'.. , ',ff MINUTES OF REGULAR COUNCIL MEETING Village of Arden Hills Monday - February 14, 1966 - 8:00 p.m. Mayor Nethercut called the meeting to order at 8:05 p.m. Roll Cal I: Present - Mayor Nethercut. Trustees Crepeau and Olmen. Absent - Trustees Hoffmann and BJorndahl Also Present - Administrative Clerk torralne Stromquist, Deputy Clerk Florence Honan. Village Attorney Vincent P. Courtney. Engineer Donald I.und and Treasurer Worth G. Read. -e Approval of Minutes The minutes of the regular council meeting of January 31, 1966, were approved as amended. PublIc Hearln~ - Street Vaeatlon Attorney Courtney explaIned that a petitIon had been received from Warren Hanson and his wife requesting the vacation of a road ease- ment over a portion of hIs property; the proper publicatIon and notices have been given to hold this publIc hearing. Mayor Nethercut requested comments from proponents or opponents of the vacation. There was no response. Attorney Courtney Informed the Council that he had written a letter explaining that the road Is not on the Hanson property as shown.on the survey and Mr. Hanson's attorney seemed to be In agreement with this. He stated that Mr. Hanson has been advised of the situation and the petitioners are no longer Interested under the circumstances. Carl Dale and the PlannIng CommIssIon question the advisability of the vacation. As ~ecommended by Attorney Courtney, Trustee Crepeau moved that the hea~lng be closed and the matfer tabled until the next council meeting to allow the Planning CommissIon to report on the matter; seconded by Trustee Olmen; motIon carried. Warren Hansen arrived at the meetIng after the publIc hearing was closed. Mayo~ Nethercut explaIned the procedure taken. Mr. Hansen reminded the CouncIl that his building permit Is being wIthheld untIl this matter Is cleared. Attorney Courtney stated that he sees no reason not to Issue the buIlding permit. BUSINESS FROM THE FLOOR - .. I , -1- ~CDu~cil MI~u~Bs 'of February 14, 1966 continued Mayor Nathercut spoke for TrustsB BJorndahl, Commlsslon~r of Parks and Recreation, and Informed the residents ~hat he realizes that ~hls Is not an Ideal set-up; he stated that the drainage pro~lem had been Considered and during the recent thaw, the water drained satisfactorily. He stated that If use of the area Is contInued, a fence will be erected, which should eliminate the traffic problem. Mayor Nethsrcut Informed them that Trustee BJorndahl would be happy to meet with the residents for dIscussion. . Mr. lagerstrom, Chairman of the Parks and Recreation Comml~tee, was present and stated that there are no plans for use of this area this summer, the warming house will be locked during the summer, the area ~III be used only 5-6 weeks during the skating season. He Informed the residents that the problems mentioned will be brought to the attention of the Parks and Recreation Com~lttee whIch will meet to- morrow night and Inlllted anyone Interested to attend 'rhe IilfiHl'l'lng. Trustee Crepeau , ! Mrs. Carolyn Tlssol registered a complaint that vehIcles have made a driveway off County Road E to the playground whIch Is causing a dangerous situation, Because of the raise In grade from the playground to the road, cars exit at an accelerated speed which could cause an accident with cars trevelllng on County Road E. Trustee Crepeau Informed the Council that the Public Safety Committee strongly recommends fencing along County Road E and possibly along the free~ay as a safety precaution. ' , Shorewood Hills Road Easement Trusi"ee Crepeau moved the adoptIon of a resolution, as submitted by Attorney Courtney and attached, releasing road easement rights on certain described lots on Falrlllew 'Avenue, Delll/lew Avenue ~nd Glen- vletl Avenue, sInce the easemeni' has exp:lred accordIng to its 'terms; seconded by Trustee Olmen: motIon carrIed. Clerk requested to send a copy of the resolution to Russell Underdahl, 3935 Glonl/lew Avenue, who requested thIs release. AddItional copies are on file for other Interested property owners. Houle Addition Improvements Copies of a letter, dated January 25, 1966, from Attorney John Bell In behalf of Dr. Houle, had been sent to Attorney Courtney and the Council. Said letter requested consideration for relmbursemeot of sewer and road Improvements costs paid by Dr. Houle In the Houle Addition since other property In Valentine Hills has benefited from the Improve- ments. ' . Attorney Courtney explained In his letter, dated