MINUTfS OF REGULAR COUNCIL MEETING Villag~ of Arden Hills Monday, Februci-y 28, 1966 8:00 p.m. Mayor Nethercut cel led the meeting to order at 8:00 p.m. Roll Call: Present - Mayor Nethercut, Trustees Hoffmann, Crepeau, Olmen and Bjorndahl, Absent - None , Also Present - Administrative Clerk Lorraine Stromquist, Deputy Clerk Florence Honan, Attorney Vincent P. Courtney, Engineer Donald Lund, Treasurer Worth Read, and Building Inspector ClayKel ley. . Approval of ~lnutes The minutes of the regular Council meeting of February 14, 1966, ~ere approved as amended. Red Fox Road Bob McNlesh, Chairman of the Public Works Committee, reported on the Joint meeting of the Finance Committee and the Public Works Committee regarding the Red Fox Road Improvement. Copies of the minutes of this meeting were previously dLstrlbuted to members of the Council. Mr. McNlesh reported the following recommendations: I. The Council request the County to Immediately consider the construction of Red Fox Road; this would take the County about 2 months to conclude a study and If approved, would be placed onlts schedule which Is now filled for the next two years, but possibly could be constructed sooner depending on priority. 2. The Council arrange a discussion meeting with the property owners who petitioned for the Improvement. 3. If the County does not approve the construction, the assessment for this Improvement should be apportioned between the Village and the abutting land owners. Treasurer Wortij Read, Chairman of the FInance Committee suggested changing the n~me of Red Fox Road. The Committees believed the County should consl~er this Improvement as It Is possible that thIs road could be extended Into Shorevlew and connects two major roads and also that It Is an Industrial road. '. Mayor Nethsrcut thanked the Committees and stated that he was pleased with the results of the Joint study. William Feyerelsen, Administrative Clerk Lorraine Stromquist and Engineer Don Lund were requested to serve on a Committee to meet with the petition- ers as soon as possible. IS~5 ~ipl"i"ie.J~ D'~~U Ing Petition Mrs. Gloria Kuehn, 3581 Ridgeaood Road, presented a p~tltlon to the Mayor and Village Council, as follows: \18, tha undersigned residents of Arden Hills, respect- Ively petition, urge and request that current efforts to change single family residential zoning In Breas of the Village to permit multiple or town house development be denied. We believe It to be In the best Interests of all present resIdents of this village that we retain this Village as a single family residential village with such Industrial and commercial development as Is consistent ~Ith the overall concept of the ComprehensIve Development Plan. 1964-1980. Approximately 250 signatures were on this petItion. PetItion referred to Trustee Hoffmann to present to the Planning Commission. Mayor Nethercut stated that to date the Council has not received the Planning Commission's recommendation, but If a recommenda- tion of approval Is received, a publiC hearing will be required. Complaints George A. Salltros, 3625 North Haml Ine Avenue, appeared before the Council and voiced discontent on several matters. He re- quested actIon to obtain lighting at the Intersection of Hamllne Avenue and.County Road E. Mayor Nethercut and the Council agreed that this Intersection Is very hazardous. Trustee Crepeau moved, seconded by Trustee BJorndahl, that the Council request the County to Install lights at the Intersection of County Road E and Hamllne Avenue; motion Carried. Referred to Clerk. Mr. Salltros requested that better direction be given to the Bethel College Campus as many people attempt to reach the site via Hamllne Avenue which Is now a dead-end street and use his drive-way as a turn-around, which Is annoying. Matter referred to Clerk Lorraine Stromquist to contact Bethel College for recommendations on simplifying the finding of the site. He stated that dogs running at large are a problem. Trustee Crepeau Informed him that a concerted effort Is beIng made to el Im- Inate this problem. Mr. SaJltros stated that he received a sewer bit ling for the complete last quarter, which consisted of October, November, and December. He does not believe he Is liable for this billing, since he did not move Into his new home until December 21, 1965, although the sewer Inspection was made on September 3. Clerk Lorraine Stromquist stated that It Is the polIcy of the Village to start sewer billing one month after the Inspection has been made; a letter had been sent to Attorney Richard Jones, at his re- quest, whIch contained an excerpt from the minutes statIng this polIcy. Mayor Nethercut stated hIs belief that the Council should nor deviate from this polley; the Council agreed. Mr. Salltros re- quested a copy of his well report, referred to Clerk Lorraine