project] Improvements.
(al Obligation to Construct and Install
Developer's [Project] Improvements.
Developer shall construct and install the
Developer [Project] Improvements in
accordance with the terms and conditions
set forth in this Section at Developer's
expense and not at the expense of the
City.
(bl Construction Plans and Approval Thereof.
Developer shall engage, at Developer's
expense, a Minnesota registered civil
engineer and/or land surveyor to prepare
detailed plans and specifications for the
complete installation of all Developer's
. [Project] Improvements in accordance with
City standards, including designation and
description of all necessary temporary and
permanent easements if any are required,

submi tted to and be approved by the City

(c) Time Frame, Developer' hereby agrees to

to his inspection, all of the Developer's
[Project] Improvements set forth in such
plans and specifications wi thin one (1]
year from the date of this Agreement
except that this period of time may be
extended by Resolution of the City
Council.
ld) Developer I s Payment of Costs for
Developer's [Project] Improvements, The
Developer shall pay, as they may become
due, all just claims for any work, tools,
machinery, skill, material, equipment,
supplies or insurance premiums arising out
. of or connected with the Developer's
[Project] Improvements required hereunder,
and the City shall be under no obligation
to pay the Developer, general contractor,
or any subcontractor any sum whatsoever on
account thereof, whether or not the City
shall have approved the contract,
subcontract, contractor or subcontractor.
All of the Developer [Project] Improve-
ments shall be free and clear of any lien,
claim, charge or encumbrance including any
for work, labor, or services rendered in
connection therewith. Moreover, Developer
agrees to indemnify, hold harmless and
defend the City from any and all claims or
charges, including attorneys' fees and
costs, arising from the performance or
non-performance of the work required
hereunder,
(e) Services to be Performed by the City and
Payment Therefor,
(1) Services to be Performed by City,
The City Engineer shall assist,
review and approve the work of the
... Developer's engineer and/or land
surveyor and shall provide inspection
services during the course of

. construction. These are the only
services which the City shall perform
with respect to the Developer
[Project] Improvements.
(2) Payment for City's Services. The
City hereby requires and Developer
hereby agrees to pay legal expenses
incurred by the City in connection
with the approval and acceptance of
the plat referred to herein and the
preparation of this Development
Agreement in the sum of Three Hundred
Fifty and nollOO Dollars ($350,00),
Payment of such legal expenses is a
condition precedent to the City's
execution of this Development
Agreement.
If Developer opts to do not only the
Developer Improvements but also the
City Improvements (i.e., to install
the entire Project), then it shall
reimburse the City for all reasonable
. costs incurred by the Ci ty in
connection with the Project,
including but not limited to costs
incurred in the preparation of the
Feasibility Report (e.g" the fees
and costs of the City Engineer),
wi thin thirty (30) days after
submission to it of an invoice
setting forth all of such costs,
Failure of the Developer to make
payment by the end of said thirty
(30) day period shall constitute a
defaul thereunder. Interest on any
delinquent amounts shall accrue at
the lesser of fifteen percent (15%)
per annum or the maximum lawful rate
from the date of the invoice until
paid in full.
All other costs incurred by the City
in rendering services to Developer in
connection with the Developer
Improvements shall be added to the
cost of the Project and assessed
against all properties benefitted by
. the Project.
(f) Acquisition of All Necessary Permits. The
Developer shall be responsible for

. acquiring all necessary permits from all
governmental agencies which have
jurisdiction over the Project and hereby
agrees that in the event the City has to
assist Developer in obtaining any permits
that Developer shall reimburse the City
for all legal and enqineering fees and
costs and disbursements incurred by the
City in making appearances and appeals
before the boards or commissions of any
such governmental agencies.
(g) Construction Performance Standards, The
construction, installation, materials and
equipment used and employed in connection
with the Developer [Project] Improvements
shall be in accordance with the plans and
specifications approved by the City
Engineer. The Developer shall cause the
contractors who are to make the Developer
[Project] Improvements to furnish the City
Engineer with a schedule of proposed
operations at least five (5) days prior to
commencement of the work.
. (h) Developer's Engineering Services.
Developer's engineer and/or land surveyor
shall provide all necessary job staking
and shall assist in the final job
inspection.
(i) Site Grading Plans, Developer's engineer
shall furnish to the City Engineer for his
approval, as part of the plans and
specifications required in Subsection (a)
of this Section, a centerline profile and
a grade line for each street with a
typical cross section of the roadway.
Cross sections of the roadway, if required
by the City Engineer, shall be provided.
The profile of grade lines shall be shown
to a scale of one (l) inch equals five (5)
feet vertical. Where a proposed roadway
intersects an existing roadway, a center-
line profile and grade line for such
existing roadway within one hundred (100)
feet of the intersection shall be shown on
standard plan and profile sheets.
. The Developer shall also furnish to the
City Engineer for his approval, as part of
the plans and specifications required in
Subsection (a) of this Section, complete

>. grading plans for all lots and other sites
in the Subdivision.
(j) Supervision 1 Inspection. All of the
Developer [Project] Improvements shall be
under the supervision of the Developer and
subject to the review and inspection of
the City Engineer > and other
any
governmental agency having jurisdiction
thereof. Full-time inspection services
shall be provided by the engineering firm
retained by Developer. The Project
inspector representing such engineering
firm shall provide the City Engineer with
weekly inspection reports which shall
contain sufficient information so as to
enable the City Engineer to determine
whether the Developer [Project]
Improvements are being constructed in
compliance with the plans and specifica-
tions.
Upon completion of the Developer [Project]
Improvements and prior to the City
Engineer's issuance of his letter of final
. approval as provided hereinbelow, the
Developer, or the engineering firm it has
retained for the Developer [Project]
Improvements, shall provide the City
Engineer with reproducable as-built plans
of all underground utili ties which shall
show, at a minimum, the location, size,
type of material and grade of all
underground utilities installed as part of
the Developer [Project] Improvement s.
(k) Easements. The Developer shall make
available to the City, at no cost to the
City, all permanent or temporary easements
necessary for the installation of the
Developer [Project] Improvements as
determined by the City Engineer and the
City Attorney. All such easements
required by the City shall be in writing,
in recordable form, and on the standard
easement form of the City, or drafted or
approved in writing by the City Attorney
(containing such terms and conditions as
he, in his reasonable discretion, shall
determine to be in the best interest of
. the City).