February 14, 1966, that assessments cannot be legally levied against property after an Improve- 'ment has been estab Ilshed. Counc n requested Attorney Courtneyfo send a copy of his letter to the Council and to Attorney Bell. J Hazardous BuildInGS Attorney Courtney -reported that It' has, been determined tha:t the' G. and W Construction Compeny, 3100 ,North Oxford Street, St. Paul, Is the owner of the Edge..ater Motel property, 'a"d submItted a copy of a letter to them requestlng.thelr proposed actlon.wlthln 10 days regarding the hazardous buIlding. . Attorney Courtney requested more detailed Information from ClayC-Kelley, BuildIng Inspector, concerning the hazardous building south o' tlie McClung property on North Snelling Avenue. Pro~osed ZonlnQ Ordinance Attorney Courtney Informed the Council that he has not completed his study of the proposed zoning ordinance. In reply to an Inquiry from Mrs. Tlssol, Attorney Courtney Informed the Council that the proposed ordinance does require considerable re-draftlng, but he expects to have a first draft ready for the next Coun~11 Meeting. Uniform Building Code Attorney Courtney submitted copies of the second rough draft of the Uniform BuildIng Code to the Council for their consideration and recommended that the Council study the charges and the Village Inspec- tors again check the proposed fees. Clerk requested to consult with the Inspectors. He stated that he believes some Information near the end of the Code does not apply to Arden Hills, such as private drive- way construction. St. Anthonv Drainage Matter Attorney Courtney informed the Council that he will keep them posted on this matter. Schmelzer Drainage Matter Trustee Crepeau Informed the Council that Ronald Schmelzer reported ~'hat the sewage has backed up Into the basement of his home, 1500 Arden Place, for the third time. Mr. Schmel%er Informed Trustee Crepeau that he had previously reported this problem to Fred Nixon and Inquired about compensation for damage from the Village, possibly $2,000.00. Engineer Lund $tated that he and Mr. Nixon had checked this problem and determined that the rapid tha~ caused more water through the sys- tem than the pumps could handle. Engineer Lund suggested to Mr. Schmelzer that he have a gate valve Installed In his line to eliminate this problem In the future. Matter referred to Engineer Lund to' check and report to Attorney Courtney for his opinion. Perry Prooerty Attorney Courtney Informed the Council that he has obtained from Trustee BJorndahl a survey of the Perry property, which the Village Is ~onsiderlng purchasing for recreatlona~ purposes, and wIll work on an option proposal. REPORT OF ENGINEER DONALD LUND ~ Rldqew9.~d ~'SanltarY Sewer vi EngIneer Luna report$d that he has the names of the owners of lots 2, 3, 4, 5 and 6, block 5, Arden Hills who will have a problom connecting to the Village sewer system unless the problem Is solved at this time. He stated that he will meet with these people and report to the Council~ ~ Red Fox Imorovement The Council looked over a map submitted by Engineer Lund showing the Red Fox Road proposed improvement. Only one map was available; there- fore It was referred to the Finance Committee and Public Works Committee for study and the matter tabled pending their recommendations. PlannIng Commission ReDort Mrs. Tissol reported for the Planning 'Commission and reminded the Council of the public meeting to be held at the Village Hall on Feb- ruary 24 regarding various types of dwellings In Arden Hills. ThIs meeting to be sponsored by the Planning Commission with the League of Women Voters making arrangements and handling publicity. -3- . . . CouncIl Minutes of February 14, 1966 continued Mayor Netharcut stated that he believes that the Hanson Road Vacation matter has made the Council and the Planning Commission anare of the street conditions In that area. Mayor Netharcut Ihformed tho Council t!'at a JoInt meeting is b,lng planned by the Planning Commission to :Include the Board of Appeals and the Parks and RecreatIon Department. There was discussIon on a date for the me~tlng. It was finally decided that the meeting be held on March 10 pending confirmation by t.he other two committees. . C'lerk Lorraine Stromquist requested to confirm the date with the Board of Appeals. ... REPORT OF TRUSTEE CREPEAU CivIc Center Report Copies of recommendations by the Public Safety Committee for.space allotment In the proposed Civic Center were dIstributed