Mayor Nethercut cal led the meeting to order at 8:00 p.m.
Roll Call: Present - Mayor Nethercut, Trustees Crepeau, Hoffmann,
Olmen and BJorndahl.
Absent:
None.

\. Approva! of Minutes
The minutes of the Special Council Meeting of January 3. 1966, were
approved as amended. The minutes of the Regular Council Meeting of
January 10, 1966, were approved as submltt.ed.
Llauor License Transfer
Attorney Courtney Informed the Coun~~that the necessary papers and bonds
were In order for the transfer of the liquor license for Llndey's Prime
Steak House; the on sale license could be made effective as of February I,
1966 and the off sale when approved by the Liquor CommissIon.
Trustee Olmen moved, seconded by Trustee Crepeau, approval of the transfer
of the On and Off Sale liquor licenses from Louis W. Llndemer to Llndey's
Inc.. effective February I. 1966, subject to the approval of the Pollee
and Fire Departments; motion carried. Mr. Sweeney, attorney for Mr. Llnde-
mer. requested a waiver of the fee for the transfer, but the Council felt
that the fee should be pald'8s 8 precedent had been made, whereby the fee
~as not waived. ' '
REPORT OF ATTORNEY COURTNEY
Dralnaqe Matter
Attorney Courtney Informed the Council that he had recelv~d a letts.
from Roger Short, BanIster Engineering Co.. concerning the drainage ,
problem Involving several ~dJolnlng municipalities. Attorney Courtney
stated that he has received a continuance for answering until Feb. 16.
1966.
The CouncJI authorized Attorney Courtney to deny any Involvement In th~
matter and to handle the matter with as lIttle expense as posslb~e~ taking
a minimal part In It.
Purchase Contract - Squad Car
Trustee Crepeau moved. seconded by Trustee Ol,mll'n. 'i'hat the purchase
contract for the new pollee squad car be sl!Jned and for:I~I-ded toO Ml(hmy
Ford Company for execution; motion carried.

Conditional Use Permit
Attorney Courtney submitted two copies of the plan changes as recommended
by the Planning Comm'lsslon and approved by the ,Council for the conditional
use permit granted Charles Neitzel to permit the construction of a dou~le
bungalow at 1965 West County Road 0; he suggested that a copy be sentb
Mr. Neitzel and a copy be attached to the building permit. Referred to Cler~
Bank Resolutions

Attorney Courtney submitted the resolution forms on which he had made the
necessary changes which cites all the names authorized for the signing
of VI11age checks drawn on the First State Bank of New Brighton and the
First National Bank of St. Paul.

Fire Protection Contract
//
Attorney Courtney returned and recommended approval of the proposed .ffre
protection contract for 1966 between the Village and the Lake Johanna
Volunteer FIre Department and Informed the Council that the contract Is
loantlcal with the 1965 contract. Council authorized the Mayor and"Clerk
to execute the contract In behalf of the Village.
Home Gas Co. Lease
.
Attorney Courtney Informed the Council that he'had reviewed the two leases
from the Home Gas Company regarding the use of the two gas tanks located
at the warming houses and recommended their execution. He Informed the
CouncIl that the Village does not pay for the use of the tanks, but only
for the gas; however, the lease absolves the Home Gas Co. from any liabili-
ty from anything beyond Its control. Council authorized execution by
the Mayor and Clerk.
Proposed Water Franchise
Attorney Courtney Informed the Council that the attorney representing
George ReilIng had requested a meeting with him to discuss matters con-
cerning the proposed water franchise. The Council agreed with Attorney
Courtney's recommendation that Mr. Reiling submit a letter giving the
Information previously requested before any more time Is spent on the
matter~ Attorney was requested to so Inform Mr. Reiling.
Hazardous BulldlnQs
Engineer Donald Lund Informed the Council that he will submit to the
Attorney the names of the owners of two houses which are considered
hazardous as soon as he receives this Information from Ramsey Co..
REPORT OF ENGINEER DONALD LUND
RldQswood Road Sewer Matter
Engineer Lund distrIbuted. maps and Information concerning sewer service
for lots 2,3,4,5 and 6, Arden Hills Plat. He stated that a home Is being
bul It on lots 2 and 3 which does have a means of connecting to the setler
facilities, but a problem wIll arise to service lots 4, 5 and 6 In the
future unless an easement Is obtaIned and a line con~tructed across lots
2 and 3 at thIs time. Mr. Lund Informed the Council that he received
an approximate estimate for doing thIs work at this time' (considering
frost depth, etc.) from Rosetown Sanitation for $3,500.00. He Informed
the Council that lots 2 and 3 were assessed for sewer, but lots 3, 4 end
5 have not been fully assessed. Trustee Olmensuggested and the Council
agreed that Mr. Lund check with the owners of lots 4, 5 and 6 to see If
they have any plans at this time, and If they want sewer service to these
lots.
Hvldsten Matter
. Engineer Lund Informed the Councl I that Mr. Hvldsten has not submitted
'a letter as requested authorizing the Village to cut down trees on his
property to correct .a grading problem caused by vIllage Improvements;
the tree cutters prefer doIng this type of work thIs time of the year.
. Trustee Crepeau suggested that Mr. Lund remind Mr. Hvldsten that the
work cannot be dons' until this letter Is received. Matter referred to
Engineer Lund. .
Red Fox Road Feaslbllltv ReDort
Engineer Lund submitted a report on the feasibilIty of ImprovIng and extend-
Ing Red Fox Road, bu~ did not have a suitable map at this time. He Ir. -
formed the Council thet the road ~ould be constructed on a 66 ft. rlght-of-
way and woulj be stra~ght and centered. This will not require any of the
Boss properyy and ~ould leave the II ft. boulevard In front of thIs home.
There was dIscussion concerning the assessment against the Boss property
as this Is the only residence involved. Mr. Lund stated that the Boss
property hos a jrontage of 250 feet. The fact was mentioned that although
th0 Bosses ~0uid nat reallze a benefiy ay this time, tne potential aas
t~~re of th!s property becoming Indus~rlal. The Council suggested that

