MINUTES OF THE ARDEN HILLS REGULAR COUNCIL MEETING
MONDAY, SEPTEMBER 24, 1990 - 6:30 P.M., CITY HALL
. CALL TO ORDER Pursuant to due call and notice thereof, Mayor
Sather called the meeting to order at 6:30 PM.
EVALUATION, PW Council conducted an annual Performance
SUPERVISOR Evaluation for the Public Works Supervisor
between 6:30 and 7:30 P.M.
ROLL CALL The roll being called, the following members
were present: Mayor Thomas Sather,
Councilmembers JoAnn Growe, Nancy Hansen, Thomas Mahowald and
Paul Malone. Also present: City Attorney Jerry Filla, Public
Works Supervisor Dan Winkel, Deputy Clerk Catherine Iago, and
Administrative Secretary Mary Ann Hillyer.
ADOPT AGENDA Malone moved, seconded by Hansen, to adopt
the September 24 agenda as revised to include
a park dedication fee from Opus/Group Health, Inc. Motion
carried unanimously. (5-0)
APPROVE MINUTES Hansen moved, seconded by Growe, to approve
the August 20 worksession, August 27 and
September 10 regular Council minutes, with the September 10
minutes amended to reflect Malones's concerns. Councilmember
Malone referred to the September 10 regular Council minutes, page
3 , last paragraph; discussion of Keithson Pond and excavation on
. the Colburn property. He expressed concern that the language is
misleading and may be misconstrued as a statement from City
representatives, rather than a statement from the residents
attending the meeting.
Malone requested the sentence be clarified to reflect that the
statement regarding no excavation on the Colburn property was
asserted by the residents and that the city has not determined
the extent of excavation of the pond at this time. Motion
carried unanimously. (5-0)
CONSENT CALENDAR Councilmember Malone moved, seconded by
Councilmember Hansen, to adopt the Consent
Calendar as submitted and authorize execution of all necessary
documents contained therein:
a. Approval of annual performance evaluation and salary increase
for City Administrator Gary Berger, with a pay increase to
$3,667 per month, retroactive to July 25, 1990.
b. Approval of annual performance evaluation and salary increase
for Public Works Supervisor Dan Winkel, with a pay increase
to Step 5, $3,059 per month, retroactive to September 1,
1990.
c. Approval of final payment to Environet, Inc. , for $6,584 for
. work done at the Kem Milling site.

d. Approval of Resolution No. 90-36, "RESOLUTION AUTHORIZING THE .
CITY OF ARDEN HILLS TO JOIN AN ENVIRONMENTAL CITIES
COALITION" .
e. Approval of the List of Claims and Payroll.
Motion carried unanimously. (5-0)
PUBLIC COMMENTS None.
ORD #272, WINTER Council discussed a proposed winter parking
PARKING REGS. ordinance as prepared by city Attorney Jerry
Filla, which would restrict parking on City
streets between the hours of 11:00 PM and 6:00 AM from October 15
to April 15, whether it is snowing or not and also during a
period immediately after a two inch or more snow accumulation and
continuing until snow removal/plowing has been completed.
Public Works Supervisor Winkel noted that signs will be posted
and a notice will be in the Town Crier, on cable TV and in the
local newspapers, advising residents of this new Ordinance.
Councilmember Mahowald asked how stringently this would be
enforced. Winkel noted that residents can call the Sheriff's
office or Public Works Dept. if there are special conditions or
special events, when a resident needs to park a few hours extra. .
In all other cases, tickets will be issued, not warnings.
Mahowald suggested a phase-in period until residents a'.'e
accustomed to the procedure.
Councilmember Malone asked who determines the two inch snowfall,
the weather bureau or the city. Winkel stated the City staff
makes the determination. Attorney Filla reported on procedures
to defend citations in court if the matter should be contested.
Councilmember Hansen asked if the mobile home park and County
roads are affected by the Ordinance. Winkel stated mobile home
parks are not affected, as those streets are privately
maintained. County roads are covered under this new ordinance.
After discussion, Councilmember Malone moved, seconded by
Councilmember Hansen, to adopt Ordinance No. 272, "AN ORDINANCE
AMENDING CHAPTER 26, ARTICLE I, SECTION 26-3 OF THE ARDEN HILLS
MUNICIPAL CODE RELATING TO WINTER PARKING REGULATIONS". Motion
carried unanimously. (5-0)
RESCHEDULE Upon recommendation from City Administrator Berger,
MEETINGS Councilmember Malone moved, seconded by Council-
member Growe, to reschedule the following future
city Council meetings due to holidays:
Monday, October 8 to Tuesday, October 9, at 7:30 PM .
Monday, November 12 to Tuesday, November 13, at 7:30 PM
Monday, December 31, to Wednesday, January 2, 1991, at 5:00 PM

