Dear Mr. Berger:
. When the City Council discusses the Pavement Managempnt Program and City
I AssessmenI Policy at ttleir Monday (light workshop, I believe there are
I several issues they should address. Briefly, these would include the
following:
l. The revised Pavement Management Program indicates a total
reconstruction need in the City of $1,700,000. Currently, there is no
clear way to finance these improvements. therefore. it is difficult to
program them.
2. What should the City's assessment policy be regarding the financing of
street reconstruction?
3. How are assessment rates calculated? What percentage of project cost
is assessed and how is it spread?
4. Should the City consider overlayment as a rehabilitation program ~ith ~
full or partial assessment to benefited properties?
5. Should a City standard street section (i.e., concrete curb and gutter,
7-ton design, 32 feet wide) take precedent, thus, scheduling streets
for reconstruction even though an overlay may extend their useful life
a number of years.
6. Should the Public Works Department purchase crack sealing equipment and
. eliminate this from contracted work?

As directed, we have prepared an update to the City's Pavement
. ~~~age~e~[ S~udy cf Me~:h 1988. This update is not intended to replace the
original study but, instead, be a supplement to it.
A:,ached to this reoort are two revised computer printouts. The first,
labeled Exhibit 1, is a complete printout of the rating of all City streets.
This rating reflects the reconstruction, overlays and seal coating
- accompliShed during 1988 and 1989. Since the original street ratings are
only two years old, an entire re-rating of the streets is not justified at

this Iime. However, a cursory review of the original ratings was completed.
An entire re-rating should be considered approximately every four years.
The second computer printout attached, labeled Exhibit 2, is an alphabetical
listing of all City streets grouped according to recommended improvement.

The primary function of this update is to help the City plan street
improvement programs to stay ahead of major street problems throughout the
City. By using the Pavement Management System. tough decisions can be made
with regard to choosing street improvement programs that yield the best
results for the City. It is imperative that the City maintain and improve
existing streets at a faster rate than the streets are declining. If
improvements are not made at a faster rate, reconstruction costs will
escalate to the point where it will be impossible to fund all of the
necessary work. As evidenced by the Pavement Management Study (hereafter
referred to as the Study). a number of streets need seal coating or overlay.
. -he City must strive tJ ~ake the 1ecessary imcrGvements to keep these
streets from further decline and ultimately needing reconstruction.
The Study is an on-going data base that provides the City a tremendous
tool to compare various streecs and systematically set up yearly street
improvements programs based on tangible evidence. This evidence is the
~ rating figures for each parti~ular street. The Study takes a wide variety
- of street criteria. such as age, type and severity of problem areas and
existing pavement chickness to give each street a single rating on a scale
of 1 to 100. Following is a breakdown of the rating ranges and the
action which is suggested by the rating on each particular street.

A. 100-95 No Work Required Other Than Normal Maintenance
Streets with a rating in this group are in very good shape. They have
few, if any, problem areas. Normal maintenance should be performed as
needed, with cr~cks being properly filled a~d any isolated bad spots
repaired i~mediately to keep the problems small.
B. 90-94 Seal Coating Required
These streets are also rated as being in very good shape. There is
really no perceptible difference between these streets and streets
rated between 95-100. All streets above 95 will ~ventually need seal
. c:.Ja.::.~ng. This break at 94 is me:ely an indicator to help prioritize
the order of streets to be sea] coated. A street seal coated within
the last 3 years is given a slightly higher rating than a street
needing seal coating next year. The difference between a street rate a
a 97 and a street rated at 92 is relatively minor.
- C. 69-89 Overlay Required
- It is in this category that greater differences between streets arE
cercelved. Al] streets in this category are st:eets that are worth the
investment to save. However, the condition of a street near the upoer
end of this range is in far better shape than those near the lower end.
It is within this range that the prioritization of which streets are
included in each year's street program will be very important. The
. longer that a street is allowed to deteriorate within this category.

the more extensive the repairs prior to an overlay will become.
Streets that are not repaired while their rating is in this range will
eventually require reconstruction as their only alternative.
D. 0-69. Reconstruction
These are streets which are not worth the investment of rehabilitating
and therefore neeo to be completely reconstructed. The causes of any
problems which led to the poor condition of the street must also be
addressed. The excavation of bad soils, placement of geotextile fabric
or construction of storm sewer are all possible a9ditions that may be
. necessary to try to make the reconstructed road last as long as

addressing the cause of the problem (bad soils or excessive water) does
not canstitut2 prudent use of money.
Currently, the existing rating data, shown on Exhibit 2 reflects the
following total estimated project costs for street work required within the

