IMPLEMENTATION; Council was referred to a report from Clerk Administrator GATfJilAY BUSINESS Berger dated 9-5-90, relative to ilnplementation of the DISI'RIcr Gateway Business District. Berger advised three actions are required to accomplish the ilnplementation an:i outlined the necessary procedures. Planner John Bergly an:i Attorney Filla were present to answer any questions on this mtter. Council an:i staff consultants discussed upjating the City Comprehensive Plan. . Planner Bergly advised a systems statement is received on an annual basis an:i the city responds to areas outlined for nNiew. Attorney Filla pointed out that changes in the Comprehensive Plan which will occur due to of the ilnplementation of the GB District an:i the proposed Iexington Avenue District will effectively accomplish a substantial portion of the Plan upjate. He noted the plan is revised on a routine basis at 10 year intervals, basically due to the availability of new data. ---- , . He noted statutory requirements must be fulfilled in the summarized version to be published. Malone noved, seconded by Mahowald, to adopt Resolution No. 90-35, Amending the Carrprehensive Plan f= the City of Arden Hills. Motion =ied unanilnously. (4-0) Mahowald moved, seconded by Malone, to adopt Ordinance No. 270, AN ORDINANCE AMENDING SECI'IONS V. B. / V. E., V. F .; AND ADDING SECI'IONS V.E. (9) AND VIII.H. AND ITS SUBDIVISIONS 'ill APPENDIX A OF THE ZONING ORDINANCE OF THE CITY OF ARDEN HILlS REUlTING 'ill THE RmlUITION OF DEIlEIDPMENT IN THE GATEWAY BUSINESS DISTRIcr, and direct staff to prepare a summarized version of the ordinance for publication, pursuant to state statutes. Motion =ied unanimously. (4-0) FINAL PAYMENT; Council was referred to a memorandum fram the Clerk CHEMICAL ANAYSIS, Administrator dated 9-6-90, relative to final payment . DRUM DI8roSAL to for chemical analysis and drum disposal at the Kem KEM MILLING SITE site. Daryl Ohmn was present to review the final payment amounts and supporting time/material data received fram the firms conducting the removal of the drums at the Kem Milling site. Council questioned why three companies were utilized to a=mplish the chemical disposal. Ohmn explained Bay West, the subcontractor hired to dispose of the drums, had the specialized equipment necessary to a=mplish disposal; Metro was hired to transport and dispose of the drums, however, they detennined four of the drums contained materials they could not dispose of at their site and Aptus was hired to dispose of the remaining four barrels. Council questioned if the project is close to finalization at this time. Ohman advised the only remaining item is the removal of the contaminated soils fram the site and completion of a report fram Delta Envirorunental on the project. Council requested the Clerk Administrator prepare a finalized breakdown of all costs associated with the phased clean-up at the Kern Milling site and a comparison with the initial cost estin1ates for the project, when a final report is received from Delta Environmental Consultants. Malone moved, seconded by Hansen, to authorize the . expenditure for final payment for chemical analysis and drum disposal at the Kern Milling site, in the amount of $7,063.42. CDUNCIL <XMMENrS PIANNING Councilrne:mber Hansen expressed concern that the Planning COMMISSION Commission did not hold a meeting on 9-5-90, due to lack of a quorum; asked f= suggestions to insure a quorum is present at all future meetings. Counci1lneInber Malone re]Xlrted on discussion from the 8-20-90 Council Worksession and the suggestions that staff establish guidelines f= Planning members as relate to excused absences and removal from the Commission if attendance is low. He also noted it was suggested the number of members be reduced to indicate the importance of being present to review the applications and timely notification to city staff of absence from a meeting. Mayor Sather discussed the Planning Commission appointments which are no:rmally accomplished in January 1991; suggested interested persons be advised of the importance of attendance and the =ent member attendance records be carefully reviewed at that time. PUBLICITY ; Councilrne:mber Hansen suggested staff notify local CLEAN-UP DAY newspapers of the upcoming Fall Clean-Up Day and that it will be a joint venture with the City of Shoreview. Hansen questioned if two public works personnel will be working at the clean-up. Winkel advised that two persons are requested and additional volunteers will be . welcome. RCLJ.G MTG. UPDATE Authority meeting. NEW CITY :ux;o eouncilrne:mber Malone questioned the stab.Js of the proposed new City logo; suggested he could infornally discuss the matter with a designer from Deluxe. Mahowald recalled rronies were hldgeted in 1989 for the :i1nplementat.ion of a new logo. srA'IUS RPI'; eouncilrne:mber Malone asked for an update on the stab.Js KEI'IHSON POND of the Keithson ]Xlnd. Clerk Administrator Berger re]Xlrted on his discussions with the Engineer, developer and neighbors