OPUS PARK Councilmember Mahowald noted that he and city
DEDICATION Attorney Filla discussed a proposed park
dedication with representatives from Opus/Group
Health, (Case #90-02), a few weeks ago for development at 3930
Northwoods Drive. Mahowald and Filla both recommended that
Council accept the Promissory Note in conjunction with a
principal amount of $49,000 for a public use fee. This payment
would be in three annual installments, (with the first
installment of $16,400 due October 1, 1990), assuming the city
maintains the storm water pond which was constructed on the Group
Health Inc., property.
The final two installments would be due October 1, 1991 and
October 1, 1992 for $16,300 each, plus accrued interest.
council also discussed the Maintenance Agreement, whereby Group
Health would complete construction of a storm water retention
pond and control structures for Lot 1, Block 1, Northwoods,
according to plans approved by the city. After City acceptance
of the improvement, the city would be responsible for maintaining
the inlet and outlet structures for the pond and for removal of
debris from the pond. The developer would grant a waiver of
trespass to the City, in order to permit the city to maintain the
. pond, provided that the city shall be responsible for any damage
to the developer's property as a result of maintenance
pL'ocedures.
Attorney Filla advised Mr. sellergren, opus legal counsel, has
not reviewed the Agreement and suggested council may approve the
Maintenance Agreement, with the condition that any changes by the
developer be approved by the Public Works Supervisor and City
Engineer, or continue this matter to the October 9 meeting.
Filla also noted that liability issues are no greater with the
Maintenance Agreement than without it because the pond is
dedicated as an easement to the city on the plat.
councilmember Malone questioned if delinquent park dedication
payments could be certified to taxes, with a procedure similar to
the one used for delinquent utilities. Filla responded that
would be possible and suggested language be placed in the
Ordinance to outline the procedure.
Mahowald noted that the current park dedication ordinance is
antiquated and needs modification. He suggested Attorney Filla
be directed to revise the Ordinance to bring it into compliance
with State law. Mahowald also stated he would recommend approval
of the Maintenance Agreement in substantial form.
councilmember Malone suggested that the water level in Item #4 of
. the Maintenance Agreement be better defined, such as a certain
number of feet above sea level.

OPUS (Con't) After discussion, Councilmember Mahowald moved, .
seconded by Councilmember Malone, to accept the
park dedication fee of $49,000 from Group Health, Inc., as noted
in the Promissory Note and as recommended by City Attorney
Filla. He further moved to approve the Maintenance Agreement and
authorized staff to make non-substantative changes, if necessary,
and to direct staff and city Attorney Filla to prepare
modifications to the Park Dedication Ordinance so that it will
comply with State law as discussed by the City Council. Motion
carried unanimously. (5-0)
COUNCIL Councilmember Mahowald commented on Congressman
COMMENTS Bruce Vento's visit to the city on Saturday,
September 22. He suggested staff send a letter of
thanks for the visit and concerns expressed over the use of the
Arsenal property for athletic facilities.
TCAAP councilmember Growe asked if the City had received
CONTAMINATION any information relative to the Mpls. Tribune
article on TCAAP contamination. Deputy Clerk Iago
noted that city Administrator Berger has had discussions with a
representative from Vento's office and will report to Council at
a future meeting.
SAND BURRS Growe also asked if the sandburr problems at Hazel-
HAZELNUT nut Park had been resolved. Public Works Supervisor .
Winkel noted that the area has been seeded and
should be in fine shape by Spring.
MCGUIRE'S Councilmember Malone noted that McGuire's Inn had
PARKING agreed to remove two front parking spaces in
connection with their recent variance approval, and
that this had not been accomplished yet. Deputy Clerk Iago
stated that McGuire's has another new manager and she will speak
to him about this matter.
WATER Malone also asked if MSA is agreeable to search for
LEAKAGE water leaks within the city. Public Works
Supervisor Winkel noted he may have information on
this Friday, with the Newsletter packet, which would verify the
data from MSA.
UPDATE RAMSEY Councilmember Hansen commented on the Ramsey County
Co. CHARTER Charter and stated that this topic was well
researched and there does not appear to be any
areas of major concern for cities if the Charter is approved on
November 6.
YOUTH SVC. Hansen also noted that the Neighborhood Youth
BUREAU RPT. Service Bureau has a new address and will conduct an
Open House on October 25 at Rush Lake Park. She .
will supply information for the Council packets at a later date.