Stromquist. League of Women Voters Presentation Mrs. Nan Smalley, Local Study Chairman for the League of Women Voters of Arden Hills presented booklets - "Minnesota TwIn Cities Metropolitan Area" and "Government In the Metropolitan Area" to members of the Council, on behalf of the League. Multiple Dwelllnos Mr. Jurgenson stated his Interest In constructing two 30-unlt' apart- ment buildings at County Road E and Highway 51. He had previously -2- . , , . . .' He stated that he Is not prepared at the present time to plan the development for the entire area, but ~ould like to feel his way before making any further commitments. Trustee Hoffmann suggested that he present his plans to the Planning Commission with the recommendation that he appear at the next month's meeting as this month's agenda Is quite heavy. BUILDING INSPECTOR CLAY KELLEY Hazardous Bulldln~s Mr. Kelley reported that the Richardson property, 1144 Edgewater Avenue Is not habitable In his opinion. I Clerk Lorraine Stromquist reported a complaint received from a tenant at 1467 West County. Road E. wh I ch stated that It is a f I ri;l haza rd as there Is loose electrical wiring, and also unsanltary'condltlons. Trustee Crepeau moved. seconded by Trustee BJorndahl, that the Bul'dlng Inspector and Health Officer Inspect the propert'y '~or health and hazard problems; motion carried. ;. Further action will be delayed until Mr. McClunp returns home to clarify the matter. . Attorney Courtney Informed the Council that so far he has not be~n able to ascertain the ownership of the old Edgewater Motel prope,- ty and feels he has reached a dead end, but does have another lead ~hlch he will pursue. REPORT OF ATTORNEY COURTNEY Proposed Zonln~ Ordinance ~ttornay Courtney submitted copies of his report on the proposed Zoning Ordinance 10r d1strlbutlon to the Council for further study. His report noted pol'rits he believes should be considered by the Council, Carl Dale, the Planning Commission and possibly the Board of Appeals; a copy had been sent to Mr. Dale. Discussion was delayed until atter Council study. Cerlk requested to send copy to Mr. Horty. chairman of the Board of Appeals, and Trustee Hoffmann requested to distribute copIes to the Planning Commission. -- Trustee Hoffmann Informed the Council that the January 4m 1966, Planning Commission minutes suggested that the Board of Appeals' recommendations be brought to the Planning Commission, and If the Commission differs. possibly two recommendations would come before the Counc I I. A special Council meeting was sat for Monday, March 21, to consider the proposed Zoning Ordinance and the UWlt~r.'Bulldlng Code. Proposed Llcensln~ Ordinance Attorney Courtney Informed the Council that he will have a rough }, draft of this ordinance In March. , CummlnQs Lane Road ImDrovement Engineer Don Lund submitted plans and specifications to Attorney Courtney and suggested 10:00 a.m. April 25. 1966, as the time for receiving bids. T~o sets of plans and .~pecltlcatlons were sub- mitted to Clerk Lorraine Stromquist. Attorney Courtney stated he will have hIs opinion st the next meeting. REPORT OF ENGINEER DON LUND Schmelzer Matter Engineer Lund believes the sewer back-up problem at the Schmelzer -3- . Fred Nixon stated that a similar situation exists at a residence on Johanna Boulevard. Trustee Crepeau moved, seconded by Trustee Hoffmann, that the Engineer be authorized to have a valve Installed on th~ sewer line on the Schmelzer property with the understanding that Its operation will not be a Village responsibility; motion carried. Clerk to so Inform Mr. Schmelzer. 4Il Rldqewood Road Sewer Matter J Engineer Lund stated that sewer construction for servicing lots 2, 3, 4, 5 and 6, Block 5, Arden Hills, cannot be further considered as he Is unable to contact Gerald R. Minder, owner of Lots 4, 5, and 6. Engineer Lund Informed the Council that Mr. Minder has not been avail- able by phone, letters to hIm have been unanswered and a specIal de- livery letter to hIm nad been refused. Mr. Jurek's home on lots 2 and 3 I s a I most comp I sted; therefore he w III I nstsll a much I anger sewer line than would be necessary under the proposal by BanIster EngIneering Company. Attorney Courtney stated that the Village could not Install the sewer lIne wIthout a public hearIng. A letter from Engineer Lund to the CouncIl and attached, describes this problem and his attempts for a solution; a copy of thIs letter Is being sent to Mr. Minder. REPORT Of TRUSTEE HOFFMANN Public MeetlnQ Trustee Hoffmann reported that about 35 people attended the public meeting of February 24, sponsored by the Planning CommissIon with assIstance from the Arden HIlls League of Women Voters. The subject of thIs meeting was on multiple dwellIngs. Trustee Hoffmann felt that thIs was not well attended and belIeves that