Roll Call: Present - Mayor Nethercut, Trustees Hoffmann, Crepeau, Dlmen and BJorndahl. Absent - None Also Present - Village Attorney VIncent P. Courtney, Engineer Donald Lund, Treasurer Worth G. Read, Heating Inspector Virgil Keller, Administrative Clerk LorraIne Stromquist and Deputy Clerk Florence Honan. The minutes of the Regular Council Meeting of December 27, 1965, were approved as submitted. ....Buslness from the Floor VirgIl Keller, Heating Inspector, Informed the Council of a request from Charles Neitzel to Install three chimneys for the double bungalow he Is constructing on County Road 0; these chImneys are not In accordance wIth the OrdInance and would requIre a variance approval from the CouncIl. There was discussIon by the CouncIl, Mr. Keller and Mr. J05. McKeon, an Interested resident concerning the various types of chImney construction. Trustee Crepeau moved, seconded by Trustee Olmen, that al I three chIm- neys be of the metal asbestos type; motion carrIed. REPORT OF ATTORNEY COURTNEY Husbv Contract Attorney Courtney Informed the Council that the Husby contract has been signed and he has checked wIth the County Assessor's office to determIne the status of the taxes. He was Informed that the taxes will be abated 3= the transaction was completed In 1965. However, the apportIonment resolution should be prepared. Matter referred to Attorney Courtney and Engineer Don Lund. Peifer Easement Clerk LorraIne StromquIst Informed Attorney Courtney that the PeIfer easement check for $250.00 was ready. Attorney Courtney informed the CouncIl that he had an appoIntment with the Pelfers after this meeting to close the trans~ctlon and wouldr therefore, leave the meeting early If possIble. Trustee Crepeau moved, seconded by Trustee BJorndahl, that the PeIfer easement check be approved; motIon carried. CummlnQs Lane street Improvement Attorney Courtney Inform~d the CouncIl that the 6 month period for CouncIl action concerning the Cummings Lane Street Improvement will expIre thIs month. Attorney Courtney read a Resolution as prepared by him ordering Street Improvement No.7 (CummIngs Lane). Trustee elmen moved adoptIon of the resolution, as attached, secon ded by Trustee Crepeau; motIon carried. . The Council authorized BanIster EngineerIng Company to prepare the plans and specIfications for the Improvement. I "'P.~2d VacatIon Attorney Courtney Informed the CouncIl that he has receIved a new petItIon which Includes the Hansonts sIgnatures requesttng the vaca- tion of a road easement on the Hanson property. He stated that every- thIng Is now In order for a publIc hearIng, and he has prepared a resolu- tIon se~lng the date of the publIc hearIng for January 31. Trustee Hoffmann Informed the CouncIl that the PlannIng Commission has recommended that the easement not be vacated until further study Is given the matter by the CommIssIon. Tbe CommIssion also would like to meet wIth the VIllage Engineer concernIng the matter. Attorney Courtney advIsed goIng ahead with the publIc hearIng and suggested delayIng CouncIl actIon untIl further study. Mayor Nethercut suggested settIng but Trustee BJorndahl stated that the loan on the property and thIs the publIc hearIng date on February 14, Mr. Hanson Is havIng a problem wIth delay would further 1nconvenlence hlm~ . -1- ----.., " MINUTES OF REGULAR COUNCIL MEETING (continued) , At-j-orney Courtney stated that the matter \1'3S "iirst re-lerred -to him on December 13th. Trustee Hoffmann moved that Mr. Hanson be Invited to the next Planning Commission meetIng and the date for the public hearing be set for February 14, 1966; seconded by Trustee BJorndahl; motion carried. Attorney Courtney presented maps, petltton and deed concerning the property and vacation matter to Mrs. Tlssol, Secretary of the Plan- ning Commission. Mrs. Tlssol returned the material to the Clerk's office. . Mayor Nethercut requested the Clerk to Inform Mr. Hanson of the above actIon and also requested Engineer Lund to attend the Planning CommIssIon meeting. Trustee Bjorndahl suggested a letter to Mr. Hanson explainIng the proposed proceuure If Mr. Hanson feels this would be of any help to him - referred to Clerk. SQuad Car Purchase Contract Trustee Crepeau moved that Attorney Courtney be authorIzed to draw up a purchase contract In behalf of the Village with Midway Ford Co.; seconded by Trustee Olmen; motion carried. St. Anthony Matter Attorney Courtney Informed the.Councll that the extension of time for our answer to a drainage matter has about expired. Engineer Lund stated that Engineer Roger Short bel)eves the matter will be settled out of court; Mayor Nethercut requested Engineer Lund to remind Engln- .eer Short to write a letter regarding the matter, and also requested Attorney Courtney to request another time extension. Hazardous BulldlnQs Clerk was