possibly a lesser assessment should be considered for this property.
Mayor Nethercut requested Engineer Lund to submit e me? showIng the
Boss property, and what proportion of cost of the project should be'
assessed against the property o~ners. Attorney Courtney stated his

Trustee Ormen moved that the matter be referred to the Public Works Com-

REPORT OF BUILDING INSPECTOR CLAY KELLEY

Mr. Kelley Informed the Council that he had received a request from
Meyers Advertising Agency to move a Shell 011 Sign from Old Highway DIO
south of Highway 696 to the Stewart Lumber Co. property until the explra-'
tlon of the contract In 1969. Matter referred to the Board of Appeals.
Roberts Warehouse
Mr. Kelley Informed fhe Council that the loading dock constructed at
the third Roberts warehouse building Is temporary and no building permit
was required as the cost of construction vas less than $150.00.
Multiple DwelllnQ Inaulrles
Mr. Kelley Informed the Council that recently he has received many re-
quests concerning the construction of multiple dwellings.
REPORT OF TREASURER WORTH G. READ
Vlllaqe Insurance Coveraae

Mr. Read Informed the Council that the Finance Committee has met with Mr.
William Hlte to discuss vIllage Insurance coverage. The Hlte Agency "
has carried the Village Insurance for the past several years and the Finance
Committee recommended that they continue to carry Village Insurance cover-
age for the calendar year 1966 through the Hlte Agency. Mr. Hlte dis-
tributed to the Council and Clerk copies of his proposal and proceeded
to explain the coverage and answer questions.
One of the matters discussed was the bonding of the Treasurer and the

Trustee Hoffmann stated that he would like to know the technicalities of
bonding. Matter referred to Attorney CourtHey. Trustee Crepeau moved
that the Hlte Agency be approved to carry Village Insurance coverage' as
outlined In his proposal (on file) with the exclusion of the coverage for
forgery and the honesty bond; and authorized the Clerk to sign the necess-

Mr. Hlte suggested 'thJt-t~-'legal descriptions of the park property
(owned by the Village be submitted to him with the date of purchase. Re-
ferred to the Clerk. Mayor Nethercut thanked Mr. Hlte for the Informa-
tion.
Finance Committee Msetlna
Mr. Read Informed the Council that the Committee does not believe that
a bond for the purchase of property by the Village can be voted on thIs
June because o' Insufficient time to get the Information to the residents.

MINUTES OF REGULAR COUNCIL MEETING CONTINUED
Metropol iYan MeeYlnQ
Mr. Read reported on a meeting he attended for Mayor Nethe~cuy ~hlch
was held in Bloomington on January 17, 1966, ay ~hlch Metropolitan taxes
were considered - namely, non-property taxes such as hotel, motel and
admission taxes. The Mayor of Bloomington plans a Committee of represen-
tatives from either 5 or 7 counties for the purpose of studying this
matter.

Mr. Read suggested that a recommendation be made to this group to keep
minutes of the meetings and the group should Include representation
from the Ramsey County and Hennepin County tax department. Mayor
Nethercut thanked Mr. Read for the report and accepted hIs offer to
attend the next meeting which Is to be held In Golden Val I~y. Mayor
Nethercut was not sure he would be In town for this meeting, but re-
quested anyone Interested to attend. Mayor Nethercut requl!lsted comments
from the Council regarding metropolitan cooperation literature which
was distributed to the Council. The Council members were in agreement
that full cooperation should be given.