. RCLLG Hansen noted that the RCLLG will conduct a ~our of
the Shoreview city Hall on October 8. She also
noted that two residents (Rob Carley and Jerry Miller) had been
contacted by staff from Decision Resources on the citizen survey,
and that both residents had favorable comments on the survey
contacts.
COMMITTEES Councilmember Hansen suggested rethinking use
of city Committees at a work session prior to
year end. She thought perhaps fewer committees might enable a
larger pool of residents to draw from and suggested this be
placed on a future Council work session agenda. She also asked
if a work session was scheduled for October.
SCHEDULE WORK Councilmember Malone moved, seconded by
SESSION Councilmember Hansen, to schedule a Council
work session for Monday, October 22, at 4:30
P.M. to discuss committee structures and a Personnel Policy, as
well as a possible assessment policy finalization. Motion
carried unanimously. (5-0)
CLEAN-UP DAY It was noted that Saturday, October 6, is the
Shoreview/Arden Hills Clean-up Day.
ADJOURN There being no further business to come before

by Councilmember Hansen that the meeting be adjourned at 8:19

SUBJECT: Final Payment Request - Bituminous Consulting

Attached are materials from Mark Graham, engineer with MSA,
recommending final payment to Bituminous Consulting and
Contracting, Inc., for the 1990 overlay and seal coating
improvements.
RECOMMENDATION:
Staff recommends final payment to Bituminous Consulting and
Contracting, in the amount of $3,741.13.
ACTION REQUIRED:
If Council concurs with the staff and engineer's recommendation,
. they should pass a motion, under Consent, approving final payment
of $3.741.13 to Bituminous consulting and Contracting -Inc., for
1990 overlay and seal coating improvements.

Pursuant to the Arden Hills city Code, Sec. 3-56 (b) Transfer, liquor
licensees must notify council whenever a change is made in the
corporate officers.
Attached you will find a letter from the above liquor licensee listing
the new corporate officers.

in the application. No license may be transferred to another
person or to another place without the approval of the city
council. Application for transfer shall be made in writing to
the city clerk-administrator and shall be accompanied by
certified check or money order in the amount of one hundred
dollars ($100.00) payable to the city treasurer, which amount
is fixed as the transfer fee. The council shall make or cause
to be made such investigation as it deems appropriate
regarding the transferee or the proposed location. This
provision shall also apply in the event of application by a
corporate licensee for transfer of stock in the corporation,
provided that no transfer fee shall be charged if the transfer.
is the first within the period of the license or the stock
sought to be transferred does not constitute fifty (50) per
cent or more of the outstancimg common stock of the
corporation.
(b) The transfer of stock in any corporation holding an on
sale or off sale liquor license in this city shall be deemed a
transfer within the meaning of this division, and no such
transfer of stock shall be made without the consent of the
council. It is hereby made the duty of the officers of any
corporation holding such s license to notify the council of
any proposed sale or transfer of any stock in such
corporation. The transfer of any such stock without the
knowledge and consent of the council shall be deemed
sufficient cause for revocation by the council of any license
granted to such corporation under the authority of this
division: In addition the corporate officers shall also notify
the council whenever any change is made in the officers of
any such corporation, and failure to so notify the council
shall likewise be sufficient cause for revocation of any liquor

Per new State regulations, a resolution from the City approving
the gambling permit application is now required. Also attached
please find said Resolution No. 90-37.
RECOMMENDATION:
Staff recommends adoption of the attached resolution, granting
approval to the National MS Society to operate a pull-tab
. operation at Howard Johnson's.
ACTIQN REQUIRED:
If Council concurs with the staff recommendation, they should
pass a motion, under Consent, adopting Resolution No. 90-37,
"RESOLUTION APPROVING GAMBLING PERMIT APPLICATION", allowing the