(l) Non-Conforming Work. All work not
conforming to the requirements of the
plans and specifications for the Developer
[Project] Improvements or not performed at
all in accordance with the progress
schedule incorporated therein shall
constitute a default. When such default
occurs, the City Engineer shall provide
the Developer with a written notice by
registered or certified United States Mail
setting forth the nature of such default,
the manner by which it should be
corrected, and the time within which it
should be corrected, which shall be
reasonable in length. It shall
constitute, without further action, notice
to any contractor or subcontractor whether
they are approved and accepted by the City
or not.
In the event Developer fails to correct
such default within the time fixed by the
. notice from the City Engineer, the City
may at its option perform the work
necessary to correct the default, and
Developer shall thereafter promptly
reimburse the City for all direct and
indirect costs of such correction incurred
by the City within thirty (30) days of the
City's submission of an invoice setting
forth such costs. Interest on delinquent
costs of correction incurred by the City
shall accrue from the date of the City's
invoice until paid in full at the lesser
of fifteen percent (15%) per annum or the
maximum lawful rate of interest.
In the event the default precipitates an
emergency, as reasonably determined by the
City Engineer, the written notice to the
Developer required hereinabove shall be
and hereby is waived in its entirety, and
Developer shall reimburse the City for any
expense incurred by it in correcting
the default in the same manner as if
mailed notice, as hereinabove described,
had been given. If Developer has not
. reimbursed the City for such expense by
the end of thirty (30) days from the date

. of the City's invoice setting forth the
, expenses, then the delinquent amounts

(m) Final Approval of Developer [Project]
Improvements. If, on the basis of his
inspection of the Developer [Project]
Improvements during the course of their
construction, and his final inspection
thereof, the City Engineer is reasonably
satisfied that they have been substan-
tially completed in accordance with the
plans and specifications, and he has
received the as-built plans as provided in
Section 3(j) hereof, he shall indicate his
final approval of the Developer [Project]
Improvements in writing by letter
addressed and mailed to the Developer, the
City Council, and the City Attorney. The
date of such letter shall constitute the
date of the City's acceptance of the
Developer [Project] Improvements and they
. shall become the property of the City
wi thout further notice or action on the
part of either party hereto. Said
acceptance shall in no manner prejudice
any rights or claims which may subse-
quently accrue to the City hereunder.
(n) Performance Bond or Letter of Credit if
Developer to Install All Project Improve-
ments. Developer agrees that in the event
it has opted to do the entire Project,
Developer shall submit to the City a
performance bond or a letter of credit--
the issuer, terms, form and execution of
which are satisfactory to the City--which
guarantees Developer's full and faithful
performance of its obligations under this
Development Agreement and guarantees the
City against defects in materials or
workmanship for a period of one (1) year
following completion and acceptance of the
Project by the City Engineer. The amount
of this bond or letter of credit shall be
one hundred twenty-five percent (125%) of
the estimated cost of the Project Improve-
. ments subject to reduction thereof,
however, to an amount equal to twenty-five
percent (25%) of the cost of the Project

. Improvements after acceptance thereof by
the City Engineer and receipt of as-built
drawings. Determination of the estimated
construction costs of the Project shall be
in the reasonable discretion of the City
Engineer. It shall be. set forth in a
letter from him to the Developer copies of
which shall be sent to the City as well.
The performance bond or letter of credit
shall be posted with the City within ten
(10) days after the date of such letter.
(0) Developer's Warranty. Developer warrants
and guarantees that the Developer
{Project] Improvements constructed
hereunder will be of good quality and free
from faults and defects and in accordance
with the plans and specifications. Such
warranty and guarantee shall be in effect
and binding upon the Developer for a
period of one (1) year after the date of
the City Engineer's final approval thereof
as provided hereinabove. Wi thin said one
(ll year Developer shall be obligated upon
. receipt of written instructions from the
City Engineer to correct all faults and
deficiencies in the Developer [Project]
Improvements indicated in said written
instructions and in the manner specified
by the City Engineer. The City Engineer
will give prompt written notice of
observed defects. The warranty or
guarantee provided in this Section shall
be in addition to and not in limitation of
any other remedies provided hereunder or
by law.
If the Developer, after receipt of such
written instructions from the City
Engineer, fails to proceed promptly to
comply with the terms of such instructions
and this . warranty or guarantee, the City
may have the work corrected at its own
expense and the Developer shall be liable
for all expenses incurred which it shall
pay within thirty (30) days after
submission to it of an invoice setting
forth such expenses. Interest shall
accrue on delinquent expenses from the
. date of such invoice until paid in full at
the lesser of fifteen percent (15%) per i
annum or the maximum lawful rate.