New that the meening of a street rating is defined, it is important to
understand that these categories are not rigid boundaries. Rather, the
categories are a tool to help organize the planning process of future street
problems.
To set up future street programs, it is important to know what types of
work are best accomplished by the City itself. The Study originally
recommended that the City institute a crack filling program. The number and
type of cracks was included in the original field rating for each street
within the City. However, the 1988 street program contracted out crack
filling work .as part of the project. We are of the opinion that contracting
. cu: c;=c~ filling is a ~oor way to acccmolish ~he worK. Contracts for
street work are usual ly perfor~ed in the Summer, but crack sealing is best
performed in the Spring or Fall, when cracks are open at their widest.
Crack filling is labor intensive work that is very difficult to measure for
bidding purposes. The cost of having an outside contractor perform crack
filling is very expensive since the work is typically small areas or. a
~
number of streets allover the City. By hiring an outside contractor, the
-
City is paying a premium price for crack filling work. We recommend that
the City begln their own crack fil ling program utilizing their main[~r.ance
forces.
As previously mentioned, maintenance work, such as crack filling, is
typically needed on a number of streets throughout the City. This is also
. true of streets needing seal coating. Although the City is not tremendously
large, the fact that it is separated by Interstate 694, U.S. Highway 10 and

various lakes makes getting arcund a little lougn. To a contractor.
"getting around" or mobilization costs, can become a rather large portion of
sma 11 jobs SUC~i r\S seC.~ coa:.ing projects. We therefore would advi~e the
City to group types of ~ork wherever ~ossible, to minimize the amount of
moving a contractor has to do. For example. if a group of streets in a
particular neighborhood or area all have ratings of 90 or above, it would be
economically wise to seal coat them all within the same street project. Bid

By using the ratings for each of the streets within the City as well as

The two street improvement programs are shown by Exhibit 3. Note that
trle total estimated project cost for beth the 1990 and 1991 programs exceed
5100,000. We anticipate that bids for the work could come in slightly lower
given a good bidding environment. We have set up the programs in
anticipation of completing as many streets as possible. However, if bids
received exceed the project budget, streets may be deleted until the project
is within budget. From an administrative standpoint, it is easier to set up
a program and scale it down than to set up a small program and add streets
after bids are received.
You will also note that the preliminary 1991 seal coating program
. ~~c:uces two s:r2~:S, 8eckman Avenue end L3ke Lcnet which are scmewhat
separated from the rest of the streets to be seal coated. The area
surrounding these two streets was included in the 1988 program. However,
these two streets, which also are rated in need of seal coating, were
omitted. Since many other areas also need seal coating, seal coating will
likely not occur again in this area for five to seven years. Beckman Avenue
~
and Lake Lane should be seal coated long before then however, so they have
been included for 1991.
It is important to note that no streets rated in the Study as needing
reconstruction are included in the 1990 or 1991 street improvement programs,
These streets are not included since an annual budget of $100,000 is not
sufficient to address reconstruction needs. The Study currently estimates
. reconstruction needs of nearly 5970,000. A re-rating of the City streets
would certainly increase this estimate to well over $1,000.000,

include assessments to benefiting property owners, use of Municipal State
Aid Funds, use of City monies or a combination of various options.

REQUEST:
The applicants are proposing to upgrade the property by replacing the
present attached single-car garage with a new two-car garage and by
making considerable interior modifications to the house. The present
garage has a front yard of 30.4 feet and is roughly parallel to the
street. The proposed garage will be turned approximately 450, so the
front corner will be 16 feet from the street right-of-way line with the
north corner being approximately 28 feet from the right-of-way line.
The applicants' surveyors have determined that the established front
yards of the neighboring homes are 30 feet--so a front yard variance of
14 feet is requested.
. CONSIDERATIONS:
1. The neighborhood was developed prior to present zoning standards,
so virtually all the lots or the dwelling setbacks on this segment
of Siems Court are substandard, with the houses and garages
considerably smaller than ones being built now. The lot width at
the 40-foot setback line measured approximately perpendicular to
the side lot lines is 72 feet (95 feet is now required). The front
yard of 30 feet for the three nearest lots is 10 feet less than the
current requirement. Side lot lines that are now required to be at
900 angles to the street are 540 on the north lot line and 1150 on
the south line of the subject lot.
2. A basement level or tuck under garage is not possible due to the
short distance between the house and street and the elevation of
the house.
3. The new garage should not project into the existing living space of
the house because the house is small as it is.
4. The present one-car garage does not meet contemporary needs where
two- and three-car garages are now the standard. Lots developed to
current standards would permit construction of an attached two- or
three-car garage.