Attached is the city's work scope from Engineer Terry Maurer
regarding the city's 509 Water Management program. This is a
requirement of the Metropolitan council. We have $10,000
budgeted in 1990 and $20,000 budgeted for completion of the plan
in 1991.
RECOMMENDATION:
Staff recommends that council authorize the City Engineer to
begin preparation of the 509 Water Management plan.
ACTION REQUIRED:
. If Council concurs with the staff recommendation, they should
pass a motion, under Consent, authorizing the City Engineer to

As we discussed, we have prepared a detailed work scope for the Rice Creek
Watershed 509 Plan. Our August 2, 1990 correspondence gave a brief
. background on what the plan is to cover. Based on this information, I would
propose the following work scope:

Recently I have received complaints regarding both year-round and
winter parking regulations. Mr. Earl Elster, 1125 Benton Way,
Daniel Donohoo, 3175 Hafner court, Shoreview (who will be moving
soon to Arden Hills) and Mr. Kurtis Ault, 1473 Arden Oaks Drive
(see attached letter) may be present to discuss the restrictions
under the Public Comments portion of the agenda.
Please note I have attached surveys of surrounding communities
regarding both regulations. council may want to note that Arden
Hills appears to be more restrictive in its regulations,
particularly, year-round parking.
RECOMMENDATION:
. Staff has no recommendation at this time.

Dear Mayor Sather and Members of the Arden Hills city council:
I am writing in request for a temporary (1 year) permit to park on
the street in front of our house.
Our situation is this: we are having our brother-in-law stay with
us in our home while he finishes his college degree. He has his
own car that he uses to drive to school each day. Last week he was
ticketed for parking on the street in front of our house. We now
are required by the city to keep his car parked in the driveway.
This is a major inconvenience to us as a family. We have a two car
garage and his having to park in the driveway for this period of
time restricts access to one of the two cars that we own, both of
which we use daily.
. Were his parking on the street a bother to our neighbors, or were
he to keep his car on the street following a snowfall, I could see
the need to keep the car parked on the driveway as this would fall
into the category of being a bother to our neighbors and to the
city. However we are sensitive to the needs of our neighbors and
are aware of no problems, and are very conscientious about
observing the snowfall ordinances by removing the car from street
immediately following snowfall and keeping it off until after the
streets have been plowed.
The prohibited on street parking ordinance, I feel, is a disservice
in this case. Though I understand that there is a real need for
such restrictions in some cases, I think that they should be the
exception rather than the rule.
Please reconsider the need for this ordinance and also consider my
request for a permit should you see the need to continue its
enforcement.

. A POTENTIAL CITIZEN'S VIEW OF THE NEW IlPM PARKING ORDINANCE
October 5, 1990
Dear Council:
We presently live in Shoreview and have been looking into
building a new residence. We have narrowed our search down to
several communities, one of which includes Arden Hills. However,
I noticed that an ordinance has been passed concerning parking on
the street that I find unbelievable.
The new ordinance I am referring to prohibits parking on
residential streets from llPM to 6AM. First off, after talking
to several city employees I was told that a similar ordinance
exists in the surrounding communities. Jerry Filla, the village
attorney, was quoted by the Bulletin newspaper that surrounding
communities have adopted similar ordinances without too much of a
problem. If Jerry Filla has the urge to write these ordinances
maybe he should do a little research to get correct facts. No
similar ordinances exist in surrounding adjacent communities
have the starting hour of llPM for their ordinances. In fact
thirteen villages were checked and three have parking ordinances
4It with two starting the no parking at 2 AM and the third at 1 AM.
If the dear people of the village council think there is no
difference between 1 or 2AM and IlPM for parking restrictions,
they cannot imagine a life other than one of total simplicity.
May I have the privilege of addressing situations that escaped
the imagination of these elected and non-elected people.
1 Suppose a resident is going to the Minnesota Symphony and
invites his friends in the area to come to his house so that they
can drive together and save gas and t raff ic congestion, a
worthwhile consideration. If the concert concludes at lOPM and
the option is exercised for stopping for a bite to eat, they had
all better watch the clock to be back to remove their vehicles
before ticketing time. Obviously, going to a late movie
starting between 9 and lOPM is not possible with friends leaving
a car at a residence.
2 If friends come over, which hopefully is not against any
ordinances, they will have to leave by IlPM. Since the village
is basically not a farming community, this hour everyone will
agree is perhaps a little early,
3 The kid's friends come over to watch a VCR movie. By
kicking them out by IlPM, they should have enough time to find
some trouble before their time to be home.
. 4 Frankly, I do not want cars parking in my driveway. I just
might have to use my vehicles parked in the garage for an
emergency.