. 4. City Improvements.
I (a) Obligation to Install City I~rovements.
Developer has petitioned the Clty for the
installation of the City Improvements and
the City Council has or4ered the installa-
tion of the City Improvements. The cost
of the installation of the City Improve-
ments shall be assessed in accordance with
the next subsection of this Section unless
the Developer opts to install them.
(b) Adherence to Requirements of Chapter 429
of Minnesota Statutes. The substantive
and procedural requirements of Chapter 429
of Minnesota Statutes, as amended, shall
be complied with by the City in imple-
menting the City Improvements. In
accordance with that Chapter, the City
Engineer will prepare final plans and
specifications for the Project, and the
contract for the installation of the City
Improvements will be awarded by the City
Council. Installation of the City
. Improvements shall take place under the
, City's complete supervision. This
provision, of course, does not apply if
the Developer does the City Improvements.
5. Special Assessments (Applicable Only if City
Does City Improvements.
(al Costs of City Improvements and City
Services Incurred in Connection with
Developer's Improvements Defrayed by
Special Assessments. The cost of the
installation of the City Improvements and
for all City services incurred in
connection with the Developer's Improve-
ments, including all engineering, legal,
right-of-way acquisition and administra-
tive costs incurred by the City in
connection therewith, shall be assessed
against all properties benefited by the
Project as provided in Chapter 429 of
Minnesota Statutes, subject, however, to
the following subsections of this Section
5.
. (b) Special Assessment Installments. The
special assessments shall be payable in
equal annual installments of principal
plus interest over a period of not to

exceed six (6) years and shall' bear
. interest at the maximum rate allowable by
Minnesota law until paid in full. It is
I the intent of the parties that the
Developer only be obligated to pay one-
sixth 1l/6th) of the outstanding balance

year. Accordingly, if, for example, the
Developer pays one-third (l/3rd) of the
balance due of the assessments, plus
interest accrued thereon, in the first
year, he need not pay any further assess-
ments until the third year the assessments

or not any such Improvements are located
inside the Subdivision.
(d) Acceleration of Balance of Assessments Due
Upon Default. In the event either of the
Developers violates any of the covenants
and agreements herein contained to be
performed by Developer, or fails to pay
any installment of any special assessment
levied pursuant hereto when the same is to
be paid, or any interest thereon, the City
may--at its option, in addition to the
rights and remedies hereunder by written
notice given to the Oeveloper--declare due
and payable in full the entire balance of
. the unpaid special assessments levied by
the City against all lots in the Subdivi-
sion owned by that Developer, together

. hereinafter be called the "Accelerated
Amount" . The City may--at its option--
~ demand in such written notice immediate
payment of the Accelerated Amount or it
may give the defaulting or delinquent
Developer until May l5 or October l5,
whichever is earlier, next following the
giving of such written notice to pay the
Accelerated Amount, together with interest
thereon. In addition to the Accelerated
Amount plus accrued interest thereon, the
defaulting or delinquent Developer shall
owe the City attorneys' fees and costs
reasonably incurred by the City in
effecting collection of the Accelerated
Amount. Notwithstanding anything herein
to the contrary, the Accelerated Amount
shall be reduced by the amount(sl by which
the defaulting or delinquent Developer, or
others, have previously paid special
assessments in excess of the required
installment amounts thereof. Section l2
hereof shall not apply to this Section
5 (d) . In other words, this Section 5(d)
. shall not apply to the successors and
assigns of either Opus Corporation or
George J. Reiling and Mary Jane Reiling.
6. Default. If either of the Developers defaults in any
of its obligations hereunder or breaches any of the terms hereof
other than the payment of installments of special assessments,
the City may--at its option--cancel, revoke or deny any building
permit for that Developer's construction of structures within the
Subdivision. In addition, if either of the Developers fails to
pay any installment of any special assessment levied pursuant
hereto, or any interest thereon, when the same is to be paid, the
City may--at its option--cancel, revoke or deny a building permit
to any lot in the Subdivision on which the assessment has not
been paid until it has been paid.
. Developer acknowledges that the rights of the City to
perform its obligations with Developer contemplated in this

Agreement are special, unique and of an extraordinary character,
. and that, in the event that Developer violates, or fails, or
refuses to perform any covenant, condition, or provision made
herein, City may be without an adequate remedy at law. Developer
agrees, therefore, that in the event Developer violates, fails or
refuses to perform any covenant, condition or provision made
herein, City may--at its option--institute and prosecute an
action specifically to enforce performance of such covenant.
No remedy conferred in this Agreement is intended to be
exclusive and each shall be cumulative and shall be in addition
to every other remedy. The election of anyone or more remedies
shall not constitute a waiver of any other remedy. Failure of
the City promptly to take legal or equitable action to enforce
. this Agreement or the performance bond or letter of credit after
expiration of the time within which the' Developer [Project]
Improvements are to be completed will not waive or release any
rights of the City, and the City can take legal action at any
time thereafter.
Developer agrees to reimburse the City for all costs
incurred by the City in enforcement of this Agreement or any
portion thereof including all engineering and attorneys' fees and
costs and disbursements incurred therewith.
7 . City's Approval of Landscaping and Lighting Plans and
Screeninq of Rooftop Mechanical Equipment. The City shall not be
required to issue a building permit to Developer for Developer's
construction of a building on Lot 2, Block 1 and on any other
. lots in the Subdivision until Developer shall have first obtained
the approval by the City's Planner of Developer's landscaping and

