Approval of Minutes The mlnu'i'es 0'1 the regular council meeting of March 14, 1966, wers approved as amended. The minutes of the special council meeting of March 21, 1966, were approved as submitted. Attorney Courtney had a question concerning the means by ~hlch a sp9clal use permit was originally granted to Mrs. Goldie Anderson to operata a beauty shop from her home at 1905 Glenpaul Avenue. The Clerk was request- ed to check back on the minutes for this information. Proposed Town Houses - Johannasburq Clark lorrslne Stromquist read a letter, dated Msrch 22, 1966, from Andrews Allan statln~ that he would be willing to conduct informational meetings for the residents before council consideration of his proposal to construct town houses on the east side of Lake Johsnna. Mayor Nethercut e~plarned that many residents had requested more information concerning this development snd believes It 15 a good suggestion. Attorney Courtney read a letter from Mr. Allen, dated March 17, 1966, which requested rezoning of the area. Attachments gave the legsl description of the property and aiso property owners within 250' of the property. There was much discussion by the residents present, the Council, Village Attorney Courtney and Richard Murrsy - Attorney for Peter Lamettl, one of the adJscent land owners. Mayor Nethercut called for a recess at 9:25 p.m. and the meeting was resumed at 9:50 p.m. Trustee Hoffmann moved that two informational type meetings be held during the month of April at lake Johanna Elementary School; these meet- Ings to be held during the week and starting at 8:00 p.m. \'1I'j-h Village Attorney Courtney acting as moderator and C'erl Dale, Village Plannel', -~ be present to answer questions. Attorney Courtney stated that the fact shoul6 be emphss$zed that neither of these meetings will be a public hearIng. Twin City Trailer Park Engineer Bruce Patterson and Mr. Adams, owner of the Twin City Trsuler Park ~ere present. Clerk lorralne Stromquist read Engineer Lund's re- port, dated March 22, 1966, on this matter. In reply to quest&ons men- tIoned In the report, Mr. Patterson stated that the owners tllll provide space tor 2 cars per unit. Mr. Patterson informed the Council that he wll I submit a petition and ownership report as required for the consideration of vacating portions of Mounds and View Avenues within the trailer park. Attorney Courtney states that the streets must be vacated before Council approval of the plans. If the requirements are met in time, the Council could SGt a date for the public hearing at the special council meeting of April 4. . REPORT OF BUILDING INSPECTOR CLAY KEllEY Hazardous Buildlnqs Mr. Kelley informed the Council that the house at 1467 County Road E Is old property, but no hazardous conditions exist; this concurs with the report previously given by Dr. Farkas, Health Officer. Mr. Kel ley stated that another house on Johanna Blvd. warrants inspection. REPORT OF ATTORNEY COURTNEY Road Easement Attorney Courtney Informed the Council that when the County turned over the Snelling Avenue service road which Is located between County Road E and the intersection of Snelling Avenue and Arden Place, reference was made to the road only; however, the legal description submitted could possibly include the easements. Attorney Courtney stated that if these easements are included, they could be used for road purposes only as this Is the only right the County has to pass to the Village. If this adjacent property Is not to be used for road purposes, the ownership. actually reverts back to the original owners, but the Village could possibly acquire this property through condemnation, and obtain the fee title. Matter referred to Engineer Lund to ~heck the legal description for Inclusion of the triangle in question, and Attorney Courtney wll I then contact the County to verify the status. Villa!le licensing Attorney Courtney advised the Council in his bpinlon the Village should ho longer enf~rce the licensing of electricians, plumbers and questions the heating and gas Installers; he wi I I give this further consideration after consulting with the Village Heating Inspector. CommunIcations Contract - Police Department Trustee Crepeau Inquired as to the Attorney's opinion regarding the radio contract. Attorney Courtney stated that he intends to study the matter and be able to report at the speCial meeting since the deadlIne for action Is May 9.' . . . REPORT OF ENGINEER lUND Cummln!ls lane Trustee Olmen requested Engineer lund to advise Fred Nixon on the grading and drainage of Cummings lane to enable residents to use the road. Arden Place Valve Trustee Olmen was concerned. about the difference in actual cost and estl- ,mate for the Installation of a valve to eliminate a sewer backup problem at a residence on Arden Place. He thought other plans could have been considered If the estimate had been truer. -2- . . Trustee Hoffmann reported that the Planning Commission has recommended approval of a conditional use permit to Markley Laboratories, Inc. to operate a testing laboratory at 4606 Old Highway 8, subjoct to the following provisions: I. Development shall be according to the sit. plan submitted March 22, 1966. 2. Odor and noise shall not be objectionable to neighbors. 3. Employees are not to exceed 6 IncludIng Mr. Markley and son. 4" Normal residential live load llml.t Is not 'j"O be exceeded. 5. Any sign must be set back five (5) feet from the {-ront property line. 6. No refuse is to be kept out doors. 7. The garage, which Is expected to be used for storage of chemi- cals, to'be locked when not attended. 8. This conditional use permit shall be subject to annual review. Clerk Lorraine Stromquist inquired about a possible smoke problem; Mr. Markley was present and assured the Council that this would be no problem. However, Clerk Stromquist suggested and the Council agreed that thi~ be an additional provision to the conditional use. Mr. Markley will submit to Attorney Courtney a petition and ownership report as required prior to the setting of a public hearing date; If these are 5~bmltted in time, the Council could set a date at the special meetin9 of Apri I 4. Variance Reque~t - Case No. 66-6 Upon recommendation of approval by the Board of Appeals and the Arden Hills Planning Commission motion was made by Hoffmann, seconded by Crepeau, that a variance be granted to R. J. McNeish to allow him to change the common lot line between lots 17 and 18, Block 2, Arden HII Is, as shown on plot plan submitted and attached to Planning Administrative Form 66-6, reducing the size of lot 18 to 11,200 feet, Carried. Upon motion by Hoffmann, seconded by Crepeau, permission for a building permit to allow an attached garage to the existing house to be con- structed 10 feet from the north lot 'Ine on lot 17. CarrIed. Roberts Construction Company Trustee Hoffmann reported that Roberts Construction Is not cooperating with the Plannlnq Commission regarding screening and boulevards. Trustee Hoffmann has been rGquested by the Planning Commission to contact Mr. R~berts. The Planning Commission recommende~ that the Council withhold action on any future building permits until past requirements are met. REPORT OF TRUSTEE CREPEAU None. REPORT OF TRUSTEE OLMEN . None. REPORT OF TRUSTEE BJORNDAHL (absent) Clerk Lorraine Stromquist read a letter, dated March 22, 1966, from Norbert Soukup, President of the Arden Hills little Lakes Little lesgue, requesting use of the ball field at Snelling Avenue and County Road F, Monday through Thursday evenings and Saturday mornings during the season. Trustee Crepeau stated his concern regarding machines dispensing perishable foods, especially when there Is an electrical po~er outage. Planqing Commissl~ft Request The Council approved the request of the Planning CommIssIon to contact the VI Ilage ~ttorney and Engineer without first obtaining authorization r:rom the Council for each Individual matter. Publicity Coordinator As recommended by ClerK Stromquist, Trustes Olman moved, seconded by Trus- tee Crepeau, that Mrs. Myrtle Schiller, 3248 Sandeen Road, replace Elaine Campbell as Village Publicity Coordinator; motion carried. S~sclal Meetlnq Reminder Mayor Nethsrcut reminded the Council of the April "4, to study the proposed zoning code. Mayor Kennedy ~III also attend.