5 Since, Arden Hills does not have bus service to the rest of
the metropolitan community (and for a good reason), the
automobile is the only means of transportation. Denying the
right of persons to use their automobile during reasonable hours
must be construed as a violation of the civil rights.
Additionally, this ordinance has great potential for . violating
the Bill of Rights, Why is it that while much of the world is
enjoying more freedom, we feel compelled to take away freedoms ?
I have talked to several village employees concerning the above
situations. I was told that in these situations, one could make
arrangements with their neighbors to park the visitors
automobiles in their driveways. Well, I for one do the not have
the time or inclination or gall to ask my neighbors. And I hope
my neighbors would not have the time or inclination or gall to
ask me to use my driveway. It is my driveway and I pay the taxes
on it and it is not property to be delegated to the public good.
I was also told that no cars on the street would make it easier
for emergency vehicles to gain access to residential property. If
this is really a life threatening situation, then no one should
ever park in the streets, day or night. Obviously, emergency
vehicles are designed for reasonable access to most buildings.
In fact, parked cars in the driveway could pose more of a threat
than vehicles in the street. Actually, children riding bikes or .
playing in the street are in greater danger of parked cars on the
street during daylight hours than at night.
I was also told that the llPM ordinance was necessary because the
present snow ordinance is not working. What Reasoning! \.Jhy
should the rights of so many be sacrificed for so few. St. Paul
and Minneapolis simply remove illegally parked vehicles violating
their snow ordinances. The newspaper article stated that the
warning tickets given out last year for snow parking violations
simply did n'ot work. Maybe if they played major league and gave
out real tickets it might have worked.
I notice that for supposedly good reason the residents could call
the village to keep their car parked overnight. My, my. The
time and effort expended by both parties is sheer waste. Just
try to get a ticket cancelled that was improperly administered
without going to court or spending an unreasonable amount of
time on the phone. With people calling in like school children
getting special permission, you could help the local economy by
hiring a person to handle their requests. Also, what time would
the calls have to be entered by? Just look at these
opportunities!
I personally. talked to many residents I know in Arden Hills. In
all cases, these people were not aware of the ordinance. After
informing them of the new ordinance, reactions varied from .
outright disgust to anger. Obviously, persons have not been
picketing in front of city hall for this ordinance. In fact a
suggestion was made that the village sirens could go off at llPM
announcing the time. Then another siren call could go off a
little later making sure that all lights are off and everyone is

. tucked in bed. Then the local enforcer could easily drive up and
down the street without the parked cars blocking his view~
Unless, the following is true:
1 The village is going in or has a vested interest in
providing asphalt and concrete for off street parking.
2 The village needs building permit fees from the above.
3 Village staff sees the administration of the ordinance as a
chance to build their bureaucracy thus entitling them to
higher pay since more employees are administered.
4 Village attorney sees additional fees defending village
against lawsuits ( he does not live in Arden Hills and he
supposedly wrote the ordinance) .
5 The thought of the village becoming autocratic to massage
egos or maybe just for so called professional gain.
6 The sheriff's office can charge higher fees to the village
for the administration of the ordinance.
7 Gopher Sign Company possibly exerting undue influence for
. the business they are receiving.
8 The idea of "We, the people" is now extinct.
9 Other reasons that time and space do not allow.
then, an immediate change of the ordinance is called for. At
this point I would suggest to get some citizen input since they
are most likel y to be affected. A serious blunder was made and
that cannot be changed. However, if there is any wisdom left,
the mistake would be corrected as soon as legally possible.