. lighting plans and its plans for screening of and materials for
screening of rooftop mechanical equipment.
8. Approval of Construction and Storm Sewer Plans by Rice
Creek Watershed District. Developer has submitted construction
and storm sewer plans to the Board of Managers of the Rice Creek
Watershed District and has obtained its approval thereof.
9. Park Dedication (Cash in Lieu Thereof) Resolution.
The City shall not be required to allow occupancy of the building
to be constructed on Lot 2, Block 1 of the Subdivision until it
and Opus Corporation have negotiated and resolved the cash in
lieu of park dedication fee payable by Opus Corporation and the
fee, or portion thereof, agreed upon shall have been paid to the
. City.
lO. Signage. For any building requiring a signage plan in
the Subdivision under the Arden Hills Code, the Developer shall
have first submitted such signage plan to the City and obtained
the City's approval before the City shall be required to allow
occupancy of such building. If Developer desires to have an
entrance monument naming the tenants of buildings on the
Subdivision, the Developer shall submit a plan thereof to the
City and obtain its approval thereof before the City shall be
required to allow occupancy of any buildings to be constructed in
the Subdivision.
II. Notices. Whenever in this Agreement it is required or
. permitted that a notice or demand be given or serviced by either
party to this Agreement to or on the other party, such notice or
demand shall be delivered personally or mailed by United States

(return receipt requested) . Such notice or demand shall be
deemed timely given when delivered personally or when deposited
in the mail in accordance with the above. The addresses of the

12. Binding Effect; Recordation of Agreement. The terms
and provisions of this Agreement shall be binding upon and shall
inure to the benefit of the parties hereto and their representa-
tives, successors and assigns, and it shall also be binding upon
and inure to the benefit of all present and future owners of all
or any part of the Subdivision and sha 11 be deemed to be cove-
nants running with the land. This Agreement, at the option of
the City, may be placed of record so as to give notice hereof to
. all subsequent purchasers and encumbrancers of all or any part of
the Subdivision, and all recording fees, if any, shall be paid by
Developer.

. 13. Incorporation by Reference. All plans, special
provisions, proposals, specifications, sketches, drawings,
photographs, contracts for the improvements, bids and awards and
all other documents relating to the Subdivision shall be and
hereby are made a part of this Agreement by reference as though
they were fully set forth herein.
14. Severability. If any portion, section, subsection,
sentence, clause, phrase, paragraph or subparagraph of this
Development Agreement is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portion
of this Agreement. I

l5. Developer's Condition. The covenants of Developer I

. contained herein shall be conditioned upon Developer's recording
the final plat of the Subdivision and upon Developer's being the
owner of all of the Subdivision. I

E and make comments ~egarding possible signal installation at County Road E and Pine
Tree Drive.
, App~oach counts we~e taken at the inte~section during the week of July 20-24, 1987
to dete~mine if volumes were p~esent to war~ant the installation of a signal system.
The war~ant ~equi~ements, as set fo~th in the Minnesota Manual on Uniform T~affic
Control devices, requi~e that the volumes be met fo~ each of any 8 hours of an ave~age
day. War~ant #1, Minimum Vehicular Volume, is met fo~ 4 hours. War~ant #2,
Inte~~~tion of Continuous T~affic, is met fo~ 7 hours. I have enclosed copies of these
~esults. Since neithe~ War~ant #1 no~ War~ant #2 was met for eight hours, a t~affic
signal is not wa~~anted at this location based on t~affic volumes.
A ~eview of accidents at the location indicates that eight accidents occur~ed at the
inte~section f~om January 1985 to J\HIe 30, 1987. This indicates an accident ~ate of
just ove~ 3 pe~ y ea~. This is not a sufficient amount to wa~~ant t~affic signals as pe~
the Minnesota Manual on Unifo~m T~affic Cont~ol Devices.
The installation of Wlwa~~anted traffic cont~ol devices leads to inefficiencies in the
cO\HIty ~oad system and encourages violation by the drivers due to an \HIpe~ceived need
fo~ them. The~efo~e, because a t~affic signal at this location is not wa~~anted, Ramsey
County's policy would be to not install one at this time.

Re: Traffic Counts, County Road E and Pinetree Drive

SEH did two different traffic counts, at two different times. They did a
total count, and a north bound lane count on Pine Tree Drive.
A 1982 count showed 3,600 cars per day. 1984 count was 5,000 cars per
day. 1986 count was 5,250 cars per day. Last week, the count was 3,750
cars per day, and this week the north bound lane count was 1,600 cars per
day. This is down from 1986.
We have no explanation of why this should be, since nothing has changed
about the area. Barry Peters will bring more data to Monday night's
meeting, and discuss some of the guide lines that are used to support
semaphore requests.

Sheriff Dept. Records show that since December 1978, twenty-three
accidents have occurred at the intersection of County Rd. E and
Pinetree Ori ve. Two of these accidents involved personal injuries.
This is an average of less than three accidents per year. No year
, has had more than four accidents. By comparison, the semiphore
controlled intersection of Lexington and County Rd. E and Connolly
and County Rd. E show fifty-one and forty-seven accidents
respectively, during the same periop.
A survey was done at the County Rd. E and Pinetree intersection. This
was done during the day and incl uded the morning and afternoon rush
hour peri od. Only during the rush hour periods was traffic flow
considered heavy. Traffic back up was minimal and only for vehicles
attempting left turns.
Observations:
l) Inattentive driving and un-necessary risk taking was commonplace
during the survey.
2) Traffic flow was heaviest shortly before 0800.
Recommendations:
1) Restrict left turns during rush hour (0700-0900 and 1600-l800)
at this intersection.
2 ) Prohibit left turns altogether.
3) Have MSI stagger their work shift to 0700,0800, and 0900 starts
instead of majority starting at 0800. (MSI employees appear to be
the primary user of this intersection)
4) Advise the businesses in the area of Harriet Ave. as an
aternate route.

