SUBJECT: Park Dedication - Group Health

I have been engaged in preliminary discussions with
representatives from opus regarding the park dedication
requirement for the proposed Group Health development
(Northwoods) . Opus has proposed a park dedication fee of
$20,000 (see attachment). I feel that this fee is quite
inadequate.
I have prepared a counter proposal for this property at a fee of
$86,300 (see attached) . This dedication fee would be equal to
. 10% of the market value of the property. I suspect that the
final dedication fee will be an amount somewhere between the two
proposals.
REQUESTED ACTION
Unfortunately, I will be out of town on business this Monday,
April 23. I would request Council discussion and concurrence
with my counter proposal as outlined. If you concur, staff
should be directed to forward the City's counter offer to opus
representatives on Tuesday, April 24.

Gentlemen:
Thank you for your letter of April 5 regarding the required park
dedication for your proposed property development on Northwoods
. Drive.
The Council reviewed your proposed dedication fee ($20(000) at
our worksession last evening. After discussion, I have been
authorized, by the Council, to offer the following counter
proposal to satisfy the park dedication requirement:
$86,300 (10% of purchase price) , payable in one lump sum,
upon issuance of occupancy permit.
This settlement offer is based upon the following factors:
1. city code requires that "the market value of the subject
land at the time of the application" be the principal
factor in determining the cash value of a park dedication.
The most accurate gauge of market value is purchase price.
County records indicate that the parcel in question was
purchased by Opus in 1985 as part of a larger tract of land
(11.8 acres) for $1,939,376. The property was divided into
three parcels with an accompanying purchase price as
follows:

2. While the property was purchased five years ago, and
therefore, undoubtedly carries a market value higher than
the actual purchase price, the city has not applied an
inflation figure to determine current market value. The
market value of the proposed development was derived by
combining the yalue of parcel 1 ($700,000) with one-third
of the value of parcel 2 ($163,000) , due to the fact that
approximately 1.0 acre from parcel 2 has been combined with
parcel 1 (5.27 total acres) for the purposes of the Group
Health facility. The total market value for combined
parcel of 5.27 acres is estimated at $863,000.
3 . The City's offer of a 10% cash dedication requirement
($86,300) is less than the 15% level authorized by existing
ordinance. However, the 10% requirement more accurately
reflects prior park dedications negotiated on similar
properties (including a $52,100 dedication on 4.57 acres in
1986 for the Northwoods Office Complex), and a recognition
that a portion of the development will be utilized for water
drainage purposes.
. 4. The Council does not agree, nor are we authorized by City
ordinance, to base the park dedication fee on a square
footage of developed property basis, as proposed in your
memorandum. The undeveloped value of the land, irregardless
. , of the facility to be developed, is the principal
t; determinent in the City's calculation.
Please advise me as to your decision regarding this proposal.
The City appreciates the good working relationship which we have
experienced with opus, and look forward to the addition of Group
Health as a new corporate citizen in Arden Hills.

At its meeting last evening, the City Hall Committee heard a
presentation from Diane Traxler of Decision Resources Ltd.
regarding community surveys as a policy information tool.
Decision Resources has done extensive survey work over the
last seven years for municipalities, school districts,
non-profits, religious and business organizations on a wide
variety of topics. Municipal surveys have been conducted on
specific issues (eg. park needs) , proposed referendums, and
global "quality of life" assessments.
Over the last year, the Council and at least three
. committees (Parks, Public Works, city Hall) have expressed
an interest in conducting a comprehensive community survey.
After last night's presentation and discussion, I am
convinced that for several reasons, now would be an
appropriate time to proceed with this survey activity.
First, as we proceed into a new decade, it is important that
the Council have reliable data to assist us in charting a
course for future policy and budgetary decisions. Community
needs and perceptions may have changed dramatically since
our last survey conducted in the mid-1980s. Further, the
City Hall Committee is very interested in determining public
interest and support for a new city hall/community center
facility--as well as desired components of such a facility--
prior to making its recommendations and report to the
Council.
The Committee unanimously adopted a motion last evening
which urges the Council to initiate community survey efforts
as soon as possible. The timing of the survey is important
to the Committee if it is to incorporate external citizen
input into its deliberations. The Committee has established
a late summer target date for completion of phase one of its
deliberations. Given that the community survey, if
initiated, will take approximately three months to design
and administer, Council approval must be received by early
. May if the project is to be completed by late July.
The design of the survey instrument will likely be an
important (and time consuming) activity. Given that only a
limi ted number of issues can be examined in the survey,

Council will need to determine those subject areas to be .
examined and develop questions to meet our needs. Ms.
Traxler suggested that a focus group of Council members,
representatives of various cOl1U11ittees, and city staff be
assembled to provide input on survey design.
The cost of the survey will vary depending on the length and
complexity of the instrument. The price will range from
$1,500 - $12,OQO. If the Council agrees to proceed, monies
to finance this unbudgeted project will need to be
reallocated or appropriated from surplus funds. I support
this activity and believe that it would be a prudent
expenditure of city resources.
Requested Action
Determine Council support for conducting a comprehensive
cOl1U11unity survey. Invite Bill Morris to the April 30
Council meeting to make a formal presentation. Direct staff
to investigate alternative funding sources for this project.