Enclosed is an ordinance prepared by Attorney Filla that would restrict
development in the Lexington Planning Study Area until plans and
regulations are adopted by the City. The Planning Commission is to set
a date for a public hearing (probably October 3).
The draft is written to impose a total moratorium on all development
within the area. The City may wish to define the types of development
that would be prohibited (rezoning, site plan approval for new
development, special use permits, etc.) or the types that would be
allowed (sign permits, changes in use that would not require site plan
approval, expansion of uses that would be consistent with the plan
amendment, etc.) during the moratorium. ~
'. This month two applications were received for property in the area:
expansion of Pot-O-Gold Bingo and expansion of a parking lot that would
require a variance (later withdrawn). Neither would have been affected
by the plan amendment or proposed zoning districts and could be
processed by the City, with or without a moratorium, with no adverse
results to the City.
It is possible that the Metropolitan Council review on the Comprehensive
Plan Amendment will be completed before the hearing date. In that case,
the City could hold a public hearing on the Comprehensive Plan and
Zoning Ordinance Amendments at either the October or November Planning
Commission meetin9s and dispense with the moratorium. But I thi nk it
would be advisable to set a hearing date for the proposed moratorium for
October 3 and then adjust the procedure if conditions change.

THE CITY COUNCIL OF THE CITY OF ARDEN HILLS ORDAINS THAT SECTION
XIV SHALL BE ADDED TO APPENDIX A OF THE ZONING ORDINANCE OF THE
CITY OF ARDEN HILLS TO READ AS FOLLOWS:
XIV. MISCELLANEOUS REGULATIONS
(A) Lexinqton-Fox Studv Area.
1. Defined. City has authorized its Planning
Commission and consultants to conduct studies and
is in the process of formulating and adopting
amendments to its comprehensive plan and official
controls for that portion of the C;j,.ty of Arden
Hills located as follows (herein "Study Area"):
a. North of County Road E; .
b. West of Lexington Avenue;
C. South of 1694; and
d. East of state Trunk Highway 51.
2. Statement of Public Purnose. The City Council has
determined that in order to protect the planning
process, it is in the public's interest, to impose
an interim development moratorium on development
within the Study Area until the proposed changes
to the City's comprehensive plan and official
controls are implemented.
3. Interim Development Moratorium. There is hereby
imposed an interim development moratorium on all
development within the study Area from the
effective date of this Ordinance until March 1,
1991 or until further council action whichever
occurs first. City may rescind the interim
development moratorium by resolution. The City
may extend the interim development moratorium by
adopting an appropriate ordinance after a pUblic
hearing preceded by ten (10) days mailed notice. .

. Effective Date. This ordinance shall be effective the day
following its publication.
Adootion Date. Passed by the City Council of the City of Arden

SUBJECT: six Month Performance Evaluation for Program
Supervisor Cynt:hia Severtson

Cynthia Severtson has completed her 6 months probation period of
employment with the city of Arden Hills, effective September 13,
1990. I have conducted her 6 month evaluation and have found Ms.
Severtson's performance to be highly satisfactory and recommend
that: she be placed on permanent employee status.
Ms. Severtson's current salary is $10 per hour. This is
extremely low when comparing program supervisor's salaries
throughout: the metro area.
RECOMMENDATION:
Ms. Severtson's salary be raised to Step 3 ($10.85 per hour)
. retroactive to September 13. This increase was covered in the
1990 pay recommendations.
An additional increase should be considered in January, 1991.
These actions will demonstrate progress toward pay equity and
comparable worth and start bringing Ms. Severtson's salary in
line with program supervisors thoughout the metro area.
ACTION REQUIRED:
If Council concurs with the staff recommendation, they should
pass a motion placing Ms. Severtson on permanent employee status
and authorize a pay increase to $10.85 per hour (step 3 of the
pay plan) retroactive to September 13, 1990.

SUBJECT: Reclassification of Public Works Supervisor to
Public Works Superintendent

At the September 24 Public Works supervisor's performance
evaluation, staff was directed to prepare materials for
reclassification of this position to Public Works
Superintendent. Attached is a job description and salary survey
for the reclassification.
Please focus your attention on the change under the Major
Responsibility Area, Item #2. This item reflects significant
organizational responsibilities that were not evident in the
previous job description. Staff believes that major
responsibility area #2 is a strong rationale for reclassification
at this time. The superintendent reclassification much more
. appropriately identifies the current responsibilities for
on-going communication with council, staff, consultants, and
community relations that were not reflected in the earlier
position description.
ACTION REQUIRED:
If Council concurs, they should pass a motion reclassifying the
Public Works Supervisor position to Public Works superintendent.
It should also be noted that Dan is currently at step 5 in the
Supervisor pay plan ($3,059 per month). Council may wish to
consider an adjustment utilizing the new pay plan, effective
October 10, 1990.