requested to obtain the addresses and owaers names of two buildings In the Village which have been ascertained to be hazardous by the Building Inspector and give this Information to Attorney Courtney to notify the owners. Roberts Construction Company Attorney Courtney reported that he has not heard from Mr. Roberts concerning site plans for his buildings In the Twin City Industrial ~ark. Mayor Nethercut requested Attorney to check with Attorney Daubney. Limited Traffic Slons In reply 'to an InquIry from Trustee Crepeau, Attorney Courtney In- fromed the Council that the posting of street signs which restrict the use of the street results In the loss of all revenue for the street. Clerk requested to send letter of explanation to the resident re- questing a "local traffic only" sign. .'"~ 4" .. . .., Perry Property Trustee BJorndah I stated that .he be II eves $1.000.00 per acre I s a reasonable price for the 22 acres owned by Perry on New Brighton Road. Attorney Courtney Informed the CGuncl1 that we could take an option on the property excluding the house and a certain amount Ol' the prop- erty; this would Involve paying e specified amount for the option. Rc~ ,j Engineer Lund presented to the Council for study copies of a feasi- bility report regarding the grading and surfacing of Red Fox Road as had been requested by the CouncIl. ' Hvldsten Matter Engineer Lund Informed the Council that Mr. Hvldsten will write a letter to the Council with a copy to htmself giving approval to the VIllage to remove trees on his property preparatory to correcting a VIllage created problem. . REPORT OF TRUSTEE HOFFMANN Planning CommissIon Matters Trustee Hoffmann Informed the CouncIl that there between the Plannlnq CommIssion and the Board of Nethercut Informed him that Thomas Horty wIll be .....-.... Trustee Hoffmann Informed the Council that the Metropolitan Planning CommIssion has offered to present to local groups Information on mul~lple housing In Arden HIlls; the matter has been referred to the League of .Women Voters. Mr. Day, who presents the program, suggested an 8:00 p.m.. program on eIther the 17 or 24 of February. Mrs. TIssol stated that the League of Women Voters could not assist at one scheduled for the 17th, because of a previously planned program. Copies of this report will be sent to the Council and also the Village Attorn,y. Trustee Hoffmann moved that letters recommended by the Planning CommissIon be sent to Mr. Spannaus, contractor for Presbyterian Homes, Progressive Design Associates and the R. L. Gould & Co. regarding 5 specifIc requests; seconded by Trustee BJorndahl; motion carried. Mayor Nethercut recommended that a copy of the letter to Mr. Spannaus be sent to Presbyterian Homes. Joseph McKeon, 1817 CounTy Road 0, Informed the Council that he Is very Unhappy with Gladltsch Construction Company property, which Is 1"cE.tod In ;:o~, Brighton on the boundary of Arden HIlls. Skatlnq Rinks Trustee BJorndahi Informed the CouncIl that the rInks are being used; that Fred Nixon has assured the neighbors that basement flooding wIll not result during the spring thaw as this problem had been antIcipated and has been provided for. In reply to an Inquiry from Trustee Crepea~, Trustee BJorndahl staTed that the Ilg~ts at the rink on Hamllne Avenue and County Rpad ~.have not been adjusted yet, but when this Is accomplished there should not be any light glare on the highway. Mayor Nethercut recommended that notIces should be posted on County Road E to prohibit parking; matter referred to Trustee Olmen. , -3- . . .. REPORT Of TRUSTEE OLMEN Malnfensnce Employees Trustee Olman reported that Fred Nixon's wage rate wll I remaIn the sarna through June 30, 1966, and requested the Publl~Works Comm- Ittee to study the matter of any adjustment to be made after that date. 'Trustee Olmen moved, seconded by Trustee BJorndahl, to hIre John Schultz for maintenance work at the rate of $3.00 per hour, effectIve January I, 1966, and WillIam Ehlers as a rink attendant, at the rate of $2.00 per hour, eff~ctlve January I, 1966; motIon carried. . REPORT OF MAYOR NETHERCUT CIvic Center Mayor Nethercut stated the CIvIc Center Committee has requested plan- nIng InformatIon from several sources and would like the InformatIon wIthIn two weeks. FIre Department Reauest Mayor Nethercut Informed the Council of a request from Fire ChIef Harry Ehlers of a map of the IndustrIal Park showIng the exIsting buIldIngs wIth a number desIgnated for each buildIng to facIlItate answering fIre calls. Matter referred to Clerk to obtaIn an approprIate map. School for Inspectors Mayor Nethercut requested the Clerk to Inform the VIllage Inspectors of a school to be held January 24 - 26 at the UnIversity of MInn. campus, sponsored by the MInnesota League of Municipalities. Board of Appeals AppoIntment Mayor Nethereut