Burning on Blacktop Streets Clerk Lorraine Stromquist Informed the Council that complaints have been received from residents regarding peopla burning lesvGs and brush on tho Vlnage streets resulting In damage TO tha streets. Attorney Courtney Informed the Council that he could not roadlly find a statute or ordinance concerning this matter, but feels thore probably I s a state statuta on this matter and will pursue It 'iurthor I f 'the Counc II - . so requests. Mayor Nethercut felt that probably It could be solved by notification a~d/ or publlcl'~y In the papers. 3205 North LexlnQton Attorney Courtney stated that the building should have been removed by Ol:tober 10, 1966, but has had no answer from the FI re Msrsha II. Trus'tee Crepeau Informed the Council that Sam Zappa claims interest In burning the garage on Victoria but not the building on the Edgewater Motel site; Fire Chief Ehlers has offered assistance. Chief Ehlers will dlseuss h~e matter 111th Mr. Zappa. Circle S Ranch Attorney Courtney Informed the Council that he has not received a reply to his letter from Mr. Reiling, owner of the Ranch, nor has Mr. Daul)nay, his attorney, returned his telephone call. Clerk Lorraine Stromquist stated that she did not have any Information here on the matter. Attorney Courtney rocommended thzt Information on all claims should be In the Clerk's office ~nd suggested getting the recommendation from the auditor. Matter referred to Clerk Lorraine Stromquist to request this Information from al I committees und al! concerned. Fern\1ood Avenue Clerk Lorraine StromquIst presented two title opinions, dated October 28, 1966, from Attorney Salland concerning Fernwood Avenue; onD title opinion for the ~est 40 feet ot the road~ay - the second opinion for the east 33 ft. Trustee BJorndahl moved, seconded by Trustee Crepeau, that the Attorney be authorized to obtain the best deed possible on the 33 feet strip ~r.d road easement on the 40 foot strIp; motion carried. Zonlnq Ordinance Attorney Courtney believes the proposed Zoning Ordinance Is now ready for p~lnting with exceptions which have beeo corrected through conversa- tions with Carl Dale and the Planning Commlsslo~; he requested the Clerk to proof read the complete proposed ordinance" Attorney Courtney Informed the Council that no fee has been establ1~had for relocating structures In the Vlllageo He recommendad checking ~Ith adjacent villages and the Building Inspector. Matter referred to th~ Clerko There was some discussion concerning the method of handling the mailed notices. Attorney Courtney suggested that post card notices be sent to all names eppearlng on the County Treasurers listing seems to be most feasible; he will draft the notice for the post cards. The Attorney also recommended that a certification of mailing be executed. eTrustee Crepeau moved thet the hearing for the proposed Zoning Ordinance be set fo~ December 13, 8:00 p.m. et the Lake Johanna Elementary School, that notices be published as required by law and post cards be mailed as feasibly determined by the Clerk; seconded by Trustee BJorndahl; motion carried. Clerk requested to have 100 copies of proposed Zoning Ordinance and map printed. REPORT OF TRUSTEE HOFFMANN Proposed County Road E Service Road I rus-~ee Hof'1mann reported that he had discussed i-he proposed service road on the south side of County Road E with Mr. Lambert and Mr. Glonnon; Mr. Lambert Informed Trustee Hoffmann that he Is wll ling to cooperate ~llth an Improvement of the area. Clerk Lorraine Stromquist stated thet unoflclally the County and State are al- ready working on lights at these points. REPORT OF TRUSTEE CREPEAU ACQuisition of Police Do~ Trustee Crepeau reported that a replacement po! lee doa hC1~ been acql! 1 red by the Village; he has been well trained by professional trainers for 14 weeks before being trained with Officer Sexton. Trus1'ee Crepeau In- formed the Council that "Nick" Is strictly a one man dog and must live with a family and be part of the family when off duty or h0 \-1111 become very vicious. REPORT OF TRUSTEE BJORNDAHL Mounds Vle\'J School District Representative Trustee BJorndahl recommended and moved the appointment of Roy Ander3on. 1910 Stowe Avenue. to continue representing the Village on the Mounds View School District Recreational Advisory Committee; seconded by Trustee Crepeau; motion carried. Pedestrian Trail Trustee SJorndahl Informed the Council that complaints are being made regarding Hondas on the N.S.P. portion of the pedestrian trail and also calls from N.S.P. asking from whom we received permission for "~he use of 4Itthls property. Attorney Courtney recommended that we get written pe.mlsslon. He also Informed the Council that N.S.P. has the right to post the property and If they request the Village to patrol same, then we would have Jurls- d I c1'1 on. Trustee BJorndahl offered to sork on this matter with N.S.P and Bethel College and then suggested proceeding getting written permission from the other property owners. Counc II referred to Clerk Lorraine Stromquist the matter of obtaining written permission from other property owners Involved. Trustee BJorn- dahl stated that this had not been done due to a mlsunds.standlng. Library MattGr In response