POSITION PUBLIC WORKS SUPERINTENDENT
-----------------------------------------------------------------
PRIMARY OBJECTIVE:
The primary objectives of this position are planning, .
organizing, directing and coordinating the operation and
maintenance of public works activities, including the
supervision and review of maintenance personnel and adherence
to policies established by the city Council and City
Administrator.
MAJOR RESPONSIBILITY AREAS:
l. Organize and direct the operation of public works
activities including supervision and review of
maintenance personnel in streets, water and sewer.
2. Communicate regularly with city council, consultants,
staff, other governmental agencies, and community
residents regarding service delivery, complaints and
problem solving.
3. Planning and coordination of all purchasing of goods and
services for street, water and sewer.
4. Planning and coordination of maintenance activities and
equipment useage with other City departments.
5. Maintenance of various operational records for all .
departments under the city Administrator's jurisdiction.
6. Preparation of budget for street, water and sewer.
7. Performance of any other duties as directed or apparent.
QUALIFICATIONS:
Must have or be able to obtain within six (6) months of
appointment, a Minnesota Class B drivers license.
Must demonstrate a working knowledge of tools, equipment and
supplies used in the street, water and sewer areas.
Should have a minimum of five years experience in a municipal
maintenance department.
Should have a minimum of two (2) years supervisory experience
in municipal maintenance operations.
SUPERVISION/ACCOUNTABILITY:
This position provides supervision for all maintenance
workers except park department personnel. This position has
direct accountability to the City Council and City .
Administrator.
STAFF AND PUBLIC CONTACT:
Extensive contact with staff from other departments and the
general public.
. TASK STATEMENT
Major Responsibility Areas:
. l. Organize and direct the operation of public works activities
including supervision and review of maintenance personnel in
streets, water and sewer.
a. Review the maintenance needs of the city and make
routine assignments (work schedules).
b. Assign personnel as emergencies arise.
c. Supervise maintenance personnel as required and conduct
annual performance appraisals.
d. Review all job assignments upon completion and spot
check work in progress.
e. Maintain time sheets and schedule overtime as required.
f. Organize and provide training for maintenance employees.
2. Communicates regularly with city Council, consultants, staff
and community residents regarding service delivery,
complaints and problem solving.
a. Maintains routine communication with city Council via
written reports, attendance at Council meetings and
. on-going liaision activities.
b. Maintains routine communication with city consultants
such as attorney, engineer and planner regarding
development, infrastructure problems and more
efficient/effective management of service delivery.
c. Maintains routine communication with department heads/
staff by regular attendance at staff meetings, daily
discussion of problem solving strategies and written
communication.
d. Receives citizen concerns/complaints, evaluates and
develops strategies for problem solving in conjunction
with City council, staff and consultants.
e. Conducts intergovernmental relations activities by
attending meetings with other governmental agencies,
written communications and coordinating completion of
construction projects with other jurisdictions.
3 . Plans and coordinates all purchases of goods and services for
street, sewer and water.
a. Determines proper equipment and deal with
. specifications, bidding quotes and acquisitions.

b. Prepares purchase requisitions, schedules delivery ,
dates, makes emergency purchases.
c. Signs receiving documents and regulates field order .
purchases.
4. Plans and coordinates maintenance activities and equipment
useage with other City departments.
a. Schedules repair and maintenance of equipment as
necessary.
b. Consults with parks director on the use of various
pieces of shared equipment (small tools, trucks, grader,
etc.) .
c. Organizes the garage activities necessary for housing,
storage and preventative maintenance, service and repair
of city equipment.
5. Maintenance of various administrative and operational records
for street, water and sewer under city Administrator's
direction.
a. Gasoline useage.
b. Ensures compliance with various State and County
regulations.
c. Maintains records of safety training and employee .
education programs.
d. Sign locations and status, water/sewer repair and
related records.
6. Prepares budget requests for street, water and sewer.
a. Reviews needs, prepares preliminary requests and
justification and estimated costs under the supervision
of the City Administrator
b. Presents line item budget to City Council.
c. Evaluates and plans for the long term need for Public
Works capital equipment and prepares capital equipment
budget.
7. Performance of any other duties as directed or apparent.
a. Maintains voting machines in proper working order, and
ensures that they are delivered to the precincts and set
up in proper working order.
b. Prepares monthly agenda for, attends Public Safety/Works
Committee meeting, and records minutes of the meeting. .