to members of the Councl I wIth copies to be sent to the Civic Center Commltte~ ~y Clerk Lorraine Stromquist. REPORT OF TRUSTEE OLMEN Public Works Committee Trustee Olmen reported that this committee has a meetIng planned for next week. Mayor Nethercut .stated that evidently minutes are not kept of these meetings since he has not received any~ however, he did receive a letter from Mayor Hasselberg, Bloomrngton, \l1hlch stated that the Committee Is considering tax presentations to the legislature If a special session Is held. UnslqhtlvAreas Mayor Nethercut stated that he toured the area near the Hanson prop- erty and noted the previously reported condition of the old motel cabin and also noted that a house at 1144 Edgewater Is vacant and dil- apidated. Referred to Clerk to request Clay Kelley to Investigate. Mayor Nethercut also reported an old car on ShorelIne Lane which Is not currently licensed. Trustee Crepea~ believes a strict ordinance should be considered. regarding this situation and also night time parking on village streets Including Junked cara Cnot currently A licensed) and also snow birds. Mr's. Tlssol recommended that Trustee ~Crepeau check the proposed Zoning Ordinance; she belIeves that this Is possibly cov~red. ~. Incorrect Zoning Sign Mayor Nethercut Informed the Counclli'hat he noted a sign on property at Hamllne Avenue and Floral Drive stating that this property Is Industrially zoned; this property has recently been rezoned .toresl- dentlal property. Matter referred to Clerk to so Inform Emil Nelson, whose name appears on the sign. REPORT OF ADMINISTRATIVE CLERK LORRAINE STROMQUIST 1965 Financial Statement Clerk distributed copies of the 1965 financIal statement and reported that the year end balances of the books of Clerk and Treasurer agree. Trustee Crepeau moved 'rhat Treasurer Worth Read be authorized to Invest surplus village funds In 30-60-90 treasury bills during the calendar year 1966 and sell same when needed; seconded by Trustee Olmen; motion carried. Clerk Lorraine Stromquist stated that Mrs. ElaIne Campbell had In- formed her of the resIgnation of Robert Campbell from the FInance Committee, effective Immediately, as they are beln~ transferred to California. She stated that she would continue to serve as Publicity Coordinator until they actually move. Mayor Nethercut requested Worth Read to submit a recommendation for Mr. Campbell's replacement on the FInance Committee and Clerk Lorraine Stromquist for a replace- ~~nt of Elaine Campbell. Plannlnq Books Clerk Lorraine Stromquist distributed copies of "Goa's" to the Council and Informed them that the usual charge Is $3.00 per book, but she did manage to get them free of charge. WHEREAS, by document dated January 31, 1955 and recorded February 25, 1955 in 1475 Deeds 328 in the office of the Register of Deeds of Ramsey County the Village of Arden Hills received a highway easement over prop- erty in the Village of Arden Hills described as follows, to-wit: Fairview Avenue - The East 30 feet of the South 30 feet of Lot 13, Block 1, and the West 30 feet of the South 30 feet of Lot 6, Block 3; Dellview Avenue - The East 30 feet of the South 30 feet of Lot 5, Block 3, and the West 30 feet of the South 30 feet of Lot 1, Block 4; GlenviewAvenue -.The South 75 feet of Lot 10, Block 4, All in Shorewood Hills. and WHEREAS, said easement contained the following statement, to-wit: "This easement to automatically expire at such time as the streets are extended into Mounds View and are actually developed in Mounds View". and WHEREAS, said highway easements were intended to provide temporary turn-around areas at the endl of the named streets until said streets were extended into Sharewood Hills No. 2 and WHEREAS, said streets have subsequently been extended into Shorewood Hills No.2, and such easements are no longer required for any municipal purposes or public purposes and have apparently expired by the term quoted . from the aforesaid Highway Easement. NOW THEllEFORE, the Council of Arden Hills does hereby recognize and declare that the streets recited in said Highway Easement hereinbefore referred to bave been duly extended into Sharewood Hills No.2. that no Village purpose requires the retention of said easement, and that said easement has accordingly expired according to its terms. -1- BE IT F1JRXBER RESOLVED that the Clerk furnish a certified copy of this resolution to any property owners or other party in interest requesting the same.