Informed the CouncIl that Glen Pederson has re- sIgned from the Board of Appeals and suggested that Rogsr Moberg be appoInted. Trustee Crepeau moved, seconded by Trustee BJorndahl, that Roger Moberg, 1315 TIller Lane, be appoInted to the Board of Appeals; for a two year term effectIve January I, 1966; motion carried. . MInnesota Plannlna Association Clerk was requested to Inform the MPA that Trustee Hoffm~nn will re- place Mayor Nethercut as a member. Clerk was also requested to check wIth the L.M.M. as to changing our representation on the Water Resourc- es CommIttee from Mayor Nethercut to Trustee Dimen. County PolIcies on Road Construction Clerk dIstributed to the Council copIes of a letter from Ramsey County EngIneer Deane Anklan regarding a change In polIcIes re- garding road constructIon. Mayor Nethercut requested the Clerk to sen~ ~oples of this letter to the PublIc Works CommIttee and also to the Finance CommIttee. REPORT OF CLERK LORRAINE STROMQUIST Village Insurance PolIcIes Clerk LorraIne Stromquist Informed the Council that Mr. Hlte from the Hlte Insurance Agency who' handles the VIllage Insurance, was not prepared to attend thIs meetIng, but wIll be at the January 31st meetIng. She Informed the CouncIl that she has a proposal from Bach- man-Anderson Insurance Company whIch states that they have gone Into the consultant service due to the changes In legislative laws of 1965 -4- . .. -----, . .. , MINUT~S OF RE~ULAR COUNCIL MEETlNG !cDntrn~ed) regarding liability; this service can be obtqln~d from them under two sepurate plans: I) A fee of approximately $500.00 or 2) If they carried the Village's policies, this service would be free. Matter referred to the Finance CommIttee. 'Bank Resolutions and Authorizations . . Trustee Crepeau moved, seconded by Trustee Hoffmann, the adoption of a two resolutions designating the First State Bank of New Brighton and the First National Bank of St. Paul to act as official depositories for the Village of Arden Hills; motion carried. The Council authori- zed the signing and returning to the banks the official signatures of persons authorlzea to sign checks In behalf of the Village. Salary Rate ChanQes Trustee Olmen moved, Seconded by Trustee Bjorndahl. that the hourly rate of pay for the Administrative Staff be Increased from $2.20 to $2.30 effective as of January I, 1966; motion carried. Adm;lnlstratlve Clerk Lorraine Stromquist Informed the Council that this Staff has not received an Increase for two years. Trustee Crepeau moved, seconded by Trustee Bjorndahl, that the part tIme patrolme~ receive an Increase from $2.20 to $2.50 per hour, and the full time patrolmen from $450.00 to $500.00 per month, with $2.50 per hour paid for over- time, effective as of January I, 1966; motion carried. ; Fire ProtectIon Contract Trustee Crepeau moved, seconded by Trustee Bjorndahl, to approve the contract ~Ith the Lake Johanna Fire Department for 1966 In the amD~nt of $6,720.00; subject to the approval of the VII/age Attorney; mot/on carried. CUMMINGS LANE WHEREAS. a Resolution of the Arden Bills Council adopted July 12. 1965 fixed a date for a Council hearing on the proposed improvement of Cummings Lane from its intersection with Snelling Avenue to the easterly termination of Cummings Lane, after the completion of the proposed sanitary sewer improvement, by constructing on Cummings Lane as it presently exists, to the width of twenty-eight (28) feet throughout, a plant mixed bituminous surfaced roadway at an estimated cost of Six Thousand Eight Hundred Seven Dollars Sixty Cents ($6.807.60). and WBEREAS. ten days t published notice of the hearing through two weekly publications of the required notice was given, mailed notice was given as required by law, and the hearing was duly held thereon on the 26th day of July. 1965, at which time all persons desiring to be heard were given an opportunity to be heard thereon, and WHEREAS, the proposed sewer improvement, Sewer Improvement No.8, was subsequently adopted and bas now been completed, NOW TBEBEFORE. BE IT RESOLVED by the Council of the Village of Arden Bills tbat said Street Improvement No. 7 is hereby ordered as proposed in Council Resolution thereon adopted July 12, 1965. RESOLUTION DIRECTING PREPARATION OF PLANS AND SPECIFICATIONS WHEREAS, by Resolution of the Arden Hills Council heretofore adopted this 10th day of January, 1966 Street Improvement No. 7 was ordered as proposed in Council Resolution thereon adopted July 12, 1965, NOW THEREFORE, BE :IT RESOLVED that Banister Engineering Co., Village Engineers, are hereby designated as the engineers for this improvement, and said Banister Engineering Co. is directed to prepare and submit plans and specifications for the making of said improvement in accordance with the aforesaid Resolution thereon adopted July 12, 1965.