the residents need educatIng along thIs lIne. He stated that In his opinion, when a decIsIon must be reached by the Council consIdering multIple dwellings In Arden HIlls, the CouncIl must decIde what is best for the VIllage and not for IndIvIduals. Mayor Nethercut stated that he belIeves the Council must keep an open mInd on the subject. REPORT OF TRUSTEE CREPEAU Annual Trauma Workshop Trustee Crepeau requested the Clerk to register Officers LaVal Ie, Sexton and Schmaedeke for the second Annual Trauma Workshop to be hel d In HopkIns on March 31, and April 1st and 2nd. Thank-You Letter . Trustee Crepeau read a letter, dated February 17, 1866, from Mr. Swenson commendIng the Pollee Department for the promt attentIon servIce given to hIs son In an emergency. Floyd and Proposed OrdInances Trustee Crepeau Informed the CouncIl that the Public Safety CommIttee Is working on proposed OrdInances as referred to them (fIre-arms, hondas, etc.). REPORT Of TRUSTEE OLMEN Road Postln~ Trustse Olmen moved, seconded by Trustee Crepeau, that the County be requested to post the Village roads at the same time as the Co~nty roads are posted and tor the same length of time, motion carried. 4It Trustee Olman recommended that the same procedure be used as In , previous years. Anyone wishing to haul overloads on posted streets, must get approval from Trustee Olmen and submit a 'letter stating that they'wlll be responsible for any damage. Trustee Olmen stated that the County would build the library If given the property. Trustee BJorndahl Informed the Council that Mrs. Vera Langer had talked with the County and It Is very Interested In build- Ing In Arden Hills. 'Mayors' Meeting Mayor Nethercut had attended the Mayors' Meeting at Bloomington and had a several page report; he defined the 'tax area to be consIdered and stated that they Intend to have a research staff of tax experts, fInanced by the Dayton Company's $50,000.00 grant; study will probably take 60 to 90 days. It ~as recommended that the study In- clude the seven counties. Federal Assistance Mayor Nethercut referred to Stan Olmen material received from Senator Karth concerning federal assistance for se~er, water, etc. Seminars and MeetIngs Clerk LorraIne Stromquist was requested to attend a ~wo day seminar sponsored by the League of Minnesota MunicIpalities on March 24 and 25. Mayor Nethercut distributed applications for nominatIons for the LudwIg Award given by the League of MInnesota Municipalities. Clerk Lorraine Stromquist Informed 'the Council that a seminar wfll be held at the University of Minnesota on March 22, 23 and 24 for Finance OffIcers and Clerks, which she hopes to attend. Mayor Nethercut ~ and Trustee Hoffmann Intend to attend the March 8,meetlng at the Arden Hills TrainIng Center, sponsored by the MInnesota Planning CommIssIon, regarding transit problems In the metropolitan area. The Ramsey County League of MunIcipalities will meet at the Village Hall In Arden Hills on March 16. A report on metropolItan government will be gIven and discussed. Information Request Mayor Nethercut requested the Clerk submit Informational data to the St. Paul Area Chamber of Commerce as requested. Clerk Lorraine Stromquist stated that Dr. Farkas, Health Officer, had given his approval. '. Trustee Crepeau moved, seconded by Trustee Hoffmann, that soft drink licenses be approved for the two Texaco stations, located at 1265 West County Road E and 3130 North Cleveland Avenue; motion carried. SIgn OrdInance Clerk Lorraine Stromquist read a letter, dated December 27, 1965, from the Board of Appeals recommending approval of a varl~nce of the ,Sign Ordinance to allow Installation of a sign at the Texaco StatIon located at Cleveland Avenue and County Road O. The sign has already been Installed. She Informed the Council that. thIs station has Just recently paId the necessary fees for license and permits for 1965, and have not taken care of this year's fees. Clerk Lorraine Strom- quist Informed the Counell that the Sign OrdInance Is a very diffI- cult one to enforce. There ~as some discussIon regarding penaltIes, especIally double feeIng for Installation without a permit. Matter referred to Clerk to check with Attorney Courtney for reasonalbe penaltIes. Apportionment of Assessments Trustee Crepeau Introduced and moved the adoption of a resolution relating to apportionment of assessments relating to sanitary sewer Improvement No. 4 as attached, seconded by Trustee Olman; motion carried. Claims Trustee Bjorndahl moved. seconded by Trustee Olmen, tha7 the claims be approved as submitted and attached; motion carried. On recommendation of EngIneer Don Lund, the Council requested Clerk Lorraine StromquIst to send a letter to Rosetown Sanitation stating their agreement to finish grading at the site of the culvert Installation on Skiles Lane.