regarding the ]Xlnd configuration and excavation process. He explained agreement was reached between all parties except regarding the excavation of one area of the ]Xlnd on the Maj='s property. Berger recalled the ]Xlnd was to be excavated to meet =iginal specifications and Mr. Majors recalled the "]Xlint" area of the ]Xlnd would not be eliminated. . eounci1lneInber Malone recalled the ]Xlnd is to be Wilt to original specifications and design. Attorney Filla cammented that during discussions with Keithson residents it was noted that the ColbJrn property, to the south of the ]Xlnd, was reduced in square footage because the ]Xlnd depth was increased and that no excavation will occur on the ColbJrn property. I::ottam elevation should be determined at that t:i1ne and corrpared to the elevation on the original design specifications; the Engineer will then review and determine how much capacity can be obtained by excavating to the proper depth. Council con=ed to direct staff to inform the developer and residents that the pond should be constructed to original design specifications and capacity and that may include removal of the "point" discussed. Attorney Filla advised the Keithson pond must be constructed as represented, to insure that other developments will be constructed as per plans approved. council questioned if there has been any further discussion with residents regrrd.ing civil action against the city. Clerk Administrator Berger stated one of the residents has expressed concern regrrd.ing loss of trees and mentioned possilile civil action. This meeting, as scheduled, will not allow our Building Committee of Sts. Volodymyr & Olga Church enough time to be prepared. According to Mr. John Bergly, the drawings of our site building plan should be submitted two weeks prior to the Planning Commission's meeting for first review by Mr. John Bergly. . We regret that we were unable to get our drawings ready. Therefore, we would like to ask the Council of the City of Arden Hills to place our subject on the agenda for the meeting on October 8, 1990 instead of September 24, 1990. MEMORANDUM TO: Mayor and Council FROM: Councilmember Tom Mahowald RE: Park Dedication - ease #90-10: Meyer/Medlin Estate, Minor Subdivision Hamline Avenue and Amble Road DATE: September 7, 1990 In negotiations with James A. Meyer, Attorney for the estate of Bernice Medlin, it was agreed that a park dedication fee of $600.00 for each newly-created lot on Amble Road is acceptable to the appilcant. The amount was determined to be in conjunction with recent park dedication fees for residential development in this area; i.e.. , Case 1/89-15: Weaver/Wegleitner Lot Division, $600.00 cash settlement for one newly-created lot on Amble Road. ACTION REQUIRED . (D. ) Upon payment of all fees due to dace, ORL shall furnish to CLIENT a written report of the survey resul ts including interpretations which may be reasonably drawn therefrom. At that time, CLIENT. in concultation with DRL, will schedule meetings for the presentation and discussion of these results. Soth the President of DRL and the Project Director of this study shall be available for meetings and supllementary analysis not to exceed twenty additional hours of time. Further time corrmitments of DRL personnel deemed needed by CLIENT shall be billed upon a mutually agreed. to hourly basis prior to their execution. Ill. PROPRIETARY RIGHTS A~D DISCLOSURE The written report required under Section II. <D.) shall become the sole property at CLIENT after payment to ORl. of the TOTAL AMOUNT required in Section III. The survey questionnaires and replies and all related data, materials and information shall remain the property of DRL. DRl agrees not to divulge or use for any purpose, including but not limited to advertising and public relations, the information obtained in the survey without the written consent of CLIENT; provided, howeve r f if the data or resul ts of the survey are directly or indirectly made public by CLIENT or anyone else, DRL may make publ ic the following information: the population from which the sample was taken, the method of obtaining the interviews, including the size and design of the sample, and the basis of the data it the sample is less than the total sample, the dates and times ~hen the interviews were conducted, the exact warding of ~uestians asked and the client's name. CLIENT agrees that if it or anyone else acting on Its behalf wishes to release in whole or in part to the public by press release, speech, or otherwise, the data or results of the surveyor contents of the written report, that CLIENT or such other person will first notify DRL in writing, and that there will be also stated in the release, speed'J , or otherwise, that the survey was done by DEC:SION RESOURCES, LIMITED, OF M I N~EAPOLI S, MINNESOTA. CLIENT agrees, at all times both during the term of this Agreement and thereafter I to keep in confidence all knowledge or information as to the processes, methods and techniques of DRL and not to disclose or