. 5. The shape and size of the lot do not offer the owners the full
property rights enjoyed by others in the R-l District. The
"building envelope" is considerably smaller than today's standard
and the shape does not allow reasonable development.
6. Various alternatives were thoroughly investigated by the
applicants' architect and City staff. Other alternatives would
require either side yard or front yard variances that would be more
objectionable than the proposed approach.
7. The City encourages upgrading of property. On the subject lot,
even if the existing structure were completely removed, the size
and shape of the building envelope would not allow development at
current home standards.
8. The adjoining lot to the north has a garage on the south end of the
house, so the requested variance will not impact the "living"
portion of the neighboring property. In fact, the proposed garage
could not be seen from that home. The existing garage side yard
setback of 4.7 feet is maintained.
9. The proposed garage has a corner projecting into the front yard.
Visually, this is less of an obtrusion than with the flat face of
the garage facing the street. It also creates more usable space in
the front yard, with the driveway placed parallel with the north
. lot 1 ine. The angled garage also allows two cars to be parked in
the driveway completely on the applicants' lot.
RECOMMENDATIONS:
Most of the considerations discussed above point to the unusual problem
created by the shape and size of the subject lot and the generally lower
standards of many nearby lots. I recommend that the proposed variance
be granted for the following specific reasons:
l. The lot is below the current standards in terms of area, width and
shape.
2. The placement of the existing house on the lot does not allow a
two-car garage to be constructed without a variance.
3. Alternatives have been thoroughly investigated, none of which would
require lesser variances than the one proposed.
4. The proposed variance does not adversely impact adjoining
properties due to the orientation of both inside and outside living
spaces.
5. The configuration of the lot prevents the applicant from enjoying
the property rights available to others in the same zoning district
. on lots which do not have the unusual configuration.

VARIANCE REQUEST FOR 3464 SIMS COURT
HARDSHIP/PRACTICAL DIFFICULTY-NECESSITATING REQUEST FOR VARIANCE
The placement of the home at 3464 Sims Court makes it impossible
to bring the property up to current building standards without
requesting a front set-back variance. The western tip of the
garage addition to the home will be a set-back of 16 feet from the
lot line, the south point will be a 30 foot set-back, and the north
point a 28 foot set-back. We would like to make the following
points:
1 ) Lot 25 is an unusual pie-shaped lot. The house is set square
with the street, but the lot lines are cut at a severe angle, not
allowing for any expansion to either side of the house.
2 ) The steep grade of the lot, does not allow for a tuck-under
garage with a realistic decline for safe maneuvering of auto-
mobiles.
3) The house and garage were built before the present set-back
. requirements were put into effect.
4 ) The existing garage is sub-standard with a treacherous floor,
which must be changed.
5) The proposed garage will maintain the northside set-back
line.
6) The garage front will angle similiar to the house and garage
at 3470 Sims Court, and will not be obstructing any view.
PROPOSED OWN~BQ~ JAMEQ ~ FIELD/MARTHA KUDAK
Martha Kudak and Jim Field bought their present home, 302
University N.E., Mpls. , ten years ago, and completely restored
this 100 year-old victorian home to its present condition. This
past year, the home received the CUE Award for Minneapolis, and
will be honored at the April 1990 CUE Dinner. It is the
intention of Jim and Martha to put approximately $100,000 of
improvements into the 3464 Sims Court house, adding to the value
and appearance of the neighborhood and the Village of Arden Hills.
. The proposed owners have met with the city architectural
consultant and the zoning commissioner several times considering
many alternatives to improving this property_ It seems that the
proposed garage placement and request for variance is the only
logical approach.