Statement of position
Reference to our request for a semaphore at pine Tree Drive and
'County Road E.
MSI Insurance requests the Arden Hills Village Councils' considera-
tion for the installation of a semaphore at pine Tree Drive and
County Road E to improve traffic flow and safety. This is our
second request for consideration in the last l2 months. Support
from Norwest Bank St. Paul and Woodbridge Properties -- who would
also benefit by this location or a stop light -- has been solicited.
Vehicles traveling to and from MSI Insurance, Norwest Bank St.
Paul, Woodbrige Properties and residential housing use this inter-
section as their primary entrance and exit. A lesser traveled
road -- Hariett Avenue -- is available, but is not as convenient.
Since MSI Insurance first occupied the site in 1979, the neighbor-
hood population has mushroomed, straining the capacity of the
present traffic controls at the intersection. The situation
is magnified by the peak-and-valley demands made on the intersec-
tion in the morning and afternoon rush hours. Traffic flow affects
the ability of Norwest Bank St. Paul to deliver service. Future
occupants of the Woodbridge Properties will further burden the
intersection with its present controls.
When MSI was granted village permission to occupy the site, MSI
donated the land for Pine Tree Drive to manage the traffic impact
'upon County Road E. MSI feels it has practiced solid corporate
citizenship, contributed to the economic health of Arden Hills
and has fostered a healthy relationship with the community.
We sincerely represent the concerns of our customers, employees,
and business associates in requesting the Arden Hills Councils'
consideration of this issue. Our business is risk management
and this situation needs resolution.
The proposed traffic controls will benefit the community as a
whole. We are opposed to a special assessment which will burden
our high tax rate. Last year MSI paid 660 thousand dollars in
property taxes for the site which is largely self-supporting.
We ask the Arden Hills Council to consider the overall business
climate, where businesses like ours struggle to remain competetive
on a national scale.
The Arden Hills Council can demonstrate its commitment to the
wellbeing of Arden Hills residents and Arden Hills-based employees
by approving the installation of the proposed semaphore. The
Arden Hills Councils' commitment continues to drive MSI's commitment
to Arden Hills.

On behalf of MSI Insurance I request that the Arden Hills Council reopen
their consideration for a semaphore at the intersection of County Road E
and Pine Tree Drive. Approximately one year ago I requested your considera-
tion. Attached is a copy of your response.
It is our judgement that the traffic crossing at that intersection is unsafe.
We have received several complaints from our employees prompting our original
, inquiry a year ago and now we have had more frequent complaints. We
strongly urge you to consider this matter before someone's life or property
. becomes a motivating factor.

I discussed this situation with a Ramsey County engineer and he suggested
that I start again with the Arden Hills Council. We realize that there are
peak traffic times early in the day and later in the afternoon. At any
time of day though there are increased risks to drivers pulling out of
the Norwest Bank. Woodbridge Properties. and Pine Tree Drive because
of the speed and flow of traffic. Another complaint that we have received
is the inability to make turns from Pine Tree Drive onto County Road E
westbound. The presence of the center lane increases the complexity of
the turn decision as drivers are impatiently waiting.
I would be happy to meet with either you or the Council to discuss this
request further.

Approximately one week ago Woodbridge Properties, Inc. received a
copy of the letter to you from Mr. William F. Bretzke with MSI
Insurance. This letter requested that Arden Hills approve the
installation of a semaphore at the intersection of County Road E
and pine Tree Drive.
Woodbridge Properties does not oppose the installation of this
semaphore as requested in Mr. Bretzke's letter to you. However,
, Woodbridge Properties would very much oppose any special
assessments to our property for this installation, as this type
of structure would benefit the community at large. I am sure you
are also aware, property taxes already are a heavy burden on
commercial properties and Woodbridge Properties believes that
these taxes, or in this case a possible special assessment, must
be minimized and reduced from their present levels in order for
Minnesota Businesses to remain competitive in the national
marketplace.
I understand that this matter will be considered at your June 29,

Re: Guidelines for completion of residential construction 612 544 7576
Mayor Woodburn and Council Members:
At your request, I have contacted several metropolitan communities to
investigate their method of controlling timely completion of residential
construction. Most communities that I contacted depend solely on the
provision of the Uniform Building Code which simply requires "continual
work progress" to avoid suspension of a building permit. I did find a
couple communities that set a time limitation on completion of one-and
two-family residential construction. However, none of the communities
that I contacted specifically address the items to which you expressed
concern. Therefore, I have drafted some suggested provisions, in
ordinance format, for controlling the completion of residential construction.
These are attached for your review.
The suggested regulations are drafted in two optional formats. Option 1
. would require total completion of all building permit related work
within the specified time frame, and would be enforcable through the
termination of the building permit.
If your concern is primarily for the completion of visible, exterior
construction work, Option 2 would be more appropriate. It would not
terminate the building permit within a specified time, but would require
the completion of exterior construction only. Interior construction
could continue for a longer time. Enforcement of these provisions,
.therefore, would be in accordance with normal zoning enforcement practices.
The difference in the two approaches is relatively minor, but it may
make a difference to one who wishes to complete the interior construction
over an extended period of time on a "do-it-yourself" basis. Please
review the attached drafts. I will discuss them with you at a Council
meeting in the near future.