make known such knowledge or information to any other person, firm, corporation or organization, including but not limited to competitors of ORl, except when specifically authorized to do so in writing by DRL. CLIENT further under- stands and agrees that the names and addresses of interv;ewers used by DRL and the names and/or addresses of persons samolea are confidential and witl not be mad~ available to CLIENT. V. EXCLUSION OF ~ARRA~TIES DRL agrees to utilize its best eftorts to insure the accuracy of any survey by it pursuant to this Agreement. Ho...ever, i:: is . specificallY understood and agreed that nothing in this Agreement. or any surveyor written report furnished under Section II. (D.), shall be considered as either a prediction or guarantee of the results of any election or the outcome of any event, and any representations or warranties, express or implied, to that effect are hereby excluded. In addition, ORL sMall not be responsible or liable for any failure by it to conduct any surveyor render any written report if such failure results from labor disturbances, fires, floods, wars, riots, civil disturbances and other events beyond the control of DRL. VI. ARBITRATION The parti es agree that any dispute arls1ng under this Agreement shall be resolved under the rules and procedures of the American Arbitration Associ at i on as applicable under Minnesota law and that any such proceedings shall be conducted in Minnesota. This District is established to implement that part of the Arden Hills Comprehensive Development Plan known as the "I-694/I-35W Plan" Cthe I'Plan" ) in order to promote high quality, unified, large scale development in a manner similar to a planned unit development, to take full advantage of the district's location as described in the Plan, to protect the district's environmental resources, to promote flexibility in land uses and development standards to achieve the objectives of the Plan, to allow development which will~nsure reasonable traffic operation on the internal and surrounding transportation systems, and to allow only development which will create an attractive environment and a positive image for the district which encompasses a tract of land located at the nexus of I-694/I-35W that is the most visible in the city and represents the city's last major development site. . Section V.L Land Use Chart. The chart below shows the uses vlhich are permitted as a matter of right ("Pll ) or by means of special use permit C "S") or planned unit development permit ("D" ) or are not allowed whatsoever in the all of the zoning districts in the ci-ty but for the GB D' " The uses which are allm-led lS-::::::-lC":... . in the GB District are set forth in Section VIILH.(4) hereof, and those which are prohibited are set forth in Section VIII.H(5) hereof. Section V.F. District Reauirements.. The table below shows the minimum and maximum requirements for all of the zoning districts in the city but fo:::- the GB District. The requirements and development standards for the GB District are set forth in Section VIII.H.(6) hereof. Section VIILH. Gateway Business District. C 1) Purpose. The purpose of the GB District is to: Ca) Implement that part of the Arden Hills Comprehensive Development Plan known as the 1- 694jI-35W Plan. Cb) Promote high quality, unified, large scale development in a manner similar to a planned unit development. Cc) Take full advantage of the site's location as documented and described in the I-694jI-35W Plan. (d) Alloy, only development that will create an . attractive environment and a positive image for this site which is one of the most visible in the communi ty and represents the city's last major development site. (e) Protect the site's environmental resources. C f) Promote flexibility in land uses and development standards to achieve the objectives of the 1- 694/I-35W Plan. (g) Allow development that will €msure reasonable traffic operation on the internal and surrounding transportation systems. (2) Procedure. The planning application and administrative review procedure defined in Section VIII.G.(2) and G. C 3), Planned Unit Development District, shall be followed subject to any modifieations or additions set forth in this section. The prescribed procedure may be modified by the city to allow planning flexibility and to encourage cooperative dialogue between the developer and the city. . 2 -.