Markley Laboratories, inc.
Attorney Courtney stated that Max C. Markley of Markley Laboratories,
inc. had applied for a conditional use permit fo~ 4606 Old Highway 8
for the purpose of a tasting laboratory on the premises. The legal
description of the property Is as follows:
The south 100 feet of the north 860 feey of the
west 225 feet of the south~est quarter of the
southwest quarter of Section 16, To~nshlp 30,
Range 23, Ramsey County, Minnesota.
Attorney Courtney stated that the legal notice had been published and
the required notices mailed.
Mayor Nethercut read an excerpt from the Planning Commission minutes
of the meetIng of March 22, 1966, which recommended approval of the
conditional use permit with the following qualifications:
i. Development be according to site plan submitted 3/22/66.
2. Odor and noise not to become objectIonable to neighbors.
3. Employees not to exceed 6 In number (Including Mr, Markley
and son).
4. Live load limit not to be Glotceeded.
5. Any sign must be set back 5 feet from the frD~t property iin~,
-6. All refuse be kept Indoors.
7. Garage be kept locked when not attended.
8. This conditional use be subject to an annual review.
Mr. Markley stated his agreement to the qualifications.

-. Michael Lyons, attorney for the \Hnklers, fee owners of the property, ~las
present In behalf of the Wlnklers to assure that the charactsr of the
building Is not altered which ~ould devaluate the property. He explained
that he understood that the property was presently under Contract for Deed
sale to the Chrlstlansons.
Markley stated he Is buying from 'Christianson and 15 also assuming
Winkler's contract In the amount of $8,206.00. ,Mr. Lyons believes tho
original contract price to be about $14,000.00.
Mr. Markley assured Mr. Lyons that the buildings ~I!I noy be damaged
nor structurally changed.

M.... Lyons Informed the Council that the Wlnklers are In California and
rather than InconvenIence Mr. Markley be requesting a continuance of
the hearIng, he requested a recess to allow hIm to confer with Mr. ~Inklsr
by telephone. The Council granted thIs request and Mr. lyens and Mr.
Markley departed.

the Council that he had completed hIs cal! and Mr. Markley has agreed to

Mayor Nethercut declared the publIc hearing closed and Coyncll action
deferred until the next CouncIl meeting.

Commercial Bulidln~ Request - Robert Schlfskv
Mr. Robert Schifsky appeared before the Council with plans for the con-
struction of a quick-stop grocery store and dry cleaning Pick up station
at the corner of County Road D and New BrIghton Road. He Informed the
C~nlnc II that he has presented fIve sets of p.l-ens to the P I ann I ng Comm I s-
lSI.JOn without gainIng theIr approval and feels that since the property is z
zoned commercial the construction should be allowed. He displayed the
most recent set of plans to the CouncIl for their consideration. Mayor
Nethercut explained that this request must be consIdered under the present
zoning, ~hlch Is commercial; he read an excerpt from e letter, dated
AprIl 21. 1966. from the Planning CommIssIon whIch recommended denial of
Mr. Schlfsky's request and listed the following additIonal reasons:
I. Increased traffic hazards.
2. Conflicts and hazards Involved Mith school children.
3. DeprecIation effects upon surrounding residential values

site at some time since all four corners are commercial. He believes

REPORT OF ATTORNEY VINCENT. P. COURTNEY
Radio Base Contract
Attorney Courtney prepared and submitted a base radio contract agreement
with a change In paragraph 4 which ~as agreeable with the V!O!age of
Nel'l Brighton.
Trustee Crepeau Informed the Council that this Joint municipal base
station will cost about $1800.00 to be divided equally by the two villages,
plus future maintenance and repair also to be divided equally. This ~I!I
enabla the villages to be In direct contact with the pollee cars and
also the pollee cars to call each other directly without relaying messages
through a third contact, for quicker and betterserulce to the residents;
however. this will not eliminate use of the Sheriff's office.