Amend Section VI of the Zoning Ordinance as follows:
i I. EXPIRATION OF RESIDENTIAL BUILDING PERMITS
i (1 ) New Construction
Building permits for all new construction of one- and two-
family residences shall expire two years after the date of
issuance.
(2) Additions, Improvements and Accessory Structures
Building permits for any addition or improvement to an existing
one- or two-family residence, or an accessory building of a
one- or two-family residence shall expire one year after the
date of issuance.
(3) Extensions
The City Council may extend the time limit for residential
building permits providing that application for such extension
is made in writing previous to the expiration date of said
permit. The application for an extension shall state the
reasons for the request.
(4) Completion of Construction
. On or before the date of building permit expiration, as
provided herein, all construction shall be completed, including:
Painting, staining, or other exterior finishing;
Paving of driveways and walks;
Removal of all construction materials, equipment debris,
and excess earth;
Placement of topsoil, finish grading, and sodding or
seeding of lawn areas; and
Finish grading of any swales within established drainage
easements necessary to accommodate natural drainage of
adjacent properties.
J. CERTIFICATE OF OCCUPANCY
Before any building shall be legally occupied, the Building Inspector
shall issue a Certificate of Occupancy. Said Certificate of
Occupancy shall not be issued until the Building Inspector has
determined that the construction has been accomplished in compliance
with all applicable building codes and that all items identified in
paragraph VI,I(4) have been completed.

The City Council of Arden Hills ordains:
Section 1. Amendment to Caption of Section 12-28 of the
Arden Hills Code. The caption of Section 12-28 of the Arden
Hills Code is hereby amended to read as follows:
"Sec. l2-28. Maximum speed in restricted speed zone."
Section 2. Amendment to Caption of Section l2-29 of Arden
Hills Code. The caption of Section 12-29 of the Arden Hills Code
. is hereby amended to read as follows:
"Sec. 12-29. Open zone."
Section 3. Amendment to Section 12-30 of the Arden Hills
Code to Establish Speed Limits in Open Zone. Section 12-30 of
the Arden Hills Code is hereby amended in its entirety to read as
follows:
"Sec. 12-30. Restrictions and speed limits in open zone
during certain hours."
"Within the open zone, between the hours of 11:00
a.m. and 3:00 p.m. and 7:00 p.m. and 7:00 a.m. on
each and every day of the week, no motorboat shall
be operated at a speed in excess of five miles per
hour. All other times during each and every day of
the week, no boats shall be operated in the open
zone at a speed in excess of 40 miles per hour."
Section 4. Amendment to Section l2-3l of Arden Hills Code.
Section 12-31 of the Arden Hills Code is hereby amended in its
entirety to read as follows:

Limiting the speed of boats to under 40llph the rest of the
tille seems to be excessiTe legislation which oTerlook. the
real problem. The real problem with Lake Johanaa is too auch
aon-resident boat~ng.

a very small lake. Now, cars towing boat trailers simply

As far as I know, speed has never contributed to any
boating accidents on Lake Johanna, but the congestion of the
lake is cause for concern on the part of lake shore residents
who, I might add, pay higher taxes to liTe on a lake which
is often too crowded for them to use as they wish.
I suggest the City Council vote on posting Lake Jehanna
Boulevard "NO TRAILER PARKING" rather than voting on liaiting
the speed of boats during the already limited boating hours
on Lake Johanna.

Sand noted that, since the last meeting of the committee, Council had
approved the 1987 Park Development Plan. Buckley is appearing at the next
Council meeting to request approval for ordering the two shelters, play
structure, grills, picnic tables, etc. on that plan.

North SnellinR Park Development
Buckley explained to the residents present Arden Hills' aim of a
neighborhood park within each neighborhood. Planner Miller's total
development plan for this park was reviewed with the residents, showing a
neighborhood playing field (which will not be large enough for organized
teams, but can be used for neighborhood soccer, t-ball and informal
softball), play equipment, picnic area, tennis court, and walking trail.
An informal skating area is planned. and a sliding hill. Current plans
are to seed the area this year, establish the playing field, and next year
put up the play structure. The Parks Department' experience has shown
that in a new neighborhood, it's best to install play structure first, and
other amenities later.
A petition from the residents (filed in the City Hall) urged early
development of the park area. Resident COllllllel\ts included:
...almost all the residents are eager for tennis courts.
...could we have an informal skating rink (over the playing field area)
next winter? We don't need any warming house or boards, just open
skating.
. i ...with the play structure situated near the storm water holding area,
will there be a danger of small children wandering into the marsh area
. below? Buckley assured them that the area will be left in a natural state
which will discourage children from venturing into the area; if this does
not prove an adequate barrier, more natural barriers will be planted.

...The sliding hill appears to be near Highway 10; will there be barriers
there? Buckley stated the sliding area runs back towards the park, will
be some distance from Highway 10 and perfectly safe.
...Residents suggested a hard court area for basketball. Buckley replied
that if tennis courts are installed, a hard court area will be provided in
connection with the courts.
...Residents seemed pleased with the park plans, agreed with Buckley's
plan to install playing field, then play equipmeQt, but reiterated their
strong desire for tennis courts. In obtaining signatures for their
petition for park development, they stated that every homeowner was eager
to sign, and every homeowner asked for play equipment and tennis courts.
Much interest in winter activities was also expressed (informal skating,
sliding hill).
Buckley pointed out the trail which will run through the park, connecting
the area with Colleen Avenue, hence to Floral Park and Cummings Park. The
trail, because of the topography of the area, will be a walking trail
only.
Before leaving, two residents of the area who participate in organized
hockey, commended Buckley and the Parks Maintenance ataff on the excellent
. grooming on Perry Park Hockey Rink last winter; felt maintenance much
< better than in Shoreview or New Brighton parka.