--- (3 ) Defini~io~s o~ Terms Used Herein. . ( a) Gateway Business District C GB). A district established specifically 'to provide a flexible framework for the development of the area of the ci ty generally located in the northeast quadrant of the interchange at 1-694 and 1-35W. Cb) Mixed Use Project. A segment of the GB District that is eontrolled by a single developer entity, containing more than one type of use, and planned as a single development but may be developed in more than a single stage. C c) Single Use Project. A segment of the GB District that is controlled by a single developer entity and containing a single type of use, planned as a single development and encompassing one or more parcels but may be developed in more than a single stage. (4) Allowable Uses. Development within the GB District will include uses that meet the above stated purpose and the following development criteria: C a) Office uses occupying not less than 25 percent nor more than 50 percent of a project's total floor . area. Cb) The mix, relationship and intensity of uses and buildings will be compatible and complementary both internally and with adjacent uses. Cc) Retail or service businesses offering goods, merchandise or personal services for sale primarily to those employed in the GB District will be allowed to occupy no more than 15 percent of the total floor area of the building in which they are located. Cd) Multi-family residential use is limited to that area adjoining the public area surrounding Round Lake and shall not exceed 15 percent of the total land area in the GB District exclusive of Parcels 2, 3, 4 and 5 as identified in the 1-694jI-35W Plan. Densities shall not exceed those allowed in an R-4 P.U.D. District. Ce) Licensed day care facilities will be allowed either in a building containing other uses or in a free-standing building. Free-standing day care facilities are not required to meet minimum floor . area requirements otherwise required in the GB District. 3 ---------- (f) The use is in the best interest of the city and . the GB District. The applicant shall demonstrate to the satisfac-tion of the city that the proposed uses, lot sizes, height, mix, loca-cion and relationship v,7i. th other existing and proposed uses are compatible and complementary both internally and with adjacent uses, and meet the intent of the city as expressed in the GB District purpose and the above criteria for allowable uses. C 5) Prohibited Uses. Some land uses are not compatible Hith the stated purpose of the GB District. The following uses are therefore prohibited: C a) Single-family or tHo-family residences. Cb) Open sales, rental or storage lots, including but not limited to cars, buses, trucks, motorcycles, bicycles, recreational vehicles, trailers, boats, mobile homes, machinery, lumber, building materials, landscape materials, and similar items. Cc) Vehicular sales, lease, rental or repair, including but not limited to the items listed in . Cb) above. Cd) Truck terminals, freight terminals and freight forwarding services. Ce) Building supply stores and yards. C f) Outside storage. Cg) vlarehousing and Hholesaling exceeding 75 percent of the building in which it is located. Ch) Mini-storage facilities. C i) Bulk storage buildings, yards and terminals, including but not limited to, forest, metal, concrete, agricultural and petroleum products, chemicals, and similar products. (j) Manufacturing that requires outdoor storage of bulk, raw or finished materials used in or resulting from the manufacturing process. Ck) Manufacturing or processing that generates hazardous waste Hithout a valid Hazardous Waste . Generator's license from the Ramsey County Public Health Department. 4 . C 1) Uses that the city may determine are incompatible vlith i'Cs objectives or Vlith development as it may occur, thereby imposing or establishing new o~ unforeseen standards. The proposed land uses in such a project and their mix, intensity and relationship may require varying lot sizes Vlithin said project, none of Vlhich lots shall be less than 5 acres in size except as otherVlise permitted herein. 2. Lots of less than 5 ac~es Vlithin a mixed use project may be permitted only when the applicant has demonstrated satisfactorily that: a. The lot Vlill be the site of a use that . Vlill be compatible v,Ti th and Vlill complement and enhance existing and planned businesses. b. The primary business of the proposed complementary use Vlill serve business activities within the GB District. 3. Single use projects shall contain a minimum area of 10 contiguous acres. 4. Interior lot lines Vlithin a mixed use or single use project may be located to allow individual ownership of specifi.c buildings. To alloVl maximum development creativity and flexibility, regulations such as side and rear yard building and parking setbacks, F.A.R., number of parking spaces, percent of landscape area, etc.. , may be modified for individual parcels and interior lot lines. However, the regulations for these same items must be met for the total mixed use or single use project area and exterior project lot lines. Cb) Minimum building size. To accomplish the scale of . development consistent with the defined purpose of the GB District, the minimum ground floor area of " ~ a build'na other than for residen~ial uses shall . be 20, oo~o square feet except as otherHise regulated herein. The use of stepped building heights is encouraged to provide visual transition. This applies to both multi-building complexes and single buildings. 