Vlllaqe Police DOQ
Trustee Crepeau stated and the Council confirmed that Cooper, the
pollee dog, Is village owned.
Letter of Appreciation
Trustee Crepeau Informed the Co~ncll that a letter of appreciation had
been received from Sheriff Hedman commending the Arden HII Is Pollee Dept.
for their cooperation In aiding the snow-mobile race in connection wlththe
St. Paul Winter Carnival.
REPORT OF TRUSTEE BJORNDAHL

Skatlnq Facilities
Trustee Bjorndahl Informed the Council that the Parks and Recreation
Committee and Fred Nixon recommend that the removal of snow ~rom areas of
the lake for skating not municipally controlled discontinued. It was
reported that In previous years this was al lowed because of Inadequate fac-
Ilities. The Council agreed to this recommendation and also that an area
on lake Valentine should be cleaned for skaters In that portion of the
village. Trustee Bjorndahl Informed the Council that Mr. Nixon has sold
one piece of snow removal equipment to Roger Reiling and any requests we
get for this type. of work could be referred to hIm.
Public Works Hourlv Rates
Trustee Bjorndahl moved, seconded by Trustee Olmen, that James Nixon
and Arthur Erickson be authorized to work as rink attendants at a rate
of $2.00 per hour, and James Nixon and William Ehlers be authorized to
do maintenance work at an hourly rate of $3.00 effective as of January I,
1966; motion carried.
REPORT OF TRUSTEE OLMEN
Service Road Acceptance
Trustee Olmen moved, seconded by Trustee Bjorndahl, that the Village
accept from Ramsey County the service road from County Road E to Snelling
Avenue and Arden Place; motion carried. Clerk requested to so Inform
Ramsey County. Council requested the Clerk to pursue the posslllblty
of acquiring of the triangular piece of property now own~d by the state;
said triangle formed by the service road, Snelling Avenue and County Road E.

Public Work CommIttee MeetlnQ
Minutes of the Publ Ie Works Committee meeting were sent to the members of
the Council. Trustee O/men Informed the Council that the area requirements
for this department for the proposed Civic Center as outl ined In the minutes
were approximations, and any further recommendations would be reported.
REPORT OF MAYOR NETHERCUT
Metropolitan PlannlnQ Commission
.
Mayor Nethercut reported that the Elected ~fflclals Review Committee
of the M.P.C. Is holding a series of six meetings, three of which have
already been held, to acquaint village and school board representatives
with metropolitan problems and to get recommendations from them to give
to the M.P.C. for a study basis. He Informed the Council that metropoli-
tan transportation was now beIng studied. Clerk was requested to obtain
~ddltlonal copies of the pamphlet "Goals" from the M. P. C.
REPORT OF ADMINISTRATIVE CLERK
Liquor Audits
Trustee Crepeau moved, seconded by Trustee Hoffmann, that the Clerk be
authorized to contact Mr. Brunsel/ to have the liquor reports for the
year 1965 audited; motion carried.
LeQaf Bulletin Boards
Clerk Lorraine Stromquist Informed the Council that the Village legally
Is required to have three bulletin boards located withIn the Village
for the purpose of posting public notices regarding voting, public
hearings, etc. We now have a bulletin board "at the Village Hall, at the
Lake Johanna Elementary" School and one at the cafe at Highways 68 and 610.
The cafe at Highway 8 and 10 Is not now operatinG and a third location
should be designated. After some dlscu5slcn . Trustee Hoffmann moved that
the thlr~ bulletin board be' placed at the MOLnds View HI~h School~ subject
to approval, seconded by Trustee Crepeau; motion carried. Matter referred
to Clerk.

as attached; seconded by Trustee BJorndahl; motion carried.

OF ASSESSMENTS RELATING TO SANITARY
SEWER IMPROVEMENT NO. 3
BE IT RESOLVED by the Village Council of the Village of Arden
Hills, Minnesota, as follows:
VffiEREAS, the assessment roll for Sanitary Sewer Improvement
No. 3 as last finally amended and adopted on October 12, 1961, was
filed and certified to the County Auditor of Ramsey County on
November 17, 1961, for the purpose of including installments there-
of to be collected along with real estate taxes commencing in 1962;
and
~~EAS, a hearing on supplemental assessments, reassessments,
and apportionment of previous assessments in respect to Sanitary
Sewer Improvement No. 3 was held on July 16, 1962, at which time
assessments for Sanitary Sewer Improvement No. 3 were amended as

the office of the County Auditor of Ramsey County on October 3,
1962; and
WHEREAS, since that date a number of parcels of property
contained within said assessment roll as amended, have been divided
and conveyed by previous property owners; and
WHEREAS, the County Auditor of Ramsey County requires that
apportionment of the original assessment against each original
tract where it has later been divided, sold or conveyed, be made
by the Village Council of the Village of Arden Hills, in order that
... the proper assessment can be extended by the County Auditor against