to Trustee BJorndahl's Inquiry, r4ayor Nei"hercu-j- Informed the Counc il that the location of the Ramsey County L1brery Is 5-;-111 being worked on and faels that the Library Board Is agreeable to the site ofysred. LeaQua of Minnesota Municipalities Mayor Nethercut reported that he Is Chairman of the Metropolitan Affairs CommIttee of the League of Minnesota Municipalities and ~Quld appreciate comments trom the Councl I for Its next meeting. United Nations DlstlnQulshed Service Award Mayor Nethercut recommended and moved that thIs award, st~ned bv PrAsldent Johnson be presented to the Arden Hills League of Vot~rc seconded by Trustee Crepeau; motion carried. Trustee Crepeau suggested that the award be framed; referred to Clerk. ~ REPORT OF ADMINISTRATIVE CLERK LORRAINE STROMQU!ST Ramsey County Asphalt Plant da,'ed October 13, 1966, Clerk Lorraine stromquist read a copy of a letter, from Attorney Edelman, to the Board of County Commissioners Informing the Council of a meeting to be held on November 7, 1966, at 10:00 a.m. at .356 City Hall regarding the asphalt plant loceted on the northeast corner of Lex I ngton Avenue an.d County Road E. Trustee Crepeau Informed the Council that thG Coun-ty Is considering a $65,000 Improvement to the plant to attempt to eliminate the nuIsance factor. He stated he would attend this meeting. Extract of Minutes ofiMeeting of Vi llage Counc i Village of Arde~ Hill~ Ramsey County, M1nnesQta Held October ~ll 1966 Pursuant to due call and notice thereof, a regular meeting . of the Village Council of the Village of Arden Hills, Minnesota, was duly held in the Village Hall in said village on Monday, the 31st day of October, 1966 at 8:00 o'clock p.m. The following members were present: Nethercut, Crepeau, Olmen and Bjorndahl: and the fol10wing was absent: Hoffman Also in attendance were Lorraine Stromquist, Village Clerk- , administrator; Vincent Courtney, village attorney; and Peter S. Popovich of Peterson & Popovich, village bond consultants. The Mayor announced that the assessment hearing, continued from October 18, was again open for the consideration of objec- tions, if any, to said proposed assessment. The Clerk-administrator then read a letter from the village consulting engineer relating to the condition of the street. All persons present were then given an opportunity to present oral objections, and all such objections or comments were tabulated as follows: ~ Property Nature of Obiection Richard M. O'Kelly, 1378 Cumwings Lane: Asked if the contractor would seal the road as part of his contrac~ or if the village would have to pay for it. Jerome Timm, 14no Cummings Lane: Commented on the irregular lines of the curb. . Mr. Olmen then introduced the following resolution and moved its adoption: RESOLUTION ADOPTING AND CONF ffiMING ASSESSMENTS FOR STREET IMPROVEMENT NO. 7 BE IT RESOLVED by the Village Council of the Village of Arden Hills, Minnesota, as follows: . . 1. The amount proper and necessary to be specially assessed at this time for Street Improvement No. 7 against every assessable lot, piece or parcel of land affected thereby has been duly cal- culated upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Minnesota Statute~ Chapter 429, and notice has been duly published, as required by law, that this Council would meet to hear, consider and pass upon all objections, if any, and said proposed assessment has at all times since its filing been open for public inspection, and an . opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments. 2. This Council, having heard and considered all objections so presented, and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment was and is specially benefited by the con- struction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and such amount so set out is hereby levied against each of the respective lots, pieces and parcels of land therein. 3. The proposed assessments are hereby adopted and confirmed as the proper special assessments for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of 6% per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual principal installments extending over a period of ten (10) years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 1967, to be payable with general taxes for the year 1966, collectible in 1967, and one of each of the re- maining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year thereafter until the entire assessment is paid. 4. Prior to certification of the assessment to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment, with interest to the date of payment, to the Vi llage Treasurer, but no interest shall be charged if such payment is made within 30 days after the date of this resolution. 5. The Village Administrative Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll, with each installment and interest on each unpaid assessment set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assessments in the . manner provided by law. The motion for the adoption of the foregoing resolution was duly seconded by C;repeau , and upon vot& being taken thereon, the following voted in favor thereof: All and the following voted ageinst the same: none whereupon said resolution was declared duly passed and adopted. . . . .