Pumping OrdInance
Attorney Courtney submitted a letter. dated April 25, 1966, which gBve~hls
opinion regarding Village Ordinance No. 3."pertalnlng to dumping In the
Village. Clerk was requested to send copies of this letter to members of
the Council. Attorney Courtney stated In this letter that he believes
the Village should require a dumping Ilcens~. Matter referred to Attorney
4Itcourtney to draft a ne~ ordinance.
Non-Conformlna Signs
Attorney Courtney Informed the Council of a letter received from the
owners of the previous Bethel College site requesting leniency regarding
the'~For Sale" signs on their property. letter given to Mrs. Trudy
Harmon, member of the Board of Appeals, for their consideration.
Attorney Courtney submItted a letter, dated April 25. 1966, concerning his
opinion on the Council requesting McGul~sto lower their unattached sIgn
to conform to the Ordinance. He states In hls letter that this sign was
constructed with Council permission before the adoption of Ordinance No. 76.
He believes that sould the Council decide to require ~he lo~erlng of this
sign, It should al.so be prepared to pay compensatJon 101" the damage.slJs-
talned by them; he cited several supreme court decisions regarding This
subject.

Attorney Courtney reported that he has obtained a resolution from the

Public Works Committee
Minutes of the Public Works Committee meeting had baen sent to memb0rs
of the Council. Trustee Olmen Informed the Council that the Commlttse
has deferred the study of street lighting. The Committee believes
the lighting needs should be based on safety needs and they would IlkG
a list of the people requestIng street lights. The level of Lake Joh0nna
~as discussed. Ramsey County Engineer's Office has offered to sand a
representative to talk with the people on this matter. Mayor Neth0rcut
e~pressed his belief that It should be a Lake Johanna Araa meeting with
the Public Works Committee In charge of the meeting and possibly It
could be held at the Village Hall. Trustee Olman stated that tha Committee
had discussed the posslbl~lty of holding twomG6tl~gs with Ramsey County _
on,e \1lth the committee ,and one with the Pub'Uc.

OF ASSESSMENTS RELATING TO
STREET IMPROVEMENT NO. 2 (60-2)
BE IT RESOLVED by tile Village Council of the Village of
Arden Hills, Minnesota, as followsl
WHEREAS the assessment roll for Street Improvement No. 2
(60-2) as last finally amended and adopted on October 10, 1960,
was filed and certified to the county All.ditor of Ramsey County
on December 12, 1960 for the pll.rpose of including installments
thereof to be collected along with real estate taxes commencing
in 1961, and

WHEREAS parcels of property as contained in the original
assessment roll as certified, have since been divided and con-
veyed by property owners, and
WHEREAS the County Auditor of Ramsey County requires that
apportionment of original assessment against each original tract
where it has later been divided, sold or conveyed be made by the
Village Council of the Village of Arden Hills in order that the

proper assessment can be extended by the County Auditor against
each parcel of property thereafter, after the same has been
conveyed and divided, to commence with the assessment to be
collected in the year 1961 and thereafter.

Cummings Lane between its intersection with Snelling Avenue and the easterly
termination of said Cummings Lane by constructing thereon a bituminous-sur-
faced roadway to the width of twenty-eight (28) feet throughout, bids were
received. opened and tabulated according to law, and the following bids were

WHEREAS, a petition was duly filed with this Council by James Adams and
others in accordance with the provisions of Section 412.851 of Minnesota Stat-
utes Annotated, requesting the vacation of View Avenue in the plat of Mounds
Center and a part of Mounds Avenue in said plat of Mounds Center, all within
the Village of Arden Hills, and
WHEREAS, said petition was found to be legally sufficient and duly pub-
lished and posted notice was thereupon given of a public hearing to be held
thereof on April 25, 1966, at 8:00 o'clock P.M.', at a regular Council meeting
in the Village Hall, 1450 West Highway No. 96, St. Paul 12, Minnesota, which
notice was given in accordance with the provisions of said Section 412.851,
and
WHEREAS, said public hearing was duly held and an opportunity was
afforded for statements for or against the granting of this petition,
NOW THEREFORE, upon motion duly made, seconded and unanimously approved,
with a quorum of the Council being then and there present, it was
RESOLVED, that it appears in the interest of the public
to vacate the following described streets in Arden Hills,
Ramsey County, Minnesota, to-wit:
View Avenue as described in the plat
of Mounds Center on file in the office
of the Register of Deeds, Ramsey County,
Minnesota,
.
and also that part of Mounds Avenue
lying Westerly of the Northerly exten-
sion of the West line of Lot 3, Block 5,
Mounds Center as described in the plat
of Mounds Center on file in the office
of the Register of Deeds, Ramsey County,
Minnesota.
BE IT FURTHER RESOLVED, that no award of damages in favor
of the Village shall be made upon this vacation.

BE IT FURTHER RESOLVED, that the Administrative Clerk
shall prepare and present to the proper County officers
a notice of completion of these proceedings in accordance
with Section 117.19 of Minnesota Statutes Annotated.