The meeting was called to order at 7:30 p.m. by Acting Chairman Paul Malone.

Approval of Minutes
Motion was made by Timm, seconded by Zehm, that the minutes of July 16 be
approved as submitted. Motion carried unanimously.
Review of Police and Fire Department Reports
It was noted that the number of police calls is 5% below the number for the
same period last year. July had an unusually high number of alarm calls,
presumably due to climactic conditions. Fire report showed only one actual
working fire in July, 17 fire runs.
. Request for Street LiRht (Bussard and Old SnellinR)
In January of 1986, a petition was received from the residents in this area
requesting installation of a street light at this intersection. At that time
they were told that the Committee was then formulating an overall street
lighting plan for the City, and preferred addressing their request after this
plan had been completed.
They have again requested a decision from the City re placement of this light.
Noting that the 1988 budget provides for installation of street lights at major
intersections (Phase I), (pending Council approval) and that a light at this
intersection is provided under Phase I of the overall street lighting plan, it
was moved by Trolander, seconded by Zehm, that Committee recommend to Council
that the residents be informed that, pending Council approval of this 1988
budget line item, the light will be installed early in 1988. Motion carried
unanimously. Rationale for the recommendation is a desire on the Committee's
part to avoid any deviation from the adopted street lighting plan. COlllllittee
asked that the Clerk Administrator inform the residents of this decision, and
add that if they choose to install lighting independently of the Village, the
lights must meet building code requirements.
Malodorous Air - North Hamline Avenue
Mr. Salitros and Mr. Sawtell attended the meeting to research with the
Committee possible causes and cures for the odors emitting from the manhole in
the street in front of their homes. Characteristics of the odor are (1) it
smells like hydrogen sulfide; (2) it seems to be heavier than air, since it
. comes out of the vent atop both homes, and settles down to envelop the homes;
(3) it disappears during the cold winter months; (4) the smell is stronger on
weekend, indicating that it's strongest when flowage is down (Bethel College
pumps into this line).

Agencies contacted to assist in determining the source of the problem include
(1) MWCC, who determined that the hydrogen sulfide level was high; (Zehm
recommend Raddatz obtain a copy of this report; (2) the Pollution Control
Agency, whose only suggestion was to check the soil to see if seepage into soil
caused the odor.
Steps taken thus far to eliminate the odor include (1) jetting the sewer line
along the entire street two or three times; (2) flushing the line; (3) last
week the line was televised the length of three manholes, one on either side
of the affected properties, were televised. This indicated no cracks or dips
in the line; there was a few rocks and sand in one section, not enough to block
the line, in Raddatz I opinion. Salitros added that the lines running into each
home have been checked and are all clear.
Committee concurred with Raddatz' plan to again jet the line to remove the
rocks that were seen in the line, then televise it again, although he is
convinced that there is nothing in the line causing the problem. He is also
requesting permission from the State to remove their fencing so he can get
closer and do a more thorough job of flushing the lines again.
Other possible courses of action suggested were (1) check to see if Bethel
could be dumping anything into the line that would cause the smell; however,
this is improbable, since the odor doesn't occur at the manhole closest to
where the Bethel flowage comes in; (2) Committee asked if abandoned cesspools
could be involved; however, they are located to the rear of the homes, so this .
is unlikely; (3) Salitros noted the corner at the end of the street had been
dug up numerous times for installation of NSP, Cable and phone lines, thought
there could be a "void" left where gases are stored.
In response to query, Raddatz stated that televising the line costs $70 per
hour (totalled $210.00). (265 feet were televised).
Review of 1988 Bud~et
General Government Buildin~s - The proposed 1988 budget is substantially the
same as 1987. Funds are requested (580, Misc. Equipment) for purchase of
vertical blinds for City Hall, and a hoist in the shop. This line item is over
budget in 1987 because the new telephone system was purchased, rather than
leased, as originally planned. $5,000 is budgeted to bring Village properties
up to OSHA standards.
Streets - Again, no substantial changes are proposed for 1988. Line item 215
(Shop Tools and Supplies) has increased because of the transfer of costs of
smaller shop items from 580 (Misc. Equipment) to this line. 226 (Street Signs)
is increased; Raddatz reports he has had to purchase more signs each year, and
that Ramsey County has increased its charges for Spring road posting. Line 381
(Street Lighting) requests funds ($6,000) for implementation of Phase I of the
Street Lighting Plan prepared by this committee. In 1987, engineering fees
(line item 303) are $14,200 and drop back to $4,500 in 1988; in 1987 SEH
developed the long range Pavement Management Plan for the City ($10,000). The
$2,500 requested in 580 (Misc. Equipment) covers the replacement of the sander .
on the #1 truck.

Sanitation - $5,800 is budgeted for possible development of a recycling plan in
1988. The subcommittee will, however, be presenting a report to Council
suggesting a larger investment in recycling. The report will be presented
later.
Storm Sewers - Line item 437 (Other Misc. Expenses) provides funds for
repairing storm sewer lines and cleaning out outfalls. Although not requested
in this budget, Raddatz recommends the City begin accumulating funds for
implementation of the 509 Comprehensive Surface Water Management Plan (could
cost up to $30.000.
Water Utility - Funds are requested for replacement of the aging water van
($11,660) .
Sewer Utility - $12,000 is provided in capital outlay for lift stations. New
electric controls are needed for Station 7, and Station 6 may have to be
entirely replaced. The inflow-infiltration study update done by SEH in 1987
indicates that 10,000,000 gallons of infiltration could be prevented by
repairing lines in Ingerson area, $10,000,000 in the trailer park area, and
10,000,000 in the industrial area near Red Fox and Grey Fox...although to do
so, would require rebuilding the street as well. Raddatz suggests repair of
the lines be correlated with the need for street repairs -- and that City begin
to set aside funds for this purpose (Pavement Management Plan).

