Elm's Addition Variance Reauest - Case No. 66-13 VIctor Pomerenke, realtor~ and Alex McNeil, builder, discussed their request for side lot variances on Lots 5,6 and 7, Block I, Elm's Addition. They also stated that Mr. Elms, owner of the tract, Intends to repeat the rest of the lots, making them larger. This replattlng will accommodate the architect's proposed homes and will not reaulre any further side-lot variances. Mcyor Nethercut snd Attorney Courtney outlined the procedure to be followed in filing an application for a revised plat. Mr. Porne~enk0 left the meetIng to discuss the matter with Mr. Elms, returned at Ii :00 p.m., and advised the Council that they would modify their variance request ta cover only lot 5, Block I. Mr. Elms also Intends to fllB an application fo. a Revised Plat. T.ustse Hoffmsnn moved that a side-lot variance be granted for Lot 5, Bioc~ I, Elms Addition which will permit a 10' slde-~arcl and 20' sld0- yard aggregate. Seconded by Trustee BJorndahl, carried. The Councl I also stated firmly that no further side-yard variances would be g.a,;tsd in the Elms addition and that the remaining area should be replattBd and/or homBs designed to conform with the VllIsge Zoning Ordinance. Mayor Nethercut congratulated Vincent Courtney on his recent election as President of the Bar Association. ATTORNEY COURTNEY'S REPORT Geroux Rezonln~ - Case No. 66-8 The attorney reported that he was unable to proceed on this rezoning matter because of insufficient Information, fla~s In the ownership report, etc as detailed In his letter of May 23 to the Council. Ad- ministrative Clerk Stromquist was requested to contact Mr. Geroux, giving him a copy of Attorney Courtney's letter, and Informing hIm that a correct legal descrIptIon and complete ownership report were needed. . Frontage Road Me I ntanance Action on the maintenance agreement was deferred until the June 13 meeting. Attornev Courtney requested that William Hlte check the Village insurance concerning the Indemnifying provision (assumed contract liability coverage). Engineer Lund will complete his study of the agreement by the next meeting. Municipal Plannln~ Act Attorney Courtney reviewed the powers of the Board of Appeals. Since the Village has a Board of Appeals which Is separate from the Planning Commission, both bodIes ~III have to consider variance requests with the Council to take action after the ne~t scheduled meeting 01 the PlannIng Commission. Attornev Courtney advised the Council tha~: I. The Planning Commission should be set up by Village Ordln<lnca. . 2. Acceptance of the Comprehensive Plan raqul,es a Publ Ie Hearing to be conducted by the Planning Commission. 3. The Public Hearing considering the Zoning O~dlnance ~~y be conducted by either the Planning Commission or the Council. Uniform Bulldlnq Code Attorney Courtney reviewed the changes In the Uniform Building Code. Clerk Stromquist \'Ias requeste,d to proof read the Ordln~nce against the rough draft. Trustee Crepeau moved that Ordinance 693 be given the thIrd and flna! reading and moved adoption of OrdInance e93 - An OrdInance Regulating the Use of Land, the Location and the Use of Buildings and the Ar~Bng0- ment of Bulidlngs on Lots In the VIllage of Arden Hills. Repealing inconsistent OrdInances and Imposing Penalties for ViolatIons. Seconded by Trustee BJornd~hl, unanImously carried. Zonlnq and Licenslnq OrdInances The attorney distributed to the Council copies of a rough draft o. the Zoning Ordinance. The Council requested the Attorney to provide ad~l- t!onal copies for the Planning Commission, Board of Appeals. Carl Dale and others concerned. The proposed LicensIng Ordinance will be ready for the June 13 meetIng. Robert's Warehouse The attorney ~III write Mr. Roberts concerning the red-tagged warehouse addition, stating he Is to appear at the June 13 Council meeting or a formal complaint will be Issued. BUILDING INSPECTOR KELLEY'S REPORT Clay Keiley stated that Mr. L. Leyke, 1923 Noble Road was concerned about the 4,0' set-beck requirement. His house Is located 32' from the roed and Is presently surrounded by undeveloped land In the Elms Addition. He hilt that a front set-back variance for I.ots adjacent to his prop0n'y would be desirable so that his home would not be the only one to protrude 8' forward of all future homes on Noble Road. No action taken. . REPORT OF TRUSTEE HOFFMANN Lift StatIon Dama~e Consultation with Messrs. Hlte, Lund, Nixon, Lamettl and electricians concerning the cause ot the January 28, 1966 11ft station damage re- vealed no e~ldence of power outage, the cold night might have been a contributing factor but apparently some type of mechanical failure caused the damage. VIllage Insurance wIll not cover the damage. REPORT OF TRUSTEE CREPEAU Safety Award Trus+s6 Crepeau presented the Special Merit Safety Award for Traffic Control received by the Village from the Minnesota Safety Council. Parks and Recreation Committee Meeting The Committee Is In favor of an Indoor hockey arena being loeata~ In this area, but feels that It should be financed by private of County funds. REPORT OF TRUSTEE OLMEN Lake Johanna Dralna~e Meeting Trustee Olmen reported that approximately 25 people attended the meeting of May 12. He reviewed the County Engineer's answers to Village questions as detailed In the Public Works Committee Report of the meeting. Clerk Stromquist was requested to write a letter of apprecl~- tion to Deane Anklan and his colleagues for the Informative meeting. Reilln~ Water Franchise eThe Public Works Committee feels that presently there is not adequate evidence of a need for municipal water via a Village or Private system as proposed. Until a petition from property owners is received ac- knowledging a willingness to pay actual costs including consumption charge and ultimate purchase costs, It Is recommended no further con- sideration is appropriate. REPORT OF ADMINISTRATIVE CLERK LORRAINE STROMQUIST Weed Control Trustee Olmeo moved that the general ~eed control notice be published June 2nd In the New Brighton Bulletin. Seconded by Trustee Hoffman", carried. 1967-1968 Ramsay County Road Construction ProQram Clei"'!\ Stromquist reed a letter dated 5/11/66"from the County Engineer's office outlining a proposed Improvement of Old Highway 010 from County Road E to County Road F. Matter referred to Engineer Lund. Clerk Stromquist was requssted to secure from the County Engineer more de- tailed In10rmatlon for the next council meeting. Arden Hills Cefe licenses Clerk Stromquist reported that this cafe Is now closed. Trustee Crepesu moved cancellation of all licenses for the Arden Hills Cafe at 4760 eHlghWay 08. Seconded by Trustee BJorndahl, carried. The clerk ~as re- quested to write the owner of the property Informing him o{- cancellation of licenses. Should the cafe be re-opened new licenses must precede opening for business. Apportionment of Assessments, Sanltarv Sewer No.2 Trustee Olmen moved, seconded by Trustee Crepeau, that a Resolution Relating to Apportionment of Assessments relating to Sanitary Sewer No.2. as attached be approved, carried. The following members were present: Mayor Nethercut, Trustees Hoffmaan, Crepeau, Olmen and BJorndahl. and the following were absent: Noae Trustee Olmeo introduced the following resolution and moved its adoption, RESOLUTJ:ON RELATDlG TO APPORTJ:OI.'iJll'lENT OF ASSESSMENTS RELATmG TO SALUTARY SEWER DiPROVEMEN'l' NO. 2 BE IT RESOLVED by the Village Council of the Village of Arden Hills, Minnesota, as follows: WHEREAS, the assessment roll for Sanitary Sewer Improvement No.2 as last finally amended and adopted on October 12, 1961, was filed and certified to the County Auditor of Ramsey County on November 8, 1961, for tIle purpose of including installments thereof to be collected along with real estate taxes commencing in 1962; and WHEREAS, a hearing on supplemental assessments, reassessments ... and apportionment of previous assessments in respect to Sanitary Sewer Improvement No. 2 was held on July 16, 1962, at which time assessments for Sanitary Sewer Improvement No. 2 were amended as provided by said resolution of said date and certified and filed in the office of the County Auditor of Ramsey County on October 3, 19621 and WHEREAS, since that date a number of parcels of property contained within said assessment roll as amended have been divided and conveyed by previous property owners1 and WHEREAS, the County Auditor of Ramsey County requires that . apportionment of the original assessment against each original tract where it has later been divided, sold or conveyed, be made by the Village Councll of the Village of Arden Hills, in order that the proper assessment can be extended by the county Auditor against each parcel of property thereafter, commencing with an assessment to be collected in the year 1963 and thereafter. NOW, THEREFORE, the Village Council of the Village of Arden Hills does hereby make the following apportionment of original assessments as contained in said assessment roll of October 12, 1961, and as amended as of July 16, 1962, against the following described properties: Original Assessment: (A) Auditor's Sub No. 80 1970.00 S 171 it of N 1011 ft of W 135 ft of E 270 ft of lot 32. The Village Clerk of the Village of Arden Hills is hereby authorized to prepare a certified copy of this resolution and to certify the same to the County Auditor of Ramsey county, Minnesota. WHEREAS, other municipalitIes have Indicated an Interest In establIshIng a temporary transit authority to serve until statutory provisions can be made; and WHEREAS, the participation of a majority of municipalities In the Twin Cities area Is desIrable for the organIzatIon of a temporary transit autborlty under the provisions of the Joint Powers Act; NOW, THEREFORE BE IT RESOLVED By the Council of the Village of Arden Hills that the proper Village officers be authorIzed to execute the Joint and Cooperative Agreement, and that the Village of Arden Hills participate In the MetropolItan Transit CommIssion.