3. The location of buildings relative to their heights will consider views and relationship from wi thin the GB District and from public and private areas off the site. 4. Minimum building setback requirements are 50 feet from all streets and exterior proj ect . property lines and 20 feet from all interior property lines, except that interior lot line 6 setback requirements may be modified by -the . city in the project review process ~ ~ specific conditions of the project plan justify modification. (e) Landscaping. Appropriate and unified landscaping is essential to effectively meet the defined purpose of the GB District. l. A landscape plan shall be submitted in the general plan stage required in Section VIII.G.(3). 2. The landscape plan shall include species, size and location of all plant materials. 3. In the concept plan stage, natural existing vegetation, earth forms, wetlands and steep slopes shall be carefully evaluated and protected as appropriate. 4. Landscape berms and buffers will be used to screen and visually separate: business sites from residential uses; business sites from public streets; and one site from another. . 5. Minimum planted tree sizes shall be 3 inch caliper for overstory deciduous trees, 2 inch cG.liper for ornamental trees ana 8 foot height for coniferous trees. The required height of evergreens used for required screening may be increased by the city. 6. Special landscape enhancement of views for 1- 694 and I-35W will be required. 7. A minimum of 35 percent of the total area of a mixed use or single use district shall be landscaped. 8. Minimum landscaping requirements shall relate to the gross square footage of all floors of a building and the building height and shall be expressed as the minimum number of total caliper inches required per building site. a. The arrangement, geometry and massing of individual buildings shall be responsive to the arrangement, geometry and massing of the whole of the GB District. 2. Exterior building treatment Cwal1 surfaces) shall be of brick, stone, glass or any combination thereof, except trim and accessories may be metal. 3. Materials and colors selected for any individual building shall be compatible Vlith other buildings in the GB District. 4. All service entrance areas, mechanical equipment and trash handling devices shall be screened from adj acent building and off-site visibility. 5. A If campus II plan arrangement is hereby encouraged and a llsignaturel! building is considered desirable. . 8 (g) Parking. Parking requ.irernents contained in . Section VI. E. C 1) shall apply. However, these requirements may be adjusted by the city in the project reviev..f process '''' the changes v,'ill more ~~ effectively accomplish the stated purpose of the GB District, and subject to the follmling: 1. Parking structures shall maintain the setbacks required for principal structures. 2. The exterior finish of parking structures shall be compatible with the principal building served by the parking structure. 3. Surface parking shall maintain a 50-foot landscaped setback from all public streets and a 20-foot landscaped area from exterior project property lines except for access drives that may cross the setback area. 4. Landscape islands totalling 15 percent of the surface of a parking lot shall be used to divide large parking lots into smaller, more pleasing spaces. Interior side lot lines should follow such islands wherever possible. . 5. The required number of parking spaces may be adjusted by the city if the developer submits adequate proof that the standard requ~rements exceed the actual demand. Proof that the required number of spaces could be increased to the number required must be shown to provide for changes in use or intensity of use. 6. Combined or joint surface or structure parking facilities will be permitted for one or more buildings and uses if the purposes of the district will be more effectively accomplished. If the total number of spaces in a project do not meet the required number of spaces, the applicant shall show to the City's satisfaction that the peak parkina load will not exceed the number provided. Such reduction in parking may limit the type of future occupants or may require expansion of parking if the parking need increases. Combined or joint parking shall be reasonably related to the destination of the user. (h) Traffic impact study. The city has determined that the traffic capacity of the interchange at . Development producing additional peak P.M. traffic hour trips Hould be allowed if travel-demand management strategies are implemented by developers and businesses in the GB District. 5. Developers in the GB District and the City may be required to provide financial ass.istance for transportation infrastructure improvements. Tax Increment Financing Hill be utilized as available in providing such financial assistance. Ci) Signs. Signs will be regulated by the Arden Hills Sign Ordinance and the Table for Commercial and Industrial Signs, subject to any modifications or additions contained herein. (j) Lighting. Exterior lighting shall be provided for the safety and convenience of occupants and visitors.