. The $31,800 in 550 (Automotive Equipment) provides for payment for the other
half of the jetter purchased in 1987.

Raddatz discussed briefly the need for long range planning for development of
the recently purchased land adjoining the City Hall. The philosophy of yearly
setting aside some funds for street reconstruction, purchase of major equipment
items, and sewer line repair and replacement was briefly discussed.
Update on Construction Projects
Northwoods sewer, water, paving, and storm sewer has been installed and
completed...costs are being 1007. assessed to property owners.
Hamline Avenue construction is complete; there will be no assessment on this.
Edaewater Estates - sewer, water, paving, and storm sewer project completed;
costs will be 1007. assessed.
Glenhill Road has been re-paved and storm sewers installed; Arden Hills' costs
were 507. assessed to those properties owners who benefited.
The storm sewer and drainage problem on G1enview Avenue were corrected, at a
cost of $19,000. Funds were diverted from the street sealcoating budget to
cover this cost.
. Royal Hill North construction is complete; there appears to be only one
remaining undeveloped lot in the area.
Keithson Addition is almost completed. The County is adding a right turn lane

on Highway 96 for turning onto Keithson Drive.
The inside of the Water Tower has been painted with epoxy; the outside is
somewhat completed, but can only be painted on weekends when there are no cars
around. As soon as painting on the outside is completed, the tank can be
filled and used. (Epoxy paint needs a 10 day curing period. which will be over
before the outside painting is completed.)
Recyclin~
Malone presented a brief report -- will be preparing a complete recommendation
to Council at its next meeting. The subcommittee will recommend financing of a
recycling plan through a $1.00 per month charge through the water bills. They
are recommending bi-weekly pick-up, and provision of containers to residents.
They expect the program to be self-supporting. Complete details will be in Mr.
Malone's report.
Miscellaneous/New Business
Steglich asked if anything could be done to make the Highway 96/Highway 10
intersection less dangerous; says he sees numerous, extensive accidents at the
corner. He suggested requesting that flashing lights be placed north of the
intersection warning that it is coming up; frequently sees large trucks going
through the red light. Committee requested a letter be sent to Don Fashon at
the State asking for statistics on the number of accidents and suggestions for
reducing same. .
Council Report
Councilmember Hanson reported on Council actions of interest to the committee.
She stated that the fire contract had been extended six months (from January
1); a proposed contract was presented to them some time ago, but no response
has been received.

In response to concerns expressed at the August 20 Public Safety/Works
meeting, the enclosed letter was forward to Hr. Don Fashant of HnDOT,
District 9.
Also, in discussing your concerns with Commander Bergeron of the Ramsey
County Sheriff's Department, the following statistics were submitted, upon
request for reported accidents and comparable intersection accidents:

There may be accidents which were not reported to Ramsey County, as both
streets are under HnDOT's jurisdiction. It was also noted the accidents
on 96/10. in some cases, involved higher speeds, therefore, accidents were
more severe.
Commander Bergerson did not think flashing lights would alleviate the
problem; he felt the majority of the acci~ents were due to people attempting
to "make it through the light before it turns"', or, simply running the
light.

COMMENDING DONALD R. LAMB
WHEREAS, Don Lamb was appointed by Mayor Crepeau as Arden Hills'
Treasurer on May 12, 1975, and
WHEREAS. in his years as Treasurer, Don has ensured the financial
health of the City by judicious investments and constant, careful scrutiny of
all expenditures, and conscientously labored to keep tax rates at the lowest
possible level, and
WHEREAS, in the pursuit of these objectives, he has faithfully
attended all Finance Committee meetings and contributed his expertise to their

RESOLUTION APPROVING 1987 ADDENDUM TO THE 1986 LABOR AGREEMENT
WITH INTERNATIONAL UNION OF OPERATING ENGINEERS
LOCAL NO. 49
WHEREAS , H.S.A. 179, Subd. 4 requires that the City of Arden Hills and
the International Union of Operating Engineers, Local No. 49, as the exclusive
representative of the City I s Public Works employees, enter into a written
contract containing the agreed-upon terms and conditions for employment of such
employees, and
WHEREAS , representatives of the City and the Union have agreed upon
the terms and conditions of employment of such Public Works employees for the
year 1987, and a 1987 Addendum to the 1986 Labor Agreement Contract embracing
such terms and conditions, has been prepared,
WHEREAS , H.S.A. 179.70, Subd. 2, requires that the City supplement the
terms and conditions of such Agreement by means of a resolution,
. NOW, THEREFORE , BE IT RESOLVED, by the Council of the City of Arden
Hills that the 1987 Addendum to the 1986 Labor Agreement Contract between Arden
Hills and the International Union of Operating Engineers, Local No. 49, be and
it hereby is in all respects adopted and approved in the form submitted, and
the Mayor and the Clerk Administrator of the City be and they hereby are
authorized to execute the same on behalf of the City.
BE IT FURTHER RESOLVED, that the terms and conditions contained in
.said Addendum be and they hereby are incorporated herein by reference and are
made a part hereof as if they were fully set forth herein.
BE IT FURTHER RESOLVED, that the Clerk Administrator be and she hereby
is authorized and directed to cause a certified copy of this Resolution to be
